Gotabaya Rajapaksa – War Criminal, Coward Or A President-In-Waiting?

With international pressure building up and a successful prosecution taking shape against him, the Secretary to the Ministry of Defence, Mr. Gotabaya Rajapaksa cashing in on the wave of success of his brother President Mahinda rajapaksa in local elections, is rushing to seek legitimacy and public support for a top job that could fall vacant in the near future. The sudden decision would have risen either from insecure complexities or as a precautionary measure of having immunity usually granted to serving heads and deputy heads of States against possible convictions in an International War Crimes Tribunal. It is also no secret that Mr. Gotabaya harbors great ambitions to fill the shoes of the President in the event the position becomes vacant, either due to an unexpected death of the latter or due to a ruling by the Supreme Court arising from a successful petition against the President for seeking an illegal third term. As for the legitimacy of the third term, only the voter should have the right to approve changes to the Constitution. By not allowing thieves, rapists, sports stars and actors to sustain a despotic regime, thanks only to their popularity, the crossover MP’s should have no mandate to vote for President Rajapakse’s third term, especially when they had hoodwinked and convinced the ignorant voters into believing that they would act as opposition members in the parliament! We as a right-thinking nation cannot allow 150 plus individuals to hold the nation of 20 plus million as hostages!

Believing it would be unfair to the readers as well as to Mr. Gotabaya if the title of this article is not explained, I hope the following will shed more light on this elusive and the most-feared character of our time.

Living in a country where anyone charged of a crime is guilty until proven otherwise, there are serious allegations and over-whelming evidences of war crimes committed by Sri Lankan armed forces on direct orders from the Defense Secretary Mr. Gotabaya Rajapaksa. While he claims credit for coordinating and directing operations and winning the war, wouldn’t it be equally right for him to own up to any breach of ‘rules of engagement’ occurring especially at the last stages of the war? And yes, your guess would be good as mine.

Having been appointed Defense Secretary in 2005, the soon-to-be-super rich Mr. Gotabaya devised a plan to cut the ‘middle men’ when procuring arms for the forces and registered a company under the name of Lanka Logistics.  However noble it may sound, it was not to be so since Mr. Gotabaya became ‘middle man’ himself! Understandably, it was not fair to ask questions about arms procurements during times of war for fear of the enemy having a head-start should they come to know of the types of weapons and technologies purchased. But with LTTE pretty much buried for good and five years after the war has ended, shouldn’t the public be made aware of the types of weapons and at what costs it was purchased? For accountability issues and for purpose of audit and good governance, shouldn’t the government also table all related documents which in turn could also clear the good name of individuals involved in procurements?

The widely reported MIG aircraft deal in 2006 stank so much of corruption at the highest levels, that it also took the life of the famous son-of the-soil Lasantha Wickrematunge and exiled many others. As a mark of respect to the slain editor of The Sunday Leader, I will publish the webpage link that which explains the story in detail and as a reminder,

With Mahinda Rajapaksa government backed owners controlling the editorial board of the ‘The Sunday Leader’, the defamation case brought by Mr. Gotabaya against the same newspaper over the same story is now a foregone conclusion. I could only pity the TEC evaluation committee and General Fonseka for being pawns and so gullible in a ‘get-rich’ game where only the Rajapakse clan know how to win.

Apart from questions that Mr. Gotabaya needs to answer over corrupt procurement practices, serious questions arises over injuries and deaths suffered by government forces possibly due to inferior defense systems/arms and aircrafts. Human lives are priceless and however bitter it may be, the truth need to be told to the grieving families if it differs from the original version. While believing that nobody is above the law, I find myself in ‘no man’s land’ waiting for the ‘nation of cowards’ to open the can of worms!

As for Mr. Gotabaya’s explanation on Lanka Logistics and his Rakna Aracksha Lanka Ltd. (RALL) being ‘government owned’, his modus operandi is now public knowledge after the expose of multi-million USD agreements/understandings with government henchmen owned businesses where the profit sharing basis is skewed in certain illegal ways and where the local law enforcement officials fear to tread to investigate any kind of irregularities!

Excerpts from interviews given by Mr. Gotabaya to BBC soon after the war, followed by questions that would NEVER be answered;

“Betraying a country is a crime and it is treason and will hang Sarath Fonseka should the General testify in an independent war crimes investigation”

If betraying one’s country is treason, shouldn’t Mr. Gotabaya’s punishment be ‘death by hanging’?

 “I am not worried about war crimes allegations”

Then why hide like a rat and a coward and not be amongst ‘men of honor’?

Dissension against the war is treason”

Then I guess suppression of independent media would be justified, is it?

“Investigations WILL NOT bring reconciliation nor does the public want it”

How and when did victims or their surviving kith and kin give the right to Mr. Gotabaya to speak on behalf of them? And to set the records straight, EVERY Tamilian in this country and every right thinking individual, irrespective of what community they belong to, would certainly lobby for an independent investigation, provided it is safe to do so!

    Very good exposure.

    Will Gota ever take up his green card status in the USA and settle there. That is a dead issue for him now. For him to settle down without diplomatic immunity is suicidal.

    The only option for him is to empower himself further and enjoy the diplomatic impunity for rest of his life in Sri Lanka. That is the only protection he has to safeguard against war crimes judgement in the near future.

    He may have to apply for a read card instead to settle in China,

      I completely agree too. This is a huge risk to remaining democracy in SL. If MR die or killed in the near future, Ghota would be ready to take over, but Ghota has no much time or patient to wait for big brothers formal retirement… Worse would be if MR is defeated by SI-CC type process, then Ghota would call all his military diplomats around the globe and UN Shawendra guy back home and take over the power by military coup.. Be ready….

          What an idiot you should be.

          As people would see it clearly today, it was not ONLY MR-GR comination but almost everyone not forgetting army, navy and air forces all deserve the credit of the war; also all other leaders sacrificed a lot until MR regime earned the relay race of the 30 year old war.
          As any political analyst would see it unbiased, any other presidents could win the war millitarily if they were too crminal minded: If all other presidents wanted to win it by killing and sent missing thousands of own citizens, they would have done the same.
          What I dont undrestand is JVP made it clear, immediately after MR took the office, he was not even interested in fighting the war to the manner he did it 2009. The very same man was sitting in the parliament for a period of 43 years and if only his magical powers brought war victory, this could also have achieved decades ago, I feel.
          Having listend to some grivances of the nother victims that lost their sons, husbands and other relatives even after the war is no long there – I feel – all these are perpetrated killings tactics of the Rajanos. They only know how to harm fellow human being regardless of being the race and religion most of the time. Recent attacks made on to Muslim community proves this further.

            Yes everybody including VP contributed but MR-GR combination was the most crucial and historic factor in the victory and it is a fact that you or anybody cannot change with silly remarks similar to what you brought in. Yes MR utilized his 43 years of political experience which nobody else in the world possess, towards the win when he got in to full power and he, though he did not want to go to war, also listened to the people of this country who therefore determined to save them in gratitude to the risks they but no other leader took, knowing that they’ll have to face the so-called international community, who is nobody but the looters of the third world countries I earlier mentioned.             Nothing became cheaper even if the war is no longer there – though everyone incl me thought things would become much cheaper in no war situations. On one hand telling that development projects are being financed by huge loans, but in the same time, they say, people have to suffer little bit when the country is being developed…. ?

      Why do the US NOT yet question the alleged war criminal/US citizen ( not a green card holder but a citizen – possessing the RIGHT to vote for US elecitons too) as it is also the regulations of state law ? Or is there any special provisions in the law that only funtions for this kind of citizens. As far as my Knowledge is concerned if I as EU citizen would go wrong during my few weeks I always spend in the home country -Srilanka, they follow me up for questioning: aLL these are settled via their embassies- here for example it should be through US embassy in Srilanka.

      This could well be the reason, these guys, none of them are reported to have travelled to the US all these recent years ? Or please add you have to say about this.

        Last year Jordan made it constitutionally impossible for a citizen of any other country to be an MP in Jordan. This meant that a number of parliamentarians having dual or even triple citizenship were disqualified unless they gave up their non Jordanian citizenship and committed themselves to be whole-hearted Jordanian citizens. It amazes me that we have so many people in governance over us with only divided loyalties to this country. The fact that they can cut and run in times of trouble, when most of the population have no alternative but to stay and put up with the result of their actions or misdeamours, is surely no guarantee that what they legislate for the country is necessarily in its best interests. And now it is beginning to seem that even a future President may have loyalties to another country instead of undivided ones to the country he comes to govern.

          I dont think- in today´s context – candidates like GR would be easy to cut and run in times of trouble – since today MR regime has close ties only with Swaziland, Iran, Pakistan,Few of Afro states, China and Belarus. This was made glass clear in UNHRC sessions in last March. So I bleieve, in trouble times, these buggers will have no big choice and could be the main reason that the speculations about GR entering active politics in the country near future. China´s diplomatic ties are fine so long MR regime would sign any commercial deals with them one behind the other. Gonraja is caught by China

        Americans cannot be the guide to a Buddhist state. We are blaming the Americans and the British for every sins we shamelessly do. We are independent for over 60 years. There were more killings during post independence than the pre years under British rule. Our passive Buddhist religion did not help us to be compassionate and the post independence Buddhist Sri Lankan governments have committed more deaths and destructions against our own people than the British and Americans did against their people.

        When I read the blood thirsty comments of my Buddhist brothers in these columns I feel ashamed to be a Buddhist. Mahinda and Gota are leading this crusade.

      If the nature would create the vacuum – sure it could be that GOTA be the president in Waiting in today#s context – since majority masses of this country are villages that are the vulnerable folks – and the voter base of the Raja oligarchs. Looking at the recent outcomes of the held elections, one may feel people are misguided. Perceptions made in them will even elect GR as the next president. As NV made it clear high literacy means only the reading ability but leaving the realiizing talents.

So, let the public at large decide who should be the President of this country by popular vote and not the so-called international gang and their cohorts in the NGO and their ecumenical evangelist or Wahhabi and Salafi tawheed fundamentalists.

          I am indeed grateful to you for you have called the spade a spade in no uncertain terms. Though I haven’t gone into that much detail to prove it, I have commented under many threads here that this so-called ‘native vedda’ is no Vedda but a kallathoni from the East. It’s a waste of time to describe him more than that for Vedda chief himself told me that he has no relation who writes to CT in English language.

            INDIAN AIR FORCE IN SRI LANKA

            Operation Poomalai – The Jaffna Food drop

            The day was June 3rd, 1987, and the place was the Maharajpur Air Force Station near Gwalior. Home to the two elite Mirage 2000 Squadrons of the Indian Air Force, Maharajpur was one of the key airbases of Central Air Command. The time was 0530 hours. Daylight has not yet broken out, when Wg Cdr Ajit Bhavnani received received an important message. Bhavnani was the Commanding officer of the No.7 Squadron ‘The Battle Axes’. He was the first CO of the Squadron after it had inducted the state of the art Mirage 2000H fly by wire fighters and was himself trained in France before the induction. He had commanded the Squadron for over three years and was preparing for his move to Air HQ after his tenure was to end on June 22nd. However fate seemed to have destined that he would fly just one more important mission for the country. The message he received was a directive to immediately move some of his aircraft to the south of the country. The destination was the HAL Airport in Bangalore. A giant Illyushin 76 was allocated to him to move supporting personnel and equipment to Bangalore airport.

            At 1130 Hrs, Bhavnani took off in his Mirage 2000, followed by five of his most experienced pilots which included S/L ‘Joe’ Bakshi, S/L NA ‘Pots’ Moitra , JS ‘Panne’ Panesar and Keshav Sidhu. After the one and a half hour flight, the Mirages approached Bangalore airport but were directed to land at Yelahanka airfield to the north of Bangalore. The Pilots had no idea as to what their mission was. Only towards the night at around 2100 hours did the pilots get their briefing. They were to fly as escorts to a group of An-32 Transport aircraft that would be dropping relief supplies over Northern Sri Lanka.

            Far away in the north of the country was the Paratroopers Training School (PTS) at Agra. Normally the PTS main task was to provide Parachute training to Indian Army soldiers of the Para regiment. Their task was to help out in daily paradrops as well as train Para Jump masters and Skydivers. Just as the Battle Axes received the surprise orders to fly south, the PTS got the surprise orders to prepare for the task of dropping supplies over Jaffna. The ground crew were working hard in loading five An-32 aircraft with ‘relief’ supplies, Dried rations and vegetables packed in cartons and canvas bags rigged with Parachutes. Overseeing the loading operation was none other than the Vice Chief of Air Staff , Air Marshal S Raghavendran himself. The An-32s would be the first Indian aircraft that would be transgressing the airspace of another nation for the first time since the 1971 War. The mission to drop supplies over Northern Sri Lanka in the Jaffna Peninsula was named ‘Operation Poomalai’ (Garland).

            The genesis of the story had started several years earlier in Sri Lanka, when the Sinhalese government put restrictive measures on the political freedom and rights of the Indian Tamil minorities. Opposition to the official repressive measures took a violent turn with the rise of tamil militancy and soon a number of militant groups like the LTTE , PLOT, EPRLF, TELO etc were operating in the Jaffna Peninsula against the Sri Lankan armed forces. Years of insurgency and fighting between the Sri Lankan Armed Forces and the Militant groups were interspersed with infighting among the Tamil groups themselves. This was followed by an allout offensive by the Sri Lankan Army in the summer of 1987. The offensive was moderately successful. The SL Army enforced a blockade of Jaffna that not only cut off the basic supplies to the entire civilian population, but also had put the major tamil militant group, the LTTE on the back foot. As the Sri Lankan Army started making gains in the Jaffna peninsula, concerns were raised in India on the future of the Tamil minorities in Sri Lanka. Even though it was the internal affair of Sri Lanka, the events in Jaffna raised considerable emotions and tensions in the neighboring Indian state of Tamil Nadu, where the tamils were seen as brothers suffering under the Sri Lankan govt policies. Whatever may be the legalities of the issue, the Indian Government of that time felt that it could not stand by while the Tamil minority representative groups were locked in what seemed as their last battle for survival.

            In late May, the Indian government informed Sri Lanka that it was sending a convoy of relief supplies to the Jaffna peninsula by a ship convoy for ‘humanitarian reasons’. A flotilla of Indian boats carrying more than 1000 tonnes of supplies were turned back by the Sri Lankan Navy as they approached the territorial waters of Sri Lanka. The sending back of the Flotilla was seen as a great victory by the general populace of the Sri Lankan capital Colombo, and it was greeted with Jubilation and ‘Victory’ celebrations. It was quite clear that the Indian government was not going to take this living down. Plans were afoot for another drastic measure. It called for an aerial supply drop.

            Back at Agra, the ground crew were helped by army personnel in loading the supplies onto the aircraft. The Aircraft were to fly to Bangalore after daylight and carry out the supply drop under the escort of Mirage 2000s. Around 0800 hours, the An-32s of the PTS took off for Bangalore flown by supporting aircrew. The actual aircrews who would be participating in the airdrop were already flown to Bangalore the previous night so that they could catch up with some rest. Gp Capt BK Sunder, the CO of PTS was to lead the An-32s over Sri Lanka. The final briefing was conducted by Air Vice Marshal Denzil Keelor, the ACAS (Ops) who had come down from Air HQ to Bangalore.

            At 1500 Hours, the Sri Lankan Ambassador in New Delhi was called to the Ministry of External Affairs office. There he was conveyed the message by Mr. Natwar Singh that Indian Air Force An-32s would be taking off at 1600 Hours from somewhere in India and would be dropping supplies over Jaffna. The ambassador was told that the aircraft were expected to complete their mission unhindered and any opposition by the Sri Lankan Air Force ‘would be met by force’ by the escorting Mirage 2000s. The warning was unnecessary – The Sri Lankan Air Force hardly constituted a ‘threat’ to the IAF. It had a handful of Turbo prop Siai-Marchetti SF260 and Argentinean FMA Pucara Twin Turboprop counter insurgency aircraft. They would be no match for the digital deltas in a fight. The only opposition if any, would be that of ground fire from the Sri Lankan troops.

            About the same time, the aircrew at Bangalore were making their final checks on the An-32s. There were a large number of domestic and International journalists who were at the airport covering the mission. It was decided let them fly in the An-32s to cover the flight. A group of 35 were finally chosen and all of them embarked the powered up An-32s in teams of seven each. At 15.55 hours, the first An-32 took to the air piloted by Gp Capt Sunder and Flt Lt SR Swarup as the co-pilot. It would be a round trip of 900 km awaited them to Jaffna and back.

            Designated as ‘Eagle-Mission-4’, the An-32s formated and climbed upto 12000 feet altitude. As they crossed the Coramandal coast at around 1645, they were met by four Mirage 2000s led by Bhavnani who had taken off about the same time as the An-32s. The Mirages were carrying three drop tanks and two Matra Magic II Air to Air Missiles, just in case the Sri Lankan Air Force made an appearance. As it turned out later, they were not needed.

            As the transport aircraft were crossing the Palk straits — the stretch of water separating the Sri Lankan coast from the Indian coast, the Mirages maintained station about a 1000 feet higher than the An-32s. They were constantly making inward turns keeping the An-32s in sight all the time. A fifth Mirage was flying around the Indian coast acting as the radio relay. Two An-32s were also flying standby and acting as relay over Tamil Nadu – keeping the main supply dropping force in radio contact with the brass sitting in Bangalore.

            The mission leader Gp Capt Sunder attempted radio contact with Colombo ATC at 1647. Inspite of repeated calls, nothing apart from static was heard. Sunder repeated the call over the Civilian air traffic radio channel and still no response was heard. It was clear that the Colombo ATC were listening in but were not responding, for Madras ATC was able to clearly pick out the radio calls over the civil channel. Sunder then continued calling on the channel, finally mentioning that Eagle Mission 4 was headed towards Jaffna on a mercy mission.

            By 1650 hours, the aircraft have approached the Jaffna peninsula. The An-32s slowed down and descended to just 1500 feet AGL. Jaffna town was in sight around 1700 hours. The rear Cargo doors were slid open and with the command given, the supplies slid down the cargo hold out of the aircraft. The White Parachutes ballooning as soon as the boxes left the aircraft. The supplies drifted down to the drop zone approx. 7km from Jaffna. Their mission completed the transport aircraft regained altitude and made a 180 degree turn. Perhaps in an unintended slight to the Sri Lankan Air Force, the formation overflew Palaly airbase in the north of Jaffna Peninsula, in full sight of those on the ground. There was no opposition to the aircraft at all. Nor did the aircrew observe any aircraft on the ground either. The aircraft continued in westerly direction for sometime before turning North.

            It was 1813 hours by the time the lead aircraft touched down in Bangalore . Once on the ground, there was much cheering and celebration for both the transport and fighter pilots. It was a job well done . AVM Keelor took the Battle Axes pilots for dinner. The Prime Ministers Office sent its congratulations to the Aircrew and units involved in the whole operation.

            The aftermath of the supply drop bought forth heavy recrimination and diplomatic flurry of allegations and counter-allegations. Sri Lanka accused India of “blatant violation of sovereignty”. India insisted that it was acting only on humanitarian grounds. The United States expressed ‘regret’ but refused to further comment on the incident.

            The supplies dropped amounted to not more than 23 tonnes and was not substantial at all. But it sent a message to the Sri Lankans that India would not be a bystander to the ongoing civil war. If it was against the interests of the ethnic Tamil minorities, then it would be against Indian interests as well as there would be corresponding repercussions in its own indigenous tamil population. The supply drop was intended to be a message – and it succeeded in driving home that point to the Sri Lankan government. The siege of Jaffna was lifted – and cease-fire declared.

          Muslims are not judged by their names they carry, rather by their beliefs and behaviours in compliance with the Noble Quran and the authentic sunnah (statement) of Prophet Muhammed (pbuh). If a Muslim denies the Islamic Shariah, by default he/she has stepped out of the fold of Islam.

All man-made system of governance is falling apart and the evolution of Islamic Finance / Economy will be the ultimate choice; first to individual Muslims and then it spreads to their communities and their states.               In order for a place to contain something, it must be free from whatever contradicts it. This principle applies to mankind and all creation as well as to belief and desires. So, if the hearts is obsessed by belief in falsehood, there will be no place for truth.

              Accordingly, if the tongue is involved in trivial discourse, one shall be incapable of useful speech, unless falsehood is abandoned. Hence, if the body is busy doing wrong actions, then acts of worship will be inapplicable unless these contradictory actions are abandoned.

                Experts truly believe that Rizzan´s life could have been saved – if the govt parties paid whole hearted efforts in that regard.

                If I have millions, all what I would do is – to donate those millions to allow poor women roaming in those camps in Middle east. If rulers have hearts, they should better focus on these issues than making further efforts to fat their own pockets.
                One plane load could bring those poor of the poor men and women from Saudi camps to the country allowing them to die on the soil they really belong to.

              You’re correct. Al Baqarah 256 or Koran 2:256 says, there shall be no compulsion in [acceptance of] the religion. And that’s the only verse Koran that offers some consolation to non-Muslims. For that reason, 2:256 is the most favourite verse of the so-called moderate Muslims. Google it you can read the context why Muhammad read it.

              There are literally hundreds of Hadith examples like Sahih Muslim 1:33 and verses in the Koran like 8:39 that says fight them (non-Muslims) until there is no more Fitnah (unbelievers and polytheism). Lets face it, that’s true Islam.

              Look at the fights in Pakistan and Iraq today. Muslims are targeting Muslims. They fight to impose true Islam on apathetic Muslims. Interpretation of Koran verses (Allah’s law) and Hadith (life of Muhammad) make Muslims to fight each other and non-Muslims all over the world. What a religion?

              Acting like a good all-round Samaritan and egalitarian, Muslim Fazl talks about “a group of power hungry people who are extremely corrupt and who will kill or injure anyone standing in their way.” Fazl knows the majority do not agree with him. Yet, the likes of Fazl think they can corrupt the mind of majority voter by writing lies. They’re sadly mistaken for entire country continue to enjoy peace and prosperity. And they’ll vote MR in coming up elections.

        I do not know what you’re talking about. I think people in Sri Lanka has many ways to show their opposition to the President and the governing party. Just count how many private TV channels, radio stations, daily papers, weekend papers, web journals Sri Lanka has. Never mind LeN like garbage is censored, they all can be accessed by typing the word ‘unblock’. Man-gala use that trash without shame. LeN recently attacked even Mahanayakes in a filthy way. If they think they can get votes to opposition that way, they’re mistaken.

        Elections are violent in most third world countries. Google and count how many people get killed in India, Bangladesh, South Africa, Kenya and etc. at their elections. Remember the Wayamba elections under Chandrika and before that the lamp and pot game under JRJ. I think our democracy functions far better now than any time before and far better than in those countries.

        These days, we can watch protests daily at News at eight. Many of them are village protests for local matters. And they get what they want without the help of radicles. Professional protesters like NGOs and three wheel parties stage their protests in front of Fort railway station and Lipton circus for international clique and their media. JVPer want to kick start a new revolution in a new way by getting students to march along main roads, have sit-ins in the middle of the main roads, driving trains slow and etc. Needless to say students put public into immense inconvenience. So public have no sympathy for them. In Weliweriya to it caused a great inconvenience to the mass. Lawyer sharks whom public hated thought they’re liked by the public and hence staged the Haltdorf spring for the corrupt CJ. And majority Majority voters do not like any of it. That’s why they keep voting MR and the government.

However, even beggars analyse the options available to them before taking decisions. Being able to read and make them better decision makers.     The Americans did not expend all that money and time and political capital in Geneva over three long years, to let this matter die down. They work to long term plans backed up with strategies put in place by highly qualified and articulate officials. They obviously have a game plan, and that must involve regime change in Sri Lanka. There are many ways they can try to achieve this:

    1) Wait for the UNHRC Report in March 2015, and together with the UK and EU, using the evidence in the report, impose targeted sanctions on members of the regime and members of the Cabinet, Ministry Secretaries, and their families including travel bans and asset seizures. This will destabilise the entire Cabinet and Heads of Public Administration, who will turn against the Colombo regime. The US, UK, EU Trio can also cripple the economy by blocking US Dollar, UK Pound and Euro transactions by any bank, especially the state banks in Sri Lanka. As in the case of Russia, the US Government can ban Visa, MasterCard and American Express transactions in Sri Lanka. The consequences are unimaginable for a puny economy like Sri Lanka’s and will affect the poor people and employees in the hotels very badly. All imports will come to a halt, as well as all export earnings. So let us hope and pray bank sanctions are not imposed.

    2) The US can try to remove the ‘brains’ and power behind the throne by removing from the scene the regime brothers who are US citizens. This can be achieved in two ways.

    a) By removing them on war crimes charges to which all US Citizens are subject. All the US has to do is issue international arrest warrants through the FBI, and 90% of the countries will oblige. Compared to the US, Sri Lanka is nothing in the world. Recently the FBI issued warrants against a number of high ranking all powerful Chinese government officials and they are now effectively caged and prevented from travelling to any democratic country as the FBI Warrants are out there.

    b) If the US feels that one or more brothers will try to obtain immunity by assuming a high political office in Sri Lanka, the US may spring the trap much earlier on the basis of an FBI Warrant for tax evasion by a US Citizen. Lately, any American or US Green Card holder having any bank accounts in any country has had to declare it. Even Sri Lankan banks have been very quick to oblige the US. The regime’s inner circle have their ill gotten gains stashed all over the world. But the US, with their NSA spying, as revealed by Snowden, has been targeting terrorists and everyone else, including bank data and emails. They probably have a very large dossier on hand already. They can do an Al Capone strategy. They got Al Capone initially on tax evasion. Everyone in Chicago was scared to give any evidence in case they be taken away in a proverbial white van by Al Capone. The evidence for tax evasion was all on paper, so no need for human witnesses. But once Al Capone was removed to jail, pending the tax case, all his right hand men, left hand men, boot lickers, puppets, and the frightened citizens came out and gave evidence on the crimes other than tax evasion.

    The Sri Lankan government attacked Navi Plliay in various ineffectual, crude and hopelessly useless ways including accusing her of partiality to Tamils as she is a (highly eminent) ethnic Tamil from South Africa. But with all those insults behind her, she will next week announce the inquiry panel on Sri Lanka, and then retire. The panel will have a life of its own, and Sri Lanka will be tried in absentia if we do not participate. But the worse news for Sri Lanka is that her replacement is a MUSLIM! OMG must be what the BBS and their puppet master is saying now. How will Prince Zeid Ra’ad Zeid Al-Hussein feel about attacks on Muslims in Sri Lanka when he reads SLMC’s submission to the UNHCR? But rest assured that as a highly qualified and respected diplomat, the new chief of the human rights body will be unbiased. But he is a much tougher individual and much more committed to protecting human rights than even Navi Pillay. Mr Al-Hussein, 50, graduated from Johns Hopkins University and received a Ph.D. from the University of Cambridge. So, no doubting his eminent qualifications. Will Mervyn offer to marry him too? After all, Mervyn is a Dr. too according to Sri Lanka standards. Dream on Mervyn and get the BBS to begin insulting Prince Zeid as a Muslim. Let’s have some fun.

    With Modi pushing on other fronts, the traps are set on all sides. Let us hope that Citizen Silva and the hardworking people of Sri Lanka do not get economically squeezed, and that the sanctions are highly targeted.

        India and USA supported the war on the basis of MRs promises that
        the cause for the war will be settled amicably- MR has gone on
        record immediately after the war in his Statement with the UNSG. All
        these have been reported on repeatedly.

        Now that MR has pulled back – of course with a hidden political agenda
        matters have gone into a new twist. Further the promises held out
        did not guarantee safety from breaches of International Law.

              The facts are to win their electoral votes – many countries where Tamil and other diasphora are held need to the win the hearts and minds of them. Gaps of amount of the votes are reported to be sometimes not even few hudreds to few thousands. This was the case with Millibrands and other candidates too to cry for the tamil or any other issues in our countries. Else they the folks are not very much interest in external political issues.
              However, our leaders should be able to handle all these throug their diplomatic channels. Unfortunatley, the ones appointed by MR regime are not worth suitable to clean those offices have led us devasstating the ties between the countries.

They don’t need to go to the UN where Russia and China consistently side with the most obnoxious dictatorships in the world, from North Korea to Syria to Zimbabwe. That is to be expected as they are dictators themselves, with A+ rankings in state thuggery and censorship. So the UN is a waste of time for ordinary citizens in suppressed societies seeking justice. Considering that 80% of our exports go to this trio and 95% of our international transactions are in their currencies should already be worrying the government.           what do you think about the upcoming war crime investigation ? since MR led administration has flatly rejected any sort of cooperation extending towards the investigation team , how would they conduct any forensic tests/crime scene inspection/metrical evidence to convince the IC about their finding in the end ? i suppose all the testimonies/ evidence can be gathered through SKYPE but what about the rest ? there are enough materials already been compiled by various organizations ( PoE, US state department report , INGO’s reports , Tamil Diaspora’s reports , C4 films etc ) all they need is to verify these serious allegations beyond reasonable doubt , for instance the alleged killing of Praba’s 12 year old son , to date i ‘ve not seen any video clip which does the actual killing , so all these allegations are subject to scrutiny before a court of law , i’m sure N pillay must have worked out a strategy to overcome the logistical nightmares , but would it be acceptable ?

          will the regime be better off with her non compliance strategy with the UN or will it be a suicidal mission ? there are enough prima facie evidence cases which have the dates , times , locations , perpetrators and the victims , will the US CIA provide necessary satellite images and recoded conversations to back these allegations ??

    We should wait for the UNHRC inquiry and report to classify him a hero, saint, sinner, war criminal,coward or a combination of two or more of these. How this inquiry will define his role in the war and labels him, will determine whether he will be the president-in-waiting or otherwise.

    Every person is entitled to due process. Although he stands accused of not granting the right of ‘Due process’ to others, he is entitled to the right to defend and vindicate himself in the eyes of humanity.

Both sides committed unacceptable acts. I will take a wait and see attitude until the details and circumstances are revealed by the UNHRC inquiries. This is not an absolutist stand by any standard,

      This Kondeminah, is trying to justify Gota’s involvement in the shady MIG deal he made money and other deals of arms purchase through his Lanka Logistic Company, that did the trick, implying that the Forces used these weapons to defeat the LTTE. No the Forces did not have the need to use any of the arms purchased, because at the behest of the assurances given to VP after he helped MR become President, VP got the LTTE to bury all their armoury, then abandoned their stronghold Kilinochchi and assembled on the Beach front to surrender and was massacred. So what is this bugger talking? The truth is Gota made a lot of money from the purchase of arms to the Forces through his Lanka Logistic Company, that was not required to defeat the LTTE. The LTTE including VP were sitting ducks on the Beach front.

          Where were you from 2007 to 2009? It was advertised in the Govt media itself that when the Forces had walked in to Kilinochchi in January 2009, the LTTE with the civilian population had left Kilinochchi to Puthukudirippu. There was no fight to secure Kilinochchi, not even a single shot fired. Then where were you when the MR Govt boastfully displayed at the BMICH after the war ended, the LTTE armoury that was unearthed, found buried? Can you explain why the LTTE buried their armoury and abandoned their stronghold Kilinochchi? If the LTTE was fighting the Govt Forces, will they bury a single weapon or abandon their stronghold Kilinochchi which had enough bunkers to give cover for them?

          I have quoted from the sequence of events advertised in the media itself reference the war. If you refer back when the forces entered Kilinochchi in 2009 January there was not a single Tamil in Kilinochchi as all have vacated. This never got highlighted due to Lasantha’s murder in January 2009 which took centre stage. Then the Dayata Kirula Exhibition displayed the entire armoury that was unearthed to celebrate the War Victory. Yet again the media exposed this. Then as for the massacre of the LTTE did not take place in Kilinochchi but at Nandikadal Lagoon, once again through the media including Channel 4. So what more proof do you want reference the above?

            You have not proved these so called “assurances” and hence it has nothing other than gossip value.

            When you claim ALL their armoury was buried before moving out of Killinochchi, the LTTE would have been defenseless after leaving Killi.

            This is obviously not true as they fought with heavy weapons even from the No Fire Zones.

            The LTTE buried weapons that they could not take with them, in order to prevent them falling in to the hands of the SL forces and for later use if they managed to infiltrate the area behind SL forces line of control.

            The fact that the LTTE carefully greased and wrapped them in polythene, before burial instead of abandoning them does not support your inference.

            What did they fight with after they left Killinochchi?

              Why would VP abandon his bunker in Kilinochchi built with fortification? This bunker of VP was left, without being destroyed by VP, for MR to market it to the South to boost MR’s moral after surrender, where he first he helped MR to win the Presidential Election. It is for this reason that VP went with the game plan of selling a look alike, before as VP to have died. Besides VP should have died in his bunker, which was the most safest place if ever there was a battle and not on a Beach front. Believe me if there was no foreign assurances, from India and America, VP would not have done what he did on MR’s word alone. LTTE was defenseless after leaving Kilinochchi as they had no heavy artillery to fight. That is why it was easy for the Forces to annihilate the LTTE.                     You claimed that the LTTE did not have Artillery after they left Kilinochchi but Darusman says the LTTE had even Multi Barrel Rocket Launchers and other Artillery even inside the 2nd NFZ (the strip of Land between The beach and the Nandikadal lagoon). Thus proving that you Lied.

                    You said what fortifications and tried to deny the fortifications but Darusman says the LTTE leadership had a complex network of bunkers and fortifications and a series of defensive earth bunds throughout the zone and mortars and other artillery positioned amongst IDPs. It proves that you lied.

              Off the cuff,
              I bet this bugger gaminiya lives in a cold damp basement in the UK and barely manage to scrape his living with his pension. Needless to say, he cannot afford to come back and live a better life here in Sri Lanka. That’s one of the reasons why he and people like him dislike MR ending the war and making a progress with peace and development. There was a time that those who were doing menial jobs in the UK used to come back for a short holiday and splash a bit of money to show off once a year. Not anymore. Even if they could afford a cheap holiday here, they definitely cannot afford to hire a decent SUV to show off their old mates.                     The LTTE was on the run. They could not stay in one place, in killi or anywhere else. They were outnumbered 10 to 1. Their ONLY salvation was escape either with foreign help or by themselves.

                    The Beach was on the East of the NFZ. VP’s last stand was on the West. The fortifications were on the West. Did Darusman claim their were fortifications on the Beach?

    Gotabaya Rajapakse has so much ill-feelings floating around, its shocking he has not collapsed with a heart-attach or brain tumor yet. Its revealing to see the range of writers wishing this or that on him.

    As for the US angle: There has been wide-spread speculation if he is a Green card holder or passport holder for many years. I do not recall if a single media outlet ever asked the US embassy for clarification of his status. They should have no issues in confirming his status because he is a public figure. They will not reveal the circumstances of his application ( Political asylum etc.). One can then frame a valid discussion about the American aspects of his alleged activities.

    As a US citizen, he cannot be involved in any of the activities alleged. He cannot give or accept a bribe..ha ha ha. Try proving that one!

    As a Green card holder , he has a little more wiggle room. Just a little more. The US can cancel his Green card if they choose to, if the alleged activities took place.

    When it comes to War crimes, none of the limitations apply. They can go after you, under all circumstances.

    Bottom line: The US is not bothered about ‘ants’. If China does something in the area, that pisses off India, and Modi asks Obama for help; and the dumb Rajapakses are involved in facilitating China’s actions….then wait for the proverbial axe to fall. The US will pay lip service every once in while to remind the Rajapakses that they are watching their every move. The US knows exactly where all the Rajapakses hide their ill-gotten gains.     1. Many thoughts and ideas are being bandied about. But let us take a look at a few salient points in this noodle soup.

    2. In war as in life, a few things are black and white. But there are many shades of grey.

    3. War is horrible and people die. The LTTE was a terrorist organisation and it was and is still designated as such by the US, Canada and India, amongst other countries.

    4. The US and India in particular gave tremendous support to eliminate the LTTE, providing real time satellite information to the Sri Lanka Navy to intercept and sink LTTE arms ships

    5. Non of these countries gave that support so as to annihilate tens of thousands of unarmed Tamil civilians. The support was only to finish off the LTTE

    6. The LTTE, far from protecting Tamils, deliberately placed them in harm’s way by using them as human shields, not to mention other massacres of Tamils by the LTTE

    7. When it became apparent that tens of thousands of civilians would get killed during the last stages of the war, the US with the support of Canada, UK, India etc was ready to implement a ceasefire (there were even US Navy ships on standby). The war could have ended without the massive carnage, and Prabhakaran and all his assistants in including KP and Karuna would today be facing trial at the International Criminal Court (ICC), or been already sentenced to life in prison (there is no death penalty or electric chair at the ICC).

    8. If we had followed that route, there would be no war crimes charges today against the Colombo regime. Only the LTTE would have been charged. Today, only KP is and Karuna are left to be charged from the LTTE, and they should be charged for the war crimes and genocide perpetrated on the Sinhalese and Tamils by the LTTE. The Sri Lanka government can and must refer them to the ICC. See point 10 below.

    9. Given that the LTTE used the Tamil civilians as human shields, and they obviously could not be saved without that ceasefire, there is still no excuse for shooting unarmed captives with their hands tied behind their backs, or killing Prabhakaran’s son or so many other captives killed in that manner. Those are war crimes that will come back to haunt the regime in Colombo as well as all true Buddhists of Sri Lanka Even during the brutal end to the JVP’s killing spree when Wijeweera was killed, his family was spared and kept in safety in a Naval camp for many years. That was the correct thing to do, whether to a Sinhalese or Tamil or anyone else’s kids

    10. The US does not need to go through the UN Security Council (where a veto by China and Russia awaits) if the prosecution is against one of its own citizens. US Citizens in the Colombo regime can be tried under US law or the US can opt to refer them to the ICC though the US is not a party to the Statute.

    . A State not party to the Statute can also accept the jurisdiction of the ICC with respect to crimes committed….by one of its nationals, and request the Office of the Prosecutor to carry out an investigation.

    (Likewise the Sri Lankan government can refer Karuna and KP to the ICC)

    • For US citizens, even giving up US Citizenship will not help escape prosecution for crimes or tax evasion because the US law on Renunciation of U.S. Nationality states that:

    “Persons who wish to renounce U.S. citizenship should be aware of the fact that renunciation of U.S. citizenship has no effect whatsoever on his or her U.S. tax liability or …… allow persons to avoid possible prosecution for crimes…which were committed when he or she was a US Citizen

    11. Even with the extremely bloody way the war ended , we could still have avoided war crimes issues if we had, as Dr. Radhika Coomaraswamy stated (see below), done certain things. We could have easily made amends, and even given financial compensation to the survivors of the war (instead of taking high interest loans to build empty harbours and airports), or even by getting financial grants from India, US, UK and EU, and ushered in a great period of freedom and democracy. But all the other things we did post-war, from attacks on the free press, to attacks on the judiciary and the Chief Justice, to attacks and thuggery on even the Sinhalese – Biyagama, Rathupawela, and Tangalle are just three examples, only proved to the US, UK, EU that we are headed for a tin pot corrupt family driven and violently maintained dictatorship that needs to be halted sooner rather than later. With cases like Ghaddafi, the west knows that the longer such rulers are allowed to exist and allowed to dismantle all independent institutions – police, law and order, judiciary and public service – the more chaotic it is when the dictatorship collapses, as they all do eventually. Then it is a much more costly exercise for the democratic west to step in with aid and help, and such collapsed states take generations to recover, if at all ever. And failed states are too big a headache for everyone else.

    Five years after the war I often think of how it could have been.

    A President who, the day after the war ends, speaks to the people of the North and East, emphasises that the government was facing a ruthless enemy but expresses remorse for the suffering they have undergone and pledges to make amends, and does.

    An army, when faced with war crimes allegations, says categorically, discipline is important to us, we will not tolerate impunity, perpetrators will be punished, all the while winding down, returning to barracks and letting the civil administration take control.

    A majority community that reaches out to their Tamil brothers and sisters, saying we are sorry about all your suffering, we never understood your aspirations, we will try now and move toward a pluralistic, inclusive Sri Lanka.
    A Tamil community that says we are sorry for supporting this ruthless organisation that killed so many people; we were blinded by their propaganda.

    Let us talk now, openly and frankly and try and work it out. If we disagree – we reassure you our protests will be non-violent.

    A foreign ministry that urges the government to engage all members of the international community, realistically confronting their concerns about human rights and returns us to a non-aligned status.

    All these developments would have signaled the nobility of our spirit – the investments and acclamations would have burst forth and we would have lived happily ever after.

        There is no tamil terrorism. But there is problems between minority tamils and majority sinhalese (that you guys represent). Latter sinhalese are as minor fraction as the ltters had been. And there was no JVP problems, but it was interpreted in that way -all what we faced in late 80tes were youth unrest across the country.

        And to remind you and the dimwits that seem to be born fools – except those plantations tamils are also lanken citizens as we the sinhalaese and muslims and other folks are.
