CJ: People’s Judgement On Your Stand Against Tyrannical Regime Is Absolutely Inspiring

By Vishvamithra

Hon. CJ, just disregard the disgraceful disinformation campaign launched by the Rajapaksa corrupt regime. Simply concentrate your constitutional obligation to the people in a broader perspective i.e.  to respect and uphold the rule of law and the will of the people, that is being ridiculed and insulted by the Rajapaksa regime that effectively made Sri Lanka a FAILED STATE in the eyes of the international community. Informed individuals of this country are fully aware of the circumstances that led the impudent Rajapaksa regime to launch this impeachment process against you. Had you simply allowed the amendment to the CPC that permitted the police to keep the citizens who have been taken into custody for 48 hours in the cells, violating their civil liberties enshrined in the constitution. And if you hadn’t declared the Divineguma bill that provided one individual, Basil Rajapakse, enormous power and control over public finance of billions of rupees, surely then you would not faced this extremely serious situation, risking your own life.

At the same time, remember that people also are well aware of your weaknesses, like allowing the 18thamendment to the Constitution that gave sweeping powers to the Executive President. The irony is that you yourself became the first victim of your own failure and now entangled in the blunder you made.

Yet, the people of this country is prepared to pardon you because you are just another human are bound to make mistakes and at this crucial hour the people cannot think of any other strong individual with total integrity to uphold the office of the CJ and effectively discharge the role of the watchdog of the people.

Therefore, remember that you are not alone. The people have already sacrificed their own security and safety, assuring the protection of your interests. Hope that you had witnessed as to how the criminals employed by Rajapaksa regime mercilessly attacked Mr Thilak Kariyawasam, the President of the Environmental protection agency, who exercised his legitimate right and challenged the sham impeachment. The unfolding of recent events only portray the imminent and ominous end of the Rajapaksa era. The people would demand resignation of President Rajapaksa, his brother Gotabaya and the IGP and the impotent opposition leader, all of who had failed to discharge of their duties effectively as required by law. All these people have absolutely failed in their duty to uphold the rule of law by aiding and abetting criminals to silence the non-violent protest launched by the people against the regime that openly undermined the rule of law. And their conduct is utterly condemned by right-thinking people.

Watch the following video clip. This sump ups everything that qualifies Sri Lanka to be declared a FAILED LAWLESS STATE. This along is surely good enough to abandon the Commonwealth head of the state meeting scheduled in Colombo this year, which President Rajapaksa wittingly or unwittingly asking for.

    Its time for every Sri Lankan living in Sri Lanka and abroad to sign a petition to the Commonwealth against Sri Lankan Government re: the impeachment of CJ.

      Will someone with the know-how organize an electronic Petition to
      the Commonwealth from all Sri Lanka residents, with copy to the Queen –
      Patron of the Commonwealth, at the earliest.

        Time is up guys …. You guys always think that outsiders are our saviours … What a servile bankrupt mentality!
        Write and write … To all outsiders because there are not takers inside … there are some inside like NGO funded people … But, people of the country know them first hand … How could they forget their 30 years experience living with them? .. Many of insiders supported by NGO’s were of the opinion that the LTTE would never be defeated without giving into them. …. These blackcoats, educationalists, professors , doctors and people with few tags at the end of their names never directly oppose the terror the country went through … They let the terrorists to control the whole real estate of SL and to recruit children for slaughter … Now, they talk about democracy, human rights and corruption … Where were they when the country was at the brink of disaster? These western ‘educated’ professionals have no regards for the people or the country … They are just group of selfish egoistic pretenders who just want to project them as humanists and selfless donors ..
        Country is still under the threat from separatists …. More and more outsiders are trying to interfere in our affairs …. The inside do-gooders are trying to convert any problem in the country to a regime change project … They know that it would ultimately result in giving away the part of the country to elamists ….
        Vessantara at least gave his own children out .. These modern day Vessantharas are trying to give others children out to portray themselves as the best humanists world has ever encountered …

          To blame anyone who has a different view as supporters of NGO is wrong. Even if they are supporters of NGO’s what is wrong in supporting NGO’s, if they are trying to protect democracy. Can you tell me if the President has done one thing correct other than making roads and buildings? You are blinded by the controlled media publicity of the government. If you open your eyes and look a bit deeper you will see what is happening in Sri Lanka. Sri Lankans do not need NGO’s to tell us what to do, any educated, democratic person will know from the heart what is right and what is wrong.

            You are asking me “Can you tell me if the President has done one thing correct other than making roads and buildings?
            See how blind you are … The greatest one this country achieved for last few centuries is the complete clean elimination of LTTE terror thereby eliminating the division of the country for the first time … It was a mammoth task considering that all the powerful nations, NGOs, UN and many others were on the side of separatists … Without Mahinda and Gota, country is still bleeding or already two countries … One is Eeellaaam and other is Sri Lanka …
            Vast majority of people of this country understand that simple fact … Even though there is very small minority of people like you do not get it … Cheers!

      Mahinda deals with any ussue like a trye leader. He finished iff the unwinnable war.Don’t try to blame everything on Mahinda. When SF came out with the White Flag talk Mahinda had to take action. When CJ tried to do dodgy deals similarly Mahinda had to take action. Mahinda is the greatest son of SriLanka post independence . Now all you anti government donkeys move on! Everything is over now go and find another issue to blame Mahinda the merciful. There will never be a strong and a decisive government like this.

    yes, this kind of simple gestures from outside the legal fraternity is important for the main protagonist – CJ – as well as ordinary people like us to reassure each other that we are together. At this time, all the forces – thuggery, media and “honest” ( as they stay bought, instead of trying to deceive us not bought by money or something else) parliamentary main opposition, this is very much needed…however simplistic and naive it may appear…look forward to hear more of this..

    Some of the values and principles of the commonwealth reaffirmed at Port of Spain in 2009

    Democracy: reaffirming our belief in the inalienable right of the individual to participate by means of free and democratic political processes in shaping the society in which they live; underlining that not only governments but all political parties and civil society also have responsibilities in upholding and promoting democratic culture and practices as well as accountability to the public in this regard; and recognising that parliaments and representative local government and other forms of local governance, are essential elements in the exercise of democratic governance;

    Human rights: reaffirming our commitment to the Universal Declaration of Human Rights and human rights covenants and instruments; and recalling our belief that equality and respect for protection and promotion of civil, political, economic, social and cultural rights for all without discrimination on any grounds, including the right to development, are foundations of peaceful, just and stable societies, and that these rights are universal, indivisible, interdependent and interrelated and cannot be implemented selectively;

    Tolerance, respect and understanding: recognising that tolerance respect and understanding strengthen democracy and development; recognising also that respect for the dignity of all human beings is critical to promoting peace and prosperity;
    Separation of powers: recognising the importance of maintaining the integrity of the roles of the Executive, Legislature and Judiciary;

    Rule of law: reiterating that each country’s Legislature, Executive and Judiciary are the guarantors of the rule of law and emphasising that access to justice and an independent judiciary are fundamental to the rule of law, enhanced by effective, transparent, ethical and accountable governance;

    Freedom of expression: emphasising that peaceful, open dialogue and the free flow of information, including through a free, vibrant and professional media, enhance democratic traditions and strengthen democratic processes;

    7. We reaffirm our full support for the Good Offices role of the Secretary-General in supporting adherence to Commonwealth principles; in conflict prevention and resolution; and as an instrument to protect and promote the Commonwealth’s fundamental values.

    10. We underscore the importance of coherence in order to protect the Commonwealth’s image and credibility. We urge all Commonwealth organisations to subscribe and adhere to Commonwealth values and principles in every possible way, including by acting in conformity with the letter and spirit of the decisions of CMAG..

    It is clear that now the govt has violated several of these principles and has effectively stepped outside the pale of the commonwealth. So is there any point in having the CHOG meeting here or appointing the biggest culprit MR as head of the CHOG for the next term.

    A very good article by Vishvamithra.

    All the events unfold during this impeachment period against the CJ are clear indications that SL is a CRIMINAL STATE, ROGUE STATE, UNCIVILISED AND BARBARIC STATE, TRIBAL SOCIETY AND ULTIMATELY A FAILED STATE.

    Vishwamithra, So you want Ranil also to resign! Eh! What wrong did he commit? Did he tramp on your foot? This is your government, isn’t it? You casted your vote for it, didn’t you? You ate kiribath, lighted fire crackers when MR won election after election, didn’t ya? He was your proud father, the prince Diyasena for whom your daughter sang a lullaby, wasn’t he? So then what the heck Ranil has got to do with your choice? Haaa? Are you getting mad or something? Walk down the park and ask these buggers whom they voted for; they will all say, “monawa unath yudde iwara kalane, Ae hinda apith dunna thamai, Aeth dan thamai ape waradda therenne!!!” meaning whatever happened we voted him in because he finished the war but now it is too late when realizing our mistake!

      Ranil is the one who pressed President to impeach the CJ, this was told by the President and Ranil never countered it, so it stands. He did not allow, even the UNP members who wanted to appear before the courts when the notice was issued. During the parliamentary debate, Ranil never opened his mouth. He did not take part in the protest march organized by the lawyers. He was unable to generate a large protest march which would have threatened the present government. So all in all Ranil is a member of the ruling party, only problem is he is sitting on the opposite side of the isle. So Ranil has to go. By the way I did not vote for UPFA.

        Lankika,

        “Ranil is the one who pressed President to impeach the CJ,..”

        So what’s up? Hah!! Your above claim answers all the allegations all of you level against Ranil! Still don’t get it???

        You can’t impeach someone if that someone hasn’t done any wrong nor can Ranil demand and press for it in parliament had there been no justifiable reason for it! This negates your conviction that CJ is an angel. It also answers why Ranil prevented others of his party from attending the courts on that particular day because it is Ranil and UNP who wanted CJ impeached over the her husband’s aiding and abetting with corruption and when you are the plaintiff in a court of law you don’t go for the rescue of the defense! I am surprised all these people are making a huge big bang theory over a simple matter such as this. This wonderful statement of yours answers your other allegation that Ranil is actually on the government side though sat in the UNP isle because then why the heck did he dragged this impeachment sage into play and jeopardized the whole Wonder of Asia utopian dream of Rajapaksha? He could have smoothly and nicely glided and cruised along enjoying further perks and privileges as Tiran Hullus had alleged few weeks back! Mr. Lankika, you are a wonderful innovator! Keep the above statement in a safe place to show to your grandchildren as trophy for brilliance since I continue to find further veins of gems in it such as when you say “I did not vote for UPFA” yet try to defend UPFA by scathing Ranil for concocting this horrible blunder for MR and not assisting him to settle this terminal mistake!!!! Didn’t you just for a fleeting moment think that solving this problem would enable MR to continue his merry making and corruptible regime further into the future whereas misleading him to jeopardy would fast track his end?

    TO WIN THE SECOND BATTLE AND TO PROTECT HER LADYSHIP, A STRONG SOLIDARITY MOVEMENT HAS TO BE BUILT UP NATIONALLY AND INTERNATIONALLY. THE DAY SHE WINS THIS BATTLE IS THE DAY THE GOVERNMENT BEGINS ITS DOWNFALL.IF SHE LOSES THIS BATTLE, THE NEXT PRESIDENTIAL ELECTION TOO WILL BE WON BY HIS EXCELLENCY MR AND PERHAPS HIS SON WILL BE APPOINTED AS THE PM

    Like the writer says, it is now not important what monumental mistakes CJ did earlier in regard to 18th amendments and other things. What is now important is that she is the only person standing up to the impeachable President (after signing the illegal order to sack CJ). She is the only person who can save the independent Judicial at this time. If Bar association, Lawyers collective and UNP doesn’t unite to fight and reject the illegal new CJ, Sri Lanka can forget about of Rule of Law. You already see the implication of a country without Rule of Law at Killinochchi MP’s office, discovery of explosive and porn material. Government and Arm Forces can set-up anything against anybody whom they don’t like. If Mohan Peris become the new CJ, no justice for Killinochchi MP who may be innocent. And, you will be next.

    These appalling video shows how Sri Lanka has descended into lawlessness and anarchy nearly four years after the end of the 30 year war. With any other intelligent and truly patriotic leader the country would have been well on its way to becoming a truly democratic and prosperous nation.

    The people who tolerated the excesses of the Rajapaksa brothers should kick themselves in their arses. The regime’s only aim appears to be to make the Rajapaksa family and their hangers on powerful and prosperous at a severe cost to the welfare of the people and the name of the country.

    If madam CJ Shirani Bandaranayake Gives up her post, It will be a slap on Democracy, Justice,Independence and Freedom on all of us Sri Lankans.

    Therefore it is the duty of all Citizens, Lawyers, Judges, Judiciary, Clergy and the Trade unions to PROTECT HER.

    Upto now Madam CJ has stood against Tyranny and should continue to do so.

    President already is a Spent force and International Community has made him a Pariah state . Also he is loosing ground both in Intellectual,Educated, Clergy,Opposition and Peasant communities.

    At the moment President and his Brothers follow the China Doctrine.
    After accumulatiung closer to One Billion US Dollars from the Sri Lankan society and from Illicit business deals, Rajapakse Family was looking for ways to hide this loot, and China came as a Guardian Angel and a golden opportunity.

    Kicking out CJ and guiding University Leadership (Military) training, Military training for Tamil women, military personnel teaching in Nothern schools,Military suites for school heads, white van goons, recent using Govt.marauders to intimidate CJ Bar Association lawyers and supporters who were protesting against impeachment were all are acts similar to China Tinemen Square Massacre and intimidation tactics,……and having fake meetings with huge publicity, displays of MARA Family Cutouts, posters, foundation stones Laid all over country with much Funfare are all part of the China Panda…and…China Dragon Game play to deceive public.

    There is no doubt that there is a clear genetic disorder in the Rajapakse Family….where some of the siblings looks Malay/ Muslim features. May be a DNA teast could prove it.
    Please watch the following Videos:

    http://www.youtube.com/watch?v=sTqO3jshilw
    http://www.youtube.com/watch?v=zOz8P_iMPtI

    This is all MARA family did by importing Mercedes Benz, BMW’s and Lamborginis brought to give to His Family Members, Party Goons and Buddhist Clergy and Preletes to Lure their support for MARA Family Dynasty with our poor innocent Children and women sent to Middle East to earn Foreign Exchange for his pleasure.

    70% of people still live below POVERTY LINE AND MOST OF THEM LIVE IN HOUSES SIMILAR TO VEDDHA (NATIVE) COMMUNITY LIVE……60 YEARS AFTER INDEPENDENCE.

    Be your own Judge.

    HELP OUR CJ TO STAY IN HER POSITION FOR OUR GOOD…..AND IMPEACH MARA FOR ROBBING TSUNAMI POOR PEOPLES MONEY DONATED BY INTERNATIONAL COMMUNITY.

    Thank You.

    It was shameful to watch the way the lawyers delegation listened to a lecture by the half educated thuggish president. He thundered that the dignity of the courts should be maintained.He said that his government will not tolerate “the chit” days when JVP closed such institutions by sending a note through a young boy. Those who know mahinda well will recall the days when mahinda wwas involved in every kind of sabotage and protest aginst the unp government,and when chandrika was in power he carried tales to the opposition.

    Now that he is in power with his nazi brother Gota making the armed forces in to private armies,mahinda is taking a new line. The former streetfighter is now the law and order man.
    Why didnt the lawyers ask the president what the State media said about the judges and the lawyers ? Why didnt they ask the president about the sit-in protest in front of the Chief Justices house supposedly about a case that she had heard ? Can a judiciary function like this ? What about the mob in front of thr parliament howling about soverignity ? Is this how the future parliaments will work , with a mob in the front lawn ? The rajapakses who are a very cheap bunch of people have dragged 20 million sri lankans into the same kind stinking hell hole that they come from. In their world every thing is deceipt, lies, violence and corruption.Just look at the faces of mahinda, basil and gota ?Will any one consider them decent gentlemen ?

    Why does the bar association permit a man like that threaten and intimidate a whole culture of legality and decency ? Are we a race that will sacrifice anything for a buriyani from a man who does not have to even pay for it ?

    Lawyers either fight now or become stinking lying hypocrites like rajapakses yourselves !

    The Parliament’s decision on the Chief Justice and the Presedents signing off the “Order for her removal dealt a severe blow to the insidious forces who used her as a cat’s paw to destabilise the government’s progressive march to uplift the rural masses” Quote..Chief Justice was behaving like a politician and her conduct was sufficient to disqualify her from the post of Chief Justice even if one does not take into account the charges against her. Now the antigovernment forces and traitors to the Motherkand will have to find another issue to keep them going as CJ’ and SF have been destined to the dustbins of history. One must not forget that these same forces once said that SF is not even fit to be a Captain in the Salvation Army and also said the the CJ’ should be reported to the Bribary Commissioner. Now can anyone guess what these dark forces will try next ? The country should forever be grateful to Mahinda for saving Sri Lanka from terrorism when the previous government was ready to hand over half the country to terrorists.

    The removal of the CJ is not something new in the world, it happens in the world, including in the United States. However, some eliments may use this opportunity to bring chaos into the country, in order to achieve their ulterior motives. Remember, few eliments were fuelling the civil war and benefited by the war, but not the Tamils or Sinhalese. We must not let that happen again. The president appointed the CJ, now the 2/3 of the parliament wants her to leave the office. If I was the CJ, I would have resigned once the parliament decided to remove me from the office. Taking this matter to the UN is not advisable. Even the CJ is blameless she must let go for sake of the country. The country has been fighting for thirty years, people are free from fighting for only three years. Just wait for few more years, be patient, you all went through the bloody war for thirty years for nothing. I know very well about the parliament members, can we change those leaders mindset overnight? No we can’t. I am also well aware how Rajapaksa brothers are dominating the country, but I can live with that at the moment. We just finished the war, lets give enough guidance and time for them to act, if things does not change then we have a plan for them too. The President himself did not go to China to eliminate the LTTE, but he was adviced to go China so the other countries will run to him to help, including India. The extremely talented Sri Lankans will direct the country into the right path. If you think, the show is running by Rajapaksa brothers then you are very wrong.

    Lets examine the external threats for the country. The Indian government created the Tamil armed groups to keep Sri Lanka under its wings. However, India also understood that letting the Tamil armed groups grow beyond its control would be detrimental to India. This is the reason Prime Minister Rajiv Gandhi reached a very good political solution for the Tamils’ issues in Sri Lanka under the Indo-Sri Lanka agreement. Unfortunately the LTTE did not see what Rajiv Gandhi did, because of the Tamil diaspora. The 2002 ceasefire agreement between the LTTE and the Sri Lankan government also broken by the LTTE. A reasonable political minded person knows that Prabhakaran would not have fought against the Indian government without the help of the Westerners through diaspora. And also Prabhakaran would not have broken the 2002 ceasefire agreement with the Sri Lankan government without the help of the Westerners who pushed him to fight against India. If you can answer the following questions you will know who have most of the Tamils’ and Sinhalese’s blood on their hands. Who have been deliberately stopping the peace agreements? Who have been guiding the diaspora? Who have been fuelling “hate and bitterness” among the Tamils and Sinhalese? Who have been facilitating the funding to the LTTE, even though they had everything within their reach to stop money get transferred from the diaspora to the LTTE. The answer is Western political minds through their intelligence network.

    President MR does not have an answer for everything, but he has the ability to deal with the external threats better than any other leader. Therefore, Lets approach matters very pragmatically for sake of the innocent people who have died due to the bloody war. It is a new beginning for the CJ. The Chief Justice Shirani Bandaranayake has a huge potential. She has a lot to give for the country. She must get involved in politics and bring new ideas to the table. Lets people decide whether she is worthy or not. She must not go to the UN, but go to her people and put her ideas forward, in order to develop the country. She must not go to the enemies who divide others, invade others’ countries and kill millions of people to keep themselves on top. Do not go to the devil to get justice. I urge every Lankan to stop listening to the enemies who divide us, they use every opportunity to bring chaos into the developing countries to rule others. We must understand what is missing, then find a solution within us, looking outside will create more problem and chaos than a solution.

    The Westerners ruled and ripped off the Indian Subcontinent for more than 440 years, but they never done anything to eliminate the caste systems, gender inequality, and racial, language and religious discriminations. Because they knew it will continue to eat the Indian Subcontinent and keep the Asians under the West forever. Four hundred years is very long time, at least 10-12 generations. The West could have done a lot, but they deliberately done little. The Westerners have a lot to talk about the Indian Subcontinent’s failure than China’s communism, but they won’t talk about it, because it will highlight their deliberate misleading to keep the Asians under them, plus the Indian Subcontinent is not a threat to their dominant power, but China. “English are to blame for India’s backwardness” published by the Dominion Post, written by Philip Collins, on page B5, Dated January 5, 2013. The Dominion Post is one of the major newspapers in New Zealand. Not all the Westerners are naive or blind, there are people like Philip Collins who sees the Westerners’ evil side. The Indian Subcontinent has enough intellectuals to develop the Subcontinent better than China, but the system won’t allow the intellectuals to lead. Therefore, the intellectuals leave the Subcontinent and develop the Western Countries. This system was developed by the Westerners, in order to keep the Indian Subcontinent poor and weak.

    We fought against the Westerners to have our freedom, but we still trust them, listen to them and run our political system according to them. This is a huge disaster. The Indians are too scared to change the manufacturing sector, because they don’t want to allow another East India Company. However, they are happy to run a political system recommended by the Westerners. The Chinese are really smart, because they have a political system what is good for them, they did not choose a political system recommended by their enemies. We must stop listening and trusting our enemies. We must develop a system according to our culture and ideology, like the Chinese did, otherwise the Indian Subcontinent will be struggling forever. We must depart from the old system and bring some changes. Being part of the Commonwealth is only helping us to stay behind. Time for us to move forward, our policies are not helping the Indian Subcontinent to move forward as China. Am I recommending a communist system? Not at all, but we need some changes, if we come up with something good, India may even consider our system in the future. We must find a way to lift the whole Indian Subcontinent. India can’t try something new, because it is too big. Sri Lanka is a small country, we must try something new and help the whole Indian Subcontinent, otherwise we will be betraying our future generations.

      Dear Peter,

      You are wrong in your analysis please dont muddy the water. Removing a CJ does happen in the world and is not new but it should be for the right reasons and there is something called a DUE PROCESS which is the cornerstone of a healthy democracy and sadly Sri Lanka has failed the test miserably. Why should the CJ take it lying down when she claims not to have done ny thing wrong. Your claim that some elements may try to use this opportunity to bring chaos in the country and whose fault is it. The fault lies fairy and squarly at the door of Temple Trees.CJ is no Jesus to show the other cheek and she is a Human Being and her livelyhood and honour is at stake and any right minded person will give his or her the whole hearted support.
      Turning to your other points the seeds of the current crisis were sewn soon after independance by the failure of the successive Sinhalse Government to solve the Ethnic issue along the Indian Model within a United Sri Lanka and had we done that we would have been the envy of the world but we miserably failed in that aspect.
      I am speaking as a person who lost three generations of my family due to violence unleashed on innocent Tamils during three race riots the first one in 1958 and I stiil grieve for them and they were not terrorists. The creation of the so called terrosits were the result of Sinhalese intransignce and this is something embedded in their gene and it is never going to change. I am sure you will vote for a Government if it says that they will make the whole of Sri Lanka into a Sinhala State and sadly that is the truth and I have no evidence to the contrary. We can only unite as two people with seperate indentity in terms of religion and language as created by God. I am not a racis as I have Sinhalese ( married to my cousin) , Muslim ( my aunt married to my uncle ) no of christians in my household and we live happily and share the values and these are individual happy stories but that is a personal choice. I must be able to protect my regligion and language which sadly I dont have at the moment.
      You need to learn a little bit of Economics and Politics before you embark on commenting about the Indian and chinese economic and Poltitical System which smaks in the face of reality.
      I agree with you in onething yes we must try something new which is repent for what you have done and right the wrong and move on but I am afraid that vast majority of your countrymen will not subscribe to this view so dream on buddy

    I was happy to read Bruno Umbato and Antany Peter and others in the forum. It is heartening. Sri Lanka is emerging as a great Country shedding its developing Status and the West is out to step on us. Few people understand this. It is the West that makes demands from us but gives less for development. Countries that had been really helping our development after terrorism like , China, Russia, Korea, Iran do not make demands or come to accuse us for violation of human rights. Canada for instance is violating the human rights of the aborigine Indians keeping them in reserves, but Canada is up in arms against us demanding the commonwealth Prime Ministers to boycott Sri Lanka and demanding the reinstatement of the CJ.

    Will our people understand that Sri Lanka has become politically respectable after the advent of Rajapakses in to the political scene ?
