JHU Will Oppose 20th Amendment: JHU National Organizer

The Jathika Hela Urumaya (JHU), a constituent of the United National Front for Good Governance led by the United National Party (UNP) will not support the 20th Amendment to the Constitution tabled by the Janatha Vimukthi Peramuna (JVP), the party’s National Organizer Nishantha Sri Warnasinghe told Colombo Telegraph.

The 20th Amendment seeks to abolish the Executive Presidency.

Warnasinghe said that the powers of the executive president were considerably reduced through the 19th Amendment and that since the presidency is now linked with the Parliament and Cabinet, no further amendment was necessary.

‘It is important to note that the JVP did not support Maithripala Sirisena’s presidential bid and did not received a mandate from the majority of the voters to abolish the Executive Presidency,’ Warnasinghe said.

He added that Sirisena’s manifesto clearly stated the intention to obtain a greater degree of democracy by reforming the office of the president, especially by doing away with certain arbitrary powers.

‘This was done through the 19th Amendment,’ he said.

‘We take serious note of the fact that those who advocate the abolishing of the executive presidency are silent on the 13th Amendment, a piece of legislation that makes the executive presidency a must.’

As of now the UNP has not officially stated its position on the 20th Amendment. Neither has the Sri Lanka Freedom Party or the Joint Opposition.

Warnasinghe said that there are certain people who want the executive presidency abolished for the sole reason that they are not confident of winning a presidential election.

‘We believe that it is fundamentally wrong to abolish the executive presidency or to enact legislation simply because one cannot win an election or because existing systems are obstacles to political advancement,’ he said.

            Having the Executive Presidency is the only thing that saved the country from terrorism. If not, it would have been coalition politics as usual, horsetrading and making deals to stay in power. The eventuality would have been you and I having to get an entry visa to visit parts of our own country.

          On this topic of executive Presidency, if you go by the history, still there are still insufficient checks and balances. Before the 1972 constitution and the 1978 constitution, there were better checks and balances.

          So where does the problem lie? In the IQ’s , greed, nationalism, racism?

          Beside JHU, says, Jatika Hela Urumaya. They are not Hela, they are Paras. It is all right to call themselves, Jatika Para-Hela Urumaya.

          This is not selective vision. This is a vision that is closer to the truth, a vision similar to the visions of Copernicus, Galileo and Kepler.

    I think what JHU saying is Hindia will not allow the wastful 13th amendment to be abolished. So keep it. right now there is a home made political solution acceptable to every community so that every caste can live without oppressed, subjugated or discriminated by Tobacck Farmers. So, 13th amendment should be modified to reflcet the ground reality. and abolish the expecutive president as he/she is weak.

I invite you, as a member of that “Majority” to tell us your reasons or the basis on which YOU oppose the 20th Amendment.       Hell no! I don’t belong to any party. I am my own master. I write my own opinions.
      I am against abolishing Executive Presidency or converting the high position into a sock-puppet elected by the Parliament which is the core attraction of the 20A.
      As stated over and over, people’s democratic right to elect a President at their choice should be protected.
      Both Maithree and Ranil have no guts to face a Presidential Election. So, the duo use 20A as a “muttiya” to check landmines.
      If everyone fires salvos, like Wimal did, who knows, Anura may withdraw 20A without making it subject to a disgraceful defeat.

    True,after the 19th Amendment Presidential powers have been somewhat clipped but Parliament should be made supreme since it is that body that enacts Legislation and the fact that it is the repository of the will of the people.

      This is hilarious. It is not a secret to even a Punchi Singho in a rural village that the current Parliament is corrupt to the core. Your so called “supremacy” now depends on the size of the money offers. Every time when there was a crucial vote, Ranil had to “buy” votes. 20A is also another such contract though the prize tag is yet to be seen.

    We are in a very bad rut. Many of us have forgotten that it was the language/religion-divided which brought us here.
    The recent LG election, SLPP unashamedly exploited the language/religion-divide. We also stumbled upon a solution – not necessarily the best. The coalition has had a jolt and a system of checks and balances is emerging.
    We must try this out for another term which implies keeping the status quo of the Executive Presidency.

    Champa: Thanks. I appreciate you making an independent decision on two reasons stated in your reply to me: (1) “Converting the high position into a sock-puppet elected by the Parliament” (2) Peoples’ democratic right to elect a President at their choice be protected”. I differ with you, in that (1) The Amendment proposes to elect any citizen who is qualified under Section 88; debarring anyone disqualified under Sections 89 & 92 of the present Constitution, by a secret ballot of the elected representative of the Parliament within a time frame of four weeks, in accordance with the procedures laid out. Also it provides, once a person is elected in such manner, he/she should not hold membership of any political party. This, I see as a healthy sign of enshrining and enhancing the supremacy of the Legislature of the PEOPLE as the apex institution of the country by not allowing another “OFFICE” to overshadow the PEOPLES’ CHOICE of their own representatives. Here I am not talking of the “QUALITY” of such representatives, a matter that needs a different approach. (2) I do not see any reason for the people to have a SECOND voting to elect an “Additional” position to run the Governing affairs of the country. That “Duplication” will create many a problems in governance and we have already seen and experienced how that position is leading and led to confusions and crippling the smooth functioning of the government machinery. You may argue that with the 19th Amendment, that issue has been addressed. But while observing what is going on in the Governmental affairs, can we be happy and feel safe with that “19th Amendment”? . I would say that “19th Amendment” is a “Half Backed” pudding spoiled by too many “Cooks”. Here I have confined myself of limiting to answer your two reasons; but in another comment, I have already expressed my position in favour of the 20th Amendment.

    JVP has turned into a company in which CEO is AKD that undertakes contacts on behalf of clients. Their clients include RAW, Tamil Diaspora, TNA, INGOs, Ranil. 20th Amendment is an outcome of one of those contracts.

    JHU seems to be right

    Yesterday’s promises may not be relevant today as there’s a new feeling that strong power centre is required to maintain integrity & make majority happy; minority fear doesn’t have a base.

    The problem is the difficulty of identifying such a person to install on the top as money is the key factor.

    Cabinet Minister of Megapolis and Western Development Achchige Patali Champika Ranawaka is the voice, hands and muscles of JHU.
    Under the Proportional Representation system lot of horse-trading occur. Champika handles the trade very well and gets what he wants – why?? Surely you know the answer!
