WAN Says Muslim Marriage And Divorce Act Treats Women As Second Class Citizens, Calls For Rectification

The Women Action Network (WAN) has called for the rectification of the Muslim Marriage and Divorce Act (MMDA) of 1951 citing that the Act renders Muslim women as second class citizens and does not guarantee them equal protection under the law. The Network has also called on authorities to ensure that the new Constitution rectifies this which will ensure Muslim women will have equal rights in the eyes of the law.

forced-marriage-and-islam“Fundamental rights are central to the constitution and if the new Constitution cannot guarantee equality and equal protection under the law for all citizens then all efforts towards constitutional reform would be futile. The reforms process must ensure a constitution that is supreme under normal circumstances. Thus the concern emerges regarding Article 16 of the 1978 Constitution, which makes all written and unwritten laws in existence before the promulgation of the constitution valid and operative despite inconsistencies with fundamental rights,” WAN said in a statement issued today.

Emphasizing their statement further, WAN which comprises of activists and human rights organizations across the island, has drawn the attention of authorities to the significant impact the Article 16 has on Muslim women in relation to the Muslim Marriage and Divorce Act (MMDA) of 1951.

“Article 16, by upholding the MMDA sans reforms, renders Muslim women second-class citizens by not guaranteeing them equal protection under the law. Muslim women, including victims of child marriage, have articulated very strongly to the Public Representations Committee on Constitutional Reform that the constitution must guarantee that their human and citizenship rights are not violated in the name of ‘cultural and religious rights’ and that every woman and girl in this country should enjoy equality and basic human rights regardless of religion or ethnicity. This includes either the removal of Article 16 in the new constitution, or amendments that allow Constitutional supremacy above discriminatory customary laws,” the statement said.

The statement said that for decades, Muslim women and groups working closely with victims have been advocating for reform to the MMDA and the Quazi court system. Women’s groups documented numerous cases of injustices faced by Muslim women under the MMDA enabled by discriminatory provisions within the Act such as lack of minimum age of marriage and agency to consent to marriage, unequal process of divorce for men and women, polygamy without conditions, arbitrary process of compensation, to name a few. “Multiple cases of child marriage have been documented all over the island in Muslim communities, which is enabled by the MMDA and Article 16,” they said.

In addition to case data, information from marriage registration, maternal units in hospitals and research on child marriage shows both child marriage and child pregnancies are prevalent, with the lack of legal protective mechanisms as a key contributing factor. “Data collected of registered Muslim marriages from four DS divisions in two Eastern districts indicates over 143 cases of underage marriage in 2014 and over 118 cases for the first few months of 2015 alone,” the statement said.

“Muslim women around the country have also articulated in multiple forums that they are discriminated against by the sub-par Quazi court system, which is significantly different from the civil court system and doesn’t allow for affected persons to have legal representation. Women are often mistreated by incompetent Quazis and the jurors of the courts; not given equal treatment as their husbands; are unable to express their side without fear of being verbally abused, threatened and humiliated in courts throughout their case processes. It is notable that the Quazi court system, while being a government sanctioned system funded by tax payer money, prohibits women from holding any position of authority, either as marriage registrars, Quazis, jurors, or Board of Quazi members and thus is marked by systemic gender discrimination (MMDA Section 8,12,14,15),” the statement said.

According to WAN, the opposition to the amendment or removal of Article 16 has come primarily from conservatives who want to maintain the status quo by claiming to have the best interest of the Muslim community at heart. “The arguments put forward by said groups include that the MMDA is based on Shariah law and cannot be reformed; however the Sri Lankan MMDA is a combination of multiple imports of versions of Shariah law and local customs, and also includes anti-Shariah provisions such as the recognition of kaikuli (dowry) which is forbidden in Islam. Others claim that the Muslim community is under threat from anti-pluralist elements and as such the MMDA must be protected; however protection in the constitution for minorities does not mean that discriminatory family laws are allowed to supersede the constitution merely to guarantee cultural/religious rights at the expense of fundamental rights of women,” WAN said.

WAN called on the authorities therefore to ensure that the new rights-based constitution must guarantee that Muslim women have equal legal status and protection under the law. “Making the constitution truly supreme by removing or amending Article 16, will provide space for the Muslim community to reform the MMDA to be equitable and address contemporary issues of the community. There are different approaches to addressing Article 16, but leaving it unchanged is not an option,” the statement added.

      Does Islam teach that a woman is worth less than a man? Absolutely. The only debatable point is by what degree.

      All Sri Lankans must live under secular Sri Lankan law. Religion is a private matter. There should be freedom for that. There should not be specific laws based on citizens’ religion. Period.

      We should not be submissive to Islamic or any other religious fanatics, who impose ideas upon modern society based on books written in medieval times. When humanity did not know where the Sun the went at night.

      Authors say scans show need to think beyond an individual’s sex as each brain has unique “mosaic” of sex-based features plus some common to both sexes

      If men are from Mars and women are from Venus, no one told the organ that matters most. There is no sharp division between male and female brains, according to researchers who found that we are all a mixture instead.

      Scientists analysed brain scans of more than 1400 men and women and found that while some features are more common in one sex than the other, each person’s brain has a unique “mosaic” of these features, as well as others seen commonly in both.

      “What we show is that there are multiple ways to be male and female, there is not one way, and most of these ways are completely overlapping,” said Daphna Joel, a psychology professor who led the study at Tel-Aviv University.

      The researchers drew on MRI scans to look at a host of brain characteristics, from the amount of grey and white matter to the strengths of connections in the brain. Much of the analysis focused on the sizes of different brain parts. While many regions showed a huge overlap between the sexes, the researchers focused on the parts showing the greatest differences, with the least overlap between women and men.

      Joel and her team next looked to see how often the form of each of these regions within a single brain was consistently on the end of the distribution where females were more prevalent than males (the “female-end”) or consistently at the other “male-end”. Across the four different sources of brain scans they studied, the scientists found the percentage of “internally consistent brains”, in which all regions were at the male end or all at the female end, varied from zero to 8%, while those with both male-end and female-end features ranged from 23% to 53%.

      “We show there are differences, but brains do not come in male and female forms. The differences you see are differences between averages. Each one of us is a unique mosaic,” Joel said. Her study appears in the journal Proceedings of the National Academy of Sciences.

      “Sex affects the brain but how it affects the brain depends on other factors. The effects of sex can be different and even opposite under different conditions. This is why you can be highly masculine on one feature but highly feminine on another feature,” she added.

      According to Joel, the study should prompt people, and society at large, to think far beyond a person’s sex. “We have to treat each person according to what he or she is and not according to the form of their genitals,” she said.

      Heidi Johansen-Berg, professor of cognitive neuroscience at Oxford University, said the results are interesting, but not surprising. “The main point they’re making is that unlike genitalia, you can’t perfectly categorise brains as being either male or female, but I’m not sure anybody would have thought you could,” she said.

      “What they show, which is interesting, is that although there are some brain characteristics that are a bit more common in males, and others that are a bit more common in females, we are all a mixture of these.

      “There are very few people at the male / female extreme ends on any feature, and, where we are on the male-female axis will vary for different features. We are all a mixture,” she said.

      “Having said that,” she adds, “Other papers have shown that, if you look across many different brains and find these characteristics, then, given a new brain you can predict with some degree of certainty whether it’s likely to be male or female.”

      Michael Bloomfield, a psychiatrist at University College London, said that while the study found no evidence for a female or male type of brain, we need a more nuanced understanding of similarities and differences in brain structure between the sexes.

      “This is important, as many mental illnesses are more common in one sex over the other and we still don’t understand why this is. Understanding this could well help us understand some of the biological mechanisms that give rise to these illnesses, which could then enable the development of better targeted treatments. Important questions remain, such as whether the sexes tend to have differences in brain chemistry and how this may relate to brain function.

      “If the results of this study are replicated and related to thinking and behaviour, this study would not support the view that men are from Mars and women are from Venus. Instead, they lend support to ideas proposed by the ancient Greek philosopher Plato and advanced by the Swiss psychiatrist Carl Jung, that our minds may be part male, part female … whatever that means,” he said.

    Many articles have been written by learned Muslims confirming the fact that the concept of Gender Equality is alluded to in the Holy Quran. One or more of the following sections of the Quran 3:195, 4:124, 16:97, 33:35, 40:40 and 49:13 is often mentioned in this regard. However, in the case of Divorce, the existing practices in Sri Lanka appear to be heavily weighted in favour of the Husband.

    The common types of divorce are :
    Mubaara-ah [Termination of marriage by mutual consent of both Husband and Wife]
    Talaq [Termination of marriage by the unilateral will of the Husband]
    Nikah-e-Fask [Termination of marriage by a Qazi at the request of the Wife, if the Husband ill-treats her or does not give her equal rights]
    Khulah [Termination of marriage by the Husband at the request of the Wife]

    All these types of divorce are contingent upon the will of the Husband and/or (male) Quazis. Yet there is a fifth type of divorce, Isma, which is rarely spoken of or mentioned in religious books.
    This refers to the termination of marriage by the unilateral will of the wife PROVIDED it is mentioned as a specific clause in the marriage contract / certificate. In other words at the time of signing the marriage contract, along with the clause specifying the amount of Mahr that the Husband will gift the Wife, there should be a another clause (Talaq-al-tafwid) where the Husband agrees to delegate the power of Talaq to his Wife.

    How many potential Husbands would be willing to agree to include such a clause in their marriage contracts ? Would it make them feel vulnerable ? Would they feel compelled to adhere to specific forms of behavior as a result of that clause ? Do they lack the testicular fortitude required to face the challenges posed by delegating the power of unilateral divorce to their wife ?

    It is time to empower the Muslim Wife so that she is a true beneficiary of gender equality as envisaged in the Holy Quran.

    Gender discrimination has reached such ridiculous levels that some Males even flout Hadith to ensure their dominance. For instance there are many Mosques which forbid the entry of women for purposes of prayer, even though Prophet Mohammed (sal) has said “Do not prevent the hand-maidens of Allah from going to the mosque” (Muslim, Book 4, No 886).

        While I am glad that my comment actually tickled your funny-bone, I believe the subject matter is of too great importance to the Muslim Community to be treated in such a light-hearted manner. I suggest you re-read the said paragraph again, much slowly this time, and you may begin to understand that I have at no time claimed that Muslim women in Sri Lanka sign the contract on behalf of themselves. I agree with you that this is definitely something that has to be rectified soon.         The current Muslim marriage contract in Sri Lanka does not contain the Talaq-al-tafwid clause. If it did we would not be having this exchange of views. However, I am of the opinion that true gender equality with regard to divorce can only be achieved by including this clause.

        But there will be strong resistance among Muslim males against this change. Just conduct a quick poll among your Muslim male friends on this subject and you will understand the extent to which the males fill fight to defend their existing advantageous position over their wives.

    There are quite a number of highly educated Muslim women in Sri Lanka. None of them have voiced any concern regarding the Muslim Marriage and Divorce Act. They do not need any assistance from the Gnanasara sponsored non Muslim women to promote Muslim Women’s rights.

      Educated Muslim women and uneducated women has raised these issues over 3 decades. They have made submissions to all the committees set up. You have to visit quazi courts to see the suffering of the women. Muslim men wants to show that everything is fine in the Muslim family. It is not so. You men and the mullahs are covering up.       4. Any Sri Lankan Muslim girl over 12 years of age can be married off with or without her consent.

      5. If the Muslim girl is below 12 years old, they can take to a Qazi Judge, and he can give permission to marry, the girl, as low as 1 day old. All the non-Muslim girls in Sri Lanka are not subject to these abuses. Why?

      All the Sri Lankan Muslim girls should have the same constitutional rights as the non-Muslim girls. They can have any belief, based on their brainwashing about after life. There are enough qualified Muslim women in the country who are all subject to the above 5 Tribal rules currently. That is what that need change now.

      So, a Class Action lawsuit need to be filed against The Muslim Marriage and Divorce Act of 1951, showing that it is unconstitutional as it discriminates Muslim girls and women.

      Does Religion promote Child Abuse? Isn’t it the duty of the state to protect the Children from the Religious Nuts? What about women? Aren’t they citizens of the Democratic Socialist Republic of Sri Lanka? Or, are they tribal Chattel of the Ulema and Mullah?

    Thank you WAN for raising this matter. Muslim men would always say our women are happy and they have all the rights and they were given the rights before the West got it.
    In reality this is not true. Do the readers in this forum, know that men can divorce women without a reason and need not pay alimony. They can get married to 4 women. There are sections in the Quran to say treat all women equally, but this statement in the Quran is not enforceable.

    Congratulations WAN for exposing the myth of everything is rosy among the Muslims. We Muslim women are equal citizens of this country and we need to be guaranteed equal rights

        For your information. I am a true Muslim. According to pure Islamic law, women have a better place than most other religion. According to Sura Bakara, verses 236 and 241, payment of compensation is compulsory in the event of a divorce. This is referred to as Mathah. This section is not incorporated in the MMDAct. Holy Text are different and progressive than what the conservative men like you are talking.

        You do not know the Quran nor you follow how Prophet Sal treated his wives. If all are men are like Prophet, we do not need laws.

        You need to compare justice in the Quran to what is in the MMDAct and also what is in practice. Is there a place for kaikuli in the Quran.

        I have no reason to go to courts to seek redress for me, but I have visited quazi courts and also have listened to the sorrows of women who go for redress.

        Quran has given equality for women and it is men like you who deny us. I think by the way you write.

          What is the Definition of a Muslim? My understanding is that somebody who submits to God, that there is No God but God. There is no mention of male or female being a Muslim.

          All the other rules are related to tribal traditions and the need to for men to control the women. The men are using religion as an excuse to control the women and show their hegemony, claiming that the rules are dictated by God.

          900 years ago the Islamic Philosophers with Reason and observations went against the Ulema, and the Rulers for political reasons, sided with the Ulama, and sided with Revelation and Stupidity.

          The Sri Lankan politicians are doing the same today, with the Muslim Marriage and Divorce Act, and treating women as chattel, to be traded between men, against the citizen’s rights given in the Sri Lankan Constitution.

But let us not forget that white Christian women were not allowed to vote 100 years ago, could not own property a little before, and were restricted to long skirts and head coverings even earlier.Some Buddhist women, on the other hand, were not allowed to wear blouses 100 years ago.
    Christianity is 600 years older than Islam, and Buddhism 1300 years older. So let’s check in a couple of hundred years, shall we?

    The last sentence is called the word of Shahadah, that is, the sentence of witnessing.

    So, if one thinks that they can interpret the QURAN to their advantage using the Hadeeth – they are out of order.

    Women’s rights is a relatively new issue (60-70 years) so one cannot particularly fault Islam for a lack of progress. The lack of progress (as with much else in Islam) may be due to the over-emphasis on rituals and rules. Praying 5 times a day, wearing a headscarf outside the home, being unable to consume pork or drink alcohol, and the marriage issue highlighted by the article, are some examples. It is not necessarily the rule which is destructive, but the blind adherence to the rule, and the severe punishment for those who disobey. Without questioning the rule and instead, blindly adhering to it, the “motivation” doesn’t make much sense. Many years ago, as part of a real-life demonstration, I was able to see a smoker’s lung, which had black spots, the result of so-called cell necrosis. Since that time, I have not had a desire to smoke. Rather than threaten to beat, stone, or kill people, there are simpler ways to provide the motivation. Unfortunately, the Abrahamic religions would rather employ the techniques of corporeal punishment. The founders of these religions were mostly charlatans and their followers were more or less simple-minded. Science at that time was wrapped in philosophy, so people did not have much alternative when seeking more logical explanations.

    A banana republic like Sri Lanka would naturally have multiple different confusing laws, I guess. One for Muslim marriage, one for Kandyan, etc. Giving Buddhism the “foremost” place. “Achchaaru” republic. You cannot protect Buddhism or Buddhist through laws. Its only through voluntary behavioral changes like at least adhering to the five precepts. Laws should be equal to all, barring rare cases such as disabilities. Religious belief have no place when it comes to civil law. Yes, you may practice your religions as long as it does not contradict the law of the land applied equality. Marriage is a legal union, and should apply to everyone equally without exception. What someones God or enlighten preacher or whatever said is irrelevant, if you want to have a neutral/secular constitution. This also applies, things such as Language, Race, Ideology, Caste etc. One should not be considered superior to the other or given preference over another.

    Woman Action Network (WAN) you got your priorities mixed up before going into Muslim Marriages Acts and other fields just look around and see for yourself how Women are being used by the Media as tools for selling their medium. For instance take a popular English Daily its second section consists of a display of Women at times many in revealing swimwear and others scantily dressed,all this used for selling the paper.Their competitors not to be outdone are also moving in that direction keeping to the motto “Sex Sells”. Further its a common site to see at motor shows a woman also in revealing dresses or even in a bikini sitting on the bonnet of a car with the idea of attracting the opposite sex to the product to be displayed.

    Just look at some of our dance sequences in some TV channels(forget the Hindi ones who make Hollywood look Victorian) which are completely against our culture and these are watched by parents and children sitting side by side.

    Shariah law is law no one can change it…I fully understood the above article dose not intend to comment about Sharia Law however it concern on how it been applied …In Islam everything is perfect but we Muslims do not follow properly and do not allow all rights of Muslim women therefore this is not an issue of Islam but of Muslims…As a principle we must accept that there should be everything in MMDA re-visited and tested against Sharia Law, whatever can be done for personal law from sharial law should be put forwarded and whatever the customs which are not sharia law and against to constitution must be comply with constitution ..

    By all looks, WAN is impotent. They can’t do a thing to change laws pertaining to Islamic jurisprudence, since we Muslims living in SL have our own strong lobby to take care of Muslim interests. They are just one of the dime a dozen NGO groups trying to make an impact by the latest fad of Muslim bashing. They just come and go trying to look respectable and important to get some funding towards their cause. Islam has survived these types of onslaughts before and survived to simply crush them and roll on. If there are evidences of any real aberrations caused by any Muslims to propel their own self interests, then it must be looked into and situation corrected immediately by our own local bodies like ACJU, with women representation on board to study and resolve our own issues. Even in the short run, there is nothing really to get excited about, since the Muslims in this country are in safe hands. They tried it with Halal and failed miserably. Look at Buddhist country Thailand which is projecting itself as the Halal kitchen of the world. Then they tried it on Sharia banking, and failed again. Even failed on abolition of Islamic dress code. Again failed to stop the slaughter of cattle, when they were explained the negative fallout of the economics of such a move. Now we have this new circus called WAN. I am sure this is not the end of the caravan just yet.

      What Sri Lanka needs to do is to adopt the equivalent of the rules that apply in Muslim countries. Then there will be no mosques in Buddhist Sri Lanka, the Koran will be banned, a single system of law will apply in all matters….and so on. Paradise on Earth wouldn’t you say Marwan?

    Here we are in 21st Century battling to end the outdated ‘customs and traditions’ that have been firmly established by centuries of established churches. The so called, oft-twisted, ‘words’ of impotent gods who should, if reason prevailed have been relegated to the realms of mythology but still govern our present-day lives.

    The established ‘churches’ continue to persist and practice the age old neanderthal notion that women exist to serve Lord and Master, in bed and out.

    All right thinking people should rise and deal a swift kick to where it would bring tears to the eyes of those who would perpetrate and perpetuate these outdated practices against all women.

    This notion of Muslim women being reduced to second class citizen is a fallacy, which bears no evidence. If there truly existed such a thing, We would have already experienced a backlash. since Muslim women are quite liberated to jointly come out into the open and claim their rights to equality before the law. By the looks of it, WAN may be another group of disgruntled women working to an agenda whose main motive is to muddy the waters through disturbing the peace and equilibrium that now exists within the Muslim community. They have come forward with plans to discredit SL Muslims and denigrate Islam, in order to promote themselves as liberators of Muslim women. When in fact, the doors of opportunity are wide open for all Muslim women to pursue their dreams in higher education and moving into positions of authority, as long as they guard their hijab (maintain modesty in clothing, guarding their moral character and living their lives as true ambassadors of Islam) at all times. Of course, there will always be instances of marital abuse and mismanaged affairs, as poverty and backwardness in education are still major issues that need to be addressed and resolved successfully. However these aberrations are not the norm but rather the exceptions, since the majority of Muslim women have been given their due and rightful place in Islamic society, as guardians and unifying figure of the family unit, rather than as breadwinners and chief of household.
