Name of the Chairman, Seylan Bank, Director Lanka Logistics, Director Rakna Lanka security, Chief cabinet legal adviser and a former Attorney General Mohan Pieris is proposed as the next Chief Justice to the Parliamentary Council, a ruling party source told Colombo Telegraph. According to another source some influential Rajapaksa supports urge the President to change the decision and nominate Shiranee Tilakawardena as a damage control technique. A member of the Parliamentary Council said three names were being currently discussed by the government. The names the government has discussed were Shiranee Tilakawardane, Sathya Hettige and Mohan Pieris.

The right thing for the government is to appoint one of the present Supreme Court judges as the Chief Justice. Such an appointment will help dispel doubts that the government is trying to control the judiciary. At this juncture the former Attorney General Mohan Pieris is not the right choice. He will not be able to bring about the much needed raproachment with the legal profession.
In the meantime the sacked Chief Justice Shirani Bandaranaike should leave quietly without any further dramas. This will bring a peaceful end to the controversy. Parliament should review the constitutional provisions relating to the impeachment of judges and make necessary amendments to ensure obervation of natural justice in the impeachment procedures.

Mohan Peiris was one of the draftsmen of the Impeachment Order. He left parliament at 3.20 a.m. on the day the Select Committee sat. He advise the Government on the imeapchment. Rajapakse employed criminals to silence the voice of the people who demonstrate their dissent peacefully to the entire impeachment fiasco. Possible this may be the most potent monumental blunder committed by him. Yet, he and his criminal aliments would be helpless when things are taken up in the international arena. Whole world is fully understands that the removal of the incumbent CJ is a nullity. Whoever wishes to accept MR’s offer of the office of the CJ should realise that his or her days in the office would be numbered as Rajapakse would be forced to respect his constitutional obligation and as happened in Pakistan to restore the incumbent CJ. If there are allegations of misconduct then there is a way to deal with such charges and one cannot simply dump a person holding the high office of the CJ without affording the constitutional safeguards for a fair trial before a competent Court. Probably end result would be that the removal of the President for intentionally violating the Constitution. Who knows this may also trigger initiation of action on war Crimes against him and his brother Gotabaya not only with the backing of minority Tamil community but with the full support of the Sinhalese majority.

Ironically both Thilakawardena and Mohan Pieris who ( according to this report)are on the government’s short list for appointment as Chief Justice, are Christians – nominal Christians or committed we do not know. But one thing is clear. If either accepts such an appointment it would be a terrible betrayal of their Christian faith bringing shame on the church to which they belong. If such Christians have a conscience they must realise that in accepting such a politicised appointment they would be supporting an evil and unjust establishment under which the country has degenerated into a place where as described by the prophet Isaiah around 700 BC in the Bible :

Mohan Pieris cannot be a true Christian because of track record as the attorney general. You and the nation know what that record was. Further, his response to the UNHRC regarding the Ekneligoda case shows what kind of a human being he is. The man is a sinner and is beyond redemption.
Shirani Tillekewardene is no saint either. She stabbed the CJ on her back while the wolves her at her door, possibly with the intention of getting her job. Here again she has not shown Christian charity, has she?

Here we now have Wijedasa R meekly cowing down, as widely predicted, after breathing hell and high water until yesterday. One appreciates the Lawyers Collective offering some semblance of resistance. Sadly, JCW, Jayampathy W and company are 2nd leaguers and their admirable efforts will pan out. MR plans his moves with great precision as he did to
sideline the more fordmidable Sarath F. The former CJ is nothing compared to the country-wide anti-Rajapakse sentiments SF was able to produce, that stood strong for quite a while.
History bears many examples when shrewd manipulators subverted strong democratic societies under the guise of pseudo-racial religious patriotism – not excluding the great German Republic itself in the late 1930s. There we saw educated, long-standing, healthy institutions brought to their knees. But these eventually collapse but not before harming millions of people and turning the land topsy turvy.
Sri Lanka stews in its own juice.

Once again the cunning, street-wise MR check-mates them all. One speaks no more of morals, ethics, the Constitution, Natural justice, customs etc in governance. It is the old village truism of “henda athey nam, beda ganilla” (If the spoon/ladel is in your hand serve yourself to full measure) MR takes the entire legal fraternity single-handedly, including those senior lawyers/PCs that threatened to ignore his nominee for CJ, and, tells the country and the world if he (Mohan P) was good as A-G what’s wrong with him being CJ. Don’t even be surprised if he tells Mohan P he can continue to be Chairman/Seylon and all those other Santhosams from the Palace that came his way. Who cares for rules and regulations in the personal fiefdom?
And so the Rajapakses ride to the next storm – so long as the focus of the yakkos is kept away from the real issues – the unbearable CoL, health, education, transport, security and what not. The majority can also be fooled the Tiger is not dead and is getting ready to pounce –
a few grams of explosives, a gun or two introduced to the house of a Tamil MP – exaggerated by the Sinhala press and the extremists, lead by the JHU, will do the trick.
If Mohan P moves and makes the entire GKCCC depositors happy settling their dues – capital, interest and all quickly – the country that is notorious for the memory span of a goldfish (2 seconds) this PR coup will go out to mitigate some degree of dis-satisfaction of a section of the public that has earned the sympathy of the entire country.
That is probably why sibling BR is in the vanguard of that exercise.
