Tamils Worldwide today welcome the establishment of an International Investigation and urge UN to support political space for Tamil aspirations.
Issuing a Joint Statement today British Tamils Forum, Federation of Tamil Sangams of North America, Global Tamil Forum, Ilankai Tamil Sangam, People for Equality and Relief in Lanka (PEARL), Solidarity Group for Peace and Justice in Sri Lanka, Transnational Government of Tamil Eelam, United States Tamil Political Action Council and World Thamil Organization said; “We welcome the establishment of an international investigative mechanism to establish the facts and circumstances pertaining to “serious violations and abuses of human rights and related crimes” committed in the island of Sri Lanka. The UN Human Rights Council adopted Resolution A/HRC/25/L.1/Rev.1 on March 27, 2014, which paves the way for a comprehensive international investigation. We urge that the investigation should cover the period prior to, during and after the end of the armed conflict in 2009.
“However, we would have liked to see the resolution better reflect the survivors’ and victims’ narratives seeking justice, reparations and closure for the killing of over 70,000 Tamils in just a few months in 2009 and determining the fate of 146,679 Tamils who remain unaccounted. While Tamils the world over appreciate the well-intended efforts of the 23 nations that voted to adopt this resolution, we regret India’s opposition to the establishment of an international investigation. India’s history of moral leadership and courage, coupled with its unique cultural and intellectual affinity with Eelam Tamils, makes its abstention and vote against the operative paragraph establishing an investigation deeply disappointing.
“Further, the resolution comes short of adequately recognizing the Sinhala military occupation of Tamil areas and the urgent need for demilitarization of the North and East. The overwhelming military presence in Tamil areas perpetuates ongoing illegal land acquisition (land grabs), state-aided demographic changes, destruction of ancestral properties, school and temples, coercive contraception of Tamil women, and sexual violence with impunity.
“Given the above, and mindful of the barriers the Government of Sri Lanka might place on an impartial international investigation, we urge the United Nations to institute an international protection mechanism to ensure the physical security and dignity of witnesses, survivors and human rights defenders. We also urge the UN Secretary General to seize the matter under Article 99 of the UN Charter.
“We wish to reiterate that the root cause of Sri Lanka’s conflict is the continuing and pervasive human rights and humanitarian law violations by successive Sri Lankan governments, primarily aimed at destroying the Tamil ethnicity, and amounting to genocide of the Tamil people on the island.
“The UN Panel of Experts report observed, “the ongoing exclusionary policies, which are particularly deleterious as political, social, and economic exclusion based on ethnicity, perceived or real, have been at the heart of the conflict”. The rule of law in Sri Lanka is based on a racially-entrenched majoritarian Sri Lankan Constitution. It is of concern to note the explicit acceptance of the 13th Amendment in the UNHRC resolution, a provision which fails to provide for power-sharing as stated by the Sri Lankan Supreme Court itself. Tamils never participated in the promulgation of the 13th Amendment or the 1972 and 1978 Constitutions.
“Thus, we appeal to the international community to create democratic space for the Tamil people to express their political aspirations unencumbered so that any gains on accountability through an international investigation can be sustained and translated into a durable political solution and peace for the peoples on the island.
“We the undersigned organisations and entities have the highest confidence in the Office of the High Commissioner for Human Rights and High Commissioner Navi Pillay’s unflinching commitment to the protection and promotion of human rights. We are confident that the High Commissioner will expeditiously establish an international investigative mechanism to comprehensively investigate the credible evidence of war crimes, crimes against humanity, and genocide. We also hope that submission of the findings to the UN Security Council would pave the way for International Criminal Court prosecution for those crimes to ensure justice. As Kofi Annan said, “impunity anywhere is a threat to international peace and security everywhere.”

This forum is a good example for the world to know why an International, INDEPENDENT inquiry is needed for Sri Lanka. Look this shows neither the Tamils nor the Sinhalese can be trusted to do their own inquiry. DO anyone see from the extreme communal situation of the Tamils and Sinhalese in Sri Lanka, the UN or the IC can trust any of the party in question trustworthy to make their own inquiry and judgement in the issue. This is the reason the UN is taking it up and it should be an INDEPENDENT IMPARTIAL INQUIRY keeping out any Sri Lankan take part as a judge. The Sinhalese say all Tamils both in Sri Lanka and the rest of the world as supporting LTTE and the Tamils say Successive Sinhalese Governments discriminated against Tamils making way for the LTTE take up arms etc. Now the whole thing has come up to the IC to intervene and bring about a settlement for all Sri Lankans alike without partiality.

Indian ambassador to UNHRC Dilip Singha said “this resolution titled promoting reconciliation, accountability and human rights in Sri Lanka at the UNHRC imposes an intrusive approach of international investigative mechanism which was counterproductive apart from being inconsistent and impractical.” That means, Pillay will have to do her investigations without any support from India.

Sri Lankan Government has decided that enough is enough. It is banning 16 foreign based Sri Lankan Tamil organisations as foreign terrorist organizations under UN Security Council Resolution No. 1373 which was passed by the Council in September 2001. The resolution was brought by the United States following the New York twin tower attack on 11 September 2001 ( better known as nine-eleven attack).

In terms of Resolution No.1373, UN member countries have a duty to assist the Sri Lankan government when they are requested to investigate the activities of these proscribed organizations. More over UN member nations have to take action to curb the activities of these proscribed organizations.
This proscription will be a major blow to prominent members of Tamil National Alliance (TNA) like Sumanthiran, Mavai Senathirajah, Suresh Premachandran, and Sritharan who very often fly to London, Toronto and other western capitals and address meetings organised by these proscribed foreign Tamil terroist organizations.Recently when Sumanthiran visited Australia he was accompanied by members of the now proscribed Australian Tamil Congress (ATC) when he visited Australian political personalities.Pro-LTTE journals in Sydney have published pictures where this Sumanthiran MP is posing for the camera with NSW Labour Party leaders and a prominent ATC member.
The big question here is who provide funds for these frequent air trips by these prominent TNA personalities. Did Sumanthiran MP pay for the many trips he made to Sydney, Geneva, UK, Toronto, New York and other western capitals out of his own pockets or did any of these banned Tamil terrorist organisations paid Sumanthiran’s bills? These are questions that must be asked of Sumanthiran now that these Tamil organizations have been proscribed as terrorist organizations under the UN Resolution.
Sri Lankan Government has not just stopped with the proscription of these Tamil terrorist organisations abroad. In Sri Lankan North itself it has brought back road checks and round ups. For over four years North East Tamils felt relieved when all the road checks and round ups came to an end. There were no arrests of Tamil youths. These are back again because of the antics of these stupid fellows.
With attempts to resurrect LTTE who can blame the Sri Lankan Government for taking drastic actions to prevent any revival of the Tiger terror.
