Minister Bathiudeen Files Lawsuit Against Bodu Bala Sena

Minister of Industry and Commerce Rishad Bathiudeen has filed a lawsuit against Bodu Bala Sena today claiming 500 Million rupees (US $ 3.82 Mn) compensation for defamatory statements made by the BBS in Colombo District courts.

The statement issued by Minister Bathiudeen is reproduced below in full:

Minister of Industry and Commerce Hon. Rishard Bathiudeen filed action through his Attorney-at-Law against the Secretary of an organization calling itself and functioning under the name of Bodu Bala Sena Ven. Galagoda Athe Gnanasara Himi.

The action against Ven. Galagodaathe Gnanasara was filed since the letters of demand sent by the Attorney – at- Law representing Hon. Minister demanding either an apology or a sum of 500 million was not responded to by Ven. Galagodaathe Gnanasara.

The action was filed at the Colombo District Court against the malicious, false and defamatory remarks that were made by Ven. Galagodaathe Gnanasara thero at a press conference held in Colombo on or around March 20th 2014.

During the Press Conference Ven. Gnanasara made the following remarks.

a) Minister Bathiudeen is responsible for the destruction of the Wilpattu National Park.

b) Minister Bathiudeen has created an exclusive Muslim Zone from Wilpattu to Mannar;

c) Minister Bathiudeen  is attempting to create an ‘Arab colony’ in Sri Lanka in the Mannar-Wilpattu area;

d) Minister Bathiudeen was a person who attacks courts and obstructs the course of justice.

The Plaintiff in the action, Hon. Minister Rishard Bathiudeen has repeatedly and categorically denied each and every assertion made by Ven. Gnanasara at all forums in order to make the public aware of the true and factual details of the said construction of the housing scheme.

It is also asserted that the entire press conference and subsequent ‘media drama’ was created and motivated solely by the anti-Muslim, anti-Islamic agenda, a motive that Ven. Galagodaathe Gnanasara pursues.

The Minister through this action demands a sum of Rs 500 million from Ven. Galagodaathe Gnansara as damages caused to him and his reputation as a result of the false, malicious and defamatory remarks made against the Hon. Minister at the said press conference.

    MYANMAR: Producing drugs for the region, fuelling addiction at home

    YANGON, (IRIN) – In northeastern Shan State, opium farmers have a special welcome for visitors.

    “Serving opium or methamphetamines to guests is a tradition of local poppy farmers in the area. Some poppy farmers are drug addicts,” said Yarzar*, a drug addict in his 30s from Shan State, where he used to farm poppy and work in opium factories.

    Myanmar is one of the world’s main sources of opiates and methamphetamines, and this production fuels rampant addiction in the country.

    Opiates, especially heroin, are the most prevalent drug in Myanmar, feeding the habits of some 66,000 heroin users and 67,000 opium users, according to the UN Office on Drugs and Crime’s (UNODC) 2010 World Drug Report released this week.

    In 2009, the country produced 330 tons of opiates, accounting for 17 percent of global cultivation, while methamphetamine seizures skyrocketed from one million tablets in 2008 to 23 million in 2009.

    In the border areas of Shan and Kachin states, the region where most of the opium is produced, about 1.5 percent of the adult population is addicted.

    “There are as many drug stalls in the border areas as there are betel shops or teashops in the cities,” Yarzar said in Yangon.

    The primary drug of choice is heroin, followed by opium and methamphetamine, the UNODC said. Methamphetamine use increased for six years up to 2008, while heroin use has dipped, and opium has remained stable. Methamphetamine use is hard to gauge, but may be reflected in the number of seizures.

    “There are clear indications of the increase in the seizures and production of ATS [amphetamine-type stimulants],” said Deepika Naruka, who coordinates UNODC’s programmes in Myanmar and East Asia.

    She said figures on drug use are hard to come by because of the stigma and illegality, but “even with the limited data that is available there is an indication that ATS use is problematic”.

    However, a Myanmar physician working with drug addicts in the country sees a clear trend.

    “Drug users in the area of North Shan, South Shan and Mandalay are still on the rise,” said Myo Nyunt Aung, who works on the harm reduction programme of the UN and Myanmar Anti-Narcotics Association (MANA).

    Cheap, easy to find

    Opium production in Myanmar has decreased dramatically since the mid-90s – when about 1,700 tons of opium was produced annually. In 2009, UNODC estimated 330 tons was produced.

    The agency says 95 percent of Myanmar’s opium is grown in Shan State. In that region, the prevalence rate of adult daily opium use is higher in opium-growing villages – 1.7 percent, compared to 0.5 percent in non-growing villages.

    Drugs are widely available along the China-Myanmar border, like in the city of Lashio.

    “In Lashio, we can buy one dose of heroin [with a penicillin bottle] for US$8-12. The price of the drug is three times cheaper than buying in a big city like Mandalay,” Yarzar said. “The closer you get to the border areas, the cheaper the drugs are and the stronger the taste.”

    In Mandalay, Myanmar’s second largest city, north of Yangon, there is a steady drug supply for, and demand from, migrants from different parts of the country.

    “It is not difficult to get heroin in Mandalay if you have money,” said 36-year-old Min Thura, a former drug addict from Mandalay who is now working with the National Drug User Network Myanmar (NDNM).

    Many drug addicts are migrant labourers toiling in jade mines or along the China-Myanmar border, but also people from wealthy families in Mandalay, he said.

    In the 1990s, Min Thura regularly shared needles with other drug users in Mandalay.

    “About 50 drug users were queuing up and giving their arms to inject heroin with only one needle. Many of my friends with whom I shared needles to inject drugs have already died,” said Min Thura, who has been clean for four years.

    Now, he said, there is more awareness about HIV and clean needles.

    Methadone therapy

    Myanmar’s first methadone therapy programme was established in March 2006, set up in drug treatment centres in several cities and towns across the country.

    There is only one methadone clinic in Yangon, at the San Pya Hospital, and patients make daily appointments for treatment.

    “It’s not easy for the drug users living on the outskirts of Yangon to go to the hospital every day to take methadone. It would be better if there were more drug treatment centres,” said Bae Lay, a member of NDNM.

    Htoo Wint Kyaw, another NDNM member, agreed: “There are many drug users who would quit using drugs if treatment were available.”

    This is a side of life the Burmese military junta might prefer you did not see: girls who appear to be 13 and 14 years old paraded in front of customers at a nightclub where a beauty contest thinly veils child prostitution. Tottering in stiletto heels and miniskirts, young teenage girls criss-crossed the dance-floor as part of a nightly “modelling” show at the Asia Entertainment City nightclub on a recent evening in Rangoon.

    Prostitution, particularly involving children, is a serious crime in military-ruled Burma, but girls taken from the club would have no problem with the authorities, the waiter assured the company, but did not explain why not. It would seem that prostitution is one of the few things the Burmese military, fresh from its recent crushing of pro-democracy demonstrations by Buddhist monks, is still willing to tolerate.

    One of the unsavory consequences of Burma’s economic rejuvenation is a revival of the country’s reputation for producing and exporting illegal drugs.

    A combination of economic pressures and opportunity is fostering an increase in both traditional poppy cultivation for opium and heroin manufacture, and methamphetamine pills, which are being churned out in their millions from hidden miniature factories close to border crossings.

    Thailand is the main target market but a UN agency says there is evidence of organized crime links between Burmese traffickers and criminals in the Cambodian capital of Phnom Penh. The shadowy nature of the business makes it almost impossible to evaluate accurately, but is believed to now run into several billion US dollars a year.

    In 2010, the US Congressional Research Service estimated Burma’s drugs export trade to be worth between US $1 billion and $2 billion per year.

    Around two million pills were seized from vehicles by Thai police just this month in Thailand’s northern Chiang Mai Province bordering Burma. They were hidden among farm produce and are thought to have been smuggled across the frontier.

    But that is only the tip of the iceberg: More than 31 million methamphetamine pills were discovered by Thai anti-drug units between October 2011 and March this year, according to a Bangkok government report. That represents a 45 percent rise over the same period a year earlier.

    The United Nations Office for Drugs and Crime (UNODC) says Burma is the source of nearly one quarter of the poppy plants used to make opium and heroin, making it the world’s biggest illegal opiate supplier after Afghanistan. The area under poppy cultivation is growing and is now back to levels last saw eight years ago.

    More than 200,000 farming families are estimated to be growing opium poppies across 100,000 acres (40,000 hectares) and 90 percent of them are in Shan State, said the UNODC.

    “The main drivers behind recent increases in opium poppy cultivation are chronic poverty, decreasing rural food security and regional insecurity due to armed conflict,” said the UN agency.

    Burmese local government officials and ethnic militias are accused of complicity in both poppy cultivation and methamphetamine production, according to a recent report in The New York Times quoting Thai border police. Others implicate the Burmese armed forces.

    Aided by European Union funding and support from the German government, the UNODC has started a program to encourage poppy farmers to grow other crops to sustain themselves and raise incomes.

    Burma remains on the United States blacklist of countries which are failing to deal with the cultivation of opium poppies, but has deferred taking any punitive action because of the country’s progress with political and economic reforms.

    Al Jazeera recently named the United Wa State Army [UWSA] as “one of Southeast Asia’s largest drug-producing entities which continues to manufacture methamphetamine and heroin free of pressure from the [Burmese] government.”

    The UWSA, based in northern Shan State, has a peace agreement with the Naypyidaw administration.

    “The UWSA has more legitimate business interests: Aik Hauk, the son-in-law of founder Bo Yiouxang, owns Yangon Airways … [which] exemplifies how tight the nexus between the black market operators and the legal economy is,” said the Qatar-based news agency.

    Burma watcher Prof. Des Ball, of the Australian National University’s Strategic and Defence Studies Centre, has alleged that Burma is the world’s biggest producer of methamphetamines.

    For years he was on a military regime blacklist barring him from the country. The ban was lifted in September.

    Ball alleges that in spite of political reform in Burma, the military is still heavily involved in the drugs business, especially via their links with the UWSA. Army units control roads, transport and the border and it would be impossible for them not to know about production and shipment, he said.

    The US Congressional Research Service has implicated other ethnic groups which have reached ceasefire agreements with the Burmese armed forces in transnational criminal businesses.

    But the drugs trade is not just an export business. The UNODC says there is circumstantial evidence that illegal drug-taking is growing rapidly in Burma, especially among young people, and it plans to make a formal study to properly assess the problem.

    The Bangkok government recently estimated that there are more than one million methamphetamine users in Thailand.

    The drugs business has forced the Burmese government to quietly put back its bold deadline of 2014 for eradicating the problem from the country. The danger is whether setting a new deadline of 2019 will merely allow the issue to expand in the shadows.

    Four of Sri Lanka’s hardline Buddhist monks appeared in court on Monday accused of insulting the Quran, in the first such case following a spate of religious hate attacks.

    Police accused the monks, from the nationalist Bodu Bala Sena (BBS), or Buddhist Force, of making disparaging remarks against the Islamic holy book after bursting into a meeting of religious leaders last month.

    At the meeting, the monks also intimidated a moderate colleague who was promoting religious tolerance on the Buddhist-majority Island, police said.
