UN Resolution Has Some Serious Hostile Provisions: Rajapaksa

Former President and Kurunegala district MP Mahinda Rajapaksa in a statement said that the resolution on Sri Lanka tabled before the UN Human Rights Council (UNHRC) has “hostile provisions” and added that it was imperative to remove them.

Rajapaksa said that the government’s argivement that the resolution has been watered down’ in Sri Lanka’s favour cannot be accepted as the resolution has some serious “hostile provisions”.

“When this resolution was under discussion, the Sri Lankan Ambassador in Geneva in fact formally requested the sponsors not to place primary emphasis on alleged war crimes issues and to change their approach in consideration for the new government of Sri Lanka. However the sponsors of the resolution have not heeded that request,” he said.

Rajapaksa highlighted ‘operational paragraph 6′ which he says ‘takes note with appreciation’ the Government’s proposal to set up a judicial mechanism to investigate violations of human rights and humanitarian law and ‘affirms’ the importance of the participation of foreign prosecutors, judges, investigators and lawyers in this process.

US sponsored UNHRC draft resolution on Sri Lanka


The government has decided to accept and pass by consensus the USA sponsored draft resolution on Sri Lanka tabled before the UN Human Rights Council on the grounds that it has been ‘watered down’ in Sri Lanka’s favour. When this resolution was under discussion, the Sri Lankan Ambassador in Geneva in fact formally requested the sponsors not to place primary emphasis on alleged war crimes issues and to change their approach in consideration for the new government of Sri Lanka. However the sponsors of the resolution have not heeded that request. There are serious issues with regard to the operational paragraphs in this draft resolution and I wish to draw particular attention to the following:

Operational Paragraph -1 The first operational paragraph encourages the Government of Sri Lanka to implement the recommendations of the recently released OHCHR report on Sri Lanka. The most contentious recommendations in that report have been included as operational paragraphs in the UNHRC draft resolution as the following indicates.

Operational Paragraph – 4 welcomes the willingness of the government of Sri Lanka to allow the mechanisms set up ‘to deal with the past’ to obtain financial and material assistance from ‘international partners’. This would amount to personnel in important judicial and non-judicial bodies in Sri Lanka being paid by foreign powers.

Operational Paragraph – 6 ‘takes note with appreciation’ the government’s proposal to set up a judicial mechanism to investigate violations of human rights and humanitarian law and ‘affirms’ the importance of the participation of foreign prosecutors, judges, investigators and lawyers in this process. This flies completely contrary to the claim now being made by the government that any mechanism set up will be purely domestic.

Operational Paragraph – 8 encourages the government to remove from office military officers suspected of having violated human rights through a vetting process (even if there is no evidence to prosecute them). This in reality amounts to a purge of the armed forces.

Such operational paragraphs run completely contrary to the expectations that the government itself has generated among our people by claiming that the draft resolution has been ‘watered down’ in Sri Lanka’s favour. If the government is going to accept this resolution and allow it to pass by consensus, then they should ensure that the hostile provisions are removed and the resolution is brought into line with the expectations of the people of Sri Lanka.

      Certainly, you do need to make those requests. You are part of the accused gang.

      Are they hostile to:

      1. Mahinda Rajapaksa

      2. Gotabaya Rajapaksa

      3. Sarath Fonseka

      4. Others in the Armed Forces

      5. Politicians

      6. Sinhala Buddhists

      7. Non-Sinhala Buddhists

      8. The Country.

      If they are hostile to items 1 to 5 above, that is all right. They are individuals, and can be disposed of or they will die of old age anyway, like you will in the near future.

      Item, No.8 above is very serious, because, Lanka the Land of Native Veddah Aethho cannot be made to suffer because of he Paras, para-Sinhala and Para-Tamils and other paras.

      There should be a fair hearing and only those accused with evidence who are convicted should be hanged or jailed.

      This should be Law and Order and Yaha-Palanaya.

      Even though MR is trying to save his and his brothers skin the reality is that what ever Sri Lanka promises it can not deliver. In order to make most of the resolution work 2/3 majority vote will be required.

      Last time they signed 13th amendment into the constitution and did not deliver. Promises have no value is Sri Lanka.

      Sri Lanka always had the track record of not delivering on promises and SL politicians don’t care what the world think of them and would sure to break another promise.

      This time it would be at the world stage including to the US, UK, UN and to EU. SL politicians has a built in DNA that makes them to promise and break promises. This co-sponsored resolution will become another embarrassment to The Sri Lanken people. Mangala said ”Don’t judge Sri Lanka on the broken promises of the past” at the UN. The reality is that the current resolution at UNHRC will become another “SPONSORED and BROKEN” promise.

      And the next foreign minister will say ”Don’t judge Sri Lanka on the broken promises of the past”.

      This time US, UK, UN and to EU will say **** *** Sri Lanka.

            Trade with EU and US is one thing, independent country with our own value set is a different thing. Take Singapore as a example, they did not prosper by licking EU or US boots.

            Do you mean our people will be better cultured if we give them access to EU/US pornography and legalise prostitution? And people in US/EU do not grope others (read how many females killed this year by the male partner in Australia)

JR UNP President closed all the coops, police stations, army camps & withdrew to Colombo. Also handed over the part of the county to Indian army to feed the South & the other Sri Lankans.
      Preme UNP President gave money to the LTTE & kept BABU for his safety & also sent arms in containers to LTTE thro this BABU. How about Paskeralingam de-facto Finance Minister who gave funds to Prabakaran. What happened to him you must be knowing. Then chandrika SLFP Pres is the only one who had balls at least took over Jaffna from LTTE. terrorists. When everyone including your friends UK,USA & EU said that you cannot defeat terrorism of LTTE & they are so powerful that no one can tocuh them but to the North & East to these fellows. can you remember the bombs that were planted in Colombo & the North. All these were eradicated by that strong Presdent Hon. mahinda Rajapakse. Honour him even if you have other political views. We will see what will be the outcome of the UNHCR sessions.

        2) who was the leader of India during MR’s war ? hadn’t Sonia Gandhi had the final say in Indian Politics ? Hadn’t Sonia Gandhi were the leader of the congress , would it possible to wage a war against LTTE ?

        3)Hadn’t Gen SF were the Commander , would it possible to annihilate the LTTE terror outfit from the face of the earth ? had’t Gen SF promised to conclude the war with precise timing ? (didn’t Gen SF warn Prabakaran , that he will not allow him to celebrate another Sinhala & Tamil new year)

        4) Complete blanket censorship on war reporting , in fact this war had been named as the ” war without any witness”

          RW had been PM and CBK, the President in the past. Under them the troops were thrown into battle and them abandoned as they both were bereft of a spine to take on the Tigers in the face of the foreign ‘advice’ that they could not be defeated by military means. It took a man, a real man to take the decision, mobilise his troops and make plans on how to defeat the terrorists once and for all, by choosing his team of able military men, and giving them the authority to do what needed to be done. We know the result on the battle field, but this did not end evil propaganda that had been a constant thorn in the side throughout, but exacerbate it.
          The US engaged in an illegal invasion of a foreign land that had done it no harm nor was a threat. Sri Lanka however put down an internal enemy which had ravaged the country for 30 long years.
          Sonia Gandhi lost her husband to the same terrorists.
          Fonseka was brought in because he was recommended by MR’s brother and it seems it paid off. Whether another would have succeeded is a moot point.
          China was an all weather friend, but we have short memories.
          RW was the PM when Karuna broke away, and his help in ending the war was invaluable. It was also during RW’s time that the Intelligence Service which has had great success against the Tigers, were betrayed.
          For a “war without witnesses”, the alleged wrong doings by the troops by alleged ‘witnesses’ is nothing if not astonishing.

      First and foremost the Buddhism practiced by the Sinhalese is an insult to the true preaching’s of Lord Buddha. The Sinhalese are converts to Buddhism thanks to Sangamitta Thera from India. Buddhism is not about planting Buddha Statues in every street corner, by the side of dirty drains, next to meat/fish markets and alcohol shops or close to other locations of other religious worship creating disassociation and a nuisance. Buddhism is not about planting Buddha Statues by three wheeler drivers and administration of the same by such low caste principled yakko type fellows. Buddhism is not about blasting pirith on loudspeakers desecrating the silence of the environment. The statue of Lord Buddha is not a Christmas tree for an ignorant shameless population of Sinhalese to decorate with sparkling colorful lights to gain attraction. Buddhism is not a pedestal for a group of Mahanayake theros to create divisional politics and caste based nikayas such as the Siam, Malwatte, Asgiriya that play and pander with the dirty politics and racist policies of Sinhalese political leaders such as SWRD Bandaranayake and very recently Mahinda Rajapakse. Buddhism is not about these Mahanayake Theras to keep conveniently silent when thousands of Tamils were being murdered on the basis of patriotism and heroism in riots of 1915, 1956, 1958, 1977, 1983 and finally State genocide of 2009 by Sinhalese and only make an issue that Lord Buddha’s photographs need to be banned from being published in Newspapers because fish and meat or alcohol can be wrapped in the those same newspapers. Buddhism is not about banning meat and alchohol and even theatres on Poya days while Sinhalese are seen ganging up at supermarkets and shops the day before filling their larders with meat and alcohol. When Rev. Sangamitra Thera converted these uncivilized Sinhalese to Buddhism, little did he realize that these monkeys would one day abuse and use this religion as a tool for criminalizing society and manipulate the same for religious intolerance and racism. It is sad that India, being the true land of Lord Buddha and having the most exemplary Buddhists of the world fails to make a statement of the level of abuse and shameless indiscipline that is perpetrated by the Sinhalese in the name of Buddhism in Sri Lanka bringing untold shame on this great son of India Lord Buddha.

    Honourable Rajapakse, Your comments are well noted. As Srilankan Citizens we are well aware that you have brought the entire country to disrepute in the international community. We cannot go alone. Thanks to the team of good governance government who were able to turn around the precarious situation to an amicable status. If you are so scared show your remorse to the world community. I believe the government is trying to sell the south african model where amnesty for some and reparations for the victims with a commitment from all parties to put everything behind to work for the betterment of the entire nation.

    Your policy, diplomacy, behaviour and executions are at the centre of the issue and you have lost all the credibility to advise the people who cleared a mess you create. Thanks for your opinion and it doesn’t go anywhere

    Please people, these is a serious statement that this serious man has made about an equally serious matter and we have to take it seriously even if the UN and UNHCR are unlikely to do so. What I suggest is that we send it to them for what it is worth and see what happens. They may throw it in the dustbin, or worse still, use it as toilet paper.

    If that fails, there is the Plan B. – The White Vans. They can be reconfigured as white amphibious vehicles and used to invade Switzerland in an offensive similar to D-Day.

    Okay, okay, listen, I did not know that the darned country is landlocked. What about Lake Geneva? White amphibious vans would be a great camouflage against snow in the mountains. The so called element of surprise.

    If everything fails, we can still save our hero. We can say that it was done by the party and that they will have to pay for it.

    Needless to say MARA is running scared and will try to put every obstacle on the way of an investigation. He knows at the end of the day the buck stops with him with regards to the horrors of 2009. The other man who is shaking in his boots is his erstwhile brother in arms, Gota.

    So please have some consideration when MARA and his clan are jumping up and down about a war crimes investigation.

    It will be a thorough shame if our country has to succumb to that international pressure-set that LTTE-persons give their money to. Sri Lanka must hold onto her honor, for all long as she can.

    It seems that the West is now attempting to balance out her monetary system using China as equalizer. In that case, any irritation by the West towards Rajapaksa’s pro-China stance will be soon alleviated.

    Hopefully, all will end up as a formality, to make up for the money the International pressure-set accepted from LTTE–persons, to avenge Sinhalese for owning mythical Eelam.

    Every Sri lankan president was ready to support forces to defeat LTTE So did Mahinda Rajapakse. Sri Lankan Army lost to Gurilla warfare several times because, it was not conventional warfare. Any way, they learned the strategy and beat LTTE and eliminated them.

    Only thing Mahinda Rajapakse did was exploiting it to the maximum saying he did every thing.

    Army learned over the time.

    What did Mahinda Rajapakse learned with his 50 year political experience and how did he handle the post war strategy. Within the first week, He signed an agreement with Banki moon and negated on that. Then came all these problems.

    It is Ranil wickramsinghe’s CFA that helped Mahinda Rajapakse win the war. Now let him handle the rest too.

    He thought lies and showing middle finger would solve all the problems.

When he turned his blind eyes to innocent killing by his forces on his brothers order, did he realize such killings were uncalled for in a decent society as ours that follows Buddha’s preaching. The bugger’s greedy got the better of him, otherwise he would be still the President as when he called the election, wasn’t his tenure still 2 years to run?. Such was his wisdom, completely suffocated by the executive power. Wondering is he still getting the peaks entitled for a former president and added up to whatever being in offer for a MP or only receiving MPs entitlement.     Mr. Kurunegala MP, any investigations on mass atrocities committed by the government against its own citizens should be victim centred and it should not be planned to protect the perpetrators or mass killers. Please get your advisers to teach you the international experiences. Thanks to the international communities for keeping this issue alive and I wish they will continue their interest and commitment until the truth is established and justice is ensured.

    We know what the Geneva UN representative is all about how he was behaving during your tern in Brussels and in Geneva. He is a perfect fit for a Sinhala Buddhist ultra nationalist. Although he is trying to switch over to suit the present regime, his own colours crop up. How can he say not to conduct war crime investigation when the thousands of innocents were killed brutally by your regime and they are demanding justice.

    You and the bunch of your supporters were keeping on saying that TAMIL CIVILIANS WERE KILLED BY THE LTTE AND YOUR ARMED FORCES WERE CONDUCTING A MISSION TO RESCUE THEM FORM THE CLUTCHES OF LTTE TERRORISM.This is a very good opportunity to prove this fact and to free yourself and the bunch of your associated from the war crime charges.

    Please remember, that if the investigations are conducted genuinely, transparently, efficiently and effectively to the satisfaction of the victims, an International War Crime Tribunal in future will become inevitable. It is advisable for you to keep quite and watch the situation. You can prepare your legal advisers and lawyers to defend the interest of the perpetrators, including yourself in the mass atrocities committed in during your regime of ethno-racist politics.     Oh dear, things are getting really hot for our hero, Hon MP for K (MP4K). He should get his horoscope read. When he manages to escape one apalaya (RW has said that he will protect MR and not allow him being sent to the Viduli Putuwa) another looms (Sachin is going to be a state witness and he is going to vomit all!!!)

    Who needs enemies when you have friends like that (I mean Sachin not RW). It turns out that his enemies are more sympathetic to him than his friends.

    So, dear MP4K, please be careful. RW is a vile man and may be just laying a trap for you. Like in the good old movies, RW may be saying ‘this one is mine’ and going for the kill himself. When guys like RW get going his targets need strong evasive action.

    Thank you for not being silent, Mr. President, when some idiots want you to stay mum.

    This cowardice government has legitimized terrorists. There is a difference between terrorists and criminals. Criminals deserve HR but not terrorists.

    Terrorism is not a result of a spur of the moment. Terrorists plan for weeks, months and years to carry out bombing. If any human can focus so much energy and time on destroying a country and commit horrendous killings, they do not deserve any rights. When a legitimate Government ‘violates the rights’ of a terrorist, it threatens the rights of all citizens. Terrorists have created a serious conundrum for democracies in the world.

    OHCHR’s Report and the US-SL Hybrid Resolution are complete jokes. No terrorist group is a party to the Geneva Conventions. They have not signed or ratified any of those treaties. How could LTTE terrorists automatically eligible for Geneva Conventions? The OHCHR is treating LTTE terrorists as Saints and the legitimate Government which fought against them to protect its citizens as Terrorists.

    If we have patriots with backbones in the Government instead of traitors, they would have demanded OHCHR to show the clauses in the Geneva Convention that safeguards the rights of democratic governments fighting with terrorists in order to protect their citizens. The Third Geneva Conventions doesn’t apply to all conflicts, especially when the enemy is not party to it and when the enemy is not abide by its terms (Geneva Convention (III), Article II, Paragraph 3).

    The Geneva Conventions is unnecessarily and unethically applied to illegal brutal LTTE terrorists to give them legitimacy. When terrorists violate the fundamentals of the international law, they are not eligible for Geneva Convention’s protection. The Geneva Conventions is politicised by the United Nation’s High Commissioner for Human Rights at the request of the traitorous leaders of the Sri Lankan Government and the separatist Tamil Diaspora. OHCHR’s Report to punish our former leaders and troops is equivalent to jaywalking. The International Law is corrupted for political reasons.

    According to the basic international humanitarian law there should be a distinct difference between civilians and terrorists. In our case, terrorists were always mingled with civilians in civilian clothes. Not only that, they used civilians as a shield. Terrorists don’t wear uniforms or they don’t respect Geneva Conventions or international laws. What do the OHCHR and US expect a legitimate government of a sovereign country like Sri Lanka which faced a threat from terrorists would have done? That Sri Lanka should have pondered the violations of international laws and let the LTTE terrorists slaughter every citizen by marathon of bombs, air raids and suicide bombers? Which one is greater ?
