Hooray For UNHRC: There Is No Constitutional Objection To The Resolution On Sri Lanka

Today, Thursday 6 October 2022, the UN Human Rights Council voted overwhelmingly for a resolution condemning Sri Lanka for its systematic rights violations: 20 for, 7 against. Besides the monitoring of war-time killings by our government and our army, assistance will be provided for efforts at gathering evidence for punishing economic crimes

After lying to the world for well over a decade, few countries are prepared to believe Sri Lanka’s promises about punishing our thieving ministers and our military murderers of Tamils.

Few people outside nationalist Sinhalese circles trust our judiciary. Was it not a Chief Justice who boasted about doing favours to the Rajapakses while two other justices meetikly signed “I agree” in the now infamous Hambantota Tsunamu funds embezzlement judgement? Until the judiciary comes forward on its own to wipe clean the big black blot on its escutcheon, I suggest that courts should suspend all findings of “Contempt of Court.” The fact that Sarath  Silva roams free without at least a knock on his kuncles, there can be little respect for the judiciary. My head hangs with shame as a Sri Lankan when I see reports of Mohan Pieris as Gotabaya Rajapakse’s encoy to UNHRC insulting the UN Secretary General Antonio Guterres of supporting terrorism and trying to effect regime change. Pieris was aptly reminded by Guterres  that the involvement of others in Sri Lankan affairs would be drastically reduced if the Sri Lankan Government takes reconciliation and justice seriously.

On October 5, our Foreign Minister, who also is our former Justice Minister, flayed the UNHRC for the resolution to be voted on the next day: “This is heavy lobbying. This is geopolitics. [The] resolution is very dangerous, [as many of its points violated the Sri Lankan constitution and the separation of powers and judicial activities within it.] … We are introducing our own truth-seeking mechanisms.” 

The world however gave us a lot of time to put our house in order. We failed badly. As far back as in 2006-2008, the International Independent Group of Eminent Persons (IIEGP) established to study our Presidential Commissions constituted  using of our most senior and respected judges, resigned en masse citing the shortcoming of our Commissions:

·  A lack of political will from the Government of Sri Lanka to support a search for the truth.

·  A conflict of interest in the proceedings before the Commission, with officers from the Attorney General playing an inappropriate and impermissible role in the proceedings.

·  Lack of effective victim and witness protection

·  Lack of transparency and timeliness in the proceedings

·  Lack of full cooperation by State bodies

·  Lack of financial independence of the Commission

Is this the kind of Sri Lankan instiution that Ali Sabry and Ranil Wickremesinghe think will investigate thoroughly all the crimes of state and of our political leaders? Will the 6.9 million persons who voted for Gotabaya Rajapakse as President, cry foul if there is a domestic investigation that with all the trappings of legal shows, lets off the criminals? Mr. Gotabaya Rajapakse’s lawyer Ali Sabry in a video shown in Colombo Telegraph tells the Muslims that GR has practically won the election and Muslims must take ownership of the victory by voting for him. If they do not, they will be smashed up he concluded. Although I raised it as a complaint at the Commission, I am not aware of any action being taken. We are afraid, I am afraid. That is the kind of Commissions we have – afraid to act against politicians and the state.

AP News reported on 5 September 2022 the empty rhetoric of Ali Sabry’s pontifications:  [Any] solution should conform with the country’s Constitution. Any external mechanism, external evidence gathering mechanism, charging citizens outside the country, getting hybrid judges to come and hear the cases, all these are against the Constitution. So we can’t agree to that.” 

Noted AP, “The statement is a retraction of President Ranil Wickremesinghe’s earlier stance when he was prime minister. In 2015 he co-sponsored a resolution agreeing to a joint investigation of alleged abuses with participation by Commonwealth and other foreign judges, defense lawyers, authorized prosecutors and investigators.”

Even though Ranil Wickremesinghe is echoing Ali Sabry’s position now, he has for long been well aware as a politician that this constitutional objection is mere spin. With his thumping big majority in Parliament, if there is a constitutional  objection, removing any obstacle is easy. 

If we want the world to respect us, our parliament must cooperate and participate in the removal and punishment of criminals amongst us. A hypothetical parallel is this. The US has no extradition treaty with the Vatican. Say Joe Atheist murders the Pope and runs to the US. Is it legitimate for the US to say we have no law allowing the US to extradite Joe Atheist to be tried in the Vatican? Decency requires extraditing Joe Atheist, especially when any trial in the Vatican would be fair unlike in Sri Lanka. Our excuse for refusing to accommodate foreign judges and observers, is just that, an excuse when our judiciary has failed so miserably in prosecuting Sinhalese who murdered Tamils, and politicians who steal our money.

As far back as on 26 Sept. 2015, P.K. Balachandran the well-known reporter, reported what then prime minister Wickremesinghe had just told a gathering of management accountants:

“Sri Lankan Prime Minister Ranil Wickremesinghe has said that Sri Lanka will set up a domestic mechanism to try alleged perpetrators of war crimes, but the mechanism will seek the help of foreign judges and lawyers. The Sri Lankan judicial mechanism, which will include an office of a Special Counsel, will certainly have the help of not only Sri Lankan, but also Commonwealth and foreign judges and lawyers. But all this has to be authorized by Sri Lankan law.” 

The key operative phrases are “set up” and “authorized by Sri Lankan law.” What was possible in September 2015, a fortiori,  is possible today given the parliamentary supermajority behind Rail Wickremesinghe and the Presidency that Wickremesinghe now has but lacked in 2015. 

India’s abstention on the UNHRC Resolution is disappointing for a democracy. N. Lohathayalan reported recently that China is making illegal encroachments into Jaffna cultivating Sea cucumbers (Kadal Attai in Tamil). I am reliably informed that the report reveals but the tip of the iceberg and that there is a lot more happening with Chinese shenanigans in the North in the islands as well as Kilinochchi that will soon be reported as soon as investigations are complete. India shares a lot with the Tamil people as a democracy and needs to take up the cause of the over 100,000 Tamils massacred towards the end of the war. I assert that India is fully aware of the death toll but is keeping quiet for fear that it is not mum on the murder of so many Ceylon Tamils, its sympathies will be used by China to make gains in the South. 

The silver lining is that India said it would work with Sri Lanka to achieve the aspirations of the Tamil minority as Reuters reported today, 6 Oct. But India’s money is not where its UNHRC abstention was. The 13th Amendment is something that India negotiated and navigated but is totally ignored to India’s shame and not in accordance with India’s aspirations, even claims, as a regional power. Even as I write there is a secret cabinet paper marked confidential that seeks approval for 6000 hectares of land in the Mullaitivu area to be transferred to the Mahaveli authority. It will end up as a part of Welioya (the tamil region of Manal Aaru, now shamelessly Sinhalesized). Such Sinhalese plots of aggrandizement and emasculation of the Tamils are a monument to India’s shame and ignominy because under the passed but ignored 13th amendment to our Constitution land authority is under the Province . To Wickremesinghe to whom the Constitution is important to block prosecution of murderers of Tamils, it is to be ignored when it comes to land grabbing from the Tamils.

We Tamils want to be proud Sri Lankans as we once were. But when our killers are rewarded with high posts, we lose any dignity we have left remaining. About two years ago at an Election Commission event I was seated at the high table next to General Shavendra de Silva. I could not run away.  It was presumably some Election Commission Official’s joke. At another Commission event, prior to the function, a few of us were hosted to high tea. A participant was Namal Rajapakse whom many of my officials were sucking up to by surrounding him and gleefully listening to his flowing words of fun, wisdom and whatever I do not know. I kept my distance.

If we Tamils are to participate in the affairs of state as equal citizens, the prosecution of war- and economic- crimes must go ahead forcefully so that Tamils in government can work in true cooperation as Sri Lankans with those who are cleared of criminal activity. 

We who truly love Sri Lanka, must sing Hooray to this important resolution by UNHCR and urge Prime Minster Wickremesinghe and Foreign Minister Ali Sabry to work towards the forceful implementation of the resolution, without telling us tales about constitutional problems that are demonstrably untrue and no one believes.

      The Human Rights Hypocrisy show in Geneva is to ensure that Sri Lanka tows the IMF line and does not buy oil or gas from Russia using Rubles and to keep Sri Lanka in the Washington dollar Debt trap and colonization project.

        No one is forcing Sri Lanka to go to the IMF. If Sri Lanka recovers all the stolen state wealth by politicians and their cronies Sri Lanka might not have to go to the IMF.

        UNHRC vote was no surprise for a few reasons. The war was over over a decade ago. Nothing has been done for people to get closure. The Justice Minister was the same person who as Justice Minister in the yapalana govt protected crooks including the Rajapaksa’s

        The person that represented Sri Lanka was the same person that represented an accused war criminal for decades making and then was rewarded a parliament seat through the national list.

        So do you think any representative from a civilized nation is going to believe a word he is saying. The only ones will be from other corrupt countries that has no regard for human rights.

          Bert, recovering stolen wealth is not that easy. Even when the political will to do it exists (which it doesn’t), differences in legal systems or the unwillingness of other nations to assist can end a recovery process. Even if recovery is possible it will take decades. https://www.unodc.org/pdf/Star_Report.pdf As a result Sri Lanka had no option other than the IMF.

            You know what had happened to Shani Abeysekara, the former director of the Sri Lankan Criminal Investigations Department (CID)?

            Most of the honest policemen are scared to investigate crooks, murderers, drug smugglers, …. corrupt officials and politicians for simple reason they not only fear for their life but those crooks will stop at nothing making life difficult for them.

            People like though a good person Nimal Fernando does not believe in justice, sin, legal process, …. leaving honest and decent people demoralised and undermined.

            Nothing in life worth its salt is easy. Giving-up on something just because it’s difficult is accepting defeat.
            Putting an honest program to recover stolen wealth does way more than whatever wealth is recovered. It brings confidence in governance to the domestic population as well as the international community. This gives breathing space for the government to bring in programs to get out of the mess it is in, and the tolerable level of the population will increase, and the international community will be more inclined to help. I don’t deny that we have got some international help but it’s like giving something to a beggar to go away, not a helping hand to a friend to stand on his/her feat.

            What is the main objective in going to the IMF. The loan the IMF gives will not be sufficient to raise our head from debt, or economy recovery but an agreement with IMF gives confidence to the world community that the systems are in place for recovery and risk base is reduced.

One feels that it may be better to drive the situation to an acute and unbearable crisis. Then it may be over soon.

When Professor Jeevan Hoole wrote an article on CT questioning whether Gota had any right to contest the election, let alone get elected, you now, two years later, ask why Anura Kumara Dissanayake did not raise the issue at nomination time. I indulged in some speculation.

        With all respect I am not against NPP, but I criticized JVPs (especially those who killed my dear friends). For example, like Manel and SJ, I am also a citizen of Sri Lanka. I should have my own right to express my opinions. I request you kindly not to be an admin to control me or other on CT, if CT stands against me, I will quit at any time. CT has not asked to do so yet.

        That’s my opinion, anyway I’m not a politician and I’m not a Sri Lankan living in that country, but anyway I hate your stalking me. It’s wrong to bash me for having low opinion of srilankans…I don’t. I have a low opinion of lanken systems..that’s for sure.
        Btw, why are you targeting me by calling me an idiot, a moron, a German citizen, etc… Don’t you have anything better to do?
        I’m not enjoying my retirement like you are, I have to work another decade to get into it.
        Again fyi, I have been a fan of Dr HA (NPP). That you surely know. But having said that, it does not mean that I can approve every JVP under NPP.

          I asked you why you didn’t make one specific response in the ten days that you had in November 2019. Even that wouldn’t have been asked had you not found fault with AKD for his silence. As I remember it, we were all confused, including even Jeevan Hoole. I was discussing it with him on the phone all the time.

          Ranil was the leader of the UNP at that time, and the Party fielded a Presidential candidate. Why didn’t Ranil ask his candidate, Sajith, to ask the question? If you want to attack one specific JVPer give proper reasons; what some other fellows did to you 35 years ago cannot be a reason.

You simply have failed to understand the fact that the issue with Sri Lanka today is not about LTTE or its atrocities but the Rajapaksa regime’s total failure to live up to its commitments vis a vis people of Sri Lanka and the world community at large. As you know, LTTE was militarily defeated in 2009 and since then Rajapaksas have done nothing to bring about lasting peace, social stability and economic benefits to Sri Lankan people who have been duped time and again by successive governments over the last 73 years since independence in 1948.

                  A Terror Story from 89 Era:

                  This is a true story, believe it or not, it’s not made up.
                  One of my friends’ friend lived in Colombo and was a young man in his early 20s. In order to explain you the story,
                  I go back to that era of terror in ’89. Even a- 3 youths could not exchange any conversation on the road as the threat was beyond expressability. People did not speak much and looked around, wondering what to say. This friend originally came from down south but he moved to Pera and lived in Colombo. According to us he did nothing like supporting any politics.

                  Alas, his fate, he was caught by a gang of JVPs and disappeared for days. Parents and almost everyone was worried about his survival. In an one evening of those worrying days, a parcel of meat was posted to the parents labeled as from former friends of the missing man, calling it fresh wild boar meat. They were not used to getting them before, however, and described it as “wild pork”; Some of them (young uncles) accepted it and thought of cooking it for dinner. They did it as usul and tasted it.

A few hours later, the family received another chit in which they clearly stated that the family was eating the body parts of their son, who had been missing for days.
                    What do you think of such an incident in that cruel age? Chit-communication was the basis for creating all the troubles in the rural mentality. What was the horror that went through the head of the youth… remember? Can any of those victimized families ever turn their minds to doing good?

                    That’s the reason why those people have been 3% for so long. Even animals would are afraid of being killed. THose who dont have senses, they could watch infomative videos for the purpose of self awareness.

                      I can well believe it. During those dark days they said that when the Government declared a curfew everybody ignored it, but when the JVP declared a curfew not even a stray dog was seen on the streets. So great
                      was the fear of these monsters, whose policies by the way, remain the same.

                      Why don’t you guys let the Sinhalese man or people like that open their eyes? Their ability cannot even be measured by today’s modern techniques. If they were given a naivety grade on a scale of 1 (lowest) to 10 (highest), SINHALA MAN or similar would be a 9 with their naivety and stupidity. Many of them his age in our country are no different. Either they don’t come out of their caves or stay away without actively trying to contribute to change. The Sinhalese man at least spends sleepless nights with his pen… but not in a proper way. He believes he might be the best advocate for CT, however, he’s just another pilot on a hijacked plane where I’m no longer going to be a passenger.

                Just because I missed one of the two hours, you made it a big issue and questioned me about the delay in commenting. Am I the one criticising your nature for that? I do not see anything happening towards Rajapakse and I will make warm comments from my heart. If anything was done to administer justice in that land, not a single member of that barbaric family would be allowed to roam the city in today’s context.       India abstained but still reiterated some form of power sharing. Countries voted against are China, Russia, Cuba, Venezuela, Pakistan…… BTW ,what has cucumber farms to do with voting. Russia told, Lanka has done enough to address issues. China told, according to their morality standards the 20 countries voted in favour are immoral.

        This is a very good article from Prof. Hoole. My frank opinion Chiv is India is very wish-washy and we Eezham Thamizh can never trust them. They have used us for their own agenda to enter the island and then conveniently discarded and betrayed us many times not only to the Chingkallams but also to the international community. We all remember the IPKF and what they did to the Thamizh, India’s part in the 2009 Eezham Thamizh genocide and the support they gave to the Rajapakse government. Even now hypocritically mouthing about Thamizh’s rights but look carefully and always give overt and covert support to the Chingkalla Sri Lankan state to discriminate and marginalize the Thamizh. They are trying their best to win the hearts and minds of the Chingkallams at the expense of the island’s Thamizh, their rights and their existence. They will be waiting in vain, the Chingkallams know how to use the China card very well and the Indians on a merry dance. Most Asian Pacific nations did not vote in favour of Sri Lanka, and neither did most Islamic or African nations. Only seven nations voted in favour far less than last year. Ali Sabry had failed miserably so did Ranil. Ali Sabry thought he was addressing the Chingkalla Masses gallery when he addressed the international community.

You simply have failed to understand the fact that the issue with Sri Lanka today is not about LTTE or its atrocities but the Rajapaksa regime’s total failure to live up to its commitments vis a vis people of Sri Lanka and the world community at large. As you know, LTTE was militarily defeated in 2009 and since then Rajapaksas have done nothing to bring about lasting peace, social stability and economic benefits to Sri Lankan people who have been duped time and again by successive governments over the last 73 years since independence in 1948.               The surname Waduge or its variation Baduge indicates Telugu origin South Indian immigrant Thamizh Vaddukar soldier descent. These were Thamizh Kariyar soldiers and mercenaries, who were imported into the island by Chingkalla and Thamizh kings, as bodyguards and soldiers. Vadugu is another name for Telugu in Thamizh. Basically meaning the language from the north. In the Jaffna Kingdom, these Telugu-origin mercenary soldiers from Thamizh Nadu were commonly known as Vadugas or Vadukkar. Hence the surname Waduge. Just trivia.

                  Yes, of course, you are absolutely right. Names like Seelawathie, Kalu Bandiya, etc are original Sinhala names, although, for some strange reason, parents nowadays prefer Hindi film actors’s names for their kids.
                  But on the other hand, there are places in Tamilnadu called Kulasekarapuram, Wickremasinghapuram, etc, which clearly show that the area was occupied by ancient Sinhalese.
                  BTW, Don David Hewavitharana and Gardihewa Sarath Chandralal Fonseka are definitely NOT Tamil origin names. But they aren’t Sinhala- origin either. Perhaps you know what they are?

            On the contrary, I am sure that MANY people know who she is.  And she is certainly NOT a MAN.

            She is one of several children of David Waduge (deceased), formerly of the Foreign Office. 

            I believe she was a regular contributor to the Defence Ministry website when GR was Secretary to the Ministry.  But I “got to know her” via her LankaWeb site which she ran for many years as a paid-up member of the SN brigade.  I am very surprised that S_M, with his nose to the ground on almost everything, hasnt picked this up.  It might have been a good place to parade yr non-SM principles on, S_M. It’s a veritable hive of nationalists

          That was what Sarath Fonseka promised to do on the eve of 2010 Presidential elections. I am sure he would have done that had he won the elections.     I won’t be surprised if our Minister of Foreign Affairs PC Ali Sabri and the Permanent Representative at UNHRC Mr. Chandraprema who represented S/L would say the following:

    ” 20 Voted FOR, 07 AGAINST, and 20 ABSTAINED. Therefore Sri Lanka WON by 07 Votes”. Mr. Ali Sabri a “Legal Luminary” has already said: “All those 20 “Abstained” are our “FRIENDS”.

    Can you “BEAT” that “REASONING”? So no wonder that Gotabaya Rajapakse managed to set aside “33” court cases argued by PC Ali Sabri.

      In fact on March 27, 2014, the UN Human Rights Council passed the Sri Lanka resolution by a vote of 23 to 12, with 12 abstentions.

      Our great legal eagle the highly educated Prof. G.L Peiris told the press that Sri Lanka won the votes because (12 + 12) 24 countries did not vote for the resolution and only 23 voted for it.

      According to the Legal Luminary Ali “All those 20 Abstained are our FRIENDS” Ali needs to spend time as an Under Study to Prof. G.L Peiris.

      Surely these Legal Luminaries are not sitting on their brain.

    It is sad that UNHRC resolution against Sri Lanka is interpreted as the UNHRC, UN, West are against to Sri Lankan people. It is only against to those who cheat the people with lies over lies and to rob this nation by some westernised Sinhalese who happily converted to Western culture and Christianity. We all know DS Senanayaka, SWRD Banadaranaiyaka, JR Jeyawardena family and Rajapaksa family who use Indian exported Buddhism as a weapon to rob this country. Even after Rajapaksa family robbed this country to kill the people by making them in poverty and they spend billions to travel UNHRC to safeguard the robbers.               I won’t attempt to discuss ragging. I’ll give my opinion: I don’t approve of even the mildest forms. For decades now there has been horrendous ragging which has caused deaths, nervous breakdowns, etc.

              Politics has nothing to do with it. They are two independent activities. It is possible that a ragger will claim allegiance to a political party. I could write reams on the subject.

                  Ragging has been a sort of initiation ritual for hand picking potential party members from among freshers.
                  Various games are played including the “Good cop bad cop” where the good cop saves the fresher from the bad cop of the same party and wins the fresher’s gratitude.
                  It is a well planned and well guided process. If not the JVP could have openly denounced the rag.
                  The rag offers parties the best opportunity to get in touch with the freshers. The JVP had monopolized it for long.
                  The anti-raggers are usually branded as ‘kult’ and stand aloof of the ‘hara’ lot that indulge in the rag. The anti-raggers did lack a tactical strategy ad were shown as pro-establishment.
                  The staff, with a few exceptions, by their silence endorse what goes on.
                  There is no politics involved in that cowardice I may agree.

If you interview former undergraduate students, many students will share with you how difficult it was for them at local universities. The continuation of hatred, envy, malice, etc., as soon as graduation courses are over, is just an extension of what was gained in the universities.

              It will not be blocked after the next government comes to power. Above all, people should be empowered for that. We have ample resources in retirement of senior civil servants. The work for a healthy national reconstruction should be demanded of them.

              To settle the dollar crisis, we can export as much skilled labor as we can by providing “some knowledge of English” and “vocational training”.

              Our “Sinhala man” or similarly trained English teaching experts can be used to inculcate the proper knowledge of English language in the youth of Uva province.
              It doesn’t have to be full-time, but at least on a part-time basis. All this should be organized by the people for the people. If temples and the schools must be demaned to take the lead, they can coordinate it properly. Excuses should not be allowed for those unwilling to participate voluntarily. All can be captured by electronic databases as is done as a routine activity by developed countries.

      India just only hypocritically weeps everywhere about Thamizh’s rights on the island but in reality, is doing everything in its power to see that the Thamizh are damned and destroyed. Constantly abstains during the UNHCR vote against Sri Lanka, so as not to displease Sri Lanka and the Chingkallams, as it wants to win them over. Gives them lots of no-string attached aid, this also includes Thamizh Nadu. Lots of logistical and military training and other overt and covert aid and support. If India really wanted Sec 13A and just Thamizh rights to be implemented it would have happened by now. It is a powerful neighbour, and can twist Sri Lanka to do its bidding and will get international support but it does not want to as it wants the Thamizh to suffer and be destroyed. This excuse that China will take over is just an eyewash. China is thousands of miles away and India is just 20KM to the north.

              Sorry Vedda, yes most probably China is also our neighbour as they have a 99-year-old lease on large parts of the county, port city and Hambantota and very soon Kachcatheevu in the north that Indira Gandhi, without consulting Thamizh Nadu or even the Indian Parliament in Delhi gave away to Sri Lanka, as if it was her personal dowry property to give, as Srimavo was her friend, will be also given to the Chinese and become part of the people’s republic of China( what an irony, damn good for the Indians), as well as all the Sea Cucumber farms in the north. SJ will be very happy and is hoping to settle down either in Kachcateevu or in one of the Sea Cumber farms and may even turn into a Sea Cucumber to help is Chinese comrades.

      I really don’t know why you bother with this question. AKD is not a special leader for me. On the question of nominating Gota in November 2019, I meant that he could have scored more points and if he had done so, perhaps this country would not have lost so much today. . AKD’s silence during that time is inexcusable. Nor do I have a better feeling about him as a leader. You may be fond of JVP, not knowing the depth of their doctrine, but I have been studying them for a long time. Today’s political parties are dysfunctional, but I am close to some people.

      My alternative would be to build a new coalition with a composition of all good young politicians for a better future. But I don’t know to what extent our nation can do that, because most of them can’t build a consensus on even a small issue, let alone work as a coalition ?

    Just watched the News first TV channel
    where they show how the villagers are suffering through out the isle.
    In Puthukudyurupu, one mother complaint how 16 year old school children are using Drugs.
    I certainly blame the Sinhala security forces of introducing drugs to the youngsters to wreck their education leading to unemployment and societal degeneration. In addition to feeding we need to stress the kids to avoid Drugs ( that includes alcohol)
    Feeding the stomach and feeding the mind should go hand in hand.
    It’s very sad to see some of the Tamils are cooperating with the Racist SL rulers to make us drug addicts/uneducated/unemployed/displaced/ to live huts with leaky roofs without electricity and water.

Prof. Hoole with all his mathematical skills should know that out of the total funds for mega projects, only 20% goes into the project, 10% goes to “the politician”, further 20% goes to several public officials and the remainder (a whopping 50%) goes to international wheeler dealers. The Prof talks of only the miniscule of 10%.

What about “Swiss Kumar” who took pleasure in oozing out the life of Shivaloganathan Vidhya? The maniac who became a Swiss after shedding crocodile tears took delight in enjoying the pleasures of the flesh of the innocent Jaffna lasses. Prof Hoole, who is renowned for dotting the i’s and crossing the t’s should account for these activities as well. Principally I agree with Prof that all those who squander public money and abuse human lives should be dealt with, but the scope should not be miniscule.

      Without a past, the future cannot be built. And without the guidance of senior citizens, a healthy youth generation cannot be built. Knowledgeable senior citizens are the wealth of a country. Knowledge and experience will be lost if not shared properly. Seniors don’t have to get hung up on the “caste issue”. I ask myself, what happened to Sri Lanka’s growing number of knowledgeable retirees in retirement?

      Eighty-year-old Europeans, Americans and others in the developed world are trying to volunteer. I know some of them personally. From what I hear in Japan, they become university undergraduates after 7 decades of their lives. They complain, otherwise they would not be able to close their eyes peacefully.

        We lost a lot of our precious time due to unnecessary civil war. There are still a significant number of people in this country who are in favor of war. The South Asian mentality is addicted to cursing others. Imagine how they use the “internet” today: many of them spread hate and tell lies to earn their living. They have learned it from “mainstream private television channel culture”.

        Everyone in this country should contribute to nation building. Saying “normal stupid people” will not open the door to a better future, so I believe all retirees should take it seriously. If young people are given basic knowledge in English, they can get out of the dollar crisis. The other day, I met a thirty-year-old young man who couldn’t figure out how to get a job in Dubai or how to open a bank account in Dubai. The result was that he had no choice but to return to Sri Lanka. He revealed that more than 100 job seekers came home sharing those shortcomings. Mainly because most people do not have a basic knowledge of English so they can fend for themselves in front of airport counters for example.

    Tamils spent 30 years on SJV’s Gandhian protests for Tamils’ rights under a federal government. Tamils spent another 30years under Leader Prabakaran’s armed struggle to liberate them from Sinhala Buddhist Chauvinism. Now they have spent another 15 years on the international community’s leadership for diplomatic agitation but the Justice they are asking for is not coming forth.

    IC is paying truly little attention to the fact that the Tamils are with Democratic countries, and they seldom associate with the international hooligan countries like Iran, Bolivia, Venezuela, Pakistan, Russia, China, Cuba……….     The interesting part here is that this INGO’s senior official, Dinushika Dissanayake, who released this statement is a Sri Lankan Citizen. From the first resolution in May 2009 until the last resolution 56/1, September 2022, UNHRC considered the resolutions a victory for its cause. 30 Nations sponsored the resolution 51/1 and 20 nations voted for it, while only 7 opposed. This is a ¾ majority for the resolution. Other than China, every powerful nation in the UNHRC had a favorable concern on this matter.

    India went on a different path; it insisted on 13A implementation, though without extracting any promise from Evil Ranil’s administration on implementing 13A. But what happened at the end of the sitting 51? On the matter of Tamils’ issue, Langkang swept a fortune by making UNHRC postpone everything until after the next EP & Parliament election. That the story of a mountain stomach pained to deliver a mouse! Some blamed President Putin’s untimely war, that is right at the appearance of first faint rays of light at the end of the tunnel of Covid – 19, So, the world’ attention lost on the Tamils issue and turned to Ukraine’s issues.

    Thanks, UNHRC did not buy Evil Ranil’s explanation of West starting a war with Russia, but they added to Resolution 51/1 a new human right violation clause that is plundering of the county’s economy. UNHRC added the Yahapalanaya’s Tamil Churches bombing to its earlier resolution. But Aanduwa never minded about that because it was also done by both, the UNP-SLFP factions like the way they two did the Tamils genocide, together. It is at that point (the addition of the Economic Crime) the Resolution 51/1 started to make some sense for Tamils (as well as for Sinhalese), instead the sitting being ended as a full disappointment, this month at Geneva.

    The answer Ali Saber produced for this new addition is that this time the UNHRC had overstepped its mandate. This explanation is not the usual “Constitutional Objection”, but the Economic crimes are not human rights violations, but the UNHRC has invented something that is not in the UN’s Charter. This shows the customary stupidity of the Sinhala Intellectual’s way of thinking that by talking some sophomoric talks, lies, or even filth & be contented that they had won the debates. Langkang parliament is place flourish these hypes but achieves nothing. Many writers and commentators from all three-language media laughed at Ali for not knowing the Economic crimes also included the human right violations.

    For me, it was not a Bigge because it is not that Ali had never cracked any brilliant case in the courts for his PC designation, but he is not a Human rights or international humanitarian law’s expert. Though he gave a posh presentation inside, i.e., standing with full makeup and reading from a paper the flamboyant report of Langkang, but outside he conceded that presentation had not convinced any country and he predicted that Lanka would lose the contest. Further, whether he accepts or not, the countries who voted against Resolution were using Langkang in their fight against the West but did not give any considerations for Ali’s arguments or Langkang dire needs. For examples, China still heavily pressuring Langkang on slave borrowing from it, but not giving a loan structuring plan to get loan independently from IMF. This is not the case with the West, where Langkang exports most of its products; that is because of their favorable treatment of Langkang with their GSP+. All UNP-SLFP leaders are well aware of the mentality of the counties voted against the Resolution. But to save them from the crimes they committed, to earn more illegal commission and to create a bogus opinion within local ignorant people that they were more tough with international countries than the opposition parties. That is why they sheepishly stays with the international pariah countries.

    But at the end of the day these shameless leaders go country after country for beging and they send their productive labor to foreign slavery jobs, which are less in dignity than local prostitution. Many times, men at home killed their women returning from foreign employment because of suspicion of misconduct in their foreign stay, after all those women dearly pay at workplace to earn a penny and send it back home. Everything in the recent life of Langkang is a hell on earth.

    The plus point in this resolution is, by adding the Economic crimes, UNHRC has given a rope to the Sinhala community to get out the self-woven cocoon they are in, by which they vote only for the party which spews the highest racist venom. Here is a chance for them to wake up and realize what is going on with their life. Though they could not see themself, every human soul on the outside is sympathizing with them as poor & sinful lives. If not for the country, at least Sinhalese can start to care about their community, by hanging to this new UNHRC rope.

    If they want to go to the next step, they can re-earn the lost name of the country by putting back where it was when Tamils and Colonialists were maintaining it, instead creating fake Miracle of Asia by mouth, which is only for racist election purposes. Sinhala community can spring into action and get an internal commission to investigate the Royal government, which is accused of the latest economic collapse, if they do not like to go with an international inquiry for economic crimes. (But I doubt a useful inquiry come out of Langkang on any issue at this time of the history.)

    Protesters, by their careful and planned action have restored the international relationship with Sinhalese which was systemically demolished by the UNP-SLFP factions from 1948. So, their call for systemic change and the brutal suppression of the government on protesters were also taken into consideration at the UNHRC. When, in the past, JVP sustained much bigger devastation, IC did not show much interest in that because JVP, like the governments, was against international interests. Langkang is not just simply against the international interests, (peace in Indian Ocean, protection of democracy, contributions and siding with the Human right initiatives, contribution to environmental protection…..) but creating tensions by setting one superpower against another on the risk of its citizens lives.

    The well-disciplined protest and the massive support from the Sinhala community has brought out the fact the Royal’s Dutugamunu image which Royals created for them by merciless annihilation of Tamil has not lasted even for a decade. The 2015 loss of election could be discounted as one time issue, but the ousting of the whole family from the politics this time is not anything negligible, even if the Royals manage to come back.
