New Dossier Released On Alleged War Crimes Committed By Sri Lanka’s New Defence Secretary Kamal Gunaratne

There is compelling evidence to charge Sri Lanka’s newly appointed secretary of defence, retired Major General Kamal Gunaratne, with war crimes and crimes against humanity. The South Africa based International Truth and Justice Project (ITJP) has released a 100-page dossier on the secretary of defence, focusing on his role as the 53 Division commander in the war and the Competent Authority for IDPs and commander of Joseph camp, an army camp notorious for torture after the war. This follows the ITJP’s publication earlier this year of a dossier on Lieutenant General Shavendra Silva, whose subsequent promotion to Army Commander, sparked enormous concern from the EU, US and UN[1].

“There is just as compelling a prima facie case against Kamal Gunaratne as there was against the current Army Commander, Shavendra Silva,” said the ITJP’s executive director, Yasmin Sooka. “Sri Lanka is intentionally and deliberately promoting impunity by appointing alleged war criminals to positions of power,” she added. 

As 53 Division commander, Gunaratne led the assault from the southern front on Puthukkudiyiruppu in February 2009, according to his own account, directly receiving orders from the the man who is now President, Gotabaya Rajapaksa. Gunaratne’s forces were then part of the assaults on Puthukkudiyiruppu, Putumattalan and Mullivaikkal, which involved repeated attacks on civilian hospitals, makeshift hospitals and food distribution points, resulting in tens of thousands of civilian casualties and the destruction of civlian objects. 

Gunaratne writes in his autobiography that he and Shavendra Silva received instructions on 14 May 2009 directly from then secretary of defence Gotabaya Rajapaksa to hasten the end of the war so as to avoid succumbing to US pressure to halt the fighting. Kamal Gunaratne said at the time that there was no option but to continue the attacks and “crush the terrorists”, claiming there were no more civilians left inside the war zone. This in spite of the fact that he was fully aware that a day earlier the Sri Lankan Government itself had estimated there were still at least 15-20,000 civilians trapped inside the war zone[2]  – which turned out to be a deliberate underestimate as the UN later said 60-80,000 people emerged alive[3]. 

The legal anaylsis of the evidence concludes that Major General Kamal Gunaratne can and should be held criminally responsible for ordering attacks in which civilians, and civilian and medical objects were the objects of attack, as well as for failing to prevent his troops from indiscriminately, disproportionately and intentionally attacking civilians and civilian, medical and other protected objects, including civilians at food distribution points, hospitals and in the densely populated areas of the “No Fire Zones”. 

The Sri Lankan Army has credited Gunaratne’s 53 Division with the killing of well-known TV presenter Isaipriya. She was filmed alive surrendering to the Sri Lankan army; forensic analysis of images of her corpse conducted by the United Nations shows she was summarily executed and her body desecrated. There is no indication that Gunaratne tried to take all necessary and reasonable measures to prevent such violations or to punish those responsible.

The ITJP dossier also examines Gunaratne’s role in running the army garrison in Vavuniya, the Security Force Headquarters – Wanni, commonly known as Joseph Camp. It cites ten victims who allege they were tortured in the camp when he was the commander. The dossier concludes Gunaratne should be held criminally responsible for the crimes of rape, torture and sexual violence committed by officials at Joseph Camp under his effective command and control.

Post-war Gunaratne was also in charge of almost 300,000 Tamil war survivors unlawfully detained in Manik farm against their will and subjected to screening in military-run sites described innocuously as Internally Displaced People (IDP) Camps. The dossier finds reasonable grounds to believe that the IDPs who included women and children were treated as LTTE suspects and unlawfully detained because of their Tamil ethnicity and because they had come out of LTTE-controlled territory. This amounts to discrimination under international human rights law, and, if proven may amount to the crime of persecution. 

“The appointment of Major General Kamal Gunaratne as the Defence Secretary poses a major ethical dilemma for countries that purport to adhere to international law and human rights standards,” said Ms. Sooka.  “When you start looking at the appointments made by the newly elected President, Gotabaya Rajapaksa, you cannot help wondering if the President and some members of his new regime could be considered a joint criminal enterprise, who could all find themselves on trial one day when their immunity runs out” (ITJP)

      1. Mannar mass graves (It belonged to the Portuguese era of the 16-17 centuries and there was no LTTE at the time),
      2. Tamil man alleged to have been killed by the Directorate of Military Intelligence (DMI) in late 2009, surfacing in Tamil Nadu. (PM Modi is aware of the case)!
      3. Australia provided a new identity to one-time leading JVP activist, Kumar Gunaratnam in 2014, and he was not missing.
      4. A missing LTTE child soldier showing up in an award-winning French movie in 2013.
      5. Likewise those who were considered missing may appear from the US, Canada, Switzerland, UK, India. etc.
      6. Nishantha Silva who claimed refugee status in Switzerland is not a Sinhalese as the name suggests but a Tamil called Kandappa who holds several passports under several names.
      7. Ms Garnia Banister Francis embroiled in the Swiss Embassy fiasco is not a Tamil either, but a Catholic/Christian Sinhalese woman called Sriyalatha whose testimony to Colombo Magistrates courts will reveal the facts about her alleged abduction. As a result of Kandappa and Sriyalatha cases the Swiss Embassy too got a black mark on their Diplomatic passport. Apparently the 2 Sri Lankans have given a good run-around to the Swiss Ambassador who believed their story.
      Given this past with lies, misinterpretations, and false allegations, the best solution is to postpone these missing and disappearing cases for at least 50 years; time will prove who lies and who doesn’t.

          The ICJ convention was signed by Ceylon in 1955

          Ranil refused to sign the convention on International Criminal Court (ICC) when it was founded in 2002.

          Aung San Suu Kyi was summoned to ICJ and not ICC.

          Just because you have access to internet it does not mean you are free to disseminate fake news.

          Fact check before typing.

    It was always a Catch 22 situation for the Sri Lankan armed forces fighting the dreaded LTTE during the final stages of the civil war that ended in May 2009. On the one hand there was “international” pressure to stop the war, mostly driven not by humanitarian interests or the welfare of the poor Tamil civilians caught in the cross-fire but by geo-political interests as well as electioneering at home in countries such as Britain. On the other hand is the contravention of “rules of engagement” which are required to be followed by elected or recognised states but not by terrorists, separatists or guerillas. Geneva conventions aside, all war results in civilian casualties. Classic recent examples are the atrocities that killed more than a million civilians in Iraq, many hundreds of thousands in Afghanistan and Libya etc where the wars were of choice and mostly on false pretexts that have been proven without doubt. Yet, no American soldier has yet been indicted, although Abu-Ghraib, Guantanamo and many other holding facilities witnessed military brutality and gross abuse of humanitarian norms, and crimes against humanity on a far more devastating scale than in SL. The ITJP must be challenged on these matters that involve powerful nations, not puny ones like Sri Lanka. If justice was done in Iraq and Afghanistan, then yes, Sri Lankan perpetrators should also be held accountable.

      You have a point but I’m not sure whether it is applicable to SL. It is true that the military increased its attack close to to end of the war in order to escape from international intervention which would have provided an escape route to Prabhakaran. But, the question is why provide critics reasons to scratch old wounds by appointing military leaders who are accused of war crimes? How can the Gvt ever expect to win over the trust of Tamils if it has any workable plan to achieve ethnic reconciliation by pulling them away from divisive politics based on race/religion?

      GoRa’s trust in and choice of his military colleague over unfamiliar civilian experts to appoint to key position in the Gvt is understandable but my worry is the resulting image of total disrespect towards the Tamil community. This is dangerous b’cos GoRa is the most hated by both Tamils & Muslims. Therefore, it is imperative that GoRa find a way to extend an olive branch towards heart-broken minorities; the sooner the better! If GoRa believe that “concrete/asphalt diplomacy” will work, he is totally mistaken!

      Please understand the difference between the atrocities committed in other Countries by outside Countries and the atrocities committed by the home armed forces on the civilian of the home Country!! I am sure you will not take it easy if your beloved kids got disappeared from your home by your home security. Who is the LTTE? and why did they take to arms against the armed forces in the 80s? are they foreigners?

      Good question. Why choose a flawed army man as DS, when there are so many others qualified?
      It maybe because GR knows he will do his bidding, and if necessary commit more war crimes again. A crooked leader will surround himself with crooked officials, who will break the law without any hesitation.
      You can judge a leader by who he appoints. It looks like crooks and thugs will be part of this new government, and the signs don’t look so good for this country.

    Doesnt this Zoooka know Ltte dragged these ppl when they retreat and used them as a human shield ? And it was SLA that gave chanc to come from ltte lines. Is Hooka taking these ppl to her home and feeding them? The menik farm camp was a genius idea to manage the humanitarian situation created by ltte …llllllllll

      Have you taken the trouble to meet and ask the detainees who spent years in the camp about the conditions prevailing inside camp?

    Screening the civilians to find ltte carders was a must and extremely important. How else is SL going to find ltters among civilians ? Was Hooka to come and point them? What about suicide bombers among them? Was Hooka to come and find them. Obviously no! The gov and army take actions to ensure security of the country ……..

      Gotabaya was the Enforcer of the TID – Terrorist Investigation Division.
      Hundreds ‘identified’ by the TID were imprisoned/ sent for “rehabilitation” in special camps, and many were jailed according to orders from Gotabaya.
      Some are still in jail without trial and are called Political Prisoners.
      They cannot be tried, as there is no evidence against them.

    Ethical or not, until proven guilty life should go on as if they are not guilty a basic ethical guideline . Every time some thing is splashed in media claiming to be credible if we try to take officials out or ask them to resign, many world leaders like Trump, Putin, Gotha etc will all have to resign. The right approach is to take legal action if one so desires. Then best case they will be out on bail as suspects and this perhaps gives room to demand a resignation. If not its just a media circus.

    I traveled from Jaffna all the way to Trinco along the East Coast in a little White Mini Van.
    And stayed two nights in Mullative. on the way.

    I didn’t seen any facilities like Toilets or Shelter for even 10,000 let alone 40, to 60 thousand civilians .
    Why would these civilians go to stay there in the first place , when there weren’t even basic facilities?.

    The lady whom I met in Mullative, said there were no killings at all in Mullative Town, where there are at least basic facilities for a Toilet break and a meal..

    She said the Army was there but they didn’t even round up anyone let alone kill them.
    This lady , who was taking care of the place we stayed ,didn’t talk much Sinhalese either.
    So obviously she wasn’t a Sinhalese..

    Wonder what this Ms Sooka and her UN buddies were doing there to know those intricate details of the Army doing War Crimes on innocent civilians in Pudduthikurrupu . Mulivakal and Nanthikdal.?…

    What ITJP’s executive director, Yasmin Sooka.was correct. If one look at the appointments made by President Gota, I think Gota is laying a foundation for the establishment for a military regime in Sri Lanka. Even when Brigadier Priyanka Fernando was found guilty by the Westminister Court, he was given a promotion by Sri Lanka. I think Gota may appoint a Military personal as Governor for Northern Province as well. Moreover, one can guess what Gota might do in Kachchativu with the passage of time which will likely to present an unpleasant situation for India on the pretext of development. When Sri Lanka has to account for all war crimes, the behaviour of Gota both in action and in interviews shows that he is not familiarized with international affairs. It won’t be a surprise that Buddhist monks who supported Gota will eventually rise against him when matters become worse. The case of the assassination of S.W.R.D.Bandaranayake was a case in point. There will be an end to the calculated and systemmatic behaviour of Gota who is trying to satisfy the public by granting some reliefs on the pretext of slashing prices of goods, reducing taxes for the middle class, cutting unncessary expenses for the politicians, etc. Even in the Swiss drama there is suspicion when Gota’s men are trying to tap details from the Embassy’s data. Otherwise why should investigations take such a long time. This is a strategy from deviating the appointment of military officers to vital posts. Let us watch the development.

    By the way, the Lady who was kidnapped called three to four days to give statement which runs into more than 24 hours of evidence. Our Govt, alleged ,on her way to work “she just hired a taxi, went missing (shopping ???) for few hours and then returned home to tell her story”, which sounds to me a simple, “open and shut case”. I wonder what she could have given as in statement, for that many hours ??????? GET IT ?????? Now , lets wait for the “Khashoggi Moment”.
