The Court of Appeal today dismissed the writ and revision applications filed by Gotabaya Rajapaka challenging D A Rajapaksa museum trial being taken up before the Special high courts. In effect, the CA verdict has now paved way for the D A Rajapaksa museum trial to begin tomorrow.

The aspiring Presidential nominee has been accused of misappropriating state funds worth Rs. 34 million to construct the commemorative museum in Weeraketiya, Hambanthota as a tribute to his late parents. He, along with six other defendants were charged by the Attorney General under Section 5(1) of the Public Property Act and Section 388 of the Penal Code, the Prevention of Money Laundering Act and the Public Property Act.
When the case was listed to be taken up before the Special High Court, which began its trials in July last year, Gotabaya’s legal team filed writ and revision applications citing the Special High Court lacks jurisdiction to hear the case.
The three judge bench of the Special High Court includes justices Sampath Abeykoon (President), Sampath Wijeratne and Champa Janaki Rajaratna.

Can the “Special Courts” finish this case within two weeks? What is to be considered, in my opinion, is only to see the records and verify that the money was withdrawn from the “PUBLIC FUNDS” of the RDA. If that has been done, the accused will be found guilty. A further proof that would establish the “Unlawful” withdrawal of “Public Funds” is the “Repayment” of such funds by the accused.
