Sri Lankan Muslim Child marriage victim, Thameem Fatheema Sharmila has died last night after being tied to a chair, poured oil and set on fire by her abusive husband last Friday.
Activist had been calling the husband to be arrested so he can face justice in courts.
“The police is yet to arrest the husband who is accused of burning a 4 months pregnant teenager alive. It is actually a double homicide.” a spokeswoman of Women’s Action Network today told Colombo Telegraph.
Sharmila a young 18 year old Muslim girl was four months pregnant and lost her baby. She is also the young mother of a 7-month old baby.
She is also a victim of forced child marriage, which is legal for Sri Lankan Muslims. She was 16 years old when was taken to the Nallanthaluwa Kodi Palli Mosque in Munthal, Puttalam and forced to marry Mohamed Imran who was 22 years old. Marrying against her will, Sharmila did not know that Imran was already married twice before and she was his third wife. She never received a marriage certificate as the nikah was not registered by the men officiating the marriage ceremony.
Writing to Colombo Telegraph yesterday, Shreen Abdul Saroor, founder member of Mannar Women’s Development Federation and Women’s Action Network said: “She faced serious physical abuse and psychological trauma after the marriage and had reached out to a colleague a month ago asking for information in obtaining a divorce via the Quazi courts, but never came back again. Later it was learnt that she also went to the police who mediated and reconciled she and her husband and sent her back to him, despite grave danger of further abuse.
“After the attempted murder of his wife, Mohamed Imran took away their 7 month-old baby threatening her that if she reported the incident as being his fault that he would harm the baby as well. Sharmila in her moments of waking consciousness was concerned only about her baby. Fortunately the baby is now safe with other family members but Mohamed Imran is on the run from the police.”
“It is unbearable to see the young lives of Sri Lankan Muslim women being destroyed because of the lack of legal protection of their rights. Sharmila was both a victim of her husband but also a victim of the Muslim Marriage and Divorce Act (MMDA) and the Constitution, which does not (yet) protect her rights. What did this child do to deserve this fate? Was it her fault that she was born Muslim in Sri Lanka?” Shreen questioned.
“This happened because of the flawed and inadequate laws in the country specially Muslim Marriage and Divorce Act and Domestic Violence Act, growing religious fundamentalism and structures like mosques and Quazi courts playing with women’s rights and of course negligence of the police. Let’s see what the court will do?”, Shreen Abdul Saroor told Colombo Telegraph.
Her funeral will be held today morning in Thillaiyady, Puttalam.

Our hearts go to Thameem Fatheema Sharmila. The tragedy shows how archaic and defective Lankan Muslim Marriage and Divorce Act (MMDA) is. Muhamed Imran was 22 years and Thameem Fatheema Sharmila 16 when the marriage took place 2 years back. One may even suggest that this aged pair marriage also takes place among “other” Lankans. The difference is Muhamed Imran has gone through two marriages already. This is possible only among Lankan Muslims. At the age when “other” Lankan youths talked cricket Muhamed Imran was being taught (by Muftis?) how to divorce. Is there a 22 year old “other” Lankan who has experienced two previous marriages before the third one? We must lend our support to Shreen Abdul Saroor in her endeavor to modernize MMDA. There surely are three aspects to this shocking story.
The first is that there should be a judicial system that goes in to action whenever serious crimes take place without it being necessary for activists to highlight such happenings. Instead, we have the police going after the vulnerable in the hope of showing that they are present and doing things.
Secondly, there is a very real need to emphasise that from the time a child is born that child has certain inalienable rights. This is true of what happens worldwide, but in our country it is the duty of the state to protect children especially. Thank you Shreen Saroor for having had the courage to highlight this incident. It is said that this young lady was forced in to marriage at the age of 16, and that the not so old (but probably, rich) man already had two wives. One wonders how the other wives were treated. These maiiages are actually LEGAL! This just shouldn’t be! Muslim MMDA has to be revised so that even if there are special laws for this community, the provisions ought to be as close as possible to what applied to all other citizens of Sri Lanka.
Thirdly, there is, unfortunately, a political aspect to this which we must recognise. Islamophobia is sweeping the World. Too many will agitate on this issue because they want to have something with which to whip all Muslims. This, obviously should not be; what is tragic is that to be born Muslim girl is to know that there is a high probability of being forced into early marriage, sans proper education, and thereafter become a child-producing machine. So we have the death of a poor girl who was not able to live a life.
It is impossible for me to feel the horror of such stories as much as I should, but we’ve got to get all these things investigated, and the murderer, in this instance, brought to justice – and don’t forget to also punish others less directly involved in this tragedy.

A Law is not for itself. It is for the people living under its jurisdiction, irrelevant of Man or Woman. A law should not be passed with words “Man, Woman” to separate them by gender and apply different jurisdiction. Under that circumstances, specially under a multicultural society Like Ceylon, the word “Islamic Law” is unimaginable. There is no space for MMDA at all. Any law passed in Lankawe parliament should be open to discussion and correction, including the constitution. Further law should protect the weak. Should not waste money and resources to pamper anybody. When the Family laws in Lankawe is accepted as fair, then there is no need for MMDA. If part of the Family is flawed, then that has to be fixed, but not to introduced a completely flawed MMDA with explicit ill will to divide communities. When the societies out in the world have advanced a lot, Lankawe, should not keep alive this divisive law in a community to implement its racial policies. When we oppose privileges status to Buddhism, we can cannot play game accepting Islam having a privileged status. The privileged status of Islam and Buddhism must go all together and country should use only secular laws.

Ooh……I’m not to sure of that Lester! Joan of Arc was considered a war-radical. Also as she heard voices from above (or was schizophrenic), she was considered to be a witch. To the French side, she was a saint. Nothing to do with sex however. But the Hindus sure burned their widows alive. Actually, this wife burning thing is not a thing a Middle Eastern Muslim would do. But it is rampant amongst the Indian Muslims. They learned it from the Hindu men and mother-on-laws who pour kerosene on their poor young females and burn them alive. Happens all the time in India. It’s an Indian cultural thing.

The widow burns herself alive, it is a voluntary act, though she is encouraged to by other relatives. This is actually an act of devotion that goes back to “Ramayana”, when Sati burns herself.
You are right, this practice didn’t come from the Middle East. It is difficult (mentally) to perform such an act. It is the ultimate act of peaceful, non-violent protest. Many Tibetan monks (over 100) have done it.

Nooo….there’s no peaceful non-violent protest in burning widows alive. It is horrific torture, where widows were thrown into the flames to fulfill Hindu ecclesiastical euphoria…..with rampant psychedelic drugs growing on their soil, anything and everything becomes devotional.
Sati was a deranged and abnormal woman, who lacked the normal perception of individuality and completeness. She thus found it impossible to live without her spouse. After Sati, the rest of the Hindoo world took their chance to throw normal women, of sound mental health, into the flames to collect their gold, whist watching the enrapturing burning….quite sick.
Now Tibetan monks on the other hand, protest real life issues like the torture and killing of animals. After much meditation and acceptance, they set themselves on fire

Islam prescribes the marrying of underage females if ever the feelings of lust should arise towards an underage female. And if the feeling is not reciprocated, then the woman is at fault. Indeed, no other culture and religion has this concept for male satisfaction. Buddha certainly never prescribed incest and pedophilia as a solution to inconvenient male feelings, If this does happen, the man is placed at grievous fault. Why are people protecting that man btw?

Firstly, Non of the religions in the world has set the minimum age of marriage. It’s the law of the country that has set the minimum age of marriage. As a Sri Lankan Muslim I accept that we Muslims in Sri Lanka have to adhere to Srilankan Law since it is not violating any of the islamic teachings.
Islam says it is a must to get permission from both the men and women to get married. it never promotes underage marriage or it is not a must in Islam.
If we look into this incident, the father of the girl must be very poor hence he would have agreed to give his daughter to this culprit without knowing about him. This culprit would have a Muslim name but may not be living in Islamic way.
Just because one person misused the religion and did a bad thing. don’t fall into assumptions and blame the whole religion. As educated community dig deep and find the truth.
No one has the right to criticise anything unless they have 100% knowledge about it.

May this young child RIP. The Mufthi and all their associates deserves to be questioned and charged for their practices and preaching. In this case belief is not a issue and of any legal value. It has to be regarded a murder trial and they should be held responsible for declaring a practice which caused this death.They should be sentenced for this murder and it should set as a precedent that for any religion based killings the religious leaders should to be held responsible.
