Tamil Man Claims Rape And Torture Upon Return To Sri Lanka

A Tamil man living in Australia has detailed shocking claims of rape and torture at the hands of Sri Lankan army intelligence, Australian Broadcasting Service reports.

Last year almost half of the asylum seekers who arrived in Australia were from Sri Lanka, which recently emerged from 30 years of brutal civil war.

The Government has been sending Sri Lankans home, claiming the threat of war and persecution is over.

But one Sri Lankan Tamil living in Australia has told the ABC’s 7.30 a very different and disturbing story.

Kumar, as 7.30 chose to call him, says just three weeks ago he was abducted, raped and tortured bySri Lankan army officers.

“I was naked and no place to sleep, except the floor like a dog. I felt like dying but I thought of my kids and family back here,” he said.

Kumar arrived in Australia in 2008. He fled Sri Lanka after being interrogated and accused of links to the Tamil Tigers.

He says he was working as a school bus driver when he was coerced by the Tigers to deliver parcels for them.

“I got afraid and I thought it’s not safe to live in Sri Lanka any more,” he said.

Kumar’s family joined him in Australia last year. In March, he needed to return home as his uncle fell ill.

Less than a week after he arrived home to manage his uncle’s restaurant, Kumar says he and his brothers were abducted at gunpoint by two men in a white van.

He was blindfolded and taken to a dark room with “dried blood” on the walls.

He says the men claimed to be army intelligence officers and grilled him about links to the Tamil Tigers, which he denied.

“They came back and again started hitting me with a log at my back and now I’ve got a spine problem as well,” Kumar said.

“The two guys were drunk and they came to me and they just put their hand on my body and they just rubbed me and I had some sexual torture as well.”

On the fourth and final day of his ordeal, Kumar’s captors branded his back with hot irons.

“I thought that’s the end of my life and I just fainted,” Kumar said.

“When they see my back they will know what has happened to me recently, because a lot of stories [do not] come out from Sri Lanka.

“I can’t forget. No-one wants to get these kinds of things in their life.

“I pray to God. No-one must get this kind of punishment.”

‘Believable’

Kumar says he only made it home because his uncle paid a $20,000 bribe to his captors.

Soon after he returned Kumar went to see his local doctor, a fellow Sri Lankan Tamil who issued a referral for Kumar to get urgent psychiatric treatment for his trauma.

The doctor was so horrified by Kumar’s injuries that he also sought help from the Tamil Refugee Council.

The council consulted Louise Newman, an expert adviser on the mental health of asylum seekers.

Ms Newman says Kumar’s is a “credible story”.

“He provides detail and is very preoccupied with some of the minute details of the actual atrocities that were performed on him which is very typical… of the accounts we get from people who have been through these sorts of experiences,” she said.

Gordon Weiss, who was the United Nations spokesman in Sri Lanka during the civil war, agrees Kumar’s story is believable.

“There have been a series of reports in just the last few months from the US state department, from Human Rights Watch, from the UN high commissioner for human rights, detailing this kind of treatment,” he said.

“One has to remember that the people in charge of Sri Lanka at the moment have got a long history stretching back to the 1980s of using torture and abduction in order to suppress segments of the population.”

Transparent

But Sri Lanka’s High Commissioner to Australia, Admiral Thisara Samarasinghe, says the allegations are false.

“If he has been treated in the manner that he has just explained by you, he is welcome to come and present it to me or present it to any government authority with his name and identity,” he said.

“Sri Lanka is transparent. Our system of judiciary and investigation is transparent.”

The Australian Government has just returned 38 of the Sri Lankan asylum seekers who arrived by boat at Geraldton in Western Australia earlier this month.

Foreign Minister Bob Carr says there is no evidence their asylum claims are valid.

“Since 2010 there has been no evidence of returnees being discriminated against or arrested, let alone tortured,” he said.

“I think it’s wrong to say Tamils live in fear and are fleeing their country.”

Kumar’s injuries mean he cannot work and is now in danger of losing his visa.

If that happens he faces deportation within a month, so his next step would be to apply for asylum.

          Sri Lanka needs to fix sick SL Police for of good. Nothing else will do.

          BTW, SL Police is not a Sinhala Police. Get over it. There are many Tamils and Muslims in the SL Police. Even more before the war. They are not any better.

          Police of all ethnicities torture all citizens of all ethnicities.
          It is truly an equal opportunity problem. All equally corrupt and brutal.

          Do not think Tamil Police are any better. As proven by “Talented Mr. VP” during his time in power. Nor are the Muslim Police. These are facts.

            This has nothing to do with Sinhala bashing. With about 70% Sinhala Buddhists living in the country, most of them happily call Sri Lanka a Sinhala Buddhist country. With over 95% Sinhalese in the police and armed forces, what’s wrong in calling it the Sinhala police and Sinhala army? Just like one swallow does not make a summer, a sprinkling of Tamils and Muslims in the police and armed forces does not make it a Sri Lankan police or Sri Lankan army. This is my personal point of view. You are entitled to your own.

              We have a problem with minority representation in the Armed Forces and Police. It has to increase. Problem became acute with the war that lasted 30 years. As as result of the mistrust that built up.

              Further, for a Tamil Sri Lankan joining SL law Enforcement was like signing your won death warrant while “Talented Mr. VP” was alive and “killing”.

              These are problems Sri Lanka can easily fix. GOSL is already trying to do it. They need to do it faster on a larger scale.

              So, we can truly call them Sri Lankan Armed Forces and Sri Lankan Police.

      Torture is a terrible problem within Sri Lankan law enforcement. All regimes since Independence are responsible for this crime. It has only gotten worse over time.

      Not only official law enforcement, but LTTE too was extremely talented at this disgusting ancient “art”. Administered by mentally ill savages. Promoted by cowards in high places.

      This story must be investigated at once by Sri Lanka. If true, savages behind this should be thrown into a jail cell for many years.

      Statement from our High Commissioner in Canberra is embarrasing. He should focus on digging out the truth. And clear Sri Lanka’s name properly. Rather than making empty statements on how “transparent” we are. Laughable.

    To claim political asylum in the developed countries these scars are enough as they believe the stories of asylum seekers by just looking at the scars. However, getting the outer skin burnt or scraped is nothing. Even punks and youngsters pierce their faces and even their private parts with needles, hooks and other metal objects. So, these scars are worth a few million Dollars or Euros once political asylum is granted. How can there be a horizontal scar – maybe the attacker has stood on a stool and done it to be horizontal (the top one)! In short, the slight pain is worth millions. Who wouldn’t do it for better life!

        Aney appochchi, please call me Rajapakaya and not Rajapassa if I support the biggest rogue in Sri Lanka. I always try to have a balanced view of everything ad here I notice that there are no even slightly deep wounds at all and only the skin is damaged which naturally arouses suspicion to claim political asylum. Living in Europe for over 30 years, I know the tactics of al the asylum seekers and my comment doesn’t mean that these tortures haven’t taken place in Sri Lanka. Yes, there had been so many and on numerous occasions I have stated that GOTA is the biggest contract killer in Sri Lanka and all the Rajapakses are looting our national wealth. I am in no way suffering due to their looting but I sympathise with my fellow brothers and sisters living in Sri Lanka whether they are Sinhalese, Tamils, Muslims or any other Sri Lankan. Also I say that this is the WORST regime not only after Independence but throughout our long history. The day the volcano is going to erupt is not very far and it could be even during this year as over 80% of the citizens are against this regime and only the crooks, rapists, drug dealers, murderers, extortionists and thugs are with these Rajapakses. They allow their henchmen to do anything to cover their own corruptions and ultimately it is aney appochchi, myself and other peace-loving Sri Lankans have to suffer.

          Not only from SL but also many other devleoping countries, people keep entering to EU, AU, Canada, UK and other developed world. Most of them have no real reasons other than – their economic conditions are not improved. That is the reasons for them to ask for asylum on the west. I have met hundreds of lankens (tamils, sinhala, muslim and other minorities) during my long stay in EU.

          These people are brought to Europe thorugh human smugglers. These human smugglers have earned millions of funds because each of such candidates to allow entering Europe was related with several thousands of dollars. They are being brought to Europe through long tours via RUSSIA or Turkey.

          Basic laws in Germany for example have allowed anyone to claim for ayslum once they put the feet on german soil. But this had been the case then, now they the german authorities have reformed their provisions in asylum law in Germany, France and other countries in Europe. This is the reason why those economic refugees cant claim for that kind of refuge in Europe today.

          So, I have no clue about truth of the picture that is depicted in this article. ALL WHAT I AM SAYING IS THIS COULD WELL BE CONNECTED WITH SELF MADE INJURIES SO THAT THE CANDIDATEs TO EASILY HAVE WON HIS APPLICATION TO GAIN A BETTER VISA LEADING TO HOST COUNTRIY^S PASSPORT.

This I have read in german press not once several times particularly early 90ties. These europeans are easily manipulative to believe all those lies spread by so called tamil refugees. So the name of the war, many that entered these coutnreis are just economic refugees to seek a better life.

          This was made very clear by one of the good tamil politician in the UK in a public forum.

          So, EVEN IF I AM AGAINST RULING REGIME, I WOULD NOT AGREE WITH ANY WRONG ONES THAT TRY TO PROVE THE UNTRUTH TO MEET THEIR PERSONAL GAINS.

          Current regime is absolutely not the capable one to lead the nation, but we have to differentiate all these through proper investigations. This kind of injuries are reported in lanken police stations – that came to surface few years ago through some you tube videos.

          So, each and every case should be investigated proerply…. then only we all could see the truth of each case, so that the autorties could take due actions against the accused.

          So Mahinda Samarasinghe or anyone who would represent the nation to the IC will have all forms of difficulties explaining why president allow courts to act without free and fair verdict. There are genuine victims under Rajapakse regime and a few try to use the tortures of Rajapakse regime to apply for political asylum in the developed countries. A number of Sri Lankans who have obtained political asylum have told me how they have got scars on their bodies without much l but worthpainfuuffering and shown those scars to the authorities to obtain political asylum. My personal view is that this person is also one like that. I know that you too are against Rajapakses because they are looters of our national wealth but in this instance, I have every reason to believe that he himself has got some other person to get these scars. IT IS ONLY THE OUTER SKIN that has got damaged and it is not very deep at all.

    If these injuries were caused by GOSL Detectives it is a sad day for Sri Lanka. When the injured say that he doesn’t want it investigated there appear to be a doubt as to how it happened. Can’t it be the result of some personal rivalry. Unless it is investigated we will not know who did it. He must through Australian HC in Colombo ask that it be investigated. When it is investigated how his uncle found such a large sum of money in a hurry etc may throw some light and we will know exactly what happened. If this is allowed to go without any investigation there can be similar complaints even with self inflicted injuries to obtain PR in Australia

          I believe there is a great need that developed countries should exchange their statistics on the refugees keep coming to their soils for refuge, that can give us all the clear view about this.
          As I got to know not even 1 out of 10 are real refugees among the flows to the Europe.

    I know personally why people try to come to Australia keeping even there life at risk by boats and all. So,there is nothing to reject that this has been done by himself. May be there is a hope to tarnish the image of the country and security forces, but major aim might be to get the Australian visa and finally PR.

      A Xinhua news agency report states that ‘ Kumar’ is claiming that he was branded on his back with hot metal rods ( see infolanka.com/news). This wil explain his injuries more accurately.

    Let’s have a closer look:

    He ‘fled’ Sri Lanka and then returns to run a BUSINESS? Not very ‘credible’ given the propaganda being done nowadays.

    In what part of Sri Lanka did this happen? Colombo? Wanni? Batticaloa? If the information is disclosed it might make any investigation easier – if that’s what he wants.

    Can we have some one who is not a part of ‘Tamil’ or ‘Asylum’ organization and also not trying to promote sales of a book to assess the credibility of this story?

    This is a test for the Australian Government’s asylum policy. Have ASIO or other Australian Government organization investigate this.

    Such an investigation is a necessity in fairness to the Australian people.

    Obviously “they” meant to kill him and that’s why they used iron rods on him and did not bother about leaving scars on his body. But the money offered to “them” was too much of a temptation and they let him go. This is not the first time “they” allowed victims to leave when “they” are bribed with money.

    As someone commented, the military has been involved in the business of torturing prisoners in the 80’s and they are doing it again now. The whip is in the hands of the same man once again!

    When are the Australians going to wise up to these stories?

    Let’s look at this story rationally without taking sides.

    1. He left Sri Lanka in 2008 at the height of the war after being question by the army for helping tigers. Yet at this point the army did not consider him as a terrorist as he was apparently not detained and released. This is how he ended up in Australia.
    2. The man who went though such an ordeal in 2008 was not worried about returning to the same place where he thought it was not safe just 5 years ago. This is amid of all the horror stories he would have been hearing about torture and rape. When boats loads of tamils were landing on Australian shores bring with them unimaginable stories about torture, abduction and rape, he felt safe enough to hop on a flight and return to the heart of trouble, all for what?– to see a sick uncle and to manage his restaurant! In his own words “I got afraid and I thought it’s not safe to live in Sri Lanka any more.” Yet he was brave enough to comeback and start managing a restaurant.
    3. Then he was abducted, along with his brothers. Apparently, his brothers were living in Sri Lanka. For some mysterious reason the army was waiting until he returned to abducted the whole bunch, when in fact they could have abducted his brothers anytime. Anyway, what happened to his brothers? The man who was so concern enough to come all the way to see his sick uncle does not even mention about what could have happened to his brothers.
    4. Then they grilled him on links to tamil tigers. What links? What specific questions were asked? Four years after the war ended why would the army question a bus driver to get information on non-existent terrorist group? What more information could he have that he did not have in 2008? This is at time when the government is integrating hard core LTTE fighting cadre to army including women fighters. Wouldn’t those people have much more valuable information than this man?
    5. If it was a dark room how did he see dried blood on walls? And how was the iron rod heated? Was there a big furnace in the room to heat an iron rod? Is it not a little suspicious that this branding was done almost to a pattern as if someone has carefully placed them? Also, why is it only the back, which is likely to be covered almost 100% of the time. If they really want torture why not face, limbs, chest, etc, where injuries would be more visible?
    6. So his sick uncle has spare $20,000 laying around to pay as ransom for his release? That is a small fortune in Sri Lanka and I don’t believe a decent middle calls family would have that much is savings.
    7. Up on his return, Kumar went to see a tamil doctor, who unsurprisingly thought his injuries were horrific and sought help from TRC. The “expert advisor” on mental health of asylum thought the story was “credible.” No surprise there too as she is making a living on asylum seekers.
    8. Then there is Gordon Weiss, the man who “choked” on Channel 4 video on killing fields, who again agrees with story. Not a big surprise too especially when he is promoting his book on this same website. What he is going to say “this is all BS” and seriously jeopardize sales of his book?
    9. Finally, he comes out government morons who say something that provide ample support for this story. It is reprehensible that that Sri Lankan HC, Admiral Thisara Samarasinghe saying that these allegations false on the premise that there is “transparency” in Sri Lankan legal system. I think this idiot is confusing the transparency in the country where he lives with that of in Sri Lanka. If he has any self-respect or has bothered to read what is on this website and other similar places, he should have realized that the legal system in Sri Lanka is as transparent as a blacked out mirror. In fact, it is this lack of transparency that has enabled anyone to come up with stories like this and convince the international community of any lie.

      Why don’t you spend your time to analyse what SL ambassador said? His comment is very similar to GR, “come forward and give us your name” This ambassador and GR are professionally trained on how to kill humans and how to destroy things… Now these professional people represent your country as diplomats and high ranking civil administrators… Spend you time analyse what these type people do and say rather than spending time to analyse one of your brothers (average man) to get asylum or help to live decently with his family in a civilized country.

    Australian govt, UK govt send back as their intelligence agencies find that SL is safe place now. These are credible agencies with excellent ground intelligence. These stories are created by LTTE groups and people smugglers to whip up idiotic western people who go with first feelings and emotions. They then get their politicians who need the votes to stay in power to force the agencies to turn the law. In turn the LTTE rump collect blood money from these groups so that they can continue to live in luxury and few bankrupt westerners to sell their books I.e. former UN diplomat and the alleged tortured refugees as soon as they get PR status go back to Sri Lanka with whatever they collected from western welfare funds which the idiotic westerners are paying through their taxes to start businesses! These tortured refugee PRs and dual citizens (some get this after their return) come back to Australia and other western countries when their sons and daughters are at university age to get top universities in these places kicking out legitimate local citizens of Australia and other western countries and live on welfare again crying out loud that they were tortured. When will the born and bread Australians and other western people realize their stupidity! Read carefully truth seekers !

    Unfortunately, his “scars” look too artistic to be authentic. Also, notice the “scar” on the top looks fresh (it is not coloured), but the one on the bottom shows colour. Yet he claims all the wounds on his back were acquired the same day. That means they should heal at relatively the same rate.

    Amina, You asked a good question.Go to Kataragama during the season to watch self-inflicted toture unlimited by SL Tamils!But this Kumar could not have come to Kataragama recently. He may have gone to a former cattle brander who ran Brabha’s notorious toture chambers like the one where Prabha’s own former Deputy Mahattaya was tortured for long period before he was finally done away with. if Kumar did not inflict it himself by lyiing down on a burning pipe.LTTE cattle branders are there down under to organise these. This is with apologies to decent Tamils.

    When will the Australian authorities wake up to all these false claims?
    As truth-seeker points out how credible is it that a man who fled SL in 2008 because he found it too dangerous to live there, should strangely feel safe enough to return to the island to help out a sick uncle? And as Lester points out the scars look too ‘artistic’ to be true. Indeed.

      Not only that the Australian authority does not seem too worried about corroborating evidence in support of these stories. If a tamil breaks an arm falling down the stairs I guess he or she could easily get asylum in Australia claiming that the SL army broke their arm. What is amazing is that there are local Australians making a living out of this scam and are only too happy to rubber stamp these stories as “credible.” Just look at the scars. They are almost of the same length regardless where they are. Now just imagine someone holding a hot iron rod trying to burn his body so that all burns would be of the same length and form very neat lines. Apparently, he has enjoyed this because if he was really in that much pain he would have struggled violently and there is no away anyone could have made these burns so perfectly.

    This is so sad. Most Sinhalese think that most Tamils are Tigers and most Tamils think that most Sinhalese are morons. I am born of a Sinhalese father and Tamil mother and I have endured enough from insensitive people from both sides of the divide. The Tigers are ruthless and killed both Tamils and Sinhalese. The Sinhalese Army (I don’t recall any Tamil army recruits in the past 30 years except for a couple of high ranking officials) has killed both Tamils and Sinhalese. Please understand that there are people who have suffered from both sides. Why all these vicious comments?

    Only Kumar knows the truth. If he was abducted by Army intelligence to get news about LTTE, he would have been rehabilitated like other militants who were arrested by Army or he may have been killed. And if he was a wanted person, he would have been arrested at the airport upon arrival. So, if he was really abducted by someone, the reason must be ransom, and most probably with the involvement of Tamil gangs who knew about his wealth.

    Asylum seeking is a big industry and anything can happen nowadays to strengthen their case. I think Minister Carr is fair about the actual situation in Sri Lanka. Since Kumar is safe now, why can’t he tell as to whom US$ 20,000 was paid and identify the culprits?

    To me this is a total fabrication. He was in Australia with Visa 457. Visa 457 is given to any foreigner if his skills are rare and hard to find. In his case he was a cook in a restaurant in Melbourne. Now that the australian federal started strictly scrutinising the issue of this visa category- he will not get a chance to further extend his stay under this category. For this reason he went to Sri Lanka (Gampaha) and fabricated this story to be eligible for refugee status. I do not know the course of action the high commissioner to Australia is taking at this moment.

    Also how did he managed to fly back to Australia with this deep and painful wounds. While he was talking he was not that uncomfortable or showing pain. I urge authorities to take a note of these events more seriously

    I hope he’s now got an Australian passport and does not ever visit Sri Lanka on holiday as most asylum seekers do within two years of obtaining asylum.

    Thanks to Jay who shed important light on this murky issue. I was wondering why he would do this to himself (or get it done by others) if he is already in Australia. The visa457 business (if it is in fact true) makes this abundantly clear. If he is going to lose residency in Australia (where he has been living for the last 5 years) this is probably the only way he could qualify as a refugee. And why not throw in some sexual abuse to spice the whole story up? If Australian authorities grant this man refugee status, they are in for a real surprise when all tamils lands on their shores with all kinds of “injuries”.
