Dealer’s Appointment As Supreme Court Judge Sends Shock-Waves

The shock move to appoint Priyantha Jayawardena PC who is a close associate of Minister Basil Rajapaksa and is alleged to have been involved in many “underhand deals” has resulted in widespread fear and criticism among judicial and intellectual circles in the country, with one of the country’s most senior Lawyers saying that “this is the worst appointment in my entire life”.

Priyantha Jayawardena has gained notoriety and prominence due to his alleged dealings with Minister Basil Rajapaksa and business tycoon Harry Jayawardena.

The move has sent shock-waves within the legal fraternity.

Speaking to the Colombo Telegraph on the condition of anonymity, senior Presidents’ Counsel who have been supportive of the government expressed shock and dismay at the move.

“The executive has the power to appoint, but all such appointments have to be above board. The men regardless of their political affiliations should have maintained a high standard of integrity. That is what is most important in a judge, and if that is compromised, everything else does not matter,” they said.

Earlier, Justice Sathya Hettige who was also considered a close ally of the ruling regime was accused of corruption and other malpractices during his tenure as a Judge of the Supreme Court.

Hettige and Justice Shiranee Thilakawardane retired paving the way for the news appointments.

The Bar Association of Sri Lanka and the Lawyers Collective, two legal bodies that have continuously voiced their opinion against intervention by the executive have maintained stoic silence regarding the appointment.

Instead the BASL has issued a letter calling regional branches to discuss the mode of appointment of judges with no reference to Jayawardena.

The Colombo Telegraph also learns that Judges of the Court of Appeal have voiced their displeasure over the appointment.

      Maghribi,

      Shipping includes land and air transport as well. Therefore Ministry of Shipping in landlocked Afganistan is truly valid.

      Real question is about the authenticity of Sri Lanka’s Ministry of Justice.

      PS: I have no idea why Hakeem sits there with that title. Access to unlimited, free, petrol drinking, road clogging 4WD vehicles hated yet, funded by Sri Lanka’s starving tax payers could be one reason. Pathetic!

    There is no surprise in this appointment. Whole country is being run by “Dealers”.

    UNP put this constitution without any real checks and balanaces in place.

    Incumbent executive clan from Hambantota rose through the ranks of SLFP’s utterly corrupt monkeys.

    Clan is now busy abusing that ill-gotten limitless power.

    Sanctioned by UNP’s dictatorial constitution.

    After All this is Family Run Business. The Family appoints whoever that pleases them.

    After all, the People Elected The Family.

    If you do not like what the Family does, please do not elect them.

    Today I happened to read a news item quoting Minister Vasu Deva as saying that Defence Secretary does nnot allow the President to implement the LLRC recommendation with regard to Northern problem. It means on the question of Northern problem the ruler is now known.

    THe now comes the appointment of judges. It shows the other sibling is in charge for it. So We can imagine that all appointments are made by him. So he is the ruler with regard top appointments to the public service and judiciary.

    Law making is controlled by Parliament which saw its effect through the removal of the CJ via impeachment.

    The rousing the nationality is done by BBS with the blessing of a ruler.

    So what does the Executive who was elected by the people directly do? Wishing the people in the opposition on their Birth day. Issuing policy statments via media which never see the blue print like no one is above the Law. Already every body knows that the BBS is very much above the law.

      The elected parliament is the legislative body in every democratic country. The parliamentarians come from every nook and corner, some with questionable education, and with varying abilities, and serving various interest groups, not the general public as is commonly believed. In every ‘democracy’ parliamentarians are for sale. Sri Lanka is not unique.

    With the absolute absence of the rule of law and the complete breakdown of the justice system in Sri Lanka, with impunity reigning supreme, it does not matter even if Basil Rajapaksa’s chauffeur becomes a judge of the supreme court. Perhaps he might do a better job. He would not need a knowledge of the law as long as he has a good sense of justice. In the instant case it is unfortunate that this fellow lacks any integrity.     The appointment of this man on the recommendation of Mr.20% will enhance Basil’s coffers on some judgements delivered by this bloke!

    For the people of Sri Lanka to realise that they should do something to arrest the downfall of the country and to take it to the correct path first the country must hit the rock bottom. With appointment of these jokers to Supreme Court the country will hit the rock bottom soon. Therefore I am happy about this appointment.

      Okay, if someone provides the proof, what would you do? You would go and drag the guy to road? It is very clear what is happening in the government of Sri Lanka. I can’t think of even one person who is genuine in the Sri Lankan government, or whose senior appointment is fair in the government sector.

    This whole legal culture is sickening. Why dont you publish the list of the Council of Legal Education ? How many deal makers in that council ? When the law college is run by such people is it a surprise that the entire legal profession has become a farce and dominated by fast talking conmen and deal makers ? About judges can you say without fear that they cannot be “approached”? So many outsiders speak to judges about cases they are hearing.Rajapakse morality is only the last nail.

    Attempt by a bunch of jealous losers trying hard to throw mud at this very talented lawyer with a proven track record. I met Priyantha many times and my friends know him well. He is one of the most humble and decent Sri Lankan lawyers I have ever met. Don’t believe the crap you read on the net. If you really want to know about a certain person, ask from the people who deal with them day after day.

    Being decent , humble etc cannot be the qualifications to be a judge. Is this unknown lawyer Priyantha Jayawardene close to Basil Rajapakse, Harry Jayawardene , the government etc ? In that case is this another political appointment. What about all those hundreds of judges and lawyers who are senior to him ? They are also humble and decent only difference is that they are also more self respecting, capable and independent !

    Don’t worry. Rajapakse Family Oligarch days are numbered. The cracks started with the defeat of the Casino bill. Soon it will spread to other Bills and the King and his cronies will be kicked out soon.

    The point is where the Alibabas with their loot going to hide when they were kicked……….Probably the southern Nanthikandal Hambanthota Swimming pool……….

    Yes both Bar Association of Sri Lanka and the Lawyers Collective should keep up the pressure until their questions are been answered.

    Remember offense is the greatest defense, means in order to achieve goals one has to go on offense.

    Hope the family crooks cartel will crack pretty soon.

    Intelligence, ability, past track record and integrity counts a lot more than seniority. Hundreds may be senior,self respecting and capable, but government selected him because they could select ONLY ONE person and obviously believed he is brilliant in they field.

    Typical of our Sri Lankans to go crazy when someone else get a promotion or recognition.

    This is what happens when people don’t exercise their vote when it matters. Many who complain here in this forum probably don’t live in SL and hence have no cause for concern. But those of you who do live in SL and did not not vote this is your own downfall.

    People! you have the power to decide your future by casting your vote. If you feel this is not working change is better than keeping silent. Yet you chose to stay silent when it matters and then cry foul when things don’t work out, ask yourselves who is to blame.

    Wake Up my fellow Citizens hold these politicians accountable for everything. Don’t be led to believe, Even the great Buddha asked us to question even our teachers and not to believe everything we are told.

    I didnt think we would meet a man who would use the daily news as a source of a character certificate and a qualification to become a supreme court judge of sri lanka. Well in that case why not appoint rajpal abeynayake, a patriotic and sober lawyer !

    That article praising justice priyantha was written by a unknown lawyer who does not forget to call himself a “senior” lawyer !From the way it is written either priyantha is a intimate friend of is written by himself.So many things only priyantha will know.The senior lawyers good stars are coming in the supreme court !

    This new judge justice priyantha thinks being junior to various lawyers is a qualification. He says he was appointed to various committees and also made a presidents counsel( President rajapakse’s) by this same government in the last 4 years. Now the same government appoints him to the supreme court!So what is wrong ?The government can now make any man emminient like they have done with duminda silva, maervyn silva and others

    This country has really hit rock bottom where such things are concerned.
