The Sri Lankan government’s attempt to invoke archaic laws against UNP Matara District MP Mangala Samaraweera in a bid to take political revenge against him, says the United Womens’ Front (UWF)

Issuing a statement today the president of the UWF, Diana Gamage says; Attempts by the Commonwealth Chairman led government to invoke archaic Victorian laws of the Sri Lankan penal code on the lesbian, gay, bisexual, and transgender (LGBT) community is a direct violation of the Commonwealth charter.
She says; “The country is in need of an era that preserves good governance and democracy while being rid of inhumane archaic laws, and that this is the expectation of multi national, multi religious and LGBT masses.
“That the government is attempting to invoke archaic laws against UNP Matara District MP Mangala Samaraweera in ab id to take political revenge against him, the press release says, adding that the government is also preparing to unleash a wave of suppression over the LGBT community in Sri Lanka through this action.
“Attempts to unleash the law against MP Mangala Samaraweera over his personal life is being done by bringing back outdated morality laws of the Victorian era. It has been a while since these laws were abolished even in England, which is their birthplace. However, they are being unearthed by the current regime and their affiliates.
“At the present, the LGBT community of Sri Lanka are pressurized by the section 356A of the Sri Lankan penal code
“As a country which not only is a Commonwealth member but also holds the collective’s Chair post, we would like to remind President Mahinda Rajapaksa that these archaic laws are a direct violation of the Commonwealth Charter”

This is a purely technical comment on the claim that invoking laws against homosexuality is a violation of the Commonwealth Charter. This claim can be contested.
The Charter says: “We are implacably opposed to all forms of discrimination, whether rooted in gender, race, colour, creed, political belief or other grounds.”
The Huffington Post (March 10, 2013) says “specific reference to ‘gays and lesbians’ was omitted in deference to Commonwealth countries with draconian anti-gay laws.”
It seems to me therefore that the charter never intended to prohibit laws against homosexuality.
While I personally find homosexuality abhorrent, I see no justification for witch hunts in a society that countenances heterosexual affairs, child sex tourism etc. The case against Managala Samaraweera is clearly a vindictive indulgence by a government that engages in murder and disappearances, illicit sex by a minister in his government office with the wife storming in past security guards who tried to stop her, etc. while finding fault with homosexuality.

When it comes to non-consensual sex or rape, it can happen in any relationship: premarital or marital, hetero or homosexual (both gay and lesbian), arranged or love marriage.

The issue as hand is not if Mangala pokes himself anywhere. It is the principle of privacy. The suspect/victim in this episode is a married man, whose wife has confirmed the relationship he had with Mangala. I live in London and work for NHS for over 10 year. I admire the courage and the pragmatic thinking of the far sighted British government to abolish these draconian laws well before the rest of the world noted.
In Sri Lanka in the past accepted the gay relationships as part of the culture and even now you could found the sculptures in Panduwas Nuwara Museum. Once the Colonial over run the island they spread the religious intolerance as well as the in tolerance to the sexual preferences. In the Buddhist culture we always practice live and let live not the might is right as the modern democracy! When our ancient kings inter married Tamil queens we had temple converted in the shared religious worship places not you were told. Sri Lankan women were treated much better than any were else in the world several centuries before. Men and women had the power to make decisions for them self. Men left for meditation, Women got divorce. Mature girls had experience premarital sex and there were no concern of virginity as it was imposed after the Victorian era.
Relationship between two grown up individual should be respected and the love should be appreciated. It is the most beautiful thing in the world. Buddhist monks should lead the way paving the way of love, kindness and compassion. I wonder the Catholics who is always vigilant and cry out for every cotton picking thing silence on this important issue!

Even the name Sri Lanka is an Indian name. We do not need this. Ceylon is preferable. The original Yakka, Naga and Veddah languages and religion must be made state religions, even if in a symbolic way.
