Sirisena Dissolves Parliament In Stark Violation Of Constitution

President Maithripala Sirisena has dissolved Parliament, a short while ago, in stark violation of the country’s constitution.

Sirisena, when he signed the gazette announcing the premature dissolution of the legislature, grossly violated the provisions of the 19th Amendment to the constitution – which he architected in April 2015.

Strong arguments have been presented against the dissolution of Parliament saying the President has no constitutional power to do so, before four and a half years into a Parliamentary term, as stipulated by the 19th Amendment.

Commenting on the grotesque illegality of a premature dissolution of Parliament, UNP Parliamentarian Dr. Jayampathy Wickremearatne PC, a co-author of the 19th Amendment said, “The Nineteenth Amendment, which was passed with just one Member of Parliament opposing it, reduced the term of Parliament to five years. Provisions that Supreme Court held required a Referendum were amended or dropped. Article 70 of the amended Constitution restricted the power of the President to dissolve Parliament. It now provides that “the President shall not dissolve Parliament until the expiration of a period of not less than four years and six months from the date appointed for its first meeting, unless Parliament requests the President to do so by a resolution passed by not less than two-thirds of the whole number of Members (including those not present), voting in its favour.” Thus, Parliament can now be dissolved by the President in the first four and a half of years of its term only if 150 Members of Parliament so request by a resolution passed in Parliament. The wording is clear and unambiguous.

Those who argue that the President’s power to dissolve Parliament is unlimited point out to Article 33 (2) (a) which states: “In addition to the powers, duties and functions expressly conferred or imposed on, or assigned to the President by the Constitution or other written law, the President shall have the power–
(a) …..
(c) to summon, prorogue and dissolve Parliament…”.

It is argued that Article 33 (2) (a) overrides Article 70. Article 33 only declares some of the general powers of the President. The manner in which and the conditions under which that power of dissolution can be used are given in Article 70. That Article states that dissolution shall be by Proclamation. Then it goes on set down the clear limitation that the President cannot dissolve for four and a half of years unless Parliament so requests by a two-thirds majority. Any power that the President claims under Article 33 (2) must not be in violation of express provisions of the Constitution. The words “In addition to the powers, duties and functions expressly conferred or imposed on, or assigned to the President by the Constitution or other written law…” cannot be used to override expressly laid down constitutional limitations on the powers of the President.

Take Article 33 (2) which provides in sub-paragraph (f) that the President has the power “to keep the Public Seal of the Republic, and to make and execute under the Public Seal, the acts of appointment of the Prime Minister and other Ministers of the Cabinet of Ministers, the Chief Justice and other judges of the Supreme Court, the President of the Court of Appeal and other judges of the Court of Appeal, and such grants and dispositions of lands and other immovable property vested in the Republic as the President is by law required or empowered to do, and to use the Public Seal for sealing all things whatsoever that shall pass that Seal…”

Meanwhile, addressing a lawyers’ gathering at New Town Hall, in Colombo, this afternoon, TNA Parliamentarian M.A. Sumanthiran PC said, Parliament cannot be prorogued or dissolved due to the whims and fancies of one individual.

“The Constitution is clear on Parliament being the place to decide who is PM but Parliament is prevented from doing so,” he added.

      All constitutions and amendments are open to interpretation – even the American – then the matter is referred to the respective Supreme Courts.

      The present constitution and political setup are not very practical for a poor country like S L; too many Parliamentarians and far too many “local governments” at an exorbitant cost; what is needed is to make these simplified and cost-effective and less prone to the endemic corruption.

    Sirisena escaped death when MR set a suicide bomber leased by VP of the LTTE by changing the vehicle. Jeyaraj Fernandopulle and Mahinda Wijesekara were not that lucky to escape.

    Uneducated Sirisena has opened the door wide open for international interference. Gota is going to run to USA to claim protection as a US citizen from being arrested by a foreign government for human rights violations. No MP of SL will be able to step into a foreign country. GSP+, IMF funding, Japanese funding all gone. This time how much of money is China going to give Mahinda? Shame on Badurdeen and SLMC who ran to Mecca. They better stay there for good. Its time all voters identify those who stole power in the midnight through a Butterfly act with the President and kick them out of the Parliament. I am shocked to see even Mano Ganesan started to climb a wall to jump on to the lap of President. How can Mano support a person who has destroyed Democracy and made a Mockery of it? Since Mano is now supporting the President he better fall at the feet of Thondaman who has been with Mahinda from the start. The Businessmen in Colombo should stop funding Mano Ganesan immediately.

      I dont think Manoganesan would support president. He just said, that he would not join the impeachment if that would be the case.

      UNP leader is the best, he has not uttered a single word harming President yet.
      Not even after President attacked him that derogatery in a public meeting few days ago.
      Ranil Wickramasinghe maintains patience and good nature of a human being as no other leaders would do. That is his strength. He is well bound to law and order. Just that Bond Bank scam almost destroyed him, but president could stand against the appointment of Mahendran if he had been that wise. Besides, as a president, he should not have been BLIND in such appointments. So, if anyone would put the blame on RW only, he or she is no fair.
      All in all, I hate uneducated president who sacked PM not by going the constitution – unconstitutional.
      Then again, within the limited chances he may have as a president, he nevertheless dissolved the parliament.
      Now all the investigations of high profile crimes are on the hands of the criminals.
      They would do anything and everything to destroy those evidence.

        Arjuna Mahendran was qualified. That is why the appointment was made. Ranil didn’t ask him to rob. Neither did Ranil profit by the appointment. This came out very clearly in the commission that Sira himself appointed. Sira’s grouse three and a half years later therefore doesn’t hold water.

    This is completely undemocratic, illegal and a serious breach of Sri Lanka’s Constitution.
    President has orchestrated a COUP to remove the sitting PM illegally. Then he appointed an illegal government and an illegal Cabinet and then dissolved the Parliament WITHOUT HAVING ANY POWER TO DO SO!!!!
    All the three actions are unconstitutional.
    And all the three actions are clear indications that this election WILL NOT BE FREE AND FAIR!!!!
    President’s illegal Cabinet will use government resources to unfairly influence, bribe, intimidate and manipulate people’s right to vote for anyone of their choice.
    President’s decision is a violation of people’s mandate ALREADY IN PLACE.
    This is BLOODY SERIOUS!
    This President should not be allowed to ROB PEOPLE’s VOTING RIGHTS like this.
    If a President can dissolve a Parliament purely because he doesn’t have the majority, what is the point of having elections, a Constitution and a voter registry?
    The most important factor here is PEOPLE DIDN’T ASK FOR AN ELECTION. This is only a work of a handful of power hungry people led by a desperate President who have only a few months left.
    This dissolution happen purely because President have no majority in the Parliament.
    Instead of respecting the rights of the other party who have the majority, he opted to dissolve the Parliament!!!!
    People have elected a Parliament in 2015 for 5 years.
    If the President wants to dissolve the Parliament (for personal reasons), he should FOLLOW THE RULES stipulated in the Constitution.
    There are only 2 occasions to dissolve the Parliament which is either with the 2/3 majority or at the expiry of 4 1/2 years.
    I invite people to go to the SC against President’s ILLEGAL DISSOLUTION!
    If the Judiciary is ALSO UNDER PRESIDENT’S INFLUENCE, it is time to call for international intervention to PROTECT THE VOTING RIGHTS OF SRI LANKAN PEOPLE.

        But this was done through a political conspiracy for which I will never support.
        I never support any violation of the rule of law.
        I was vehemently against Ranil when he violated the Constitution.
        The same way I will be against Sirisena even Mahinda, when they violate the Constitution.
        There is no way I change my opinion according to the person.
        What is wrong is wrong whether it is done by Ranil or Mahinda.
        About Samanalaya, this is the first time in the world a President sacked his Prime Minister for personal reasons and for him being a Samanalaya and fluttering erratically!

      It is “33 (2) c” :D :D :D :D They don’t know what implies with that word “dissolve” there.
      This gazette will be annulled by the Courts.
      I don’t think a lawyer has given this “legal” point. This should be given by an “Andare” (the court jester.)
      Oh, if I saw this before, I wouldn’t have written my above comment. There is no need to worry at all. Ha ha ha ha ha

        The President has violated the Constitution to please Mahinda and JO who agreed to field him as their Presidential candidate.
        If the President ever has done something it is for selfish reasons.
        Did he stopped Ranil when sold Magampura Port to China? Did even MR or JO opposed? Only 5 MPs voted against the sale!!!!
        For the last 4 years Ranil did everything, passed every Bill detrimental to the country with the support of the President and his SLFP faction and even with the help of JO.
        Why they are suddenly like this?
        For Sirisena, it is because he has only 10 months. Rajapaksas, because they have the fear that a non-Rajapaksa will because the next President and their dynasty will end with that.

      I agree absolutely, and salute you for your honesty and consistency. I am in Malaysia at the moment at the end of a 15 day holiday that my daughter paid for. The first time I’ve been out of the country for 24 years. My daughter returns to Sri Lanka in December, with her daughter’s aged 5 and 3, to educate them in Sri Lanka.
