WikiLeaks: As The Oldest Democracy In Asia, Sri Lanka Has Its Own Investigatory Processes – Jaliya To US

“Wickramasuriya had no immediate reaction to the report itself, but said the GSL believed that economic development and resettlement of internally displaced persons (IDPs) would foster reconciliation. As the oldest democracy in Asia, he said Sri Lanka has its own investigatory processes, including administrative sanction against police and soldiers who commit abuses, such as occurred in the 1980s. He said the Army was much more disciplined this time and showed restraint in this final offensive against the LTTE, losing a lot of soldiers as a result.” US State Department wrote to US Embassy Colombo.

A classified diplomatic cable which details a meeting the US Assistant Secretary for South and Central Asian Affairs Robert O. Blake and Ambassador at Large for War Crimes Investigations Stephen Rapp  had with Sri Lankan Ambassador Jaliya Wickramasuriya on October 21, 2009. The Colombo Telegraph found the related US diplomatic cable from the Secretary of State section of the WikiLeaks database. The cable was classified as “Confidential” and signed by Hillary Clinton.

State department wrote; Assistant Secretary for South and Central Asian Affairs Blake and Ambassador at Large for War Crimes Investigations Rapp met with Sri Lankan Ambassador Jaliya Wickramasuriya and DCM Tissa Wijeratne October 21 at the State Department to provide them a copy of the Department of State ‘Report to Congress on Incidents during the Recent Conflict in Sri Lanka.’ The report was posted on the Department (S/WCI) website on October 22.Rapp first asserted Sri Lanka’s right to self defense against a terrorist group. He also stated at the outset that both sides to the conflict are required to respect international humanitarian law. He went on to outline the report, noting that it included reports of the use of human shields and child soldiers by the LTTE, and reports of unlawful attacks on civilians and civilian objects such a hospitals. Rapp next identified specific limitations, such as lack of access to the conflict zone and the inability to corroborate many incidents, which explained why the State Department was not in a position to draw factual or legal conclusions. Rather, the report should be seen as a compilation of credible incidents worthy of investigation by the GSL. He expressed great respect for and confidence in Sri Lanka’s legal institutions and traditions. He said the United States is not calling for international investigations, but is looking to the GSL to identify and implement a credible accountability process. Blake emphasized the importance of the Sri Lankan government engaging Tamil leaders in Sri Lanka on what they would consider to be a credible accountability mechanism.”

¶4.  (C) Blake noted recent information the USG had received 
that the GSL was about to embark on an ambitious returns 
process over the next few weeks.  Wickramasuriya said there 
would be 50,000 releases by the end of the month.  The 
government had agreed to allow IDPs who cannot return to 
their villages -- due to mines or lack of infrastructure -- 
to join friends, in addition to joining family members (which 
had not led to many releases).  Some of these releases would 
be to Colombo.  He said 50,000 per month would be the target, 
emphasizing that with the ten new excavators the GSL has 
acquired, demining is moving very quickly -- he witnessed it 
himself during his recent visit -- and the GSL expects to 
have the majority of inhabited areas demined within six 
months.  Resettlements would begin within two months to newly 
demined areas.  Wickramasuriya also said that all IDPs now 
have ID cards, and all have been registered, though a 
separate screening process continues for "strong LTTE 
cadres."  Blake and Rapp emphasized the importance of the GSL 
communicating the positive steps it is taking.  (COMMENT:  We

      India got independence from Britain in 1947, one year before Ceylon and is an older democracy. It is also the world’s largest democracy. What a moron this fellow who is supposed to represent Lanka but only represents his family criminals – the Mahinda Rajapakse clan of which he is a member. No one will believe anything the representatives of Sri Lankas Jarapassa regime!

        India is a pseudo Democrasy as it has effectively been run by a tiny tiny minority since independence, with 1 family having ruled India for decades. — Sri Lanka too was hardly ever a democrasy, it only had the overt trappings of a democrasy but it has never really had respect for rule of law and fundemental human rights.

    It is true that Sri Lanka had a good democracy and there is no doubt that the justice system is capable of investigating provided that it is independent from the authoritarian interference. The fact is justice is not allowed to function independently and they are the slaves of the power of the authoritarian rule. Democracy is not about having elections and I don’t think opportunistic diplomats like Jailya can understand the facts.

      Democracy we enjoyed to some extent – until 2005. It was not the best but CBK s terms were not bad. However the very same idiots were the parasites in her second terms, so she had to end up in that way. But people may remember it to this day – torture had NOT become to today ^s levels during her 2 nd term.
      These are facts. Foreign policies were also not that paralyzed before MR took the office.

    If the investigatory processes of Sri Lanka are followed, every sudden death has to be recorded and a coroner’s inquest held. Every Supreme Court Judge has revisionary powers to ensure that the law is followed. There have been killings of the Sinhalese (innocent) youth during the JVP uprisings. Killings of Tamils from 1948, 1958 onwards. There are no records. Leave alone the 2009 war, since then there have been disappearances of people unaccounted for. This fool who is ambassador speaks of investigatory processes in Sri Lanka when they have been non-existent as the police and judges are as crooked as the politicians and ambassadors. At least, the man can desist from talking about matters he knows nothing about.

    Yes, Sri Lanka had a democratic tradition and a judicial system where rule of law , equality before law and equal protection of the law were upheld even during colonial era.The famous Bracegirdle is a case in point,though it may not be ideal.But this cherished system has been ruined and systematically replaced by a autocratic,tyrannical, corrupt ,despotic rule under MR and his criminal hooligans. This fellow is MR’s bootlicker turned diplomat chosen to utter thinks that even MR does not realistically comprehend.

      Earlier as far as my knowledge was concerned, it was like that any candidate that have passed a particular entrance exam were entitled to apply for foreign affairs. How is that today ? No secret, that none of those former soldiers but made diplomats by MR are in accordance with those prerequisites. But today, even Mervin or anyone of his standard could, represent the country, if close to the President ?

    It is very famous that jaliya wickramasuriya use to be a tea tester in sri lanka.as soon as mahinda became the leader of the country, tea tester appointed as the counceler general to los Angeles CA.
    Then he became sri Lankan ambassador to US had no knowledge about any diplomatic service. Sooner he will be the next sri Lankan high commissioner to Canada.
    this was the main reason why sri lanka faces lots of problems at Geneva.(most of sri Lankan diplomats are good for paduru paties and they have 0 knowledge of external affairs)

    Killing unarmed soldiers going home for their vacation.
    Killing and preventing Sinhalese and Muslim fishermen fishing in the northern part of the Indian Ocean. (As LTTE had a secret pact with Tamil Nadu fishermen!)
    3)Sri Lankan Armed Forces are mentally and physically fit to defeat any terrorist group as they are disciplined to the core.
    They will face the enemy than use “drones” to attack.
    4)Massive post war development work in the north using peoples tax money!!
    Tax money is used to develop the north, which Tamils destroyed!!
    Specialized army offices clearing all land mines in the north put by the LTTE.
    Ex LTTE terrorist solderers are freed back to the society. (unlike in US or UK, where they are tortured inhuman ways in prison camps)

Since then, women have enjoyed a significant presence in the Sri Lankan political arena. The zenith of this favourable condition to women has been the 1960 July General Elections, in which Ceylon elected the world’s first woman Prime Minister, Mrs. Sirimavo Bandaranaike. Her daughter, Mrs. Chandrika Kumaratunga also became the Prime Minister later in 1994, and the same year she was elected as the Executive President of Sri Lanka, making her the fourth woman in the world to hold the portfolio.

    The biggest weakness of all of Sri Lanka’s envoys
    overseas is that they play to the gallery in
    Colombo. They send reams of news reports to the
    local media speaking of things which they never
    do.In the case of Jaliya, he has even hired a
    PR agency at US $ 30,000 public money to promote
    himself. They sing paeans of praise for this horseless
    jockey. What a waste of funds!!!
