Operationalizing The ‘State Of Emergency’ Giving Government Headache

The government has run into a crisis following the declaration of a state of emergency for 10 days.

It was when documents following the gazette notification announcing the emergency was drafted that the possible repercussions have surfaced, Colombo Telegraph reliably learns.

Source involved in the process reveal that the ‘nitty gritty’ will cause the government embarrassment in relation to the ongoing engagement with the UNHRC and resolutions thereto.

In addition, there could be a negative impact on the tourism industry as well.

The Government didn’t have any options either, given the circumstances where communal violences threatened to spread and go out of control.

The Government is currently struggling to draft the provisions for the operationalising of the emergency. Colombo Telegraph learns that the task is yet to be completed.

A state of emergency has been proclaimed by the President in terms of Article 155 of the Constitution read with section 2(1) of the Public Security Ordinance of 1947 bringing into operation Part II of the said Ordinance. However, no emergency regulations have been made as provided in section 5(1) of the said Ordinance. Under section 5(1), the President is empowered to make such “emergency regulations” as appear to him to be necessary or expedient in the interests of public security and the preservation of public order and the suppression of mutiny, riot or civil commotion, or for the maintenance of supplies and services essential to the life of the community. Currently, action is under way to make emergency regulations that are necessary to bring an end to the current state of emergency, and it is expected that the regulations will be made and published in the Gazette by Wednesday.

He was murdered by the Sinhala Racists in the hospital, in a plot to turn this into a full scale riot as it is goin on just now. Gnanasara and Ajith pPrasanna openly speaking nice words to fool everyone, but there are a lot of code words being used in their videos to incite their teams to go ahead with the pogrom against the Muslims. This is a well planned operation conducted with the support of the state. Thats why the actions are late and slow by the govt. Thank you Maithree and thank you Ranil for burning the country.

      You have a YAHAPALANAYA govt to look after its people. The President., PM have not visited the area which is the first thing to be done. They should talk to both communities and call for peace.
      It seems that they either do not have the courage to go there, or do not mind this festering to shift the spotlight away from their own inadequacies.
      Aren’t their respected community leaders from both commmunities who can take the initiative here. They should be people with no political affiliations. Peace Committeees withrepresentation from both communities could be one approach.
      Also important is that the blame game should stop here.

    Give SF the Law & Order Ministry to quell the situation. The opposition, SLPP, UPFA and BBS are all destabilizing the govt because the President and PM are indecisive and doesn’t show strength in leadership. PUT COUNTRY BEFORE YOUR POLITICS AND DELIVER ON YOUR PROMISE. Otherwise say ta ta to any hope you have on holding on to power. President, don’t trust the serpent i.e. MR lying still waiting to upset the coalition and take SL back to the stone age by looting and pillaging after selling us to the Chinese.

    All those who are doing these dastardly acts not only destroying the Muslims but their own country too. It’s like cutting their own necks. Just after thirty years of carnages, the country is trying to look up, tourism and investment are picking up, country’s image too getting better but now all going to be reversed, and toll of it going to be the burden of all the inhabitants of the country. The moment tourism drops, all those investments in that sector would suffer , when no one invest in a troubled country, and unemployment would shoot up. The oil market is going from bad to worst due to the fracking revolution in North America, and solar and wind power revolution all over the planet. Middle Eastern oil producing countries are feeling the pinch, and packing off foreign workers. Over 1.5 millions of our workers are there, when they return, if the economy is not sound enough to absorbed them, there are going to be a terrible choas in the country. When things are like this, do any one guess there going to be a better economy in the future. The whole trouble is our rotten and opportunistic and fishing in the troubled water leaders, politicians and officials are not communicating well enough with the people to educate them about the harm of these terrible things going have on their daily lives. It always a peaceful country would lead to better lives for all. A country in crisis would be crisis for all, none live better, including huge hardship for all these trouble markers.

    In Kengalla,, Digana, a Muslim person’s property is next to the boundary of the Pallekele Army Camp but the house in it was ransack and looted last night. It all appears, the police and the army are with the trouble markers, else how such thing like this could happened. If the authorities wouldn’t be able to protect life and belongings of the citizens of the country, there wouldn’t be a future for the Muslims and the minorities in SL. Local people have behaved well but all main ham was planned and done by outsiders. There is a force and well organised group is at it. State intelligence agencies should go after them, penetrate into their organisations, and nail them hard for good to end these troubles. Other wise just after the death of this Sinhalese gentleman, how could all these materialize. There should be some persons or an outfit to organise these in such magnatitude to burn and destroy so much innocent people’s properties. Government could make an appeal to all social media outfits to monitor these people’s Activities in their platforms. All over the world, Facebook has appointed local monitors to check for hate activities. Why wouldn’t our IT authorise lias with them to stop these hate activities, definitely if request is made, they would oblige owing to their responsibility towards the well being of the society and the world for all these creating terrible consequences to all the communities in the country.

    It is all their fault. When they realized that there could be a tensed situation in Theldeniya, they could have imposed police curfew and installed a few check points on the Kandy Road before the incident occurred, not after. The problem is, IGP is unable to work on his own “police instinct” as before. He has to get the instructions from the PM + M/LO or from the President as “Reconciliation” matters to the government more than Law and Order of the country. Therefore the Police is in the dark unlike before when there is communal clash. That is the reason for the Police to impose two riot laws in the country – one to the North and another to the South, and three separate laws for three ethnicities; Sinhalese, Tamils and Muslims.
    Government has two options: 1. fulfilling reconciliation at the expense of law and order or 2. maintaining law and order at the expense of reconciliation.

      Champa stop your nonsense suggestion. Enacting laws for different communities amounts to racial discrimination. Every one should be equal before law. You are asking to enact separate laws to north and south. This is the basis of federalism which Tamils are demanding. When you oppose federalism how can you advocate different laws for regions as well ethnicities. Government has only one option. Enshrine justice to eradicate discriminatory laws and practices and enforce law and order equally to all communities. If this is done reconciliation will automatically materialise.

      The IGP is a person who forces his subordinates to engage in Buddhist religious practices. He says he got his job due to “bodhi poojas”. Every Police station has a Buddhist shrine in it.
      What sort of police instinct do you expect? Soon we will have to import Chinese or Indian policemen to keep the peace impartially.

    All I can tell you now is Dr Ranil’s No Confidence is off the Table..
    And Dr Ranil has forced the Inaugural next Election Rally in Nugegoda to be cancelled…..

    Now I don’t think there is any use in going behind finding faults in political level as the politicians have miserably failed to prevent this negative energy being created, or we even don’t know if they are the creators of it. As the situation has escalated and this negative energy spread is usually auto-pilot at this stage, it is the law & order, religious leadership, the media and the right thinking people should act together to stop further spreading of this.

    No wonder the government was dragging its feet. Similar events to JR Jayawardana’s time when colombo was burning, and the President was contemplatin with no action for several days. Why should PM act? Its his UNP key activitists and supporters that might have been behind the stirring up of racial hatred, using as their trump card to deflect the UNP defeat and to deflect public attention from Yahapalu governments failures, of mega bond scam, defeat in the hands of the voters. Shit stirrers could be of any color, or from any ethnic group, given that the objectives are political and to point fingers at SLPP; they are not interested in racial harmony as long as the effects could be harnessed to promote their own cause.

Then blamed Mahinda rajapakse getting loans every where. In the mean time, Some Hindian from a Far away state has Asked the Trincomalee area again. I
    MG loan paid $ 154 million to a company for surveying that. Mongloian experts checed the foundation of those rocks, IT was verified and showed that was a set up by those small men. Then their own experts checked it and found to be different. This is why MY3 is really disillusioned because some others talk say we know what is happening.

    All the so called ‘leaders’ be it UNP, UPFA, SLFP, Pohottuwa, SLMC, Religious leaders, Security force etc. you name it, are all playing politics while the country is up in flames. This is absolutely evident in every single one of them pointing their finger at the other whilst people are being killed or their lives destroyed. Even the ‘educated’ are participating in this lunacy in glee (e.g GL). It is abundantly clear that the Security forces were once again actively inactive whilst law breakers are blatantly carrying weapons, burning, torching and destroying property. There is a lack of honesty and genuineness amongst the leadership regardless of their utterances (e.g. MR, Ranil, Maithree, Police, Mahanayakes, Muslim MPs etc.). The general public have lost faith in them as such everyone now believes in the crap that’s defecated on to Facebook and go down their own rabbit holes and end up at an extreme. At this rate SL is heading no where but to another War. Ultimately it is AGAIN the innocent people and their children who will suffer the consequences for a few generations to come. It seems like we have NOT learnt anything form what happened until just a few years back. Now is the time for those who have been silent to come on to the streets and show the rulers and the thugs that this has to stop. However, I dont think ‘decent people’ of Sri Lanka have a backbone to stand up.
    As for social media, like Facebook, we all need to reflect on the good and bad it has brought us as humans. For all the small wins we’re all got off it, it has helped cause many wars and destroy many countries and it’s peoples (e.g. Ukrain, Libya, Siriya, Rohingya to just name a very few). It hasn’t spared wreaking havoc on a super power like the USA (e.g Trump). Sri Lanka has no chance but on a front row seat to heading to join that list. Think about it!

    It is the duty of the incumbent government to protect all civilians and their property irrespective of caste creed or religion . This government has failed time and again to uphold the rule of law. We cannot afford a repeat of 1983 which would set the country back another 25 years.

    Dilrukshi was removed by President at the request of Rajapakse. Sarath Fonseka was not given the post of Minister of Law and Order at the request of Rajapakse. It appears to me President has another external President over him.

    Sinhalese would have probably also gotten killed by other Sinhalese for blocking the road. . But come to think of it, I wonder how much the US gun lobby is involved in this. Soon Ranil’s 2nd amendment will contain the right to own guns (Evangelical groups are praying for the great many souls soon to go up to heaven in the blaze of gun glory). All a conspiracy to make money for the capitalistic machine of Ranil’s, I think. Whatever it is, Ranil’s golden opportunity to contain all the ruffians and hooligans who are going to up-rise against his economic policies is ripe.

    The government has shown good signs by condemning the violence, and the media has also emphasized the need for unity for this country. This is far better than the deafening silence by the previous regime.

    If the armed forces are looking the other way (like they did during the 1983 riots), and not taking any actions against the terror mobs, then they should be held responsible too. The have to prevent violence and protect all citizens from being harmed, as well as property and places of worship. These ethnic problems are a curse on this country, and prevents the country from progressing. It has to be tackled from all angles.
