Sri Lankans Who Left Due To Political Persecution To Receive Passports

The Government today announced that it was ending the restrictive practice of preventing the issuance of passports to Sri Lankan citizens residing abroad who were compelled to leave the country due to political persecution.

The government under former President Mahinda Rajapaksa, in March 2011, issued instruction to all Sri Lankan missions abroad to refrain from issuing passports to those who sought asylum due to political persecution.

A circular was issued today by the Government to the Controller of the Immigration and Emigration ending this restriction.

“This circular constituted a serious violation of our citizen’s rights under the constitution and under the many human rights conventions to which Sri Lanka has become a party over the years. It has also caused immense hardship and difficulty to many Sri Lankans who were forced to leave the country as a result of their struggle against authoritarian rule,” the Foreign Ministry said in a statement.

The Ministry added that the Government under President Maithripala Sirisena and Prime Minister Ranil Wickremesinghe has renewed its commitment to upholding citizen’s rights and the rule of law.

“Freedom of movement and impartial treatment of our citizens, irrespective of their political beliefs, will be secured for all our citizens. Furthermore, as a result of the good governance and reconciliation efforts of the current government, many Sri Lankans living abroad have expressed an interest in visiting and investing in Sri Lanka. Ending this restrictive practice will further enable our citizens overseas to visit and return to Sri Lanka and thereby contribute to the country’s development and reconciliation process,” the statement said.

The Ministry added that the Government has directed the Controller-General of the Department of Immigration and Emigration, to issue a circular ending this draconian practice and restore the procedure followed since Independence of enabling every Sri Lankan citizen living abroad to obtain a passport.

    Good move but the government have to control security people from hijacking people from the Airport as well – should not be like encourage people to come into the trap and take them in white van. Also keeping so much army in North and East after the so called one sided war ended 7 years ago and suffocating ordinary people is bigger violation than this. That should be the first priority than this. How many people are willing to come back from heaven to hell is a different question.

        Its terrorism based on who defines it. Even today the military is terrorizing the population of the north after seven years when the guns were supposed to have been silenced.

        Terrorists are subjective based on whether your asking form someone in the N/E or the South. Whether your asking a Sinhalese or a Tamil.

Rajapaske used this ‘slogan’ to wage his dirty war with the help of 20odd countries. That is the victory he claims for himself. Leaving out the General who conducted this war, and took an opportunity to send him to prison . That is the history, that you seem to know. You will gradually come to know more about other faked stories. One of which had been narrated By this General, about the event claimed by Rajapaskes, on the miraculous escape Gotapaya had in 2006 from a terrorist attack. Some one recently queried how the Tamil FM met his assassin yet to be a mystery. No one charged, though two Tamil youth were in Jail for some time but later released as there were no evidence they committed this crime. There would be many more truth that could come to light if only the former regime is thoroughly investigated by an independent or unbiased panel of judges.

Read the news item on CT which says that on Wednesday, the Colombo Additional Magistrate discharged Bagirathy Murugesu who was arrested in Katunayake Airport in early 2015, when returning from france as a suspected sea tiger cadre. There may be others which will come to light.

      I agree, every Sri Lankan born must be entitled to get a Sri Lankan passport. Including people who have obtained other countries’ citizenship due to the war. I refused to apply for the Sri Lankan dual citizenship because of the cost. Please explain to me why I should pay 10 times to get Sri Lankan dual citizenship than paying to obtain an Australian citizenship? This is clearly shows you don’t really value us yet.

        Because the Australian gives you elephant mouth you never had and involves visa at sight.

    This is really good move because of the following reasons:

    1. The UNP could increase their vote base as they definitely know that they can not get the majority sinhalese vote in future elections.
    2. All “Kallathoniyas” from Tamil Nadu can get Sri Lanka passports and can legally work and settle in Sri Lanka.
    3. All the hard core “LTTE” members who live in overseas countries can come back to Sri Lanka and create the “Tamila Elam” very soon.

    These are the impending burning issues and solutions of the “Yahapalanaya” government.

      1) Which opinion poll are referring to when you UNP definiely know that they cannot get Sinhalase votes. You do not represent ALL the Sinhalese in the country.
      2) Whether somebody is Kallathony or not is irrelevant to obtaining a Sri Lankan passport. Same way every money laundering common opposition members and their supporters are entitled to a Sri Lankan passport. Every Sri Lnkans are eligible to apply for one. That is the law.
      3) You do not need a Sri Lankan passport to return to live in Sri Lanka. Under the Rjapakse government, there existed a category of permanent residency for sri Lankan expats. That category still continue to exist.

    This is an excellent step by the government as part of the reconciliation process it has launched in association with the international community.Needles to say it will bring negative comments ,as seen above, since some people for obvious reasons would like the reconciliation process to fail.Sadly they belong to both the Tamil and Sinhala communities…..in fact more to the Tamil community than the Sinhalese.

      I have doubts about what the Minister appears to have contradicted, as not factual. The Overseas Embassies continue to provide Passports to all applicants who provide the following basics documents. In Switzerland it is:- Previous Passport and if lost, a Police Report, a SL Birth Certificate, (NIC if available) 3 photos and the Residence Permit. A Marriage Certificate if applicable. Currently the fee levied is Chf. 165.00 (Rs. 24250/=) even if the applicant is one month of age! In Switzerland the Statistics to end 2015 show 25000 Sri Lankans with valid Residence Permits of which only those holding “N” Permits are NOT expected to show a Native Passport and the Consulate is prohibited from issuing one as their Asylum application is under consideration. These number around 1000 at end 2015. The number of Sri Lankans who have obtained Swiss Citizenship to end 2015 stands at 25004 (granted over a period of 34 yrs. commencing with 3 in 1982). The
      No. Passports issued in 2015, via this Embassy is around 1300, going
      by their Reference sequence numbering.

      It is a fact that MR Regime created a Tamil Diaspora, unintentionally and this has worked against their hidden policies? The GG is only
      glossing the Western countries with such announcements from time to
      time. Does one know the no. of Tamils who obtained Dual-citizenship
      compared to Sinhalese, since its revival on 23rd March 2015?

      You might have lived with dole in one form or other, like the dole from stolen money but for the people who left the Island one of their difficulties in returning is that their children either was born or grew-up in the western society and everything they value is in their adopted country.
      One might get duel citizen to keep an holiday residence there but it would be stupid to give-up everything and move back irrespective of what race or religion you belong to.

    Very welcome news indeed.

    An elderly Tamil who reached the UK some 20 years ago and who lost his two children in the Ethiopian Airline hijak drama over Comoros Island is without a passport since he surrendered his SL passport to the human smugglers.

    He wants to visit to SL and his attempts to obtain SL passport were not successful so far. I hope the change of heart of the new government will pave the way for issuance of passport for this sincere Sri Lankan.

      He is entitled to a Passport. Pl.read the SL Immigration website. He
      has to produce a “Lost Report” from the UK Police as supporting
      evidence, as much as you would do if his house burnt, destroying these
      documents. Smugglers hold on to the Passport until the balance dues are paid,is a well known tactic of old.

      The Foreign Ministers statement has noting to do with Passports, as no
      known ban was effected by the Immigration Dept.! Can the Dept. produce
      a “Black list” which if existing, is challengeable under Human Rights
      and the FM must be aware of it?

        It is not straight forward as you state.

        An applicant will have difficulties in going to the police as he has already confirmed to the Immigration that his passport has been taken away by the agent. Therefore, it is not a matter for the police as you state.

        Human smugglers hold on to the passport for various reasons and one of them could be to get the dues on their deal as you state.

        With regard to the person I mentioned, he applied for new passport by attaching his ID and birth certificate two years ago. But it was refused on the grounds that the passport office could not trace the applicant’s details in their data base. His passport was a genuine one and obtained well before the computer system took control of the records, resulting in the inability of the passport office to trace his details.

        Change of heart of the govt to give flexible consideration is indeed welcome news.

      The UK is well within the law as applied by all EU nations. He does not submit a SL passport Or a authentic birth certificate to exchange it for a UK refugee passport (which clearly states except sri lanka until nationality is obtained 5 years after receiving refugee status.)
      There are many pakistani, bengali indians with refugee status in the EU with his problem. There are many refugees that cannot be deported because their origin is not known.
      Why did he not spare £50 and obtain his original birth certificate from LTTE those men are never harmed in the UK?

    Sri Lankans specifically the Tamils left in hoards not due to Political Persecution, but simply due to Sinhalese racism. Who created the Tamil diaspora? Diaspora was created by Sinhalese racism of 1915, 1956, 1958, 1977, 1983 pogroms where thousands of innocent Tamils fell victim, houses burnt, businesses destroyed all of this done by ordinary Sinhalese. The diaspora are those who managed to flee to secure countries and continue their life. These were all criminal acts committed by ordinary Sinhalese with state sponsorship. State sponsorship bcos absolutely none of the perpetrators in these incidents were identified, arrested and sentenced. In the 1983 riots, even hospitals with pre-dominant Sinhalese health workers refused to treat innocent Tamil injured victims. Police and armed forces who were predominantly Sinhalese refused to stop blatant blood shed, murders and looting that was happening right in front of their eyes. In fact, they tacitly supported by vanishing from such locations. This is the truth and should always be remembered for generations to come.

    I think the Sri Lankans should first see if the Govt. has put in place what it has proclaimed and is sincere.No one wants to come back if security is threatened.
    Why should they leave safety for fear?Sri Lankan Government has to change its mindset,then only can people trust them.

    Please address the UN HRC resolution, you willingly accepted, co-sponsored and signed on, You are the only country that co sponsored your own resolution.

    The international community is expecting your oral report in Geneva in two weeks time. Please explain why you and your good government are still refusing to accept to implement the resolution in full, and no progress other than the minimum superficial release of land.

    Why is the fear to accept international judges, prosecutors and lawyers to investigate the truth on why and how more than 100 000 were killed during the genocidal Mullivaikkal war.

    Keep your passport, but don’t fool the UN HRC, or should they refer it to the ICC ?

    We do not know, how many Singhalese killed by suicide bombs, were carried out by the government agents – identified one by GR. Still others to be identified. That is also one of the reasons why MR & CO and bad monks doesn’t want international investigation but we will not give-up. The geo-political advantage for srilanka will not work for ever but the karma will chase you for ever. In Hinduism, we can do some good thing or santhi to balance our karma but many Singhalese continue to pile up more and more karma.

    The government co-sponsored the US resolution adopted at the UNHRC sessions on October 01, 2015 called for a “hybrid special court” including judges, prosecutors and investigators from outside Sri Lanka. The relevant para reads as follows: The resolution — which was proposed by the U.S. and co-sponsored by Sri Lanka — affirms “the importance of participation in a Sri Lankan judicial mechanism, including the Special Counsel’s office, of Commonwealth and other foreign judges, defense lawyers, and authorized prosecutors and investigators.” Now President Maithripala Sirisena and Ranil Wickremesinghe are saying there will be no hybrid investigation, it will be only a domestic investigation by Sri Lanka judges. This is a clear case of reneging a key provision of the resolution co-sponsored by US and Sri Lanka. The insistent on domestic investigation as opposed to a hybrid will not sit well with USA or other countries like UK, Canada and India, the mover of the resolution. The refusal to establish a hybrid court is confirmation that the armed forces did indeed committed war crimes. If this is not the case what is the reason for the change of mind?

    Previous Governments of Srilanka,have ostensibly attempted to resolve the National Question; The B-C Pact,Dudley-Chelva Pact,and even the Indo-Srilanka Pact[13th Amendment]!This has been the Political menu,since 1956!
    With this experience of playing out and buying time, the Govt: may have thought even the UN can be outsmarted!

    When you are nabbed in the land of birth that you rejected in the first instance the western passport does not give you the protection that it gives a native westerner.you may even be born in the west but the background is clear.
    The real world is not the stupid social one that most are trying to promote. The rich always win.

    If you are a Tamil from the north or east you will be shadowed like the former Canadian MP. The diaspora would be right behind you making matters worse.
    If you get killed then only recourse is having connections with Prince Charles but you can never be brought back to life. The issue of the 1% diehards not worth a bone but play tricks with sensational matter.

    There is no compromise on the system or the politics of the state dies.

    For those of you who are ignorant of the fact that there are more than 200,000 (2-3 generations of) Sri lankans from the North, who have fled over the last 30 years are living in refugee camps and are being exploited by unscrupulous elements in South India with no hope whatsoever; who are in need of an IDENTITY !

    THE MAJORITY OF THEM BELONG TO THE LOWER EBB OF THE TAMIL COMMUNITY, WHO COULD NOT AFFORD TO GO TO A WESTERN COUNTRY !

    Hope this arrangement of issuing of passports will restore their dignity and help them return to their homes they deserted years back!

      Its the stupidity of Tamils to get back and be reused for protest/terror.

      They would end up like KP and as it is the Indian passport has better value today.       that is not entirely true. The fisherman of LTTE were living hand to mouth and today they are millionaires in the west having done various legal illegal business to get here in the first place.(now you see why Mangala is luring them with a SL passport??)

      Socialism ends when others money ends. Majority of Sinhalese and Tamils are socialist/communist and that goes with the poor.25 years of socialist government from the demise of Premadasa.
      Poor Tamils come to the rich nations make their money but are unable to change your genes(the way you study and understand.) There isn’t one Tamil MP in the UK – all loss.
