If the Island report today (18 November 2013), by Zacki Jabbar, is correct you have said that “time was of essence and the allegation of war crimes could not be investigated at the speed Britain wanted.” You may or may not be correct in respect of the time constraints, given the fact that the country and your support base are not being prepared for the necessity of conducting such investigations aftermath of the ‘war against terrorism.’ But the important fact is that you have not denied the need for such an investigation on an independent basis. I commend you on that.

The information regarding the alleged war crimes during the last stages of the war obviously by some security personnel is undeniable. I in particular would highlight the killings of Prabharakan’s son, ‘Colonel’ Ramesh and the LTTE TV announcer Isaipriya. They were all in custody when they were killed. There are more accusations on indiscriminate shelling into civilian areas or no fire zones, the denial of food and medical supplies etc. There are some numbers given and incidents recorded in the UN Specialist Report based on the evidence available to them and it is high time to investigate all side/s of the stories and allegations and establish the truth as much as possible.

You have also said at the same media briefing that “anyone found guilty, no matter who it was, would be dealt with under Sri Lankan laws.” I also commend you on that. It is good that you prepare the country for such an investigation. During the war against terrorism, you had an announced policy of ‘zero civilian casualties’ and upholding human rights. Therefore, it is high time that if there had been any deviation from those instructions and policies that they should be investigated. It is obvious from the information available (i.e. Channel 4 videos etc.), that those are given by some army personnel themselves. Most of them might be the same people who might have indulged in the atrocities. I am only highlighting a possibility. Punishing the perpetrators is necessary for disciplined armed forces. I also recollect the Secretary of Defence once admitting the possibility of deviations or violations given the large number of new recruits etc.

You have expressed the opinion that the whole of 30 years should be investigated. I have no objection for that. But we have to realize that for the purposes of reconciliation, particularly on the grief and the grievances of the Tamil community, that the last stages of the war should take priority. What could be done is somewhat the South African model where various sub-committees looking into various aspects and in this case various periods as well. The report on the last stages of the war could come as early as possible. Otherwise the whole investigation could be perceived as a delaying tactic.

It is high time that more is done for reconciliation. It is high time that as the President of the country that you make a public apology to the Tamil community and also to the Muslim community for whatever hardships and injustices that they have had to undergo in the past. A particular apology is in order to the families of the disappeared and the missing people of all communities.

It is also correct on your part to highlight that you alone cannot move in the direction of reconciliation. The leaders of the Tamil community in particular should extend their cooperation and assistance. To the credit of the TNA, I must say, that their responsible behaviour during the CHOGM is an indication of their moderation and possible cooperation. You have done the right thing by holding the elections to the NPC. The NPC deserves more funds and initiative within and beyond the 13th Amendment.

Sri Lanka has now become the Chair of CHOGM, you at the helm. Therefore, the responsibilities are to uphold democracy, human rights, rule of law and independence of the judiciary among other core values of the Commonwealth, of course eradicating the common poverty as you have already emphasised.

To come back to the issue of war crime investigations, it might be unreasonable to say that the British Prime Minister was asking Sri Lanka or you to complete the investigations before March 2014. The request was in my opinion was to initiate or appoint an independent commission before March. While it could be a national investigation, it could also incorporate at least few members from the international community at least from the region. It might also be possible to conduct immediate investigations into the alleged killings of Praphakaran’ son, Ramesh and Isaipriya and punish the perpetrators even before March 2013.

Our politicians were arrogant towards media during CHOGM. I wonder what it could achieve for the country. Western media didnt come to SL for a debate. The president at least was less arrogant which was great to see. It is childish to 100% refute war crimes committed during 2009. It is high time to start investigations into war crimes and reduce the pressure on the country and the people.
    MR & GR are at the verge of committing more crimes against humanity by bringing the BBS into the picture. many places of worship for minority were attacked and distroyed. I hope SL will try to stop this ongoing violence against minority as the chair of the CHOGM and avoid limelight on it again

    Laksiri Fernando seems to be happy that an alleged war criminal is the head of the Commonwealth as he wanted. He is asking a mass murderer to start an investigation as to why he conducted mass murders. Isn’t it a cruel joke?

    Furthermor, he wants people from the region, some of whom who are stooges of Sri Lanka like Kamaleseh Sharma, Nambiar and others: The regional leaders who supported SL’s miss-deeds in Geneva in investigations. What happened to the investigation conducted by a committee headed by an Indian judge during the war? It ended up in naught!

    He simply forgets South African reconciliation truly started as the oppressor accepted committing atrocities. Will the MaRa regime accept its crimes?

    Is independent investigation possible in a country under the following prevailing conditions?:

    Judiciary highjacked by the President is pliable in support of his miss-deeds.
    No free media as exposed by many Sri Lankan and foreign journalist as recently as during the CHOGM,
    Regime manned with many turncoats from the opposition, betraying the voters’ trust, hanging on as yes men with the regime for financial gains,
    Abduction, torture and murder using white vans are still prevalent,
    Occupation and repression of the Tamil homeland by a bloated Military,
    Military controlling all aspects of Tamils’ lives,including schools, marriages and deaths.
    Military depriving Tamils of means of living by running most businesses themselves.
    Sexual abuse of Tamil women and children, and using them as comfort women for them,
    Grabbing Tamil-owned lands by the military to illegally settle Sinhalese form the South, while the displaced Tamils live in refugee camps,
    Destroying/damaging Hindu Temples and building Buddhist temples by the state in places where there are no Buddhists,
    Destroying the culture and values of Tamils by introducing drugs, comfort women for the military, etc.

    With all these still going on, does this ‘educated’ man believe that the present Sri Lankan ethnically-biased authoritarian, rogue state of Sri Lanka can conduct a truly independent investigation into war crime and crimes against humanity?

    This is like asking a murderer to conduct a fair trail to find out if he is innocent? Of course, he will manipulate everything to find himself innocent!

    Does Laksiri Fernando believe that the world is full of fools who will buy Sri Lanka’s lies?

    The Sri Lankan state has failed in its responsibility for its peoples, Sinhalese, Tamils, Muslims and others. It must be dismantled first.

    What the Tamils all over the world demand is an international independent investigation to the genocide that occurred during the war and continuing in covert form now.

      I forgot the most important fact: The military intelligence and police intelligence personnel are everywhere as reported during the CHOGM by the Channel 4 team. Under these circumstances, without any mechanism for witness protection, will the living victims come forward to speak to the investigators?

      When Navi Pillai spoke to the victims, afterwards they were abused and threatened by the Sri Lankan intelligence personnel. During the CHOGM those who spoke to Callum Macrae and the Channel 4 team also suffered the same fate.

      I ask Laksiri Fernando if a genuine independent investigation by the regime feasible under these circumstances?

        Do you often forget important facts Thiru? Never mind, it is simply a joke to cheer you up. I hope you wouldn’t mind the gag despite our so-called ethnic difference. You seem to be a frank person.

        On your important question: I am ‘agnostic’ about whether it is at all going to happen and whether it would be genuinely independent. But we can try and we should try our best. That is the best way to go about it. If we just want revenge, then an international investigation might be the best. But if we want to rebuild the country and bring all the communities together, as much as possible, then an independent (mainly) national investigation will be the best. Having such an investigation itself is a forward step. It will be acceptable, but an international investigation itself might divide the country. Through such a national investigation, the country will go through an important learning and healing process. Take the example of South Africa. I also forgot to mention in my article (at my age I am perhaps more forgetful than you) that Sri Lanka should seek South African assistance. I am positive that we can find independent and enlightened minds among our communities. I am not saying that the LLRC fulfilled all hopes. But many of the members did their best. I had a friend who was a member (Sinhalese). His wife once mentioned that after some proceedings in the North he was quite remorse and even couldn’t take his meals properly. I am saying that there can be suitable people among the Tamils, Muslims and Sinhalese. Otherwise in my personal outlook I don’t have any objection for international personnel. I am concerned about the acceptability and also ground sensitivity/knowledge. The conclusions of such a national investigation can be built into our institutional system much better to prevent such things repeating in the future. These are only some brief points.

        I will be leaving this station now for a week. I may not be able to respond to your (no doubt equally valid) counter points. Nevertheless, please make them.

          I understand your sentiments.

          However, truth of what the Sri Lankan regimes have done to Tamils for long must come out first.

          Then justice must be done and reparations made. How much lives, properties of Tamils, and their lands lost?

          Then reconciliation may follow if the victims feel it is time to heal.
          It is not a privilege of the tormentor to say, OK it’s all fine let’s now reconcile.

          As it is structural genocide of Tamils continues vigorously, do the Sinhala community raise a finger to stop this?

          Does the present regime have the will or capability to conduct an impartial independent investigation: They don’t become saints overnight and say we are going to confess now. South African whites succumbed after enormous external pressure for truth and reconciliation.

          With the Mahawamsa mind set, I can guarantee that no such thing will happen with the Sri Lankan regime.

    It is a fair and reasonable analysis and a humble request. Can you start the process immediately? You have the power. You can do it. Don’t waste your time in other matters. It is urgent. The Nations image has to be saved. Your image has to be saved. Don’t let down the nation! You need the support of the opposition, Tamil leaders and Muslim leaders.     The regime complains of very brief period of time from November 2013 to March 2014, as per Cameron’s exhortation. The UNHRC resolution was in March 2013, what has happened since then? What happened on UN initiatives taken earlier? What happened on the LLRC Report? What happened on the Interim Report of the LLRC, which preceded it? What ever happened for four and a half years from May 2009?

    Is it to be assumed by the aggrieved party that the SL government can have no initiative or kinetic energy to move on its own to institute an inquiry? Does it at all follow that the SL regime cannot act, unless prodded by the International Community? It is on top of a very long period of default that Cameron has said what he did. Comes hot on the heels of the CHOGM confabulation,is China’s urging for decent governance.

    Most welcome sober thoughts from a learned professor. Now it is more than four years since the war ended. How much more time does MR want just to commence investigations? Five tears? Ten years or more? The main issue is that MR has not even got started with any meaningful investigation. He and his siblings simply live on denial with the hope of passing off time and the false hope that everything will be forgotten and any remaining witnesses disappeared! Even China seems to think differently now. It is time the regime takes up these cautions and warnings seriously.

    Thirty years is a goodly period what? Lets start with the birth and death registers and the last census of the north and east and account for everyone shall we? The war crimes tribunal can go its own way without waiting for the report on the last thirty years since it will take another three hundred before it is prepared.

    All in all nothing new here, but an independent investigation is what it will take to get these Western goons off of the back of the Sri Lankan government, and the majority of Sri Lankan citizens who take offense at this biased treatment. No apology should come from the Sri Lankan government without a simultaneous apology from the LTTE overseas cadres masquerading as human rights activists for Tamils (whom they care little about in reality), their supporters and the TNA for their role in the long drawn out war, and while we’re at it, the UNP for their willingness to sell the country short to terrorists on numerous occasions. All of these groups need to apologize to the Sri Lankan citizen.

    On the topic of international, unbiased investigation, anyone with half a brain would realize that if any of the past attempts, the bogus Darusman report based on LTTE propaganda information having never gone to Sri Lanka and Channel 4 shenanigans, any government would be cautious. The governments reports while not independent seem a hell of lot more credible than anything that has been out there yet. The big question is not should an investigation be carried, but who has the credibility to do so? I think we need to rule out from the beginning the ‘independent organizations’ like Amnesty International, Pillay of UNHCR or biased western governments like the UK, USA, Tamil Nadu…where the Eelamists are having a hay day.

    It has been argued from day one that the so called evidence that was brought to light, need to be verified by truly independent sources before they can even be accepted as evidence of anything. Thus far, Channel 4, the only entity that has provided any ‘evidence’ are not releasing their sources, and the ones used as ‘eye witnesses’ are known LTTE cadres. What credibility do they possibly have? Nobody says the Sri Lankan government has to know who they are, but until this is all verified, it remains the main obstacle for any progress in investigations. These fools are not satisfied with the evidence reported by the government, even though the sources are real people that can be verified by anybody. The ball still remains in the court of the accusers. Cameron should go home and clean up his own house, he has no business or credibility to talk about the activities of another nation.

    What is the time Frame for War Crime Allegations.

    1)There is no Time Frame for MR as he will never set an Independent Inquiry on his own free will as he has a lot to hide despite his denials. There is overwhelming evidence against MR and his Cronies. He has had over 4 years to put the record straight but he has not done that but instead has employed different Tactics to cover his Crime and in this respect he was helped a great deal by India and others who received handsome pay cheques.

    The Soldiers who provided the Video Footage and the evidence to Channel 4 have all been interviewed by British Intelligence who provided Mr.Cameron with their report which proved beyond doubt MRs complicity in the Crime. It was this report which convinced Mr.Cameron to tackle this head on with MR.Mr.Cameron said so in his interview.
    MR has run his course and he has no escape route except give evidence at the HAGUE and face the Music.

    The time frame you are talking about being short is laughable because MR will not set one up whether you give him 3 months or 3 years and what about the Time Frame for those who have been waiting for justice for over 4 years.

    2)You have expressed the opinion that the whole of 30 years should be investigated. I have no objection for that. But we have to realize that for the purposes of reconciliation, particularly on the grief and the grievances of the Tamil community, that the last stages of the war should take priority.

    **** I totally disagree with you as the Investigation should span the last 63 years including not only the last stages of the War but also the STATE TERRORISM which is now sweeping the country particularly the North.
