Chief Justice Is Sacked

By Colombo Telegraph – 

Sri Lanka’s President Mahinda Rajapaksa today sacked Chief Justice Dr. Shirani Bandaranayake. Lawyers of Dr. Bandaranayake acknowledged receipt of the removal letter sent by the President this morning and said the letter is dated January 12, 2012.

              Else, I cant see any other ways to figure out why as over 65year old could come with this kind of statements.       Sirisena Yatawara, thanks a lot for letting us know that people like you still exist. The impeachment did not follow any rule of law. The courts had judged that this process was unconstitutional. The courts also recommended the parliament to pass new laws to make it a proper impeachment. The parliament neglecting such legal interpretations of the constitution went ahead with their arrogance. That is not RULE OF LAW my friend. That is rule of the likes of the Robert Mugabe and Idi Amin. Your “PARALLEL centers in state power” explains how state media has brainwashed you guys. The fact that the Executive, the Parliament, and the Judiciary should run independently and in parallel is an age old concept accepted to be in the best interest of the people. The likes of Robert Mugabe, Idi Amin, and Mahinda Rajapakse care more about their family and close friends than the people. This is a proven fact. Look at the growth of the per capita income level and the commensurate growth of the Gini Coefficient in Sri Lanka. You would see that the wealth now increasingly gathers around a niche group closely known to the president. To give you one corrupt example, how did Basil Rajapakse get more than 20% shares in Mico Car Company? Did he invest any money? No. Those shares were given as a bribe. Then Basil ordered all Government Institutes to buy Micro Cars. This is more or less the Suhartho Family approach that led to the collapse of Indonesia, because businesses cannot grow with such corrupt business models. This situation will worsen with the Divi Naguma act, which the Chief Justice held to be unconstitutional. Rajapakses are now immune from normal fiscal laws. They will bribe underworld thugs in the name of giving micro-loans, and nobody who does not offer party favors will get any loans. Already the Samurdhi officers are enslaved for political purposes. The Divi Naguma Department will be a true PARALLEL STATE CENTER that runs against the constitution, if you truly care to worry about. I am sure people like you will be OK with it. So, a parallel independent judiciary is needed to protect the people of Sri Lanka from this greedy and corrupt family and friends like you. Rajapakses started to hate the CJ after she made recommendations to revise the Divi Naguma bill to be a more PEOPLES’ friendly one. So, with the greed of people like you around Rajapakses, the normal people must get courage to peacefully overthrow the Government. They cannot expect any good coming out in the future.

    The question is not who is supreme. What happened here was that a power drunk government sacked a judge just because she did not play ball with them. We all know this government, and also almost all the politicians in this country ( which includes that abomination Ranil) have no moral right to accuse another of misdoings. By this act we have shown the entire world what a barbaric and uncouth race we are.
    Mahinda, crude, uneducated, lying and pretentious is the leader we deserve. Ranil is worse that mahinda in every way

    This is a very bad message given to all citizens of this country by its president. If the Chief Justice is removed from the post despite the supreme court order not to proceed with the PSC can a ordinary citizen have any hope in future? Where can he go as a last resort? Are we to appeal to the parliament?

    I think Sirisena and Dushy is wrong. When the SC has ordered that the PSC is unconstitutional and the proceedings are not meeting the Articles of the Constitution, if the CJ leaves her post because Mahinda as a Bull in a China shop wanted to smash the whole country then it may make a big problem. I listned to MP Sumathithran’s speech, during the debate and he provided all the ammunitions for the UNHRC to take Sri Lanka to what ever place they need to take the country. The joker MP’s provided the back ground music. Sri Lanka is not in isolation to do what Rajapaksa and his brothers want to do. Our Country is watched by others and in this hi-tech world any information will be around the world in few seconds. If in March UNHRC revive goes bad for Sri Lanka, CHOGAM will be full-out from Sri Lanka.
    If President Rajapaksa wanted to impeach CJ, he should have done it in a proper and in a leagl manner as the answer is yes or no from the inquiry, he can still impeach her. Now he created a mess and he may satisfy the locals but the IC will be going to look at this in a differnet manner. The Sinhal saying “Hadisiyata Koraskateth Thatha Danna Bariya” is proved correct by Mahinda Rajapaksa.

    justice and relief. They ended up gobbled by the very saint to whom they prayed for succour. How valid is the argument of the learned counsel the Residencies were de-linked from the SC order not to dispose of any GKCC properties. Often evidence in our land can be manipulated and the chances are more when the sum is near astronomical.
    But the good news is GKCCC depositors may get their 3rd instalment of Rs.200,000 soon – courtesy Basil, Thilanga and Big Boss himself.

    And the plucky Rajapakses win one more battle. Is it real or pyrrhic is a question only the future and unfolding events will reveal. Meanwhile, let us watch Cricket, luverly Cricket – played by the greying, balding, ra-bada Champs of 1996 – some in The House, others outside, one Dancing in Bollywood as well while the rest swimming in
    filthy lucre. As Dickens would say it is also the best of times for some.

    As to The Royal Family – they get ready for the next battle in Geneva.

      In spite of ex CJ was found guilty for failing to declare details of 20 bank accounts and for purchasing a property and then taking control of cases involving the company that sold the property to her and also for having a conflict of interest because she as the CJ had supervisory powers over judges in a bribery charge against her husband among twelve other thing she was accused of.

      Now you ugath modayas want her to be ‘…the CJ of this country as long as she wants to remain in that position….’ I can’t imagine how much muck in your head and hate baggage you carry not to understand that Shirani B is deeply involved in a regime change through a judicial coup. We are happy she is gone with her national and international conspirators for obvious reasons. We know that they have tried it before with SF but abandoned him when he is of no use.

      We patriots feel jubilant and at peace because all those conspirators and bustards that backed her failed to make this country an Egypt leave out a Syria.

    The president has violated the constitution he has vowed to uphold. According to the constitution the Supreme court will interpret the constitution. Now the president is ignoring the supreme court.
    What can you expect of a man who is occupying both the Presidents house as well as Temple Trees which was allocated for the Prime Minister.He takes over every thing. This President by his low cunning has brought a stink to these houses. We must now pass a resolution that whichever house he has occupied is not fit hereafter for a President or Prime Minister.Both the Presidents house and Temple tress must be made public offices as they are not fit for human habitation anymore

    It is sad that President Rajapakse, demonstrated his sheer ignorance and greediness of absolute power over all organs of government, (impotent legislate already under him and he is determined to have the Judiciary as well). He simply refused all advises given in the interest of the country by all learned people and simply showed his egotism and lack of knowledge of all norms of the governance. Rajapakse knows the whole process adopted to dismiss the CJ was absolutely unlawful and his actions effectively made Sri Lanka a ‘failed state’ in the eyes of the international community. Yet, his sheer greed for power ruled over everything and displayed the extent of his blindness for absolute power. It is sad that he had failed to realise that all this time he was somewhat safe under the majority Sinhalese which is no more there. This man’s future is in real peril now as he had given a golden opportunity to the international community to round him up with his brother Gotabaya for war crimes and crimes against humanity against ethnic groups of Sri Lanka, which would be backed by all right thinking Sri Lankans belongs to all communities.

    It is very sad end.CJ’s is educated lady but as a CJ she should follow tradition of Judiciary.ethics.etc.Still Bar is control by politically motivated NGo control Lawyers.Some of them are depending on NGO instructions.Take a video’s a news papers,web and other media tools there is some thing going on this whole episode.Government is completely wrong procedure and behavior aspect.Any government not tolerate always ,adverse behavior from judges.We cannot work according to the rules every time.Some controversial judgements of given by the SC is responsible for whole episode.one is 5000 extra University Student places to re-enter universities of Sri Lanka.I cannot understand how the hell they are going to afford from their budget.( more loans)No Room,No lectures,over overcrowded etc.Two side of this story.Any sensible person should understand this.S.C. may be correct?Finally what has happened they cannot work together.Any one can understand reality.no point of lamenting for this now.UNP,JVP,Sarath Fonseka and NSSP all of them dance according to the tune.Bar Association even control by ,now politically motivated few lawyers,NGo henchmen.they have done their part very well.Poor Shirani (former CJ) not realized this until now.

    This script had already been written over a month ago when the decision to set up a PSC after the signatures were taken. So no surprises!

    We must now allow the Govt. to literally fall into the trap of their own making, like the trap gun that the hunter sets, to which he will be the victim.

    All we do is watch this act play out with some trepidation lest the fall out will affect the citizens of the Country more than the creators of the mess, (those who are running the Country today)

    Let us hope this act of sheer lunacy is apparent to our populace, because only then will we be able to replace them democractically. It is to that end that all efforts should now be directed.

    Government labels everybody who criticizes its undemocratic actions as LTTE sympathizers or members of NGOs or INGOs.The main reason as I understand is to fool people and be in power as long as possible. Removing CJ is only a small part of their programme.     The Divineguma Bill was deemed to be inconsistent with the constitution unless approved by all provincial councils,by a Panel of the Supreme court including the Chief Justice.
    But only the CJ was targeted for scrutiny of her private finances by the PSC,and now removed by the President after impeachment by parliament.
    But, why were the other members of the Panel not similarly examined by the PSC?

    There are moment in history of world when PEOPLE all over the five continental seem to rise up, that something SYSTEM is wrong,TO DEMAND FOR CHANGE.That was NOT happened in Indepedence Judiciary -Sri lankan under the ex-CJ leadership.Capitalism run by central command OF CAPITAL of all forces under ONE CENTER theory OF STATE BY CERTRL TOOL OF Executive power of MODERAN STATE.If power blance are change by Judiciary,needed to address by State to correct imblance using tool of Parlimentry Sovergenity. Imbalnce of power not suited to even Parilmenrty democracy at all.What MR did in simple term is correct the IMBLANBCE-that is not dictatorship.
    Ours nation are lack of ELITE politicians, there are FEW of them in Parliment.Members of Parlimentry 225 additional to PC are more.They are not poitical elites,obviously elecated handpick members by the Party,voted by people according rule of political game changes of Power and Positions.
    Last couple of years certain verdict of Judiciary NEW ruling has concenration more power in hand of court of Law or Judges ;into certain level anomalous in between power of Judiciary and Parlimentry & President power; that power Judiciary exceed beyond President and Parlimentry power as well.That created many centers in STATE without knowing to the Politiacl class and political Parties. That is how concept of Independenc of Judiciary came into being in RULE Of LAW within legal system in island.Nobody identify such negative trend in apperance,due busy on fast track of route going behind eraning paper currancy to become RICH within short period Parilimenarty tenure.
    On the other hand since end of 1960 -or begnging of 1970 proseasse of youth insurgencies had undermine Major Politiacl calss and parties until 2009 may.Nation run by dual form of Insurgensies one-in south by JVP and other North by LTTE,both cases has totally distrubed social and legal order incuding Judiciary.Result of such political and social upheavals was the products of legal disorder in Judiciary.This has not been address by regime in power.
    My problem is not yet over after appointant of NEW CJ. Why new social CLASSES deamding and ASK FOR CHANGE THE OLD ORDER OF DEMOCRACY OF LESS-developed, WEAK AND BACKWARD capiatlism could trun into NEW ERA OF DEMOCRACTIC CAPITALISM.
    Ours legal system has to change accrodingly.New appoinment of CJ will be impair and temporization of ongoing crisis Judiciary without immunological soluation.

    In the Democratic Socialist Republic of Sri Lanka, democracy is practised through club carrying thugs, socialism is for those in the helm of power in the Govt. to have control of all the available financial resources and enjoy use them for their benefits and the power given by the people through the ballot is abused to deprive the country of justice and freedom. Even though Mugabe has somewhat changed now and Ghaddafi and Hosni Mubarak ended up in disgraced for abusing power our rulers are following the arrogance that Mugabe has given up and the iron fist attitude of Ghaddafi and Mubarak which provoked the people to rise against them.
