‘Who Is To Know CJ Is Corrupt Till We Make The Appointment’ – Vitarana Goes Against The Left

“I feel this lady is not fit to hold the office she is holding. Look at the charges against her. Is it alright to get that ‘Millennium transaction’ 1.6 million reduction in price? Then transfer a case that has been going for three years under a very able judge successfully which they only wanted number of people on the bench to be increased from three to five so that it will be strengthened? She takes it into her courts. This is very wrong. This may be genuine money she got from her sister. We are not bothered about that. But if she withdraws that amount of money from the bank account and has it as cash, she must include that in her declaration. But sadly it is not in her declaration.” says the Senior Minister Tissa Vitarana.

The Minister who is also the leader of the Lanka Samasamaja Party (LSSP) made above remarks when asked his views about the present developments with regard to the impeachment motion against the Chief Justice by Daily FT.

In an interview with Daily FT journalist Chamitha Kuruppu,  when asked ‘is it justifiable to come to such conclusion by looking into only one side of the case?’ Viatarana said; “How can you say it is one-sided? This is all documented. What she should have done was, if she had evidence, produce that evidence to refute it. She was given time to produce written evidence. She didn’t do that. Giving evidence, Shiranee Tilakawardena said that this case was taken off her without her consent. Where in the world is a judge who is peculiarly interested in a particular case going and taking it from another judge and putting it into her court? Is it fair to do that? Do you justify that? Look at the bank statements. The amounts there are withdrawn in middle of March and statement at the end of March is blank. And then in April that amount of money is put back in the bank. If even a Government official had acted in that manner, it would be taken against that person. Here we are having the Head of the Judiciary doing that. We raised this matter at the party leaders’ meeting with the President. We asked President Rajapaksa why he appointed Shirani Bandaranayake’s husband Pradeep Kariyawasam as the Chairman of the NSB. The President said he did it under her specific request. President Rajapaksa did not want to antagonise her and therefore had to accommodate her request. Where in the world does a judge go and make such requests? When judges retire they are not supposed to take any posts, otherwise they will be offered things while they are acting as judges so they will be biased in those cases in anticipation of some reward later. These are ethical standards a judge has to maintain. Here we are talking about the Head of the Supreme Court of our country.”

We are not only having local reactionary forces led by the UNP and the JVP, but there are also American-led British and European forces, he further said.

Meanwhile the Executive Committee of the Samajawadi Janatha Peramuna (Socialist Alliance) including LSSP which met at the Communist Party office on 01 January has decided that the Members of Parliament belonging to the Alliance should not take part in the vote on the impeachment of the Chief Justice.

    If the CJ should be impeached so too should Mahinda Rajapakse who offered a bribe to her husband in order to politicize and destroy the judiciary.. The bribe giver and taker are equally culpable though in this case the fact that the bribe giver was the holder of the Executive office makes it doubly criminal.

    Vitharana is a GERIATRIC clownish lackey of the Dictator who has divided and killed the dead-left. This doddering old bugger should retire to a home for the aged and stop living the high life off tax-payers funds -as a all the dead left and the PSC members of the Kangaroo Court of the corrupt Diya-wenna parliament who should be IMPEACHED along with Mahinda Rajapakse.

        Bruno, do you believe what Mahinda says. This could be yet another lie. For us it is very clear that the job was offered to Pradeep so that the CJ would be under obligation to the Executive and now he says that the CJ wanted her husband a good position. Just go through the list of all the promises including the Rs. 2,500 increase in front of the Buddhist Clergy. He is the one behind the Impeachment but all of a sudden he bacame a “thoththa baba”.

    How can a senior minister make an allegation of this nature casually against a sitting CJ? How can he say publicly that the President IS making vital appointments due to pressures? When un uneducated thug become the head of the state, this is the price a nation has pay [I know this librarian became a lawyer via the back door but he doesn’t at all behave or speak like an educated or a mature person!!]. The future for Sri Lanka is very, very bleak.

    The question is not the guilt or the innocence of the CJ now. What the Appeal court has declared is the PSC has no standing in law as it is now. Hence, it does not have legitimacy. The other question on how the PSC proceedings were conducted becomes mute now, because the PSC itself has lost its legitimacy.

    Prof. Tissa Vithrane is about to vote on an impeachment motion that will carry no wight in law, even if passed by parliament . He probably knows this quite well and is going along with the process to be part of the team. Unfortunately, he is paving the way for constitutional chaos or has joined the bandwagon to force the CJ to run, before she is proven guilty beyond any doubt. It appears now that the government strategy would be to hound the CJ, until she can bear it anymore and decides to resign. This strategy will misfire in the court of public opinion that is running currently in favour of the CJ.

    It was also rather shocking to learn that the constitution requires a judge to prove their innocence when subject to the impeachment process. In our system the accuser has to prove the guilt of the accused. Why is an exception made of a judge? Is this a mistake or a deliberate inclusion in our constitution.

        Interesting.

        So the Judges ruled that the PSC is not legit. The rulings are not legit.

        Even any resolution passed in Parliament is not legit.

        That means the CJ stays.

        So how can she be proven guilty of anything?

        Perhaps the UNP with the TNA and the JVP can bring a special motion,withdrawing all the allegation they made in parliament and outside and ask for a resolution expressing full confidence in the CJ and her husband, to serve the nation.

          Legitimise the impeachment procedures and process. Appoint a panel of judges to inquire into the allegations against her. Thereafter go through the impeachment process. If found guilty by the panel of judges, the PSC accepts their report and thereafter the parliament approves it and recommends impeachment, the president can dismiss her legitimately. The CJ has to be given every opportunity to defend herself during the process.
          This will be the only sensible and civilised way to proceed now.

          However, I personally feel that everyone should draw back from the foolish trajectory we are on and restore the status quo ante. The reputation of the CJ, the president and the parliament stand quite sullied at present.

          Remember also that the Appeals Court has yet to rule on the CJ’ s appeal. What this ruling will mean to the CJ impeachment process is yet not known. This ruling will have major implications for the country.

      Once the money is in your bank accountmy dear,it is your money and you have to explain that,it is as simple as that! On the otherhand if money was sent by the sis and BIL why not declair and explain? it is not illegal to recieve money from family. Yes,It was wrong for the President to appoint a sucker like that to a responsible position but it is even more wrong for the CJ to condone it and stay on the job, but what is even worse is to continue in the job after he was made an accused in a major fraud case.If she was reluctant to resign assuming their innocence she atleast should have taken leave of absense and stayed away from the proceedings until case was resolved.
      CJ is clearly playing games with judiciary and the parliament. One of the main complaints against the impeachment motion was that the accusers themselves bacame the judges violating norms of justice but here the SC/AC delivers judgments on a petion by the CJ while still being the CJ and the chairmen of the JSC.

    (1) Why your government doesn’t apply same law other corrupt politician.
    (2) How retied CJ decide which bench heard the case. Is it legal?
    (3) If MR. Pradeep Kariyawasam appoint as the Chairman of the NSB according to the present CJ Request, is it legal? Then why we don’t punish the present president.
    (4) Can you remember first, former Supreme Court jug Balapatabade make a media statement on behalf of bribery commission there is no evidence against MR. Pradeep Kariyawasam.

    Dear Politician Vitharane:
    If you are so convinced that CJ is guilty, why is that all the old left parties including your LSSP took a decision not to participate in the Impeachment debate? Is that the correct action? Shouldn’t you, with your conscience, participate and vote for the motion to declare CJ guilty. Isn’t that your duty by the people of Sri Lanka?
    I think with your interview you have exposed your hypocrisy. Your party, who voted for the 18th amendment later told country, that it was a mistake to vote for that amendment. Likewise you will turn your coat.
    The bottom line is that no Minister rpt no Minister would want to loose all the perks and privileges enjoyed now. So you have to sing to retain your supper.

    OK, let’s assume that the present CJ has some faults as per Dr. Vitharana and others which are not yet even proved, who is the clean person in Sri Lanka to be the CJ. Dr. Vitharana, are you cleaner than the present CJ or can you name anyone who is eligible and who is cleaner than the present CJ. The present CJ’s whole history has been thoroughly scrutinised by the entire Government maybe even from her childhood but they could find only a few charges which are not even proved as she was not given ample time to give her version. Husband’s charges are also not proved. If the PSC could finalise their recommendations within a few hours or days, why not Pradeep’s case heard and finalised. No, it couldn’t be done as the big bosses are involved and he is only a scapegoat. If the GOSL says that the present CJ has some undeclared transactions, I say so that she is still the best out of all the bad lot since NO ONE IS PERFECT or IMPECCABLE. Dr. Vitharana says that she has withdrawn and put back the monies after the 31st of March so that a big balance is not shown in her account. That is not her fault and the law allows anyone to do so and she has declared her assets as on that date and the monies were later on utilised to buy a property in her sister’s name – maybe she didn’t want to show her sister’s money and did it within the frame of law. Legally she is correct. But, have you declared your assets? you may have but what about the others in the GOSL. All of you have “pol parala” (coconut beams) in your eyes and you are trying to remove show the dust in CJ’s eyes. We are very sad that we were born in a country where the ruling politicians are all rogues, looters, rapists, extortionists, thugs, drug dealers, uneducated ones except a few like Vitharana, Amunugama, G.L., etc. but they are opportunists. Please stop this nonsence and develop our country which is the mandate that you have got from the masses and not only the development of the ruling politicians and their henchmen.

    Prof Vitharana, what happened to the principles of your party?

    Let me deal with your charges. It is a common practice by the sellers of apartments to give discounts. Ask the previous Chief Justice what he received as a discount. Look at the prices paid for all the similar apartments before you slander her.

    The next charge is the funds received by her in her capacity of being the Power of Attorney for her sister, to pay for her sister’s apartment. How can she declare such funds in her declaration of assets, when they were legally paid to buy an apartment in her sister’s name?

    It is the business of a panel of independent judges appointed in a manner consistent with the law to determine whether she is guilty or not. If she is guilty, she should be sacked. If not she cannot be removed just because she and the members of the Supreme Court pointed where the Divineguma Bill is inconsistent with the legal framework of Sri Lanka.

    Leaving aside for the moment the question of guilt or otherwise of Shirani Bandaranaike of the charges brought out in the impeachment motion or the question whether MR is trying to fix her for not giving judgments in favour of his government,by her very own conduct subsequent to the tabling of the impeachment motion she has disqualified herself from continuing to serve as the Chief Justice of Sri Lanka. As a Chief Justice she should have gone to the Parliament in her official vehicle and faced the charges without the assistance of practising lawyers. Instead she went to Parliament in her lawyer’s vehicle and appointed a set of practising lawyers to argue her case. How can one now expect her to give impartial judgement when the very same lawyers who appeared for her in the Parliamentary inquiry appear before her on behalf of their own clients? How can you expect her to be impartial when all those lawyers who chanted “jeyawewa” and sent her off to the Parliamentary inquiry appear before her in the Supreme Court on behalf of their clients?

    If she has not done anything wrong why is she seeking the blessings of the Maha Sangha and the Catholic bishops? Rightly speaking she should have stood down as Chief Justice from the moment the impeachment motion was filed by the MPs and taken leave. Standing down does not mean resigning from her position as Chief Justice. In the Australian Federal Parliament, Speaker Slipper recently stood down as Speaker when a court case was filed against him alleging sexual misconduct. He eventually resigned when the media exposed his vulgar statements disrespectful of women.

    The charges against her are not without foundation. As rightly pointed out by Professor Vitharane, she removed a sitting Supreme Court judge from continuing to hear the case against a company with which she had personal dealings. She had withdrawn all monies from bank accounts only a day before the deadline for the declaration of her assets. The law required her to declare all bank account details, including details of dormant accounts. She is alleged to have had several bank accounts. What was the need for a Chief Justice to maintain so many bank accounts?

    Shirani Bandaranaike by her own conduct has brought disrepute to the entire Sri Lankan judiciary. In the past we have never witnessed judges and lawyers saying “Jeyawewa” to a Chief Justice like party faithfuls in political rallies. She has done irreparable damage to the image of the Sri Lankan judiciary. The impeachment motion was made personally against her. What was the need for her to convene a conference of all the judges in Colombo disrupting all the court works in the country when the issues she tried to explain to the judges had nothing to do with the judiciary? For this alone she can be removed as Chief Justice.

    For saying these I do know that may readers will call me an MR stooge which I am not. I have my own criticisms about the way he is running the country. What I am more worried is the conduct of many judges and lawyers of this country. Never before I had seen such a divide among the lawyers and judges. A single impeachment motion against a judge of the Supreme Court does not mean that the government is trying to subjugate the whole judiciary to its dictats. I personally believe a career judge would have not suffered the same fate. Shirani Bandaranaike was not a practising lawyer or a career judge. She was an academic parachuted in to occupy a position in Sri Lanka’s highest judiciary because she happened to be the favourite student of a law professor turned politician.

      It is the UNP that demand to impeach Shirani Bandaranayake first and then it is the JVP. It is the JVP that complained against CJ’s husband to the bribery commission. However, when the government started acting against her and her husband at long lst, all those opposed her have become her strongest backers. Soon, all that were against the government have lined up with the CJ. She has become their idol. From the way she and her backers behaved since, it was obvious that the entire drama is stage managed by interested parties.

      So, this impeachment has nothing to do with saving democracy or stopping dictatorship or saving judicial freedom. We were not loosing any of it anyway. It was only an inducement to gullible by interested parties. For one thing, Shirani Bandaranayake has become a political animal. So, one could conclude that this impeachment started with politics and will end with politics.

      This CJ has no sense or objectivity. Mark my word. The President will fire her after the parliament vote. But still she will not vacate her room. So, she will be locked out of her office. And she will be gone with the wind in a disgraceful manner. Those who think she will make a political mileage for them will be lost just like when they tried it with SF.

    The core of your comment bothers me. Is she to be damned if she does and if she does not- an instance of double jeopardy? To clarify,

    1. Has the CJ the right defend herself?
    2. Has the CJ the right to the best defence lawyers available?
    3 . Does being a judge imply that she is the best lawyer?
    4. Does the fact that she has hired lawyers to defend herself, deny her the right to continue as CJ?
    5. Does a judge lose his/ her objectivity because he/she has been defended and supported by the legal fraternity?
    6. A judge through training and experience has to develop a high sense of objectivity. Do you think the CJ lacks such objectivity.
    7. How can you pre- judge her future objectivity?
    8 Is she not liable to be impeached under proper procedures and laws, if there is a demonstrated failure in her future objectivity ?

      The gist of what Naga trying to say is that the CJ should have distanced herself away from the position of CJ and fought her case.
      Instead she chose to runway with a blame game. May be her blaming is justified but running away is no way to clear one self from any accusation,if one actually believes his/her innocence. No matter how skewed the process is.

    Okay Prof. the President appointed Kariyawasam at the request of the CJ as he did not want to displease her. But did not the President know that this man was removed from the Chairmanship of the Insurance Corporation on allegation of improper share purchase deals? Then whose fault it is? What has the Prof. got to say about this? Are these people thinking that the people in Sri Lanka, although quite a number of them are stupid, that each and everyone is so and is gullible to false excuses.

    Vitarana gives wishy-washy answers to difficult questions raised by the interviewer. The president is a numbskull to appoint an unqualified man to the position of chairman of the NSB. Mahinda Rajapaksa should be impeached for dereliction of duty! Vitarana’s answer to the question about Rajapaksa’s role as HR advocate in the eighties and the opposition voices against the HR violations of Rajapaksa is mind boggling. Vitarana’s defence of Mahinda is nothing short of shameless arselicking. When we have people like Vitarana in parliament we have no hope of saving the country from becoming a failed state.

    The once relevant LSSP has to be rescued from the ageing leadership of men like Prof. Tissa Vitharna and Vasudeva N – both seduced by opportunism and the comforts of ministerial office. In fairness to Vitharna, it must be said he tried his best to bring unity and peace through what the Big Boss turned into that wasteful exercise of the APC. Looks like the affable lawyer Batty Weerakoon, who also was in the Cabinet, has thrown in the towel. The next in line has some formidable men like Jayantha Wickremaratne, Prof Vijayan Kumar and
    comrades. They will have to do much work to attract Varsity Dons,
    students, the intelligentia and trade unions – now in the clutches of neo-fascists – to rebuild the LSSP to the nearest possible levels of its heights in the 1950s.
