SriLankan Ex-CEO Kapila Chandrasena And Wife Neomali To Be Arrested Over Rs 17 Billion Airbus Deal

Rajapaksa era former SriLankan Airlines Chief Executive Officer Kapila Chandrasena and his wife are to be arrested shortly over charges of money laundering in a corrupt deal that cost the national carrier upwards of in excess of 17 billion rupees (USD 116 million).

The Police Criminal Investigations Department (CID) submitting B Report bearing No 14363/19 to Fort Magistrate into the inquiry over procuring a fleet for SriLankan Airlines stated that there is reasonable suspicions for the existence of adequate evidence to name Kapila Chandrasena and his wife Priyanka Neomali Wijenayake as suspects  and to report to Magistrate Court and obtain a warrant for arrest under the provisions of the Code Of Criminal Procedure Act (No. 15 of 1979) in order to record statements and produce the suspects before Court.

In addition the CID informed Court that two suspects had conspired with some other individuals and companies hitherto unknown to the prosecution.

The CID also informed Court that Singapore’s Central Authority (I.e. Attorney General’s Chambers) has replied with a set of documents on 5th November 2019 subsequent to a request made by the Ministry of Justice under Mutual Assistance in Criminal Matters Act No. 25 of 2002. 

The request was made to obtain information into three accounts maintained at the Standard Chartered Bank by a company by the name and style of Biz Solutions. 

Accordingly it is revealed that:- 

  • A sum of USD 2 million has been paid as bribery to an account bearing No 0107130602 under the name of Priyanka Neomali Wijenayake the wife of SriLankan Airlines CEO Kapila Chandrasena by EADS HQ/ SSC France (i.e. European Aeronautic Defence and Space Company N.V.)  the parent company of Airbus SAS. 
  • The money was accepted by Priyanka Neomali Wijenayake who possessed  an account under the entity – Biz Solutions bearing No 0107130602 maintained at the Standard Chartered Bank of Singapore. 
  • Thereafter by remitting money into an account of her husband Kapila Chandrasena bearing no 06323610119179 maintained at the Commonwealth Bank in Australia Priyanka Neomali Wijenayake had committed the offence of money laundering
  • This offence of money laundering was committed by Kapila Chandrasena  and that his wife Priyanka Neomali Wijenayake aided and abated the committing of this offence.  

The CID is also informed the Director General of the CIABOC (Commission to Investigate Allegations of Bribery or Corruption) for necessary action. 

Last Saturday the Colombo Telegraph reported that as aircraft manufacturer Airbus reached a record 3.6 Billion Euro settlement with US, UK and French authorities following a 4 year investigation into allegations of bribery and corruption, Transparency International Sri Lanka wishes to highlight the importance of paying compensation to the countries who are the victims of corrupt deals involving Airbus.

The statement of facts issued on 31 January 2020 as part of the Deferred Prosecution Agreement reached between Airbus and the prosecuting authorities, indicates that Airbus had agreed to pay out a sum of 16.84 Million US dollars (Rs. 2.5 bn [2015]) to influence the aircraft purchase, to a company registered in Brunei under the wife of an executive at SriLankan Airlines. Furthermore, the statement reads that Airbus had paid out a sum of 2 Million US dollars of the agreed amount to the company.

On 4 April, 2015, the Colombo Telegraph reported that a Board of Inquiry has found shocking details of corruption running into billions of dollars, manipulations of service contracting, recruitment of unqualified staff and major security breaches at Sri Lankan airlines under the former government. The panel headed by anti-corruption advocate and senior lawyer J. C. Weliamuna found instances of gross abuse of power by former Sri Lankan Chairman Nishantha Wickramasinghe, who was the brother in law of President Mahinda Rajapaksa, whose penchant for young air hostesses cost the debt-ridden airline even more problems.

The Board of Inquiry (BOI) found evidence of Wickramasinghe and then Sri Lankan CEO, Kapila Chandrasena falsifying documents to lease a luxury sports utility vehicle for the use of Wickramasinghe. This was in addition to a luxury Mercedes Benz vehicle and a Prado super luxury vehicle.  The BOI has found CEO Chandrasena unsuitable for the job and was surprised to discover that he was paid a minimum monthly salary of 1.5 million rupees on top of other perks and he had also enjoyed salaries simultaneously from his other appointments. There had been a time when he drew a salary as Mobitel CEO as well as Mihin Lanka CEO. 

The BOI recommends criminal prosecutions of Chandrasena as well as Wickramasinghe, among other senior management staff, but was never carried out by the administration of Prime Minister Ranil Wickremesinghe. 

On October 10, 2015, it was reported that Ranil Wickremesinghe’s appointee and confidante  SriLankan Airlines Chairman Ajith Dias has condemned the ‘Weliamuna Report’ saying there was no financial misappropriations found as stated in the final findings made against the former Chairman Nishantha Wickramasinghe, CEO Kapila Chandrasena and thirteen others as those who were accused of corruption and malpractices that caused the national carrier to plunge to a monumental loss of over Rupees 120 billion during the Rajapaksa regime.     The Government of Sri Lanka should demand Airbus to return the USD 90 Million taken for breach of contract when 4 Airbus A350-900 planes were cancelled during the Yahapalanaya regime. Airbus has no right to claim breach of contract since the contract had been signed using undue influence.

      How come that the press and all the country knows about the people to be arrested – before the arrests – to the criminals have ample time to flee?!
      Who is leaking information from the AG’s Department when a decision is made to arrest some criminal politician or a criminal politicians business crony like Kapila C and wife.

      Also, was Shiranthi Jarapassa’s brother Nishantha in bed with air- hostesses when this crime was committed? How much of the 2 million USD ended up in the Minhinda Rajapaksa and extended family coffers?
      Why is Sajith and Bondscam Ranil silent on this matter?

      How does airbus be responsible for breach of contract, due to the misconduct of the airline’s staff ? First admit that you have employed a group of under-qualified individuals with absolutely no ethics, moral values and integrity to operate the national carrier. Bribe takers are more guiltier than the givers, just remember that !! Then again one who appoints a commission to investigate themselves ….. Do I have to spell out the report and what would happen to the culprits after the general elections ?

        I agree with what you have pointed out K L Pathirana. However, bribe takers as well as bribe givers are equally guilty.
        Since we have lost a enormous amount of money, at this point the Government should try to recover at least the penalty paid for breach of contract since no one can deny that the contract executed by the holding company of Airbus was secured with Sri Lankan Airlines by paying a bribe to a person/s in the decision making body.
        In our country punishing culprits will never happen, going by what has happened in the past.
        Don’t be so sure that the culprits will be caught in Sri Lanka (especially when people at the top are either a cousin, an uncle, an aunt, a friend, a bosom pal, etc. etc. of those in the same circle)!

      Govt should demand but they won’t b’cos big companies like Airbus are in the position to blackmail small Gvts like SL. If GoRa Gvt ever tries to go after them they will release damaging information regarding politicians to the media. Since it is very likely that whole Ra..kse family is involved not only in the Airbus deal but also in many others as well, I can guarantee that GoRa regime never will demand compensations from the Airbus.

      China also did what Airbus did to SL: Adding the bribes to the cost H’tota harbor, port city etc and then taking over the harbor bay paying less than the cost along with other investment rights, all of which are directly part of China’s global expansion plans. It is these kinds of mountains of debts incurred by inexperienced, short-sighted & greedy politicians (Ra..kse family) that drives costs of living on one hand and delays the economic recovery on the other. But, they manage to keep ruining the nation over & again b’cos of the corrupt media which maintain a symbiotic relationship with the corrupt Ra..kse clan.

    He will be given bail within a short period. Kapila’s heroics are clearly written in the Presidential Commission Report on MIHIN and Sri Lankan. Should have taken action many months ago and as usual all Heads of State are not keen to nail the culprits.

    Kapila has many houses in Melbourne and Colombo and clearly his income sources can be easily traced. He owns luxury vehicles.

    Money was made when entering into the Airbus contract and also when exiting the contract. Why isn’t there any action on the board of directors and senior management ? Both parties are at fault for ruining the airline and turning a blind eye. Appointments to Sri Lankan board were all questionable for decades.

    Why aren’t the heads of state who are the appointing authority not questioned? Past chairmen and directors enjoyed enormous benefits in kind and in monetary form with no questions asked.

    It is now or never !!

      Most likely, the couple will be arrested but as did Arjun Aloysius, Kapila would not divulge the names of others involved. However, since the wife is also now hooked, there is a slight chance of entering into a plea bargain in lieu for early bail for the woman. As I said, this only a remote chance; most likely they might have already cooked up a beautiful alibi to save other big sharks. But, the point is that a huge transaction of the nature of buying 10 Airbuses couldn’t have gone through only one person when such a deal must get the approval of the then Prez (MaRA), finance minister (also MaRa) and the cabinet. Since Rajith & Patalee are now in the opposition, they should be reveal whether the proposal was approved by the cabinet.

      So far, money trail stops in an Australian account belongs to Kapila. The big question is whether the CID could trace how/where the money went from Australia! If the CID could find that piece of the puzzle, a plea bargain wouldn’t be necessary. I can almost hear MaRa’s heart beat turning into a big thud!

    Why only this man and his wife? Take the entire Board of Directors including the Chairman. Then there are other “Senior Managers” who shared in the “Loot”. One of the members is another Rajapakse clan – Sashindra Rajapakse, the son of Chamal Rajapakse. Demand the tabling of both the “Waliamuna Report” and the “Presidential Commission” finding in the Parliament. Another to be questioned must be Sajin Vas Gunawardane along with the present President, who were “Colleagues” in crime. If this “INVESTIGATION” is done properly, the PEOPLE would know HOW and WHY the National Carrier “GOBBLED” million and millions of tax payers money. Also , remember, these “Purchase” “Agreements” and related “Loans” were raised on “GUARANTEES” of the Treasury under the then Minister of Finance, MR and the Secretary to the Ministry P.B.Jayasundara – the present Secretary to the President. So who is going to “Bell the Cat’ and break open this “ROYAL MAFIA” is the “BIG QUESTION” Will it happen? I doubt it very much.

I am sure there will be enough and more surprises to unearth. He would have laid his hands on what ever was left or else search for evidence , where Ajith Perera came from prior to his appointment in SLA. I am told every govrnment institution ,has gone through years of corruption. Others which are top in the list includes SL cricket, SL telecom, Port authority and Govt banks.Regardless of party , Lankans in general have turned immoral and corrupted. The politicians over years have normalized such behavior. When no one is made accountable , including the accused , which includes President ( Avant Garde), PM (Tsunami) , current ministers who,s cases have been suspended , what is the message given to our immoral public. As long you are with us (who ever the ruling party) we will cover you. Even if the govt change the other will not touch us , because they too are rogues, as in Bond Scam. It is not anymore a surprise why not even a single case reached its end during RW/MS time. ( MS has played out big time). When more and more of this shit is exposed , who do we believe ???? None of the bigwigs will be prosecuted and life in the upscale will continue. The Rajapakses will bring progress to the country but at what cost?

    I do not know wwhether arrest would work. Even Duminda Silva, he may have to wait a few more months. Even Ranil said, he would bring FCID, and he was among the first few in the line up to provide excuses. These same CEO is connected to having layers of hotel rooms booking for a party in Emirate/Dubai Hilton.

    EADS/ Airbus Sales HQ in France deposited USD 2 Milluion in Naomi’s Standard Chartered Bank Account in Singapore.
    Beloved Naomi transferred it to Kapila’s CommBank Account Down Under, most probably in Sydney.

    The times of presidency, whether MR, MY3 or GR is immaterial. What mechanism does it exist to prevent wrongdoing of this kind? All this shows that there are no checks and balances. In the first place why must deals take place through “brokers” or third parties? Of all places to deal with Airbus a company in Brunei? All this would have triggered alarm bells long before had the system in general was honest. Clearly it was not. There are other questions that arise out of this. Was this the only matter that the duo were involved in earning fat bucks. They came into the scene in the Telecom sector from about 2001, prior to that they were in Australia. The next question is were all these doings done with the blessings or a wink with the higher ups? The Sri Lankan Airlines and the entire country has been bleed almost to death by these blood suckers. This is yet another racket like the infamous bond scam. The poor here do not have a square meal. One therefore wonders the real worth of these so called expatriates of Sri Lankan birth having a foot hold in another county up to in the light of the bond scam and this Airbus affair.

    It is shame and nothing but a damned shame that after 72 years of so called independence Sri lanka cannot even maintain a successful airline. Other countries in the region that are smaller than Sri lanka such as Mauritius and Seychelles have and maintain profitable airlines.
    The citizens of those countries are proud of what they have and do but in Sri lanka it is the opposite.
    Sri lanka in fact has no independence as it is governed unofficially by India the Big Brother & Master of all in all matters. Every time a government changes the leader in power is called upon and summoned without fanfare to New Delhi to meet, receive instructions and obey his Indian Masters in all matters of governance.
    The politicians of the new set up have only one intention and that is to make as much money as possible in the shortest possible time.
    So where is the country heading ????????? Into the shit bucket if its already not there.
    Present day Sri lankans unlike the past are a bunch of modern day wankers who only want to wank off all day long with the fantasies forming in their minds. What a bunch of Wankers in this world.

    By the way Tsunami Fund & Mig Deal suspects also been known for a long time. Would they ever be brought before the justice system?!

    Wait and see where this will lead to, and my advise to GR is to get to the bottom of this and biggest crook, MR will be on focus with other relatives that got this ill gotten gain..
    We knew Kapila is on the take and country with hardly any net foreign revenue, this is unbelievable corruption at wast scale.
    Knowing GR, this will be a dilemma for him and same time his unquestionable love of the country will be on forefront. If GR refuse to tackle this our families major investments in the country will stop including our friendship with GR.

    I think this article should be published in Sinhala News papers and Sinhala media, without being distorted.
    The biggest problem we have in Sri Lanka is communication barrier. If only our Sinhala majority could be informed of the issues plaguing Sri Lanka transparently, peoples mindset would begin to change towards normalcy.
    What Sinhala media do with every news is to put some spin or political bias before reporting. Since majority have no means of independently verifying, they simply have to depend on and are stuck with propaganda.
    To break this vicious cycle, truth and seeking media houses or websites should publish the truth in Sinhala. Let the people decide. Everyone has a right to the truth.

That is after shutting up the whole intelligence dept, getting rid of independent judges, threatening and intimidating the sitting ones, bring all services under him, placing his men in all higher up positions, sending a few to prison, getting all pending court cases suspended, withdrawing the cases against self, making BASL toothless, appointing his people to AG dept and judiciary, sending EVA to France on a long vacation ——etc. This is what I call SARC style governing. “They exactly end up doing what they promised not to or they had already done it before promising”, pretty simple . They are living the most luxurious life in Melbourne, Australia disguised as distinguished Australians with the blessing of their godfathers, the Rajapaksa clan.       Australian citizens have to declare and pay taxes on their worldwide income. Sri Lankans in Australia should report this family’s and their immediate relatives money laundering activities and looting to the country’s tax dept. Sri Lankans living in Australia came in droves to and voted to bring in the incumbent prez to power and this is good opportunity to show you support to SL.
      Historically starting from JRJ time Australia has been a popular destination for corrupt families from SL to convert black money to white using real estate. Starting form politicians to govt officials own real estate in Australia and their local income could never support such investment.
      Members of the SL communities who really love SL should boycott these corrupt families.
