The funeral of Justice Sriskandarajah is scheduled for this morning at the General Cemetery, Borella, where several speakers including the Bar Association President and the acting President of Court of Appeal had been requested by the family to deliver funeral orations. President Rajapaksa did not appoint Justice Sriskandarajah to the Supreme Court on several occasions, though he was the President of the Court of Appeal. Justice Sriskandarajah presided over the Court of Appeal bench which set aside the impeachment findings of the Parliamentary Select Committee recommending the removal of the 43rd Chief Justice, Shirani Bandaranayaka. The Bar Council of the Bar Association, the representative body of bar, expressed their sorrow at today’s Council meeting over the death of Justice Sriskandarajah.
Despite the previous intimations, the family of the late Justice Sriskandarajah has now indicated to the acting President of the Court of Appeal and the President of the Bar Association that their family is under threat over possible criticism of the government during funeral orations, and that therefore they do not wish to have any orations at the funeral. The seniors lawyers who were contacted by Colombo Telegraph expressed their anger, stating that while Justice Sriskandarajah was alive, he was humiliated and threatened, and that even after his death, the regime continues with the harassment of this distinguished judge because of the independence and impartiality he displayed in the impeachment proceedings.

Justice Skandharaja has been a true patriot in our times. He strongly stood for justice and what he believed in as correct. It is very rare to see such a people in modern day Sri Lanka. There are plenty of opportunistic individuals from top to bottom around the ruling maffia regime. But it is very rare to see people like Lasantha, Justice Skandaraja, Justice Wigneswaran , MP Sumanthiranand and some other unnamed individuals. We are so proud to have you in our country. I do not wish to discredit the good work Justice Skandarajah did. But he too is directly responsible for laws delays in this country.
He too was appointed to the Judiciary from the Government dirty work Cleaner’s department (AG’s).
People come before the Writs Court (Court of Appeal) seeking justice without delay. And The rule book of the Court of Appeal has been designed to ensure speedy disposal of cases. It says that when any Executive action is challenged before the Writ Court, the Respondents to file objections, if any, within 14 days of the receipt of the Notice.
Who appear for the Respondent? The AG, who requests date after date, sometimes over 6 months goes on like this to file objections, demonstrating sorry state of affairs at the AG’s Department. And when the case is fixed for arguments, again the AG play for time. He requests for postponement of the hearing giving flimsy reasons. And the Presiding Judge, also appointed from the AG’s department simply permit these applications made by his fellow colleague serve in the same Department. Surely This is a pathetic situation from the litigant’s view point and this rubbish practice should be seized forthwith.
Every lawyer, whether belongs to the official bar or private bar, should be made to abide by the rule book. If any lawyer faces with a issue, he must make sure that someone else present the case before the Court for him without compelling innocent client to suffer for no fault of him, because of the lawlessness in the Court System.
We all should take notice that delay in Justice is no justice. We all should know above all we all have social obligation to uphold the rule of law.

“The New Kathiresan Hall in Bambalapitiya came under an extensive security blanket on Saturday, 25 May, with a large number of police personnel making their presence felt rather conspicuously. The hall was packed mostly with the members of the legal fraternity from the bench and that bar. The judges of the superior courts who were in the front row were seen enjoying the Nathaswaram music by veteran artiste, P. Sithamparanathan.
The wedding ceremony began with the arrival of the bridegroom in a procession, accompanied by his father, Justice Sriskandarajah. According to the tradition of a Hindu wedding, the procession was led to the dais to the sounds of Nathaswaram music.
However, when the wedding ceremony was in progress, the musicians were suddenly removed from the hall by the relatives of the bridegroom, leaving the guests who were enjoying the music, wondering somewhat bemusedly, why the music had stopped suddenly and why the musicians had been moved out, along with their instruments.
Their unasked questions were answered shortly, when to the surprise of all the guests there was another procession, into wedding hall to the accompaniment of the Nathaswaram music. The procession this time ushered in, not just any guest, but the head of the country, President Mahinda Rajapaksa.”

The socalled Impeachment of the Hon.C.J.Shirani Bandaranayake was passed in Parliament 155 for 49 against on 11th Jan.2013,long after the decision of the Supreme court that was delivered by Justice Sriskandarajah to the effect that it was illegal.The fact that the President graced the occasion of the wedding of Justice Sriskandarajahs son in May 2013 does not mean anything.He was an adornment to the Higher Judiciary.
