Duminda Silva Challenges Death Sentence

Former Parliamentarian, Duminda Silva who was recently sentenced to death in the Bharatha Lakshman Premachandra killing has filed an appeal in the Colombo High Court, challenging the sentence delivered by the Court this month.

Last week, three others Anura Thushara De Mel, Chaminda Ravi Jayanath alias ‘Dematagoda Chaminda’ and Mudiyanselage Sarath Bandara, who were also sentenced to death along with Silva submitted an appeal on the death sentence.

On September 8, they were sentenced to death by the Colombo High Court in a divided judgement over a shoot-out in Mulleriyawa between Silva and Premachandra and their thugs, which killed Premachandra in 2011.

    Can Hirunika appeal to MARA/GORA duo to bring back Bharatha back to life. This hired assassin killed Bharartha on the support extended by the God Fathers for the execution and was protected by the God Fathers up till now.

    My only concern is whether Dumi’s and MARA’s dirty money will influence the Supreme Court. Not short of Kudu and plundered wealth.

    Hope saner counsel prevails at the Supreme Court.

      Why not try this line.

      Say that Bharatha Lakshman Premachandra would have ended up in ‘Apaya’ Hell, and by your actions, you sent them yo Nirvana, Nibbana. Therefore, your death sentence must be commuted to life imprisonment with hard labour.

      If you are going to enfd up in Apaya, Hell anyway, why not go tjhere early, accept the death sentance, and move on?

      Are you a coward? Remember the Son of Kappetipola, the brave Patriot?

        He can come out of cell only when Rajapakse returns. Rajapakshes comeback can only if MS or others would have been no longer there.

        THis Duminda Silva fellow should be given not death sentence but Life sentence and put to work on road construction or some such stuff. We need manual labour and this idiot has the brawn power of 12 ordinary sri lankans to make a lasting contribution.

        Absolute shame on the Rajapakses’ but nothing surprises. Awaiting with bated breath, MARA’s visit to prison’s death row to go and whisper sweet nothings to this murderer.

      Are you casting aspersions, on the Judges who are led by the first Vellala Chief Justice of the Yahapalana High Court?.

      In doing so, aren’t you doing the same to the Yahapalana PM , Yahapalana President, Suren Surendran and Mr Sambanadan who personally selected the Selection Committee, the CC to give us Yaha[alanaya which we were craving for a long time?.

      Duminda s future was predictable by any 10 year old when looking at the manner he behaved himself during the high days of his Guru -Mahinda Rajaakshe. I have overheard all other rubish except ” Athigaru Janathipathi thuma did than and this ” on his stage public speeches. Besides, Kudu gaththo kudu walin ma naseey – those who deal with Drug, the drug addict s curse will take to the hell – lanken youth today have been captured by drugs – as comparable to any other countries in Latin america. Every 4th young chap or more is reported to live on drug. School going children are becoming Drug addict due to the reason the easy availablity of drugs in school vicitnities.

      What have the authorities been doing or done sofar ? If they had stayed silent ? Why we were fallen to this levels even if the country had impressive records on youth and their performance 2 decades ago. Can we put the blame only on the 30year war all to have fallen this level ?Or the name of war, thugs, high criminals have been given a chance to loot the nation that way – politicians should be investigated for all the high crimes not neglecting it for any reasons.

      These can be used as social indicators when assessing the society and its development over the years. socio-psycho analyses of the society will help to find solutions where the folks have failed over the years. Talks have always been big, but nothing has been achieved in relation to the countries in south eastern asian region.

      There are significant fractions in the society, whose grievances such as not having proper drinking water for them have been forgotten, until the untold stories came to light lately, no high men have reacted. What have the politicians been doing in this god punished island.

    He is going to keep appealing this case until he goes to grave first or until the judiciary gives him a favorable judgement.

    So the nuisance will not go away quietly any soon.

    my point of view is 3 judges where 1 judge was not in favor of the sentence ,he said all should be released as nothing can be proved (why)
    Keeping this point Dumindas lawyers will play,Keep in mind whatever said and done all lawyers and judges are one.

    now duminda will appeal. this will take 6 to 9 months or may be more to come up at the Supreme court.1st hearing the SC court will accept the appeal and give a date another 6 months then after that 2nd hearing Sc will tell dumindas lawyers to submit on a further date and this will go on for 4 or more years and then everyone would have forgotten and the fairy tale ending,

    this is Srilanka , Thats My Prediction.

      The case will be heard by a 5 member Bench of the Supreme Court. The good thing by handing down the death penalty (rightly so) to “Dumi” and his henchmen are,

      (1) They cannot be granted bail
      (2) They can have only two visiting days per month.
      (3) No meals can be brought from outside.
      (4) There can be no more appeals. This is the last.

    While i was in Sri Lanka i heard over the TV news channel that the decision was 2 to 1 in favour of death sentence and two judges individual guilty statements were contradictory as such the accused may have a chance to revert the decision.

    By a strange quirk of fate it seems that Hirunika may well meet her nemesis Duminda in jail.She has been already indicted in the well known case where a youth was kidnapped.Actually all of them are the same.But they try to show themselves as been innocent babes..How could Hirunika who cries crocodile years at the fate of her father at the drop of a hat have that innocent youth mercilessly assaulted and dragged away in broad daylight with all the world watching.Bloody thugs and murderers – all of them.

      Sorry, Correction. What I meant was Ehelapola’s son, either Loku Bandara or Madduma Bandara, the brave child.

    Will this slowly turn into a “Game of Shape” (Sri Lankan term for cover up) or will the legal system have the courage to refuse to lift the death penalty and actually carry it out!?
    Hope it does not slowly turn to life in prison that eventually leads to a release after a few year once enough people have forgotten about the murder!

    Do not forget other than Bharatha Premachandra another 3 individuals who were state employeees by way of police constables and assigned to the presidential advisor for labour relations a title MaRa was to give for Bharatha that time.

    so these 3 individuals had to die on duty and they were just doing their act of duty and they have families and kids too.

    Also note that the T56 used to kill these 4 was owned by LTTE and smuggled by then monitoring MP for the Ministry of Defense, Kudu Dumi.

    Im wondering why the opposing judge did not consider this simple point which is an offense of non-bailable.

    Those thugs that accompanied kudu Dumi was all well known criminals and drug lords.

    Wonder how much change hands with that judge from kudu money ?

    Sri Lanka should introduce news papers systems so that this kind of news will go to all people. Then the people will become aware of arrests and tortures by police, it will helpful to steal public fund carefully and safely.

    Death sentence was given to hime by the nature. Death sentence is not enough to this thug. Raped innocent girls, treatened and murdered innocent people I am not esp talking about premachandra, premachandra was a nasty thug too, but before premachandra was murdered this idiot should ve been in jail if there was a non bias proper legal system in Sri Lanka.

      Rohan Polwatte, I hope this does not turn into another drama to fool the public!!! I wouldn’t be suppressed if they slowly remove the death penalty!! In this case the death penalty should not be removed and should be carried out without delay. Let’s see what this government that the people have so much faith in do…
