What You Need To Know About Ahimsa’s Case Against Gotabaya

The daughter of Sunday Leader murdered Editor Lasantha Wickrematunge, Ahimsa filed action against Nandasena Gotabaya Rajapaksa in the courts of Los Angeles, California on 7th April requesting a Jury trial and compensation.

Wickrematunge v. Rajapaksa Why was a complaint filed?

Ahimsa Wickrematunge has been seeking accountability for her father’s murder for over ten years. Despite the hard work of the investigating authorities in Sri Lanka, there have still been no charges filed against those responsible for Lasantha’s death. For these reasons, Ahimsa and the Center for Justice and Accountability (CJA) decided to bring this civil suit in the United States. Even though the suit will not result in any jail time, it is an opportunity for Ahimsa to have her father’s case heard in a court of law, and to have an impartial judge rule on Gotabaya Rajapaksa’s liability for his murder.

Where was the complaint filed?

The complaint was filed in Los Angeles, California before the U.S. District Court for the Central District of California.

Was defendant served with the papers?

Yes, the defendant was personally served on April 7, 2019 in Montrose, California (within Los Angeles County). Service was performed by a private investigator from Ideal Investigations, with support from the Mintz Group.

What are the issues raised in the complaint?

The complaint alleges that Gotabaya Rajapaksa was involved in the extrajudicial killing of journalist Lasantha Wickrematunge as well as the widespread and systematic targeting of other journalists perceived to be critical of the Rajapaksa government.

What laws are referenced/What is the legal framework for such a complaint?

The case brings civil claims under two federal statutes: the Torture Victim Protection Act (TVPA) and the Alien Tort Statute (ATS).

The TVPA, passed in 1991, allows U.S. federal courts to hear claims against individuals who, acting under the actual or apparent authority of a foreign nation, committed torture or
extrajudicial killing. Under the TVPA, both U.S. citizens and non-citizens may file suit. The perpetrator must be served with the lawsuit while they are present in the U.S. in order for a court to have jurisdiction over the individual.

The ATS, passed in 1789, allows foreign victims of international human rights abuses to sue the perpetrators in U.S. federal courts for violations of customary international law. U.S. courts have applied this law to hear claims involving crimes against humanity, torture, extrajudicial killing, war crimes, and other serious human rights violations.

Neither of these laws require U.S. nationality to pursue a claim. However, the Defendant must be within the jurisdiction of the U.S. for a case to be initiated.

What is the defendant’s obligation now?

The defendant has three weeks from the time of service to respond to our complaint, by either affirming or denying the facts we allege or by filing a motion to dismiss. If he does not respond, the case can still proceed without him, and the court will assess the strength of our claims against him.

What is the legal process in such a case?

Gotabaya Rajapaksa has now been served and is therefore put on notice about the case. He must respond to the complaint and may obtain a lawyer to represent him in court. Should the case continue, both parties will have an opportunity to depose witnesses and obtain evidence from one another. The case may eventually go to trial, and the plaintiff will be required to prove the case before a judge or jury through the testimony of our client, witnesses, and experts in court.

Will there be criminal sanctions?

If the judge or jury determines that Gotabaya Rajapaksa was indeed responsible for the crimes in the complaint, the case will result in monetary damages. Unlike a criminal case, it will not result in any jail time. However, we hope that our case, if successful, will support the criminal investigation in Sri Lanka and eventually lead to criminal accountability.

Will this case prevent justice being pursued in the Sri Lankan courts?

We fully support the need for fair and independent prosecutions of attacks against journalists in Sri Lanka. Unfortunately, such cases have not yet materialized. If and when such prosecutions become viable in Sri Lanka, our case will not prevent these cases from moving forward. Instead, our hope is that our case will serve to support the ongoing investigations and future prosecutions of the attacks on Lasantha, Keith Noyahr, and other persecuted journalists.

Are there any similar cases filed in the United States that have provided justice for victims?

CJA has successfully brought a number of cases in U.S. courts seeking justice for human rights abuses that occurred in Bosnia, Chile, China, El Salvador, and Somalia, to name a few examples. The following are two examples of recent victories:

In 2012, a U.S. court awarded Somali torture survivors $21 million against General Mohammed Ali Samantar, Somalia’s former prime minister and minister of defense. Samantar had presided over countless killings and torture of civilians in the 1980s. The case was the first to ever hold a Somali official accountable for human rights crimes committed under the Siad Barré regime. It also established the precedent that foreign officials cannot claim immunity for acts of torture, extrajudicial killing, or other universally recognized human rights violations.

In 2016, a jury found Lieutenant Pedro Barrientos Nuñez responsible for the murder of Chilean singer Victor Jara and awarded Jara’s family $28 million. In 1973, Jara, famous for his outspoken messages on social equality, was tortured and murdered along with hundreds of others by the military under the Pinochet regime. Former soldiers finally broke their silence in 2009, and a number of officials were indicted in Chile. However, because Barrientos had moved to the U.S., the Chilean courts could not reach him. The decision in CJA’s case, along with the prosecutions in Chile, have finally provided judicial acknowledgement of the government’s role in his murder.

Who is CJA?

The Center for Justice and Accountability (CJA) is a San Francisco-based human rights legal organization dedicated to deterring torture, war crimes, crimes against humanity, and other severe human rights abuses around the world through innovative litigation, policy and transitional justice strategies that strengthen the global net of accountability. CJA partners with victims and survivors in pursuit of truth, justice, and redress, and has successfully brought cases against a former Minister of Defense of Somalia’s Siad Barre regime, the military officer responsible for the assassination of Chilean activist and singer Victor Jara, and Syria’s Assad regime for its targeted killing of war correspondent Marie Colvin. Sir,
Corrupt cowards who attack defenseless citizens for exercising their civic duties, pay attention from now on. YOU ARE ON NOTICE. Criminal Sri Lanka Police or our corrupt Judiciary may not stand up for Sri Lankan citizens. But, the long arm of Justice will seek you out the moment you set foot in the civilized world.
    Cheers!
PS: If I were ever to be blessed with a daughter. I pray she be made of the same steel LW’s daughter Ahimsa is made of. She tackles psychopathic Gota head-on. While all Gota has ever done amounts to hiding behind white vans and unleashing merciless killer squads undercover upon unarmed civilians. What a CORRUPT COWARD!

Dear Ahimsa Wickramatunga and Those Seeking Justice,

Thank you for your efforts to seek justice. May your father and the countless others who died may Rest In Peace, but those, those living must strive for justice.

May Amarasiri suggest that you open find for all those who seek justice to contribute to your efforts and meeting the legal expenses of this civil case. Any excess can be used against the other criminals, besides Nandasena Gotabsya Rajapaksa.

We are proud of you Ahimsa. We will always support you getting this bugger caught by hook or crook. The reason him to return to the country is, there only he can show the world that people behind him whatever the murder allegations would have been levelled at him.

        I’ve noticed that myself.
        .
However, what I feel guilty about myself is not having been able to eloquently praise Ahmsa for what she has done.
        .
Obviously, she’s done it mainly for her father, but it’s something from which we all benefit.
        .
        So, thanks, Ahimsa.

Partly for her father and mainly for her political masters.
          Dear Sinhala_man,
how many unresolved murder cases are in our books you reckon? Do you feel the same towards the family members of the victims? Can they demand compensation from the Secretary to the Ministry of Justice? You seem to be quite unbiased in your opinions, at least I appreciate your attempt to be so. Yet I observe that you too can’t help being carried away by sensationalism. Unconciously your political bias is creeping in.
Ahimsa doesn’t need any ‘proof’? Mere suspicion is sufficient? What are your own arguments for making Ahimsa an exception to the rule?

      BH,
I have no doubt, this would not let Gotler to be free with his renunciation of americal citizenship. He will rather have to count with lot more high profile cases being filed against him in the days to come.
And also his brother Basil too will have to face the music in terms of his money laundering acts. They never thought that people in this country would be able to corner these buggers since they stupidly believed to keep their reign forever.

This former National Hangman built his entire career, life, wealth, status, reputation, power, ………….. sense of fear on killing or at least the threat of killing and Sinhala/Buddhist smart patriotism.

There is no denying that Lasantha’s killing was not an isolated incident. He had to think, speak and act tough. And he did. As a consequence many people lost their life and limbs while many became rich including The saddest part of his presence in this island, prior to 1992 and after 2005 has been blood shedding even after the war had ended. some people are conditioned to believe a tough leader could make trains run on time keep the country together. And many others including academics too believe in it.

As everyone knows that Gotabaya is the man who murdered Lasantha and many more.
Gotabaya must be brought to justice and incarcerated for life.

Unfortunately it did not happen in Sri Lanka but definitely must happen in USA

Similarly everyone knows that Mahinda is the man who murdered Lakshman Kadirgamar. LK’s daughter must follow the example and file action against Mahinda.

Lanka Perera – you are one intelligent man who thinks wisely. Yes, I totally agree and he was shot with a pistol not a rifle. This was due to CBK, who wanted to make him the PM and not Mahinda, I believe Gota had it done for him brother. I completely agree with you LP.

Mahinda can also be the person to have murdered that Hirunika Premachandras father.
And Sripathi SOoriyaarachi. And the next one on the list was Sarath Fonseka, But SF is tough guy. He proved himself that Rajapakshes would not succeed their killiing plots always.

Why the great satan Mahinda is still pussy footing or sitting on the fence? Will he go against the wishes of his enforcer?
Do you think MR has become an obstacle for Gota to move to the next level.

Don’t you think people should give Gota a chance by electing him as the next president from which they could learn a valuable lesson, that is fascist were never able to run train on time and it is not that easy to get rid of them from office?

I do hope Ahimsa will one day be presented with the justice she is desperately seeking. Only she will know the pain and torment she has undergone in this quest. We should also not forget how Iqbal Athas narrowly escaped death after his expose of the MIG-27 deal in 2006. He detailed his harrowing experience during his speech at the launch of Sri Lanka’s Center for Investigative Reporting – earlier this year.

Thank you CT for providing the background to this joke. The ‘prosecuting’ individuals and process has no chance of success because Mr Gotabhaya Rajapaksa was not a commanding officer of any military force, he was just a bureaucrat who had no ‘official’ capacity to carry out acts of the alleged nature.

If this case could succeed, why can’t we pursue the descendants of Portuguese, Dutch and British Jews ho murdered millions of male Sinhala resistance fighters and raped millions of our women and stole our land and other resources? Africans have examined the legal processes involved and have given up pursuing the descendats of those mass murderers for obvious reasons. They (or us) have not been compensated for those crimes.

In Wickramatunga’s case, curiously, the army chief at the time (Sarath Fonseka) who has hinted in many ways that he had reasons to ‘punish’ the stupid Wickramatunga is not being pursued!

Wickramatunga was a fundamentalist Christian fraud that was destabilising Sri Lanka and Gotabhaya was a brave ex-soldier who was risking his life to save the coutry from Prabakaran’s menace. He had no control over armed thugs, Fonseka had. If you want credibility on the issue, pursue Fonseka.

Acts of Rajapakses have brought us into the category of Bosnia, Chile, China, El Salvador, and Somalia. No one should blame Ahimsa W for what she did. If my father was killed brutally on the road using a tool used to kill animals, I would personally go behind the killers and the backers to take revenge if the police and the state is not doing that. Why did they kill LW so brutally, when an unidentified gunman (sniper) could have done it very easily without any trace. They wanted to teach a lesson to the others who try to go against them. They did not want to hide the fact who or why he was killed as they expected to be in power for ever and thought that they would never be punished!

Lasantha’ case, beyond the concern on humanistic sympathy to his family, beyond general thirst for justice, has a special concern to Tamils. That is the reason Tamil political right activists & politicians should pay attention to this case. Aanduwa manipulated the October 26th coup case at SC and CoA to save all Coup partners. It managed the entire case with a simple injunction. Then it had forced all 122 MPs to withdraw the quo warranto to save all partners in the Coup. But its agent Tilak has been using the coup injunction as a fair verdict of Sinhala Jury Only Justice system in UNHRC, in March 2019. In fact, the justice for Coup case was completely blocked in SC and COA by Trio to save themselves. So instead all Coup partners, that the trio must have received capital punishment from SC, now back on their seats. Further it appears the loss of was manipulated to steal Opposition Party leadership from Tamils too. But Lasantha like high profile cases against the War Heroes who carry out Tamil Genocide with full impunity tell what the real status of Sinhala Jury only verdicts. 25 Tamil Journalist are killed during the peak time. 45 were affected. But, I understand, not even one Tamil journalist went to apply for compensation from the Affected Journalist Compensation Process. Everybody knows why. Whatever happened to journalist in past, still the truth is only journalism and free media can bring out Tamils’ plight. That is why Tamil politicians and activist must pay attention on how Lasantha’s case progress in getting his family the justice.

  • 21
    4

The abduction and murder of number of journalists and human rights activists including Lasantha were never brought under justice during the Mahinda Presidency or under the presidency of Maithiripala Sirisena & Prime Minister Ranil period. The governments in power over the 10 year period never showed an interest in finding the justice to the victims because those who planned and executed those crimes are very powerful and they are protected by majority of Sinhalese people as well. Almost all those victims are branded as LTTE sympathisers by those murderers. The real reason was that Lasantha brought the corruption deals carried out by those who were in power. Now they are the richest after sucking the blood of poor Sinhalese and Tamils.
You will never get justice in Srilankan courts for these murders.

  • 22
    6

Lasantha’s family have been relentless in their pursuit of justice, for the brutal murder of their love one. It is very impressive the way they have kept this crime in the limelight all these years. Shame on the present leadership for not solving this murder, along with so many others, and bring hold the criminals accountable.

It’s very sad that this girl lost her Father at such a young age. A daughter’s most favored person in this world is her Father and it’s tragedy that it was taken away from her and she had to grow up without a Father.

No amount of Money will bring her solace but at least it will cause some damage to the perpetrators.

          SJ,

JVP fellas committed crimes. Serious crimes at that. And some for frivolous reasons such as boutique owners opening their shops in spite of JVP warnings.

There is no sympathy there. They deserve a nice plot of land, free of charge by the stare but 6 feet underground.

How on earth do you compare this good looking girl and her Father to the JVP rats?

Shame on the lawyers of the AG’s Department for sitting on this case for so long….shame on the CID and police to have bowed down their heads and allowed others to dictate terms to them….shame on the Judiciary to have allowed this case to get dragged on giving useless dates to appease stupid lawyers ….. Shame, shame shame….

Ahimsa, you would have had to wait for over 100 years to get judgment for your father’s murder over here …You did the RIGHT THING by going to the US courts and catching Gota in the State of California itself. Go girl…All the very Best to you!

Views such as Kalu Nangi’s are worth heeding. I know her to be a lawyer who practises in Sri Lankan Courts.

Hmmm! No. I know her to be a lawyer. Perhaps she works for some corporate group knowing the Police and the Judicial system are too corrupt.

There is an unwritten pact between our leading politicians that they will scratch each others backs in and out of office. Oh Yes, they will throw shit at each other, but thus far and no further. That way, crooks and murderers live to fight another day in the game of musical chairs that is our wretched lot. One day, the majority of people will come to their senses and elect people who are capable and competent to run this blessed country. But not just yet, so don’t hold your breath.

        Dear Spring Koha,
        .
About the main actors, what yo say is true, but not about guys like Nagananda. That said, Nagananda’s campaign has not reached out into new territory yet. I’ve done my duty by sending a couple of messages, but no response yet.
        .
SK, I agree that the two major parties each imposes Hobson’s choice on us. However, we’re not totally helpless. If we are indeed forced to acknowledge the inevitability to vote either UNP or Rajapaksa nominee, we can still give the guy only our THIRD Preference: the FIRST and SECOND must go to two of the fifteen or so others who will contest. Among them, there will be a couple whom each of us has some faith in. Vote for them. It doesn’t matter our each voting for a different guy who will not get anywhere near winning.
        .
Depriving the winner the chance to say that he had more than 50% First Preferences is what we should aim at. Educating 13 million registered voters is plain impossible. Forcing a Second Round of counting will cause at least half the voters, on the post-election night, to understand that in 2025 we could meaningfully have Third, Fourth, and Fifth hopefuls contesting.

          Sinhala Man,
please take care of yourself. I know you are one of the few that I consider as very honest on this Platform.
          :
I really dont want you to face any kind of getting caught to white vanning or the slimilar. Gotabaya as I got to know from what Ahimsa has explained it to various other platforms are the most cruelst in that Rajapakshe family. There are also credible info about how cruel it had been behind that so called colombo beautification projects. There had been beggars that faced brutal stoning before being killed by Gotler s underworld men.
          :
All in all, I am bit scared to travel to SL even if my heart is melting towards some who are really in need of my support (funds and various other support).
          :
Anyways, whenever I travel to lanka next, one of my wishes is to come and see you too. THat I will pass you by writing you and email.. as already shared you in few weeks ago.

            Dear “desperateasnoother”,

Thanks for realising that I at least mean what I say. Actually, you say even nicer things about me!
            .
I haven’t received an e-mail from you yet. I think that I understand why CT guards our personal e-mails: in case they are being used to post comments, since our gravitars depend on the e-mails entered here. Others could then impersonate us, and we’ll have only ourselves to blame. That is common sense. I’ve already made the adjustments that are necessary.
            .
Dear “desperateasnoother”; I’m getting old now. I’m not “an important man”. I am indeed taking calculated risks. Someone has to. I have just posted a comment to Uthugan telling him just that.
            .
One way or another, we all have to die. I wasn’t able to tell readers enough about how well I got to know Richard de Zoysa. I would rather die without being tortured. Ahimsa Wickrematunga obviously lost her father too early. Although his was a quick death, he lived with vivid knowledge of the risks he ran.
            .
When I put the choices before us to my family as starkly as I do now, they are not happy, obviously. But there’s no guarantee of our safety. The Boeing 747 Max planes were supposed to be safe!

….”Nagananda’s s campaign has not reached out into new territory yet. I have done my duty by sending a couple of messages, but no response yet”.
May be people were unconvinced ofv his true intentions, because they felt he was somehow not genuine enough especially when he unconditionally apologised as soon as the court prohibited him practicing.

            Dear Uthungan,
            .
I’ve been recommending Nagananda. Let’s discuss him separately. You don’t have to accept what I say. However, time is running out. I’ve been as open as can be. I think that you, like many other regular commenters on CT, actually know my real “work-a-day” name. You have possibly seen articles written by me. They have been accompanied by my photograph.
            .
Please, let us have your suggestions regarding whom to vote for. I will seriously do a little checking, and I will quite possibly vote for the person suggested by you. We’ve got to show greater commitment than you display, if we are to get anywhere.
            .
Alternatively, what do you say to my suggestion that we target the 2025 election, and spread our votes around in January 2020, so that a President gets elected only after looking at preferences? I’m being pretty specific. Please reciprocate to the extent that it is possible for you.

You have yourself said that ‘Nagananda’s campaign has not reached into new territory as yet’. What reason or cause made you to say so?.
Similarly I too have my own views and doubts about his Presidential suitability.
But I certainly having a high regard for his professional abilities and frankness and commitment on the issue about defeated candidates nominated as MP’s..
The former CJ’s position that ‘it is not of national importance’ canot be condoned and Nagananda’s objection to that is justified.
I also admire him for his determined campaign and stance about Parliamentarians unjustly profiteering by selling their duty free cars.
As for your suggestion about targeting the 2025 elections, I prefer to not delay that task till then but to get it over ASAP in 2020 itself.

Uthungan, I’d prefer to see a change tomorrow, but we’ve got to be realistic. I live here in the hills of Sri Lanka, away from the capital.
                .
I’m just trying to be realistic.
                .
Do you not realise that some like “desperateasnoother” think that am taking too many risks as it is? I try not to be unnecessarily nasty towards those who think differently.
                .
I don’t want to put pressure on those who think differently, but I myself will never compromise. If you have the time study T.S. Eliot’s play, “Murder in the Cathedral”. Beckett didn’t want to court martyrdom, but nor was he running away, either.

You may so regard what we are trying to do. If Nagananda contests, I will vote for him, knowing that he stands no chance of winning.
                .
I don’t think Gota to be intelligent, cultured, sensitive or truthful. I will indeed spoil his chances if I can. It will be done in the hope that our people will act with greater finesse and compassion in future.

The Ahimsa vs GR and the Roy Samathanam vs GR have somethings in common.
The US government, as prosecutor, will keep in mind that GR is from the Lankan Elites without political borders. The case may bring other Elites and/or skeletons to the forefront.
US knows the loyalty of the ‘Sinhala Speakers Only’ Lankan Armed Services.
The US government has to note the absence of media coverage regarding GR return. Who has the power to impose this self-censorship?
    .
Holding our breath will not help. Breathe easy.
Remember the US Courts dismissed a case against a Royal Family member on sex charges.

      :
Of course, the two cases ALREADY filed against Golter will not make him easy to renunouce his US citizenship. Whatever being said and done by the stupid men being flanked to RAJAPAKSKE family; US laws would never leave room the kind of high criminals to escape. That is what I believe, this young girl did it at her best. We should support her from Europe, I will do whatever contributions I can make.
      :
The stupid men should have nbeen well aware of the factS, if you take the US citizenship, whatever crimes you have committed during your citizenship are investigated going by one behind the other. Not just 2 ,… lot more to be filed against this bugger in next days. So, now Gotlers nemesis is almost certain.

You mean to say that even our Judges will not visit US in future for fear of being served a similar process for the judgements they have taken side, under the previous Regime and the present?

This also brings to my mind the new Investigative Reporting
Centre – my challenge to them: There is an ex-president who murdered his first wife and the inquiry was stalled by a 5 times PM
by a telephone call to the ASP supervising the inquiry, followed by

If you are so concerned about justice, truth, human rights, ……………….. why didn’t you raise the question in the last 29 years? Are you trying to defend your fascist hero with the stupid argument?

“Is there a similar process in Sri Lanka where Batalanda torture victims can seek justice from Ranil Wickramasinghe, where LTTE victims can seek justice from Sambandan, where IPKF victims can seek justice from the Indian Government?”

Everything is possible under an impartial Truth and Reconciliation Commission appointed to investigate all war crimes and crimes against humanity committed between 5th April 1971 and 9th January 2015.

Whys you are so interested in IPKF’s victims. Your Sinhala/Buddhist army was hiding behind VP’s bum when the atrocities were committed by the invaders. What was you fascist hero doing at the time. MR went to UNHRC only to shame Premadasa’s government. He never mentioned IPKF atrocities in his plea to UN. Now you want an investigation into IPKF’s share of atrocities. What a hypocrite you are.

Are you being clever by demanding an investigation into IPKF occupation and conduct do you think you can stall all the investigations related to war crimes? You are really pathetic.

Let the Tamils/Muslims speak for fellow Tamils and Muslims who really were at the receiving end of IPKF atrocities. IPKF did not commit war crimes on Sinhalese or Buddhists. Therefore your concern sounds like Crocodile tears. Stuff it inside

By the way while IPKF was committing war crimes on the innocent people of the North East your future fascist smartass patriot along with his fellow butchers was slaughtering innocent in the South.

By the way why didn’t you demand the other Public Racist Somawansa Amarasinghe be investigated before his death? Is it because he was a fellow Sinhala/Buddhist fascist like you?

      Selective justice?

The debate here is whether ‘selective justice’ demands based on political motivations and timed to coincide with political opportune situations aimed to entrap one’s political enemies is justice at all OR as commentator SJ above believes it is at least some partial justice after all.

When a crime is not a crime, and when it is?

When justice is denied within the corrupt/racist legal and state structure it is obvious/natural victims or their relatives/friends seeking justice outside the normal corrupt system. Even to the extend of some approaching Malayali Shamans not only for redress but also for revenge.

Please stuff your clever dick defense of the war criminals and murderers.

You have a huge chip on your shoulder.
It is not easy to relieve you of the burden.
Your salvation (whatever that maybe) is only in liberating the Buddhists from Sinhala/Buddhists who are

          Loud and obnoxious
          Generally unproductive
          Particularly destructive
          Easily startled or angered
          Sh*t on everything

  • 4
    4

Nearly a decade ago, I told many people that they should use ‘unorthodox’ methods to hold SL war criminals accountable. Even with a civil case, if the case goes through and a judgement is entered, and GR doesn’t pay, the next time GR tries to visit the US, bounty hunters can be hired to wait for him at the airport and take away any of his personal property in order to ‘collect’ the judgment. For instance, if he parks his car and goes into a home, the bounty hunters can legally break into the car and seize it.

This has happened to some wealthy deadbeats in the US. GR should know that he will be hounded for the rest of his life for his crimes.
