No Proven Allegations Against Individuals On War Crimes – Sri Lanka Respond To HR Chief: Full Text Of Foreign Minister’s Speech

Statement by Dinesh Gunawardena, Minister of Foreign Relations, Skills Development, Employment and Labour Relations of Sri Lanka

Madam President, 

Madam High Commissioner,

Members of the HRC and Delegates to the 43rd Session of HRC,

Ladies and gentlemen,

As this Council deliberates on the written update presented by the High Commissioner on progress regarding the implementation of HRC Resolution 30/1, I wish to reiterate that Sri Lanka remains committed to engaging with the High Commissioner and her Office in achieving sustainable development, peace and reconciliation, within the national framework overwhelmingly approved by the people of Sri Lanka during the Presidential Election last November, where President Gotabaya Rajapaksa was elected with an overwhelming majority. 

Yesterday, the Government of Sri Lanka, at the High Level Segment made clear it’s position with regard to HRC Resolution 30/1, particularly, its decision to withdraw from co-sponsorship of Resolution 40/1 of March 2019, which also incorporates and builds on preceding Resolutions 30/1 of October 2015 and 34/1 of March 2017.

Notwithstanding withdrawing from co-sponsorship of this Resolution, we emphasised our commitment to achieving accountability and human rights within the framework of our Constitution, towards sustainable peace and reconciliation – through the appointment of a domestic Commission of Inquiry, by implementing policies rooted in the Government’s commitments to operationalise the Sustainable Development Goals (SDGs), and by continuing to work with the assistance of the UN and its agencies. 

To those who have expressed disappointment on Sri Lanka’s decision to withdraw from co-sponsorship of Resolution 40/1, despite the Government’s re-assurance to this Council of our commitment to achieving the goals set on accountability and human rights, towards sustainable pace and reconciliation, it is clear that they are privileging a superficial facade which has failed to deliver for four and half years, over the genuine possibility of reconciliation, underpinned by a people’s mandate. 

In keeping with our consistent policy of continued engagement with the Human Rights Council, Sri Lanka wishes to respond to the current Report of the High Commissioner and engage in a constructive discussion with this august assembly today, with the sincere hope that this Council would recognize the realities on the ground.

We do so conscious of the fact that, of the period of 1 year since the adoption of Resolution 40/1, and 4 ½ years since the adoption of the initial Resolution 30/1, our government has been in power for only a little over 100 days out of the said period. 

I wish to recall that, during the 40th Session of this Council, almost one year ago, the Government of Sri Lanka (GoSL) was represented by a  delegation headed by my predecessor, the former Minister of Foreign Affairs, who, in Sri Lanka’s statement, explained at length the constitutional, legal and socio-political challenges involved in ‘fully implementing’ HRC Resolution 30/1. In this context, we consider that the High Commissioner’s insistence in the current Report on the “full implementation” of the demands made on Sri Lanka in Resolution 30/1 indicates that the OHCHR fails to recognise the rational and legitimate concerns voiced by States that are seeking, in good faith, to address issues.     

As highlighted before this Council on several occasions, Sri Lanka has consistently refuted the credibility of the false and unsubstantiated allegations leveled against Lieutenant General Shavendra Silva, the present Commander of Sri Lanka Army and Actg. Chief of Defence Staff (CDS). Sri Lanka considers that the continued arbitrary accusations made against Lt. Gen. Silva in OHCHR Reports and other statements made in this Council and unilateral actions by certain countries, are unacceptable and a violation of the principles of natural justice. We also stress that there are no proven allegations against individuals on war crimes or crimes against humanity in the OISL report or in any subsequent official document. It is an injustice to deprive any serving or retired officer of the Sri Lankan security forces or the police of their due rights. 

With regard to alleged “intimidating visits”, “surveillance”, complaints of harassment” and “reprisals” referred to in the High Commissioner’s Report, The Government has already publicly refuted these allegations, and is committed to protecting and promoting freedom of expression and civil society space, and ensure that complaints received on alleged attacks against journalists, human rights defenders and civil society are investigated and prosecuted. 

With respect to references in the report to the Thirteenth Amendment to the Constitution that established Provincial Councils, it must be noted that, soon after the end of the conflict, the citizens in the Northern Province were able to use their franchise at a Provincial Council election after a lapse of 25 years. However, the near two year delay in holding Provincial Council elections in any part of the country, by the previous Government which co-sponsored Resolution 30/1, with the active support of Members of Parliament representing the North and East, has hampered the operationalization of devolution of power as mandated by the constitution of Sri Lanka. The new Government, is committed to holding the Provincial Council elections at the earliest possible opportunity, upon suitable amendments being made to the requirements that are needed to conduct the provincial council elections in terms of the law. 

We wish to reiterate to the Council Sri Lanka’s commitment expressed during the High-Level Segment to achieve sustainable peace through an inclusive, domestically designed and executed reconciliation and accountability process. 

The existing reconciliation mechanisms established by an Act of Parliament such as the Office on Mission Persons (OMP) and the Office of Reparations (OR) will be continued, with appropriate adaptation in line with Government policy framework. With regard to the issues on missing persons, steps would be taken, after necessary investigations, to issue death certificates or certificates of absence, while also providing livelihood and other assistance to affected families;

A Commission of Inquiry (COI), headed by a Justice of the Supreme Court, will be appointed to review the reports of previous Sri Lankan COIs which investigated alleged violations of Human Rights and International Humanitarian Law (IHL), to assess the status of implementation of their recommendations, and to propose deliverable measures to implement them keeping in line with the new Government’s policy;

National law enforcement systems will continue to investigate and prosecute cases on all allegations of torture and other human rights violations that are currently before the judicial processes.

We hope the Council would appreciate this approach of focusing on deliverable measures of reconciliation that are in line with the interest of Sri Lanka and its people, instead of the practice of taking on a host of undeliverable commitments with the intention of never implementing them.

Within the above parameters, we look forward to continuing our engagement with the Office of the UN High Commissioner for Human Rights, UN Human Rights mechanisms and procedures, and to continue to work in close cooperation with the international community through capacity building and technical assistance in mutually agreed areas, in keeping with domestic priorities and policies.

If the Foreign Minister alleges that there are no proven allegations against individuals on war crimes or crimes against humanity, then why should he drag the issue of disappeared persons who were handed over to the Security forces. Either say that they were shot dead or the place where they are kept. It is ridiculous that such persons are kept for more than 10 years for inquiry. What is Foreign Minister’s account for Channel 4 News. The Foreign Minister boasts that Sri Lanka is a Buddhist country but Buddha’s teachings of love & compassion have never been practised. Even during the Bangladesh’s independence war, the Indian Army Commander Gen.Maneksha treated the Pakistani Commander with great respect and 90,000 Pakistani soldiers were never killed but returned to Pakistan. But in Sri Lanka, there was inhuman treatment by the soldiers to those who have surrundered against Buddhist teachings. The reconciliation mechanism were only in names. The government still is reluctant to implement the 13th Amendment and not allocating adequate funds that are necessary for the economic development. On the contrary, the government appointed Governors who were an obstacle for the smooth functioning of the Provincial Council which signals the government’s motive of suppressing the Tamils. Providing livelihood to affected families have become a question mark in the Northern Province where Sinhalese (who are not affected) from other areas have been colonized & settled with facilities. Is this a reconciliation mechanism?

      The Foreign Minister lied through his teeth, He proved that he has no scruples and any standing in the society. His dirty linen might end up being washed in public. Sri Lanka is no more a Buddhist country and there is no way to lift its image as a spiritual country.       You say there are no war crimes committed by the SLSecurity forces. LTTE says there were no war crimes committed by them. Both are using different definitions. However, if one goes by the definition used by the Geneva Convention, and Sri Lanka is a signatory to, while LTTE, is not, still war crimes were committed by both.

      The available evidence, points towards that. You tried to cover up the evidence, but it was incomplete.

      Try changing the Geneva Convention war crimes definition, so that your war crimes will fall outside the Geneva Convention definition.

      Foreign Minister Dinesh Gunawardena says at UNHRC, “No one has the well-being of the multi-ethnic, multi-lingual, multi-religious and multicultural people of Sri Lanka, closer to their heart, than the Government of Sri Lanka.”
      Sri Lankan politics is very strange. When the politicians are within the country and if the election is close, Sri Lanka turns into a Sinhala-Buddhist country. During other times and when the politicians are outside the country, Sri Lanka turns into a multi-ethnic, multi-lingual, multi-religious and multicultural country.

    Readers should watch the pro-LTTE Channel 4 documentary and decide for themselves.. The main point is that until the very end, LTTE was mixed in with more than 200,000 civilians. LTTE was using these civilians as a cover to attack the army. For example, LTTE would fire artillery or a missile from within a densely populated civilian center, then run away and hide. Of course the Army would retaliate, unintentionally killing some civilians in the process.
    Readers should also read Thamilini’s interview with “Island.” According to her, “Soon after losing Kilinochchi, in early January, 2009, Prabhakaran admitted that he couldn’t do anything to reverse the ground situation.” So LTTE knew the war was over in January, but kept fighting for 4 more months. If the LTTE had surrendered in January, there would have been no issue. The reason LTTE did not surrender?           the intelligence agencies of respective countries are not dumb but politicians in those countries have the final say with their manifestos. They do not want to lose their parliamentary seats especially where a large gathering of diaspora Tamils live. These are valuable votes to secure seats when faced with marginal seats. So MPs will go with Tamil demands. this is known as Lobbying. Yes monies are still being collected by diaspora Tamils to gain political favours from so called “respective countries”. It is still happening as you read now. Not only in Canada, UK, Norway, Switzerland and in many more countries. also Diaspora Tamils are known to tap into NGOs by bribing them to get their support. Sadly a handful of Srilankan politicians let the nation down big time for their personal intentions.

            How many seats do you think depends on Tamil Diaspora votes. Mind you I understand Tamil diaspora voter loyalty is not only divided but also geographically and demographically scattered among various parties and across regions.     UNHRC is just an annual event for those privileged who in the name of representing their respective countries visit Geneva on a pre-Summer holiday at State expenses.     When Mahinda Samarasinghe was the Minister of Disaster Management & Human Rights and later Minister of Plantation Industries when the Rajapaksa brothers were ruling the country, he acted as the spokesman of the government, both locally and abroad for all matters relating to the war with the LTTE and the aftermath.
    He made several promises to the UNHCR and foreign governments and kept asking for “More Time and Space” to address the grievances of the Tamil people who were subject to serious human rights violations and other disabilities. He said this was a complex matter and that the government would solve it gradually and kept asking for More Time and Space but hardly anything constructive happened.
    Now the government has as usual gone back on its promises and has withdrawn unilaterally from the UNHRC Resolution!
    The Sinhalese refer to the Muslims as “Thoppi Turners” but the Sinhala Politicians are far worse Thoppi Turners than any Muslim! This is one more instance in the long history of Betrayal of the Tamils by the Sinhala Politicians!
    Another thing I wish to say is that Muslims, whatever their faults, will not renounce their religion and convert to another religion in order to grab political power like the Sinhalese.

    The WAR is OVER! The LTTE lost. SL knows that the UN, US, etc supported the LTTE TERRORISTS with the NGOs, ICRC, etc. Sri Lanka prevailed. SL does not need to answer to the USA or the UN. End of story!

    The only thing the USA wants is to recommence the War, sell weapons, get more coolies and make SL into an ‘Air craft/weapons carrier’ for them.

They were gathering information and looking after LTTE terrorists’ well being as well. That’s why amy country or official organization hasn’t made any allegation OFFICIALLY, except bitter loosers. If these counties or organizations had any evidence of war crimes or foul play which could be proven in court of law, then they would have pounced on Sri Lanka 10 year ago.

Until now there have been no impartial investigation, even the investigation that appeared to be impartial was stopped by not providing funds to continue with it.     According to a Lawyer who appeared in a TV discussion, UNHRC has no mandate to intervene in relation to the conflict between LTTE and the Government of Sri Lanka because LTTE is a local terrorist outfit. The Government of Sri Lanka had an obligation to eradicate terrorists and restore peace. For any deaths and disappearances, LTTE should be held responsible. So ‘Para’ Demalu should go after LTTE cadres instead of charging the Government of Sri Lanka and its Armed Forces.

UN intervened in Bosnia when there was a conflict between the Government of Yugoslavia and Muslim terrorists. UN intervened in East Timor when there was a conflict between Government of Indonesia and Catholic terrorists. UN intervened in South Sudan when there was a conflict between Government of Sudan and African terrorists. So there cannot be double standards in dealing with Sri Lankan state. Again UN has intervened in Sudan an has taken the former President to ICC for war crimes in Darfur and has granted autonomy to people of Darfur. It will not be much time for UN to intervene in Sri Lanka and take former President to ICC for war crimes and install autonomy to Tamils. LTTE committed war crimes but those who committed have been killed in combat or killed after surrendering. In contrast all Sinhala murderers are walking free, some given high positions. In law a case is closed when an accused dies. So harping on LTTE crimes is not going to help. Because of incriminating evidence, the Sri Lanka government does not want to face it.

    The UNHRC process is being made a joke.

    But the fact that more than 10 years after the end of the war, the US has just imposed a travel ban, shows why the victims and their advocates should stay on the issue . This could drag on for another decade and some criminals could simply die of natural causes. But that is the way it is. The coronavirus crisis shows the unpredictability of many things.

    Communist Gunawardena did not explain why Lankawe cannot agree for an International arbitration. He said as the resolution was against the Sinhala Buddhist constitution and the Ministers had not approved the resolution. Well nobody ever broke any element of the Sinhala Buddhist Constitution. It is only done but Communist Gunawardena to climb to power. The Coup partners broke in to parliament it with Chili Water Cannon to control it. Then they have staged a American citizen on the throne, which is specifically prohibited by 19A. The Prime Minister of the Kleptocracy has no membership in Parliament and his party has no winning Member of Parliament seat. He denounced in front of the Media though Lankawe media is ordered not to replay those clips. He has been made as PM in violation of the constitution. This is a government which no MPs, but rowdies. SLFP has only 17 members in Parliament. Communist Gunawardena became FAM and went to UNHRC to represent wildlife Sanctuary only because, there is no constitutional ruling, but only anarchy is ruling. Slap Partiers are not the one to talk about complying with constitution, even it could the 20th & 21st centuries’ most satirical scripts; probably funnier than Mahavamsa.
    We need not to talk about the legality of the binding of the resolution on Lankawe. That is obvious even to the 8the graders of the parliament. All UN member countries are in agreement with UN to accept the UN conventions and resolution. If their Constitutions are not giving space for that then they need to amend their constitutions to and have to sign and ratify the conventions. If the Lankawe constitution is not accepting that Lankawe take the ruling of UNHRC Communist Gunawardena‘s minority Government has to amend the constitution, but cannot leave one sided the Resolution signed by to two parties.

    Communist Gunawardena had only one to vote for King. He thinks he represents the whole Sinhala Buddhists so King will have to obey him and retract from UNHRC agreements. There was never any referendum was conducted in Lankawe on UNHRC resolutions. Tamils unanimously wants an International Investigation recommended and sponsored by UNHRC. The investigation is for them against the Sinhala Community’s governments which have violated their Fundamental rights to live in their land. There was no mandate for EP in the last election to abolish the resolution. Gunawardane caretaker government never received any mandate for on this subject. In 2015, September Yahapalanaya Parliament received the mandate to resolve Tamils problems and they are majority still in the parliament. In that election Sinhala Buddhists voted to Yahapalanaya Parliament abolish all Chinese contracts. But Ranil violating the constitution and the mandate added Hangbangtota sale to the ones existed.
    Before election America had asked Sinhala voters’ consent needed to be obtained. Neither party had put forward MCC for referendum in the November 2019 election. But Sinhalese selecting an American citizen, who has no legally obtained Lankawe citizenship means Sinhalese wants to work with America. Further, almost all Sinhalese longing to migrate to West, with special focus on America (Including Communists like Gunawardena, Anura Kumara et al), all are in agreement with MCC. In that case we are not sure what the substance in Communist Gunawardena explanations and reasoning is.

    Now, it is reveled, instead of just serving injustice to Tamils, the communists want to help their Royal friends to use this UNHRC drama to balance with America on MCC, SOFA & ACSA. More than these are expected because Ranil, Old King and King recently visited to India demand some new protections from. They returned failed and though they announced that Old King was negotiating with India for loan extension. These trips are just reminders of” Before coup trips” of New King, Old King and Ranil to India.

      Give me an appointment and We can discus the UN Report (securitycouncil report.org) on the last six months of the war. The evidence is clearly given. It is this report that generated 30/1 which is now 40/1.
      From that report you will know that the UN satellite and another (probably the US or Indian) monitored the war during the last 3 months or more. The resolution is such that the UN could count the number of people around the tents. These satellites monitored the 58 and 59 Divisions and the 3 Or 4 Task ForceS Moving in the area.

      Then there Are the videos and photographs by persons and by Army soldiers that were released and published by Ch 4. Only some photos were published in the report. The video where two soldiers shot naked blind folded and hand tied behind their back was shot on the back of their head. The video has been in circulation soon after the war ended. This video can only be taken by another soldier (with conscience and sent it to be published) was authenticated by the UN and the American Association for the Advancement of Science.
      When USA say there is irrefutable evidence they mean it. They and UN will produce those evidence to the ICC or the special mechanism that would try the accused.
      As for those who were handed to the armed forces the govt has to investigate and find out who killed them and where were they buried. Wake Up Foreign Minister.
      You know that without justice there can never be resolution or reconciliation in Sri Lanka.

        The Sangha should have studied the Christian inspired Truth and Reconciliation Commission (South Africa) and guided the state and the governments to adapt such a Sri Lankan model and ensured similar commission is established, properly funded, properly manned, ……………. honestly investigated, ………………… bring all the cases to closure, on the basis of confession, apology, begging for pardon, pardoned, end of the war crime issue, end of guilty consciousness, …. finally get the life back.

        Sri Lankans generally clever, they do everything possible to postpone the problem.
