Proposing Mohan Peiris As CJ Belies The Claim That The Impeachment Was All About Integrity

It has been reported that the name of Mohan Pieris has been proposed as one of the names for the office of Chief Justice by the Sri Lankan government. If the role of the chief justice is to be that of a stooge of the government perhaps there is hardly anyone more suited to the post that Mr. Peiris.

The proposal of Mr. Mohan Peiris belies the government’s argument that the reason to move for an impeachment against Dr. Shirani Bandaranayake was on the issue of integrity.

What integrity can Mr. Mohan Peiris claim? He has worked hand-in-glove in almost every activity that has ended in scandal in recent times. Whether we are speaking about enforced disappearances or blatant abuse of authority to forgive criminals and to prosecute innocent persons or covering up any of the scandals relating to the government, Mr. Mohan Peiris has a hand in all these matters. The whole world is aware of his attempt to cover up the state’s responsibility for the enforced disappearance of Prageeth Eknaligoda. He blatantly lied before the United Nations Committee against Torture and the world media saw him do so. Later, before a Sri Lankan court he stated the very opposite of what he had said before this august treaty body of the United Nations.

The manner in which he abused his position as Attorney General is well documented, published and commented upon by many persons. We do not wish to repeat here the long list of wrong doings that are attributed to him.

The attempt to place Mr. Mohan Peiris in the position of chief justice confirms the fears repeatedly expressed during the impeachment debate that the aim of the government is to destroy the Supreme Court altogether. What the public needs to fathom is the reasons for this scheme of the Rajapaksa government to destroy the Supreme Court altogether.

It is obvious that the government is aware of what it is doing and what it intends to do in the future and that it will cause serious violations of the rights of all citizens. Naturally the citizens are going to be aggrieved and will want to seek protection. The habit of turning to the courts for protection has been well established in Sri Lanka and now the government wants to send the very clear message that the courts are no place for citizens to contest the actions of the government.

The government also wants to suppress all judges who do not fall in line with the government and perform the function of frustrating the people’s aspirations for justice.

The government wants the people to abandon all hopes of finding justice in the courts and cultivating this sense of hopelessness has become necessary for the very survival of the government.

It was the will of the government to impeach the Chief Justice, Dr. Shirani Bandaranayake by hook or by crook. It is the same approach that the government is following in trying to appoint their man to the post of Chief Justice.

The people do not owe the obligation of obedience and cooperation for these kinds of schemes of any government and the only way the people can protect their own self interests is to withdraw cooperation for such schemes.

    The attempt to plant a corrupt stooge as chief justice must be rejected by all means. A man who was in the paid service of the president has no right to head the courts where many cases are filed against the govt headed by the president. It is in fact a shameless bid to transform the supreme court into another kangaroo court like the PSC.

      This is the only solution to the concerted attack on the Judiciary and the disrepute and harm they have caused institutions in the country to cover up the hideous corruption of the Rajapassa Family.

      These dirty Rajapassa buggers who are the scum of the earth – having run a Kangaroo court in the Diya-wenn Parliament and brought great harm and disrepute to the Judiciary, legislature and people of Lanka must be impeached and Gota the white van goon packed off to the Hague!

        Dear Mr.Mahinda Rajapaksa,
        We all agree that Percy Jilmart Rajapaksa should be impeached…but how in God’s name do we get 2/3rds of parleyMutts to sign an impeachment? As I keep saying over and over again, Percy Jilmart Rajapaksa did not bring in an 18th amendment for nothing. He and his family are in this for the long run. Only a revolution with the help of India and the west can get rid of this family of hijackers who hijacked our country while the people happily let them.

      From the point that the current CJ is impeached by their so called 2/3 mandate in parliament, none of the right thinking (sane ones) would expect the current regime to perform any of the their duties to a legal manner.

      Similarly, we cant expect totally corrupted ones to react fairly.

      It is like with all the evidences letting Mervin to function SOFAR as a minister in his cabinet… BUT IN PLAIN TEXT, HE IS STATE SPONSORED CONTRACT KILLER

      Ours is now officially a failure state – this is the sad truth.

    Mohan Peiris is a Liar and a crook who has far fewer morals than the Chief Justice, Madam Bandaranayake.
    He has lied to the international community by saying that the Journalist Prageeth Ekneligoda who was disappeared by Gota the White Van Goon, whose security company, Rakna Lanka, board he is on, is living overseas.
    Mohan Peiris is singularly UNETHICAL AND UNPRINCIPLED and not fit to practice law as a common lawyer, never mind be CJ of Lanka.
    Well, well, the Lanka Spring has more grist for its mill!
    The lawyers and bar association will fight the good fight with the support of all mindful Citizens of Lanka.

      All these are proved to us all, but not to the thieves.

      So, that is the reality before us. Ones respecting democratic values but are compelled to live in SAUDI have no powers to go against that..
      The very same manner, ones who respect the rule of law and the justice cant go against, so long the robbers are in the office.

      Ours have now been alarming but opposition and we are all who wanne to have a fair state are compelled to be silent – untill the majority folks would realize the need of the hour.

    Mr Mohan Peiris has published himself as a liar at UN inquiry on the enforced disappearance of Prageeth Eknaligoda. He was also responsible (or irresponsible) in many cases of high profile killings by being a stumbling in their investigations. He is an ideal candidate for CJ to rubber stamp the wishes of the all powerful president who has already bribed, bought and enslaved the legislature. Sri Lanka is made a laughing stock with his expected illegal appointment as the CJ but the lawyers and other judges and magistrates may make his office ineffective by boycotting his functions.

      A judge is not there to carry out anyone’s ideals. He/she is there to enforce and enterpret the law. Carrying out the president’s ideals is the definition of stooge!

    Mohan Peiris is the shameless man to please the Rajathuma WHO WITHDREW THE CASE OF CHANDANA KATHRIARATCHI of Piliyandala FOR MURDER WHERE THE EVIDENCE WAS SO COMPELLING when it was in progress.It was widely known in legal circles that he will get convicted.

    In those rare moments when despots raise their hands against the rule and function of the due process of law, it is the organised legal fraternity that must resist such dubious moves. Here we now have Wijedasa R meekly cowing down, as widely predicted, after breathing hell and high water until yesterday. One appreciates the Lawyers Collective offering some semblance of resistance. Sadly, JCW, Jayampathy W and company are 2nd leaguers and their admirable efforts will pan out. MR plans his moves with great precision as he did to
    sideline the more fordmidable Sarath F. The former CJ is nothing compared to the country-wide anti-Rajapakse sentiments SF was able to produce, that stood strong for quite a while.

    History bears many examples when shrewd manipulators subverted strong democratic societies under the guise of pseudo-racial religious patriotism – not excluding the great German Republic itself in the late 1930s. There we saw educated, long-standing, healthy institutions brought to their knees. But these eventually collapse but not before harming millions of people and turning the land topsy turvy.

    There will be a rift very soon within the ruling party. Rajapakse brothers will fight with each other – disputed commencing from their children through hunger for power, like M.Karunanithy’s children fighting. Meanwhile shameless G.L.Peiris will be frustrated on being disappointed of not offered the Prime Minister Post. Similarly there are other senior Parliamentarians who are frustrated are likely to cross over and there will be no control because of the consequences of malignant economic policy. There will be also some factions within the Armed Security Forces and religious groups which are likely to split on account of suspicions. Every one can expect this last episode in this drama during the course of this year, during which period some tragedies are likely to occur. These are history.

    We should have a powerful Non-cooperation movement staged by honest and self respectful Judges and lawyers in all courts all over the island and mobilize the support of the masses taking examples from the movement of Mahatma Ghandi.Unfortunately, we really lacking with brave and militant type of professionals who are really looking for the people’s sovereignty but always looking for their own financial and political gaining. I salute the people who are still standing for democracy and good governance even facing serious threats from the regime.

    All the articles written with vitriol notwithstanding,BASL has decided to cooperate and work with the new Chief Justice. If the impeachment is illegal, the new appointment cannot be legal. But the BASL has helped the powers that be to knock the bottom off that thesis. No government need ever fear that the Bar Association will or can precipitate a crisis. In the sordid political and legal history of the country, impeachment was a brief chapter. BASL has closed it and is turning a new leaf.

    Once again the cunning, street-wise MR check-mates them all. One speaks no more of morals, ethics, the Constitution, Natural justice, customs etc in governance. It is the old village truism of “henda athey nam, beda ganilla” (If the spoon/ladel is in your hand serve yourself to full measure) MR takes the entire legal fraternity single-handedly, including those senior lawyers/PCs that threatened to ignore his nominee for CJ, and, tells the country and the world if he (Mohan P) was good as A-G what’s wrong with him being CJ. Don’t even be surprised if he tells Mohan P he can continue to be Chairman/Seylon and all those other Santhosams from the Palace that came his way. Who cares for rules and regulations in the personal fiefdom?

    And so the Rajapakses ride to the next storm – so long as the focus of the yakkos is kept away from the real issues – the unbearable CoL, health, education, transport, security and what not. The majority can also be fooled the Tiger is not dead and is getting ready to pounce –
    a few grams of explosives, a gun or two introduced to the house of a Tamil MP – exaggerated by the Sinhala press and the extremists, lead by the JHU, will do the trick.

    If Mohan P moves and makes the entire GKCCC depositors happy settling their dues – capital, interest and all quickly – the country that is notorious for the memory span of a goldfish (2 seconds) this PR coup will go out to mitigate some degree of dis-satisfaction of a section of the public that has earned the sympathy of the entire country.
    That is probably why sibling BR is in the vanguard of that exercise.
