CJ’s Writ Applications Will Be Supported Tomorrow Morning

The Writ Applications filed at the Court of Appeal by Chief Justice Shirani Bandaranayake will be supported before a three judge bench of the Court of Appeal at 10 a.m. tomorrow.

Chief Justice Bandaranayake has sought to quash the findings of the PSC Report that found her guilty on three charges and restrain any further action with regard to the findings.

President of the Court of Appeal S. Skandarajah and Justices Anil Gooneratne and A.W.A. Salaam will comprise the three judge bench to hear the application when it is taken up tomorrow. The Chief Justice’s petition will be supported by Romesh De Silva PC, and his team of lawyers, instructed by attorneys Neelakandan and Neelakandan.

    Glad she has money to burn. Nothing to do with the SC, PSC has acted in accordance with the constitution, a constitution that JR brought about. CJ’s Lawyers are going about proving that they are utterly useless at their job.
    How much has the country thank JR for? A war that lasted 30 years???
    We know where Danny boy and his pals are from, a place they know all to well, a mud hut.

      Sorry pal, you are showing your nakedness in public!!! If you fail to understand that this is about the governance structure (and not about individuals), you are either a lackey or a complete idiot (may be well intentioned, but still an idiot). Just so that you know, personally I believe the the current CJ (and in fact a few of the former CJs) should be in (people’s) jail, but the current issue (to me) is not about the current CJ, but rather about creating a monarchy under the current (may be even future) Presidents.

      I do not understand at all … How could these three judges hear a petition filed by their boss?
      Something wrong some where?
      Isn’t that the reason that the cases of impeachment of judges could only heard by the legislature which was elected by the people?
      Open support given to their boss by some judges would make this hearing a comic play … It is high time to fix this system and should be solved without delay … LTTE rumps and all the haters of SL are having a field day … They want to escalate this conflict into ‘regime change’ project … Judiciary in SL is like all other institutions in SL … Inefficient, corrupt and run by ego driven personalities … All the people know this … They know it first hand if they have dealt with it. The CJ’s public dealing with personalities recently is very very questionable .. It is a political circus wholly supported by the gang for ‘regime change’ ….
      People are supreme and hence country is supreme … Do not let the country drag into the darkness by pseudo supremes …

        A regime change is overdue and it should not be bad just because LTTE rums also want it. “the cases of impeachment of judges could only heard by the legislature which was elected by the people?” In this case it was heard by the government party that is exclusively designed to serve the present executive. In the light of unexpected protest to the unfair hearing and hurried report by the government MPs the president want to appoint a panel (in compliance with the constitution of people’s supremacy?)to get a second opinion.

        The ruling on the Divineguma Draft Bill by the SC is in accordance with the constitution and to replace the head of SC to get a friendly justice in order to get the desired ruling is against the spirit of natural justice and against the constitution. The council of members elected by NPC must give the approval to the Draft Bill and not the appointee of the president as they are one and the same.

Baduth Hamuduruvange ,Naduth Hamuduruwange.I can not understand Who is CJ.Chief of the judiciary?Court of Appeal and their judges not the same judiciary?Who is above.Parliament,Executive,or Judiciary.You expect impartial judgement from them OK.?Wait and see good or bad move.After our independence this type or jokers not come to the highest position in our country.Com-on Neelakanthan ,Are you ready to battle with the Sri Lankan Parliament.What ever said and done end is very sad for both parties.mark my words.Settle this matter amicably for god sake.you can not win this matter for ever.

    Medamulana Thug withdrew Chandana Kathriartchi’s murder case using that spineless Mohan Peiris when the case was in progress.
    Kudu Raja Mervin is above the law.
    WHERE IS RULE OF LAW
    May the Devas help now by getting rid of the Rajapakse Samagama now to get the country on the recovery path.

      CJ has the Backbone to fight against Medamulana doctrine.Persons without backbones are supporting budding dictator and his henchmen. Think of your country and next generation and come forward against this budding dictator and family rule. This is not the time for party politics.

    court of appeal is going to once again humiliate judiciary of sri lanka. cear decision in this regard has already been given by the speaker that the parliament is not to ready to accept any order from court. Under these circumstances their orders would be useless further eroding general public faith on judiciary. I am more than 100% sure CJ can not escape from this pathetic situation bcs sri lanka is not pakistan or a middle eastern country. Even if 80% of people go against a sri lankan government it would be very difficult to topple down a government by any other means except an election. So cj has to understand this bitter truth and get ready to face very sad situation that is going to happen after she is removed from the post at the beginning of next year. She would be hapless after next month. So this is a good lesson for people who run the judiciary. if they can give fair decisions at all the times with out giving into political pressure this would have not happened this way. But we know this CJ also gave many unfair decisions to appease political authority. Later this CJ wanted to go against government bcos of her husband. But she was too late in this case. Almost every body would forget her like what happened to fonseka. Now nobody care abt fonseka.

    cj should know the law of this country. Parliment is the supreme.cj is not above the law. How can she challange the PSC? Can’t she understand this simple truth?
