Parliamentary Privileges Not Violated By Checking Phones Of MPs Suspected Of Wrongdoing — Vasu

Vasudeva Nanayakkara, MP, contends that it is well within the law and not a contravention of parliamentary privileges to check the phone records of MPs suspected of wrongdoing and submitting such findings to the particular court or commission.

Nanayakkara, referring to a privileges question raised subsequent to revelations that certain members of COPE (Committee on Public Enterprises) had communicated with the prime suspect behind the Central Bank bond scandal, Arjun Aloysius, said in a media release that once a Comission appointed by the President has been tasked to investigate, if the said Commission fails to conduct such investigate that would be an infringment of privileges of all MPs.

He also pointed out that the investigating officers had checked the phone records of Aloysius and not those of the relevant MPs.

Nanayakkara charged that investigating officers are now being queried by their superiors in the Police Department, a state of affairs which he considers a challenge to the Commission. Whether such queries have been initiated by the IGP or a higher political authority is unknown, Nanayakkara said.

The media release follows a statement by Speaker Karu Jayasuriya to the effect that the Privileges Committee would take up the matter of telephone conversations of COPE members and that a discussion with party leaders will also take place. The Speaker was referring to a complaint made by Minister Lakshman Kiriella on Monday.

MP Bandula Gunawardana of the Joint Opposition meanwhile has stated that Kiriella’s assertion was erroneous since the phones of COPE members had not been tapped, as revealed by the PCoI.

Kiriella, however had explained that what was objectionable was not investigating but leaking the information to the media.

Another Joint Opposition MP, Udaya Gammanpila, countered ‘people should know how the MPs act and asked why the government was trying to keep it a secret, when the Right to Information Act was now functional.’

‘The Presidential Commission of Inquiry is a public commission. It’s proceedings should be transparent,” he added.

      UNP has destroyed itself. There was no phone tapping of mps involved. CID under instructions of the bond commission obtained call time records from the service providers to establish if calls were made by/to COPE members and Aloysious when the committee was inquiring in to the bond scam.

        Dear Mr. Jayasinghe. Precisely. To be more precise all call time records of Aloysius were examined. In the process the parties who made a significant number of calls were noted and in the process MP’s were identified who were essentially in the foot-note club. Particularly the MP who came into the COPE from the sky. Naturally they are found fault with either covering up a crime, aiding a crime or what not. Legal Eagles know better.

(Just watch recent 360 program and see the sarcastic way they conduct the program) You don’t have to be a rocket scientist to understand the motive behind appointing Bond commission only for certain period and extend it’s mandate 3 times. Also now it is more clear who is behind unattended files in AG department. Why can’t CID disclose the No of telephone calls exchanged between Shiranthi Rajapaksha and Narahenpita Police station on the day Waseem Thajudeen murdered. MY3 played a double game while in the Rajapaksha regime and now again playing a double game. But he may have forgotten that RW is champion in Political chess game.

        I watch NewsFirst regularly and there is one journalist in particular, Faraz Shauketaly who seems to have it all out to attack the UNP. It is ridiculously biased.
        I say this now, as it stands in the current political landscape, the UNP is the only party in Sri Lanka that can take this country forward towards reaching it’s full economic potential. Corruption has existed in Sri Lanka from the time of the old kings. I do genuinely feel that corruption is being slowly systematically eliminated by the independent comissions being put in place now. Let us wait until the government’s term is up before passing judgement.

Mafia Killi is criminally abusing his right to broadcast in SLto leverage his own business interests, promote political puppets etc. Private Media Mafia must be tackled. Before we become their slaves. Applies to Ada Derana & Swarnawahini too. State media is even worse. Yahapalanaya has totally failed deliver on robust, profitable, unbiased, ethical & 21st century media standards this country absolutely needs to progress. Otherwise start worshiping at corrupt Killi’s altar of media power.

        True. Both SLFP & UNP are busy trying to win a championship in Chess. But, were they appointed to those positions of power to play Chess? Do they need luxurious mansions, 4WD vehicles, duty free car permits, 5 star meals and fat pensions etc? While they play Chess? At whose expense? With indirect taxes collected from impoverished, starving rural Sri Lankans? When they buy sugar, flour and rice? While the impoverished people suffer in run down government hospitals and on stinking public transport? These leading clowns in the SLFP & UNP, have they no SHAME?

However, it doesn’t matter who said what, it is we, the people, who should have access to all the facts. A string of events has led to a situation where we find that the guys voted in to Parliament by the people (includes me, of course), can no longer be trusted by us.

    We do know that Ranil, [Edited out], was in a spot of troublebeen unable to pay even the electricity bill of his party office let alone finding the money to run the Elections in August 2015. He had to find a way out and found Mahendran, a Singaporean as the governor of the Central Bank and hatched the plan. He was caught red handed by the JO. When Maithree lost control he appointed the Commission. Now it had gone beyond of his expectations. That’s why he recently said that he did not target anyone. As Ranil did not take any thing to stop the likes of Ravi K, running riot with the ill-gotten wealth, it was too late. Therefore, Ranil and his cronies should resign and get some intellectuals with some wisdom to run the country so that MARA won’t come to the fore front.

    It’s too embarrassing to us the Law Abiding God fearing citizens of Srilanka but the Mega Crooks continue to enjoy the Freedom plus the Loot.
    How and Why in this Land of Majority Lord Buddha Worshippers continue to get protected from Law and Order ?? And too from the Prealates who are suppose

    Vintage Vasu has a point. There is no harm in doing so, but under Mahinda Rajapakse there were no freedom like now. Most of the news readers who are attacking the government would have been bumped off. The difference is the ruling party are democratic thieves and the previous government were dictator thieves or highway robbers who are still roaming around under yahapalanists.

    At long last Vasudewa N has come out with a credible argument.
    1. Since it was the Members of Parliament (MPs) that were investigated but the mobile phone records of the accused , Arjun Allosius
    2. Only mobile conversations were investigated. What if all the fixed phone calls were also to listed
    3. the PCoI has analyzed ONLY the number of calls, but not the exchange of information in such calls.
    4. Imagine the confusion if the details of the phone conversations were yo be published.
    5. Looking @ Ranil W’s response to the PCoI, it is very evident that many of the stakeholders of the Bond Scam have being lying to each other, including to the PM.

    Yet Ranil W, is keeping Arjun Alosysis , the former governor of the Central Bank as his Head of the Strategic Plan -2025 program.

    What a shame Ranil????

    revealing of telephone transactions with rogue arjun aloysious and sujeewa senasinghe is shocking. Sujeewa must step down immediately from MP post. He has broken the trust of the voters by conniving with a international rogue Arjun Aloysious who robbed poor workers EPF money. Voters will never pardon Sujeewa for what he did.

      Just, FYI

      The book was published, yes published after the 1st COPE investigation in 2015, about a year before Sujeewa was appointed to the 2nd investigation which was in June 2016. So, attorney at law Sujeewa Senasinghe, MP/Minister cant even lie properly.

      Also, what I find interesting is that Sujeewa was appointed to the COPE midway through the proceedings because another UNP member “resigned” due to “family reasons”. Bet it was crooked Ranil bringing in his hatchet man, the Junior Poodle(Kiriella is the Senior Poodle) to scuttle the proceedings which led to the footnotes.

      Ranil and the footnote gang needs to resign. Then, charged for corruption.

      Of course, that will NEVER happen.

    There are no law abiding And God fearing MP’s. The God fears the MP’s as they are all powerful. In fact a no confidence motion has been passe on all Gods in Srilanka.. That is why most Mp’s, Ministers, Prime minister and the President fly to God’s Kingdom in India. There are plenty of Gods there and one or the other may help them to commit more sins without getting caught.Amen!

    When Politicians are experienced rats, when after the first Bond Scam, it had been exposed, why Those MPs should have privileges anymore. Ranil Baba is Ranil Baba because the clarification process itself is corruption. It is like I KNOW NOTHING RAVI staying I KNOW NOthing until the 750 phone calls exchanged were revealed. there was a huge favouration to Ranil baba because he did not step down leading to an investigation. Other wise, Attorney General should have checked the phone and emails of Ranil and the documents implicating in this FRAUD. Clarification itself was corruption as this is a mega fraud. PResident shad to quit in South Korea, Latin america, PMs had to quit in thailand, India, Pakisthan, Australia, Europe etc. Why Sri lankan politicians are special. IS it because they are experienced Rats who do something then go and hide. None should have privileges as soon as they were accused. Even in Water Gate scandle, they removed boxes of documents and the president stepped down. In Trumphishthan, very often Senators are prosecuted Why Sri lanka is special.

    Well. Call times matched the times of COPE Meetings. That is what the CID has found. They do not need a knowledge in rocket science. Once the report is submitted to the Bond Commission, it becomes public info.

    Communicating with outside world via a mobile phone is a right of every citizen. However, COPE Members should have switched off their mobile phones during sittings. Is it in Robert’s Rules? Or in Standing Orders of the parliament?

    I have watched videos of sittings in the British Parliament. I have never seen MPs using their mobile phones.
