Hybrid Constitution Comes Home To Roost

The Supreme Court in a judgment delivered last week  (21/02/2014) said that the Court of Appeal possessed no jurisdiction in terms of Article 140 of the constitution to review a report of a Select Committee of Parliament constituted in terms of Article 107(3) of the Constitution read with order 87A (2) of the Standing Order of Parliament or to grant and issue an order in the nature of a Writ of Certiorari purporting to quash the report and findings of a Parliamentary Select Committee on the basis that it was not properly constituted. The five-judge bench of the Supreme Court set aside the impugned judgment of the Court of Appeal dated January 7, 2013. The application filed by the petitioner respondent Dr. Shirani Bandaranayake in the Court of Appeal, shall stand dismissed due to lack of jurisdiction.

The concept of supremacy of Parliament is a principle in the Westminster system of government but not in a presidential form of government where the principle of separation of powers operates. Unfortunately President J.R Jayewardene in 1978 adopted a hybrid Constitution taking disparate principles from the two forms of government and mixing them to strengthen the power of Parliament. But under a system of political parties where the Executive President is elected from the ruling political party, he gets the control of Parliament as well. In presidential forms of government there is a clear separation of the composition of the three arms of the State. The Executive Presidency is assisted by Ministers who are not drawn from Parliament. In France where the presidential system prevails, the Ministers if appointed from Parliament cease to have voting rights in the Parliament. Of course the Judiciary is independently appointed although the President may formally issue the letter of appointment.

The Founding Fathers in USA who understood how fickle the people are, opted for a single elected leader as Chief Executive and gave him the power to appoint to his Cabinet persons of proven capability who will not have to pander to voters since they are not elected. So US Presidents have appointed as Ministers outstanding men who were either professionals or Academics but who invariably had management experience in the large private sector organizations that country has a surfeit of. Even France and Japan appoint men with considerable management experience to be Ministers. In France ministers are appointed from retired Public Officials, men of the Grande Ecole, the prestigious French academic institution as well as from the Parliament. As a safeguard against populist decision-making and also to ensure accountability by them the Ministers so appointed have no vote in Parliament and are summoned before Parliamentary Committees to answer for their acts of commission or omission. Unfortunately we did not accept this safeguard for reasons of political expediency.We have not appointed persons of sufficient education with experience in any sphere of government as Ministers. The Singapore government consists of several Phds. Hardly any Minister has only a mere secondary school certificate. How can a modern State be run by persons who lack sufficient education?

Politics in our democracy  has become a mere tool to capture power and to use power to rob the state. The powerful strode like the Roman colossus dominating the  political, administrative, judicial and business spectrum.  Around the high centers of power there were the cringing bureaucrats, the criminal minded police and even some venal judges feathering their own nests. Appointments to high posts were more or less on ‘quid pro quo’ basis. The appointees were allowed to be venal and could indulge themselves as long as they complied with the dishonest requests of the high command.  This is the foundation on which our present democracy functions.

So the hybrid Constitution of 1978 has destroyed democracy as a form of government where there is the Rule of Law and government according to established laws. The UNP is as much responsible for the destruction of democracy as the SLFP.

    RMBS and Tisaranee G serve a useful purpose in educating the public
    of the various weaknesses of a Govt run by near imbeciles. The confusion in the country and decline in almost every field of governance is due mostly on account of square pegs in round holes. Not just Singapore but even Zimbabwe, in the beginning, boasted a Cabinet of learned Ministers with established academic qualifications – until that time when Socialist Robert Mugabe destroyed the economy of that country which was then prosperous and called the Bread-basket of the region.

    Be it Democracy or Dictatorship, Justice must prevail. A strong and independent judiciary is the last resort of the people. Laws of natural justice must prevail. President and Parliment should not have immunity and impunity.

    In genetics, cross breeding results in hybrid vigour resulting in healthier, better performing, vigorous and intelligent individuals. Inbreeding on the other hand has the opposite effects. Cross breeding minimises the negative and enhances the positive traites. What we did in constitution making was to marry the most expedient features of two constitutional systems to produce our home grown constitution. The result is what we have an enfeebled constitution that lacks the vigour to provide for good governance and nation building. It was like a marriage between siblings or close relatives that produces enfeebled and abnormal offspring.

    We were intent on creating a constitution that was convenient for JR then and is now being altered to suit MR. Where did the country and its interests come in? The 1972 Sirimavo constitution was also made to suit her and her partners from the left and not this country. What we are planning to create for the future, will also not be a constitution for this country, if our politicians have a hand in designing it. It will be constitution made for mediocre power hungry rulers and the hungry, the corrupt , the crooks and the self seekers, who are our politicians, despite the manifold quotes from the Buddha.

    The concept of the supremacy of Parliament is based on the inalienable sovereignty of the people. A non elected body can never be superior to an elected body.

    Unfortunately this is not all. Our short sited education system only produce memorizers not thinkers. Most of government post are held by persons who passed competitive exams. So everything is crumbling. There is no future for Sri Lanka!
