Hijab Case: “Issue Arose After New Appointment Of JBV Principal”; SC Observes

Justice Priyasath Depp today observed that the banning of the Muslim cultural dress at Janadipathi Balika Vidyalaya was subsequent to the new Principals appointments, after Provincial Council Authorities and the Principal undertook to permit the Muslim parent to enter the school in her cultural attire.

558-1women“This happened after the new Principal was appointed. Prior to this there was no issue” he observed.

When the case was taken up today before a bench comprising Justice Priyasath Depp, Justice Buwaneka Aluwihare and Justice Priyantha Jayawardena, the respondents said that they were willing to settle the issue by permitting the parent to enter the school in her cultural attire.

Earlier a parent of the Janadipathi Balika Vidyalaya in a Fundamental Rights application said that the Principal of the school had prevented her and thereafter abused her when she visited the school in her cultural attire.

Her attire includes a head scarf and gown.

The Petitioner alleged that the Principal violated her constitutional rights and was bringing the government into disrepute by her actions.

Sanjay Rajarathna DSG appeared for the state, Manohara De Silva appeared for the Principal, Tishya Weragoda appeared for the Provincial Council authorities while M.M Zuhair together with Hafeel Fareez and Charith Samaradiwakara appeared for the Petitioner.

      Thanks Aratai, I never looked at the picture carefully before. You noticed it. It is not Sri Lanka. It is definitely not Nawala Janapathi Balika and the people in the back ground are not Sri Lankans. Why does Colombo Telegraph do this.The Victory sign is not familiar in SL either.

    If you want to practice your religious traditions you have to send your child to particular religious school. In this way if Sinhala students wear national suit and girls wear lamasari, school could not implement particular uniform. Law should be applied according to the situation not because it mention in constitution.

    DO we have to redefine the meaning of the word “Uniform” for the sake of a minority? School Uniform is something that make all school children equal without prejudice. Uniform makes the schools look neat without differentiating the social status, cast creed or race.It should be respected. If it is not maintained, rich girls will start to wear designer clothes from USA and make a mockery of poor children who can’t afford them.

The top tier of education is also like that when you consider the Hirumburegama couple who are barely qualified occupying posts of UGC Chair and VC posts!! When the top is rotten what do you expect at the bottom? Sometimes there may be some branches that are still OK! When the CJ is corrupt you expect the judges to be the same?     Why you need Islamic uniform to Schools???? what’s the message you trying to give… If all of people make their uniforms according to religious manner how would be the mess??
    I saw station master at Ragama railway station wearing his Islamic uniform instead of station master’s uniform..

    before to Islamic lunatics Sri Lanka was a peaceful country
