
Former President and Kurunegala district MP Mahinda Rajapaksa in a statement said that the resolution on Sri Lanka tabled before the UN Human Rights Council (UNHRC) has “hostile provisions” and added that it was imperative to remove them.
Rajapaksa said that the government’s argivement that the resolution has been watered down’ in Sri Lanka’s favour cannot be accepted as the resolution has some serious “hostile provisions”.
“When this resolution was under discussion, the Sri Lankan Ambassador in Geneva in fact formally requested the sponsors not to place primary emphasis on alleged war crimes issues and to change their approach in consideration for the new government of Sri Lanka. However the sponsors of the resolution have not heeded that request,” he said.
Rajapaksa highlighted ‘operational paragraph 6′ which he says ‘takes note with appreciation’ the Government’s proposal to set up a judicial mechanism to investigate violations of human rights and humanitarian law and ‘affirms’ the importance of the participation of foreign prosecutors, judges, investigators and lawyers in this process.

The government has decided to accept and pass by consensus the USA sponsored draft resolution on Sri Lanka tabled before the UN Human Rights Council on the grounds that it has been ‘watered down’ in Sri Lanka’s favour. When this resolution was under discussion, the Sri Lankan Ambassador in Geneva in fact formally requested the sponsors not to place primary emphasis on alleged war crimes issues and to change their approach in consideration for the new government of Sri Lanka. However the sponsors of the resolution have not heeded that request. There are serious issues with regard to the operational paragraphs in this draft resolution and I wish to draw particular attention to the following:
Operational Paragraph -1 The first operational paragraph encourages the Government of Sri Lanka to implement the recommendations of the recently released OHCHR report on Sri Lanka. The most contentious recommendations in that report have been included as operational paragraphs in the UNHRC draft resolution as the following indicates.
Operational Paragraph – 4 welcomes the willingness of the government of Sri Lanka to allow the mechanisms set up ‘to deal with the past’ to obtain financial and material assistance from ‘international partners’. This would amount to personnel in important judicial and non-judicial bodies in Sri Lanka being paid by foreign powers.
Operational Paragraph – 6 ‘takes note with appreciation’ the government’s proposal to set up a judicial mechanism to investigate violations of human rights and humanitarian law and ‘affirms’ the importance of the participation of foreign prosecutors, judges, investigators and lawyers in this process. This flies completely contrary to the claim now being made by the government that any mechanism set up will be purely domestic.
Operational Paragraph – 8 encourages the government to remove from office military officers suspected of having violated human rights through a vetting process (even if there is no evidence to prosecute them). This in reality amounts to a purge of the armed forces.
Such operational paragraphs run completely contrary to the expectations that the government itself has generated among our people by claiming that the draft resolution has been ‘watered down’ in Sri Lanka’s favour. If the government is going to accept this resolution and allow it to pass by consensus, then they should ensure that the hostile provisions are removed and the resolution is brought into line with the expectations of the people of Sri Lanka.

Even though MR is trying to save his and his brothers skin the reality is that what ever Sri Lanka promises it can not deliver. In order to make most of the resolution work 2/3 majority vote will be required.
Last time they signed 13th amendment into the constitution and did not deliver. Promises have no value is Sri Lanka.

RW had been PM and CBK, the President in the past. Under them the troops were thrown into battle and them abandoned as they both were bereft of a spine to take on the Tigers in the face of the foreign ‘advice’ that they could not be defeated by military means. The statue of Lord Buddha is not a Christmas tree for an ignorant shameless population of Sinhalese to decorate with sparkling colorful lights to gain attraction. Buddhism is not a pedestal for a group of Mahanayake theros to create divisional politics and caste based nikayas such as the Siam, Malwatte, Asgiriya that play and pander with the dirty politics and racist policies of Sinhalese political leaders such as SWRD Bandaranayake and very recently Mahinda Rajapakse. Buddhism is not about these Mahanayake Theras to keep conveniently silent when thousands of Tamils were being murdered on the basis of patriotism and heroism in riots of 1915, 1956, 1958, 1977, 1983 and finally State genocide of 2009 by Sinhalese and only make an issue that Lord Buddha’s photographs need to be banned from being published in Newspapers because fish and meat or alcohol can be wrapped in the those same newspapers. Buddhism is not about banning meat and alchohol and even theatres on Poya days while Sinhalese are seen ganging up at supermarkets and shops the day before filling their larders with meat and alcohol. When Rev. Sangamitra Thera converted these uncivilized Sinhalese to Buddhism, little did he realize that these monkeys would one day abuse and use this religion as a tool for criminalizing society and manipulate the same for religious intolerance and racism. It is sad that India, being the true land of Lord Buddha and having the most exemplary Buddhists of the world fails to make a statement of the level of abuse and shameless indiscipline that is perpetrated by the Sinhalese in the name of Buddhism in Sri Lanka bringing untold shame on this great son of India Lord Buddha.

The notorious Kurunegala district MP believes the resolution even at its current status is hostile to the former President. When he turned his blind eyes to innocent killing by his forces on his brothers order, did he realize such killings were uncalled for in a decent society as ours that follows Buddha’s preaching. The bugger’s greedy got the better of him, otherwise he would be still the President as when he called the election, wasn’t his tenure still 2 years to run?. Such was his wisdom, completely suffocated by the executive power. Wondering is he still getting the peaks entitled for a former president and added up to whatever being in offer for a MP or only receiving MPs entitlement. Either way, he would wouldn’t care, the tsunami collection is enough for decades even if his family just sit down doing nothing, which is a jackpot.

Mr. Kurunegala MP, any investigations on mass atrocities committed by the government against its own citizens should be victim centred and it should not be planned to protect the perpetrators or mass killers. Please get your advisers to teach you the international experiences. Thanks to the international communities for keeping this issue alive and I wish they will continue their interest and commitment until the truth is established and justice is ensured.
We know what the Geneva UN representative is all about how he was behaving during your tern in Brussels and in Geneva. He is a perfect fit for a Sinhala Buddhist ultra nationalist. Although he is trying to switch over to suit the present regime, his own colours crop up. How can he say not to conduct war crime investigation when the thousands of innocents were killed brutally by your regime and they are demanding justice.
You and the bunch of your supporters were keeping on saying that TAMIL CIVILIANS WERE KILLED BY THE LTTE AND YOUR ARMED FORCES WERE CONDUCTING A MISSION TO RESCUE THEM FORM THE CLUTCHES OF LTTE TERRORISM.This is a very good opportunity to prove this fact and to free yourself and the bunch of your associated from the war crime charges.
Please remember, that if the investigations are conducted genuinely, transparently, efficiently and effectively to the satisfaction of the victims, an International War Crime Tribunal in future will become inevitable. Who needs enemies when you have friends like that (I mean Sachin not RW). It turns out that his enemies are more sympathetic to him than his friends.
So, dear MP4K, please be careful. RW is a vile man and may be just laying a trap for you. Like in the good old movies, RW may be saying ‘this one is mine’ and going for the kill himself. When guys like RW get going his targets need strong evasive action.

Thank you for not being silent, Mr. President, when some idiots want you to stay mum.
This cowardice government has legitimized terrorists. There is a difference between terrorists and criminals. Criminals deserve HR but not terrorists.
Terrorism is not a result of a spur of the moment. Terrorists plan for weeks, months and years to carry out bombing. If any human can focus so much energy and time on destroying a country and commit horrendous killings, they do not deserve any rights. When a legitimate Government ‘violates the rights’ of a terrorist, it threatens the rights of all citizens. Terrorists have created a serious conundrum for democracies in the world.
OHCHR’s Report and the US-SL Hybrid Resolution are complete jokes. No terrorist group is a party to the Geneva Conventions. They have not signed or ratified any of those treaties. How could LTTE terrorists automatically eligible for Geneva Conventions? The OHCHR is treating LTTE terrorists as Saints and the legitimate Government which fought against them to protect its citizens as Terrorists.
If we have patriots with backbones in the Government instead of traitors, they would have demanded OHCHR to show the clauses in the Geneva Convention that safeguards the rights of democratic governments fighting with terrorists in order to protect their citizens. The Third Geneva Conventions doesn’t apply to all conflicts, especially when the enemy is not party to it and when the enemy is not abide by its terms (Geneva Convention (III), Article II, Paragraph 3).
The Geneva Conventions is unnecessarily and unethically applied to illegal brutal LTTE terrorists to give them legitimacy. When terrorists violate the fundamentals of the international law, they are not eligible for Geneva Convention’s protection. The Geneva Conventions is politicised by the United Nation’s High Commissioner for Human Rights at the request of the traitorous leaders of the Sri Lankan Government and the separatist Tamil Diaspora. OHCHR’s Report to punish our former leaders and troops is equivalent to jaywalking. The International Law is corrupted for political reasons.
According to the basic international humanitarian law there should be a distinct difference between civilians and terrorists. In our case, terrorists were always mingled with civilians in civilian clothes. Not only that, they used civilians as a shield. Terrorists don’t wear uniforms or they don’t respect Geneva Conventions or international laws. What do the OHCHR and US expect a legitimate government of a sovereign country like Sri Lanka which faced a threat from terrorists would have done? That Sri Lanka should have pondered the violations of international laws and let the LTTE terrorists slaughter every citizen by marathon of bombs, air raids and suicide bombers? Which one is greater ?
