Gnanasara At Large Courtesy Bail From Homagama Magistrate

Galagoda Atte Gnanasara, recently sentenced to hard labor for a year was granted bail by the Homagama Magistrate when an appeal challenging the verdict was submitted by his lawyers was taken up today (June 22nd)

He was released on the basis of two personal bonds of Rs 500,000 each by Magistrate Sudesh Ranatunga, who also ruled that the Controller of Immigration and Emigration be notified to bar Gnanasara from leaving the country.Related posst:

    We tend to blame the judges. The judge did not grant the bail on his/her own. There was an application for bail. The prosecutors did not vigorously oppose the bail. The judge had no option.
    The lesson learned is that GoSL does not have any control over ‘Law and Order’.

      Are the state functionaries really scared of the prospect of Dr Gota being elected as president in the next elections? Gota has already threaten officials and the functionaries do not want to rock the boat and sacrifice their career and other prospect.

        The national Park has reserved 8,000 acres there for it. People displaced from that land is not settled.         CT should ask an official of NPC to write the situation here to clear concocted stories of Appe Aanduwa’s commission part taking, story tellers. As the story coming out now is completely different from what Appe Aanduwa feeding to media, A Tamil judge should ask park officials,
        1). Why the people still not settled and they are remaining as refugees in their own land?
        2). What was the need to reserve 8000 acres to park while they opened a lot of area to settlement? Release that land to NPC immediately.
        3). Who was going for games in to those park lands. What is happening to that income.
        4). Why the mate of the stray leopard shooters (Rapist Army) not prosecuted.
        5). Fire immediately the park official who went the leopard in the first place because tier efficiency is worse than Kotte 8th grade Parliamentarians.
        6). Appoint qualifies Tamil workers to maintain the park who can take of the Tamils living in the area from wild animals.
        7). NPC has to appoint a commission to investigate northern Park department’s function. Aanduwa has to appoint this commission under CM CV.

    I don’t think, we should ridicule the Legal System just because this Gnanasara was given bail. A convicted has the right of appeal and in considering the case, the Judge has by law the power to grant bail with conditions attached. This has been done accordingly and that RIGHT is enshrined in the Legal System. Therefore it is not correct to subject that Law to ridicule. There are very many other instances, such bail conditions have been “Violated” by the accused awaiting trial and still others whose bail conditions have been “Lifted” to accommodate frivolous and also “Bogus” claims of culprits who should never have been granted such protection under any Legal System. One such case is that of Jaliya Wickramasuriya, a close relative of MR and ex Ambassador to US. He is still at large and the Government is spending much money to arrest him. The best part is the two sureties are also absconding. What happened to them and the “Surety” placed in a pledge to produce the culprit? Do the “Lotus Eating” and the 98.9% literacy rated PEOPLE and the MEDIA discuss or question the “Legal System” that relates to such instances? But this “Gnanasara Case” is of paramount interest to stage “Protests”; “Media Briefings” ; “Media Circuses” etc. nothing but to UPLIFT him as “HERO” even at the expense of RIDICULING and DEGRADING the proper execution of the Legal System that the Judge who examined and made an appropriate decision on an Appeal. So no WONDER even if a “Hitler” type takes over the country, with the BLESSINGS of “MAHA SANGHA”. This “Gnanasara” now out on bail; but not FREED , will most probably be taken in a PROCESSION to “Meet” (Behadikkinna) the custodians of the TOOTH RELIC . Who knows? This “Maha Sangha” will make that a “Historial Event” to SIGN a “PLEDGE” in the “Chamber of the Tooth Relic” promising to INSTALL a “HITLER”.

      How come all the convicts who are connected to absolute powers (whatever that maybe), power centers and state institutions get bail and not those who really deserve .

      There are cases where detainees have not been charged nor bail granted for 20 years.

        Sri Lanka’s PTA is very weak. That is why LTTE supporters like Sivajiliangam, Wigneswaran, Sarveswaran and Vijayakala Maheshwari glorify, justify, erect monuments, light lamps, cut Birthday cakes in the name of Prabhakaran and LTTE. If they did that in Britain, they would be serving a life time imprisonment.

        Same as British Terrorism Act 2006, Sri Lanka’s PTA should incorporate the following as criminal offences if they are not already included:
        – Encouragement of terrorism
        – Disseminating terrorist publications
        – Preparation of terrorist acts
        – Training for terrorism
        – Making and possession of devices/materials
        – Misuse of devices or material and misuse and damage of facilities
        – Terrorist threats relating to devices/materials/facilities
        – Trespassing on nuclear sites (should be changed as military camps.)

        Government should ARREST Northern Provincial Councillor M.K. Sivajiliangam, Chief Minister/North C.V.Wigneswaran, Northern Province Education Minister Kandiah Sarveswaran, and State Minister Vijayakala Maheshwari as a counter-terrorism strategy to stop Tamil youth becoming terrorists, supporting terrorism and to prevent future terrorist attacks.

          Champa, I didn’t read that document, but I am with you. Britain is not going to allow all those undocumented immigrants going in UK and do all those terrorism. Further, many original countries don’t take back their criminals agents they send, unlike Lankawe accepted back Karuna after send him there on Diplomatic Passport. If Karuna was not taken back, then only option Britain have had is put him in without releasing. America was even stronger on that. It did not allow the ISIS fighter enter island even after they were captured. So it kept them in the Cuba’s leaded facility, Guantanamo Camp.

          Lankawe, too, can have a law like that for Tamil Eelam Nationals. But it is the UN and UNHRC responsibilities shorting out problems between two nations.

    Where are those Supreme Court Judges who are trying to indict Ranjan Ramanayake for Contempt of Court? It is best if these Judges make the dogs in their house wear the Wig and cloak, as they will do a better job of guarding Justice in the Country. These MF are a damn disgrace for recusing through fear to sit as Judges in cases where Gota is charged. The bravado of these Judges are only for the law abiding and they shit in their pants when thugs raise their heads. What a mockery of Justice?

    The root cause of the political crisis facing the country today is the Buddhist clergy. In fact they are the crisis. And only the Sinhala-Buddhist people themselves who can address this grave situation and halt the downward spiral. If they don’t, then an imminent plunge into a fascist theocracy cannot be evaded. He/she is socialized from very early age to worship at their feet looking up to them as protectors and saviours of the Rata, Jathiya & Agama – as representing the Noble Buddha himself. Then education and popular culture further reinforces this mythology as history. So it is not easy to free oneself from this warped view of the world. It is deeply ingrained in the Sinhala-Buddhist mind-set. No wonder people who have no difficulty whatsoever in believing the Anunayaka of the Asgiriya Chapter when he preaches that the Buddha visited Sri Lanka 3 times, 2500 years ago – accept without question his knowledge and evaluation of what Hitler was all about (after all he died only 73 years ago), and his endorsement of Gota, the wannabe little mousey dictator.

    Seven suspects including former Defence Secretary, Gotabaya Rajapaksa have been granted bail by the Colombo Magistrate’s Court. (Allegations of Bribery or Corruption over a Rs. 11.4 billion loss to the government)
    The Court of Appeal today extended a stay order preventing the arrest of former Defence Secretary Gotabaya Rajapaksa.

    Basil Rajapaksa, former Sri Lankan Minister of Economic development and younger brother of former President Mahinda Rajapaksa, was on Monday granted bail by the Colombo High Court in a case concerning alleged misappropriation of public funds.

    Parliamentarian Namal Rajapaksa and two of his Directors were granted bail today by the Colombo Magistrate Court over money laundering charges.

    The Colombo High Court this morning, granted bail on Pivithuru Hela Urumaya (PHU) leader MP Udaya Gammanpila, in connection with two separate indictments filed against him by Attorney General. The indictments relate to an allegedly fraudulent share transaction that took place in 2000.

    Bodu Bala Sena (BBS) General Secretary Ven. Galagodaatte Gnanasara Thera, who was sentenced to one year rigorous imprisonment, was granted bail on two sureties of Rs.500,000 each by Homagama Magistrate Udesh Ranatunga

    Meanwhile, SPC former chairman was granted bail in respect of 13 other cases for causing a loss of Rs.74 million to the government when paying hotel bills and bonus payments using SPC funds.

    Former Lanka SATHOSA Chairman Nalin Ruwanjeewa Fernando was granted bail by the Colombo Fort Magistrate a shot while ago.

    He is alleged to have misappropriated state funds amounting to Rs. 39 million while importing sports equipment during the last Presidential Election.

    Perpetual Treasuries Limited Arjun Aloysius and its CEO Kasun Palisena were further remanded until the 05th of July when they were produced before Fort Magistrate Lanka Jayaratne this afternoon.

      There has to be a bond robbery to have bond thieves. There is no such thing. There aint a case as yet and no one is convicted on the other hand Ganasara is a convicted criminal according to the law of the land.

    Yes! Some are more equal than others. The judiciary did the same thing of granting bail to a convict on appeal when there is no objection from the prosecution, both in the cases of Palpita and Weeratunge combine and as well as Gnanasara. The difference I believe is that the former group did not have to wear the prison garb at all and from the point of conviction to granting bail and no time was lost in between. In the case of the latter it is understood that he had to wear the prison garb for a few days. Some media did not make a fuss about the treatment of the former group whereas in the case of latter they even tend to cast aspersions on the judiciary for applying the same yard-stick. As an advocate of amity among people I find Gnanasara as a challenge to my cherished goal due to his much publicized conduct involving violence against an ethnic group. Why is he not roped in for that? Some of the integral parts of promoting amity are the adoption of the policy of meritocracy and fairness, including the uphold of rights of people whom one considers a pain in the neck.

      Leave Buddhist clergy out. Go to an Arab country or a Christian country to see how everybody respects their laws. US President must swear on the Bible when taking office.
      Buddhism has no such laws or the Buddhist clergy don’t impose strict laws like some other religions.
      Following Buddhism is based on the laymen’s capacity to understand Buddhism on individual basis. In Sinhala, we call it “Thama thama nena pamanin dena gathayuthu.”

    Native Vedda: I too pose the same question. Where does the wrong come from? It is with the Judges? A very recent case. Did you know the Chief Justice decided to make a change in the panel of Judges set to hear the case (fraud) against MP Aluthgamage, on the request of the Accused. He, this known rouge, Aluthgamage protested stating that Judge Kulatunga is “BIAS” against him and he should be removed. The CJ agreed and removed him. What does that “Decision” convey?. There are Judges in the Legal System who are “BIAS”. Do we have to live with that in the Legal and Judiciary system. Shouldn’t that , being “BIAS”(as decided by the CJ) to an accused, be considered a “DISQUALIFICATION” to REMOVE him from the entire operational system of the Judiciary? Properly speaking, that Judge should not be allowed to operate in the system. Same goes, with GR’s case. where number of Judges “REFUSED” to hear the case. Why? Are they “BIAS” or “FEARFUL” of the ADVENT of a “Hitler”.? Do we need such “Judges”. ? These are very serious matters that need dialogue by the people of all walks of life, including the Media. In “Gnanasara” case , in my opinion, nothing has gone wrong so far.

      Of course the Judiciary is bias. For an example, Suganthika Fernando who lambasted judges, lawyers and the system and acted like the goddess of justice was charged for violating the speed limit laws on the Express Way. But the Judge didn’t impose a fine on her only a warning. Then again she has disgraced the Courts by violating the dress code rules. Again, only a warning. Either Judges are scared of her or she is blackmailing Judges not to enforce law on her due to some evidence she said to have in possession. How about if a common man violates the speed limit on the road and a common man disrespecting the Courts by sneezing? There is a different law for privileged in this country.

    I thought that Bail is available ONLY when a person is in remand. Is there any legal provision for Bail AFTER a person has been sentenced and is serving his sentence? Seems strange.

      Not strange at all.
      Lalith Weeratunga and Anusha Palpita who were sentenced for 3-year Rigorous Imprisonment were granted bail. I also came to know that there is a such thing only after they were granted bail! One even went abroad. I feel sorry for other prisoners who are under similar circumstance but not having “money” to file Appeals. I don’t agree with only the wealthy and the privileged enjoying all the “luxuries of our law.”
      Unlike Ven. Gnanasara Thero who spent at least a week in prison, they didn’t spent a day in prison. From the Courts they went to a luxury ward at the Prison hospital. I don’t remember you objecting at the time.
      If I am the President, the first thing I would do is closing down the Prison Hospital where all elite, privileged and wealthy rogues enjoy a luxury holiday at the expense of poor taxpayers.

        Definition of Bail in the Oxford Dictionary “The temporary release of an accused person awaiting trial, sometimes on condition that a sum of money be lodged to guarantee their appearance in court”. By definition bail should not apply when a person is sentenced. However, appears when an appeal is made and the prosecution does not object, bail can be granted. Agree with Champa regarding the absolute unfairness in the use of the Prison Hospital. With regard to Lalith Weeratunga and Anusha Palpita the former President intervened, in the case of Gnanasara Thero he did not for reasons better known to him.

    I heard Ven Gnanasara was sodomised by a gang of well built LTTE inside the jail. It’s going to take sometime for his a*se to heal. We can’t send him to jail again , he will be sodomised again. He is a political prisoner.

    Champa: Thanks. I wish you could be more “Independent” and a “Free Thinker” so that all these problems could be viewed with an “Unbiased” mind set. Of “Aluthgamage” I said and qualified in saying “known” rouge. Only a “known” rouge could be brought before courts. How do we “know” it? It is by exhaustive “investigations” done and “Known” to Law Enforcement that he deserves to be brought to meet justice. Equally, I hope all the “Bond Scam” rouges. presently “known” to the Public with abundantly available information would also be brought to justice. No disagreement with what you say. That “Suganthika Fernando” case. Why a “Speeding” case come before a court? Normally a such a person is slapped with a “spot fine” by the Police. Has she refused to pay the fine or contested the case in courts. Did she “Plead” guilty and ended with a “warning”? Do you know what “happened” and in your opinion, what could have been the appropriate “punishment” in an “speeding violation”? Answers to such types of questions I raise here would have provided you with an “unbiased” opinion. So let us discuss matters in that frame of mind.

      You can’t call Aluthgamage a rogue, as it is not proven in the Courts.
      On the other hand, this government established a special FCID to use a different channel to deviate from the normal legal system targeting political opponents. As you see he has brought before the justice. But that doesn’t give you a right to call him a rouge.
      About Suganthika, yes, she pleaded guilty in the Courts, but not fined. Why? There could be many people who plead guilty for traffic offences. Have they all given a warning and not fined? You can’t find fault with the Police for producing her before the Courts. After all she is the one who criticized inaction of the Police. Last year this government increased traffic fines to Rs. 25,000. I don’t know the exact fine for driving over 100km/h on the Expressway. She has put the lives of other law abiding drivers in danger. Why only ordinary men pay fines and not the privileged?

If, in your own reasoning Aluthgamage is not a “Rouge” because it is not “PROVEN”; then Ranil, COPE members too are not “Rouges” and not even Arjun Mahendran, Aloysious, Palisena , Ravi K . In my reasoning all of them are “Known Rouges” from “investigative evidence” surfacing and that is why they must be brought before justice. Then the “Known Rogues” must be tried and convicted. I wonder whether, you have ever heard of the term “Known to Police” used by the Law Enforcement in their investigative process. Have a nice day.

    It is time at least the 3 new courts should have strong Judges, like the one who was in Jaffna who was transferred recently whose police protector was killed. Those Judges who wait till the last minute to withdraw from hearing cases should be demoted and sent to rural areas. If the Judiciary is strong in a country there will be order and harmony. Unfortunately in SL we have lost both. Judiciary as per the constitution is an independent body from the Executive and the Parliament. Unfortunately now, especially after CJ Sarath Silva the Judiciary has has become the peons of the politicans. Very unfortunate.

        Thank You for asking. I am busy these days – don’t let anyone tell you old age/retirement is just a string of long lazy days. I am busier than ever.

        Busy as I am, I am determined to do my civic duty. Our biggest challenge these days is to shout out loud and clear at the the bastards who will bring misery to ALL our communities. These days they just happen to be false prophets of many religions. In Indonesia the Mad Mullah who sanctioned bombing of places of worship in that country has been sentenced to death. Indonesia has the largest Muslim population in the word.

        Here our biggest curse are the thuggish impostors who put on robes and assume the right to ‘act to protect Buddhism’. A load of bollocks! I am old enough to remember similar characters who worked behind the scenes in the fifties. Gnanasara is the tip of an iceberg – there are more lurking in the dung pile. The judiciary is bound to ‘follow due process’ but I would discard my liberal tendencies and sanction locking these buggers up and throwing away the key.

    The main reason why thugs like Gnanasara are roaming the streets wearing a yellow robe can be attributed to the inability of the Mahanayakes to protect the Sasana. Mahanayakes are today interested in supporting any politician who can give them “santhosam” in the form of Benz cars, money and land. If the Mahanayakes stopped Gnanasara and Ravana Balaya thug monks and other thugs wearing the yellow robe we will not be in the present position where a monk verbally attacks a women who has lost her husband that too in the court premises. The President should have to guts to bring a law that governs the behavior of all religious priests as they are the main trouble makers in the country. Today we do not have LTTE but we now have thugs wearing yellow robes and some mullahs.

The problem is that the Mahanayake’s and the impostors both enjoy political patronage. Religion – Buddhism – should be freed from being shackled to politics.       So, what is this nonsense about ‘courtesy bail’? The charge was an open and shut case of a very public contempt of court. The obnoxious Gnanasara should have detained immediately he defiled the court. The next we know is that bugger feigns sick, and since the Merchant Ward is overflowing, he will be sent to Cinnamon Grand or Shangri-La. Aiyoo! Aiyoo!
