I Was Not In favour Of Impeachment, I’m Saddened By Recent Developments, I will Appoint A Committee – MR

An impeachment motion was signed and given to me, I was not in favour of it that time. Now that has been tabled in parliament, the next step is to appoint a committee and obtain a report,  President Mahinda Rajapaksa said today.

“There is a parliament. However I’m saddened by recent developments, I’m a lawyer by profession. When you look at this issue from that perspective I’m not in favour of undermining the judiciary. If someone has made a mistake then I do not think that should be discussed in public. It need not be made public. I will appoint an independent committee to look in to the PSC report that will be submitted before its implementation. Because I only have to be held accountable to my conscience. At the end of the day I have to be content with the decision I make. Under my instruction I will implement system although it has not been stated in books or law. However I have to be content with the decisions I take.” he further said.

      MR like the Proverbial cat that shat on the rock, is turning in circles unable to cover his act and in the process is getting his shit all over himself, blaming others and accusing that he has been prompted on this Impeachment, which he was not in favour. What a Diabolical Liar this Mother F…er is? Now MR knows he has made the biggest blunder, which RW knew all along that MR would succumb sometime soon and now he has.

      MR has been spinning various stories. After MR has given a call to CJ’s Counsel requesting CJ to step down that he would offer some other Post, he started to spread on the other hand that the CJ was pleading with him to let go of her husband that she will step down. Now he knows that there is only one way he can get the CJ out, that is the accepted procedure under Latimer Rules laid down by the Common Wealth. He can not appoint his cronies like Asoka De Silva, Balapatabandi crowd. So the present CJ will stay in all probability. The issue is now both CJ and husband will come out with some home truths, exposing this HUMBUG MR of his deeds. Leave alone the CJ falling at this Bugger’s feet, this Bugger MR will now offer to lick anywhere of CJ or her Husband’s, in order to prevent the ‘Revelations of the Century’. If it was only the CJ, this bugger is quite capable of staging an accident. However the CJ should be mindful for her whole family not to travel together.

      Now what has this Scum Bag got to say about the paid demonstrations and the parade of the 500 Tri Shaws against the CJ? Is he now trying to deny that as well? What a shame to say that the idea of the Impeachment was first promoted by the UNP Gen Sec Tissa Attanayake. So this bloody goat admits, if so he fell for the UNP trap? HA! HA! HA!. He claims to be a Lawyer. What an insult to the Profession. The truth is, this is his real level of intelligence anyway. Is MR also trying to deny that he never arranged Dilan, Wimal and Rajitha to humiliate the CJ?

      I advise all those Buggers who bashed Ranil Wickremasinghe all this time to see the unfolding events from now on. As Ranil said by 2014, he will form a UNP govt. Let us see who will have the last laugh?

        I think Ranil or any other opposition parties do not have to wait till 2014 at all.

        If CJ could prove (of cause she could with all her academic and practicle experience) that MR brought this impeachment FRAUDULENTLY FORCING OTHER 117 TO SIGN….then it will be his and the 117 ‘s own grave yard. Because once the International Community castigate him as a Pariah….that’s all. So I think things are accelerating much faster where the whole Judiciary, SC, Bar Asso. and the opposition are united , there will be no escape.

        It’s catch 22….check mate.

        MR’s next best choice of work would be to act in Comedy Central, Hambantota Comedy Club…..more suitable.

        Gamini all that you say , is true, but , where you went wrong is about Ranil W. I do not know what is happening in Colombo but, where I come from (Anuradhapura and Kandy) people are shocked at RW ‘s behavior. All the lawyers university professors and the ordinary citizen, is doing what jhe should do. Did he speak one word against the silly commission with thugs and rif raf, when it was appointed? Did he even agitate when the prisoners were killed, did he speak one word against the likes of Kotalawela? Do you really believe we are waiting for him to come forward once all the hardworking is over?
        Now that we know that he is a worse dictator even with out power, what. Will he be with power?

          Kiri, you have to understand the issues you have mentioned is insufficient to turn around a society against MR who still do not see the gravity of this bugger continuing as the President. The door has at last opened with the CJ issue which RW allowed MR to commit the blunder. Even yet the eyes of the masses are not fully opened for them to be turned around. That is why there are some yet out there willing to do the bidding for MR. So have patience, RW has said that he will oust MR before 2014.

      WHO APPOINTED THE CJ,

      The people who make comments about impeachment of CJ ,are omitting one factor. They criticizing MR’s wishes of appointing independent body to reviewing the whole case. If MR totally against of SHRIYANI BANDARANAYAKE as CJ, very first, he could do it by not appointing her as CJ. There were circumstances which leads that she was totally favor on decentralization of powers. That’s why she got the post of so called judge. MR didn’t follow JR. He appointed she as CJ. Now he has absolute power to removing her because she is totally favor for the decentralization of powers. Chandrika appointed she as a judge for favor on decentralization of powers. Mahinda is going to removing she as a judge for favor on decentralization of powers.
      What I am thinking under this circumstance is if Chandrika was wronged,Mahinda too will be wronge. if Chandrika was right,Mahinda too will be right.

    Independent Comittee need not study and waste their time on a bogus report. Independent Committee should include international observers and follow due procedure of law. This report should be thrown into the Diyawanna where it belongs.

    Whether the Island newspapers will publish it or not, the following is the conclusion of a Letter I sent to the editor yesterday Dec.10th seeking publicity. I was supporting a point of view expressed by another former senior public servant who was my old classmate. I did, however, refer to our ancient tradition of ‘consensus’ (Summutiya) followed in governance, a tradition imbedded in the Mahasammata principle, which came to us through Buddhism which stands out against the western principle of separation of powers.Percival Dyke, the first Govt.Agent of the Northern Province for nearly 40 years, observed this especial characteristic among the Sinhalese people under his administration which he said, was absent among the northern Tamils. That is taking decisions by consensus in their village Sabhah and listening to village elders.

      Consensus refers to a decision making process in which all parties concerned take part. Both the executive and the legislative have consensus on the issue of getting rid of CJ. Why should CJ, the accused, who still maintains her innocence, conform to the decision unilaterally taken by them and resign? Instead, the executive and the legislative should agree with the CJ on her right to fair trial. As a citizen of the country she is entitled to a fair, unbiased trial and she does not have to forgo her right for anybody else. If she does, it is a disaster for the human rights of the Sinhalese people. (Let’s not talk about Tamils whose human rights are already violated).

      What consensus (sammutiyen) you are talking about…when the whole CJ impeachment carried on utter Fraudulent, pre-fabricated, pre-planned murder to castigate CJ, her family and the whole Judiciary system in Sri Lanka.

    Mr President, why do you think we voted you in. Just for a minute , look at the opposition leader, he behaves like a yesteryear, very mediocre school principal. You may have looked at that and realized how stupid he looks and how ineffective his actions are. This is the very reason you were able to buy the majority in parliament.
    Therefore you can at least, follow lord Buddhas teaching on this and follow the moderate path.
    You do not have to wash your hands off on the responsibility of, letting your MPS run riot, using filth on ladies , using filth in parliament , their children peddling drugs, hitting and killing others, tying people to trees, making our precious country ,the joke of the world by letting fools like Weerawansa carring out a bogus fast,( it would have been admirable if he did the real thing. After all Sri Lanka would be better off with a dead Weerawansa, since he can not keep his sewer shut)
    Why , when some one tries to do some thing wrong don’t you democratically stop them ? Be it your party members or the CJ. Why , can’t you even direct your brother, the speaker , that grade 9 unqualified fools should not be in a committee to read understand, and study a case seriously and then do the right thing.
    Mr president there are lawyers and lawyers. The supposedly a lawyer who chaired the commission , did not even have the intelligence, to make the investigation look authentic. Don’ t you think what the speaker and the commission did , reflected really poorly on you.

    “Realizing that the Select Committee process would be longer than expected, the Mahinda Rajapaksa Government is contemplating short-circuiting the process. According to reliable sources, the Government is now thinking of advising its members in the PSC to submit a report to Parliament on 08 December on only one or two of the 14 allegations made in the impeachment motion. The majority would say in the report that those one or two charges have been proved and that there is no need to go into all the 14 charges.

    Colombo Telegraph also understands that the Government is worried that the PSC’s majority report will be seen as a hurried job. Therefore, the President will request three retired judges of the Supreme Court to consider the report and advise him as to what should be done. The three retired judges will be persons who are certain to give a report unfavourable to the Chief Justice. Former Chief Justice Asoka De Silva has been entrusted with the job of getting three “safe” judges for this exercise. The three retired judges would then advise the President that the PSC report is a “sound” report.

    The plan is to submit a short report on one or two charges on 08 December and pass the impeachment motion on 08 January after the one month period required by the Constitution. However, senior SLFP-ers are said to be concerned about the proposal. They have pointed out that such a hasty end to the process would lead to loss of credibility both within the country and internationally.”

      I wish to draw the similarities between Premadasa and MR in their persuit to become despots. Premadasa similarly tried to enforce his will on all MPs with a work pattern of having Cabinet Meetings at Godly hours, that suited himself, suffering from insomnia. The reason was RP did not have a family life as his wife Hema was living out in style. It is over one of these meetings that Gamini Disanayake was removed from the Cabinet Portfolio he held where RP asked for GD’s resignation if he could not fall in line. To wit GD had replied that RP to use his powers and remove him instead. GD was the only one who stood up to RP, where RP abused the MPs and Public Servants in filth as MR has been doing now. Power had gone to their heads and both thought no end of themselves. Then came the Impeachment on RP and he went and sat with the MPs at the Old Parliament steps for a photograph leaving aside the throne he had got made. Then RP went on to create Ministries to so many MPs merely to appease them. That was the end of him.

      Now this man MR who also behaved in similar fashion blasting any MP or Public servant, as his domestic aids, after the CJ’s Impeachment has lost all his flair and is seeking refuge in others that he never wanted to have this Impeachment and it was merely thrust on him namely by Tissa Attanayake. He is heard pleading that he will appoint another Committee to look in to the Report of the PSC, which earlier he was waving at the CJ to rid her. Does he know that he can not appoint any Committee he likes but should be in accordance with the Latimer Committee? So MR will never be able to full fill his dream of becoming a Dictator ever. Very soon the country will come to know the real MR from his own cronies. The deals he made, the illegal monies he and his family earned and a lot of dirty linnen where there is blood as well. Now who said Ranil is a weak leader?

    I think he (HE) is looking for an “escape route”. Many “Pandiths” who are sorrunding him and sucking his “blood” must be finding it extremely difficulty to face the situation that has been created by this PSC, who acted as a”Know All” and “Mighty All”. The whole of the country and the outside world have now come to know what went on in those sessions of the PSC beginning from 24 August to 07 Dec. 2012. The last “comedy” act the seven remaining members of the PSC was to confine their investigation only to five(5) of the allegations and drop the rest(9) nine.

    What if CJ was at least told that their decision was only to investigate the five(5) charges? Also how these seven members decided to summon orgal evidence of about fisteen(15), that also having in an erlier occasion announcing that there will be no “oral” evidence and CJ will not be given the opportunity to “cross examine” such evidence? Then again how they evaluate the evidence of these high profile evidence of persons like Central Bank Chairman, Secretary to the HE, the Managing Directors and Legal Personalaties of Banks and Companies in a maatter of hours and also submit a report?

    I presume these “emminent persons” whould have been given “multiple choice qestion paper” OR a question paper to mark only “YES/NO”. Then work out the averages and conclude as these seven members were instructed to comply with.

    Now the HE The President has realized that the Government has opened a “can of worms” and he along with other “goons” do not know how to get out of the stinking mess. They including HE roamed around the country and at each and every “opening ceremony of roads and buildings”, “granting Akthra Patta to Hight Priests” boasted that anyone who had done wrong will be punished irrespective of the rank. The Government “Media including SLBC” also joined the “Band” Then came the so called “accredited journalists”. for example, when one said “Legislature cuts the Judiciary to its size” and “CJ hoist with her own petard”. They wrote pages and volumes in the electronic media and tried to “humiliate and intimidate” a High Profile Defendant and win the favour of the the “Chief”.

    All these persons, including the seven members of the PSC, did not realaize one fact. By engaging in all these “comedic stunts” at the hearing of the allegations and other publicity work they, were doing an “IRREPARABLE DAMAGE TO THE INTEGRITY AND DIGNITY OF GOVERNING SYSTEM AND THE COUNTRY”.

    All can critize, but offering a solution or what is the best we could do by our Governemnt and the country at this moment is the need of the hour. The one such in my opinion is: DISBAND THE WHOLE PSE AND ITS REPORT.STARAT AFRESH WITH CLEAR CUT PROCEDURES AND SELECT PEOPLE OF STANDING (Not Mr. Sarath Silva type) TO HEAR THE CASE WITH DIGNITY AND IN A JUDICIOUS MANNER.

    Like in the turn around in the perfidious decision to completely dishonour the 13th Amendment, the King is now getting cold feet in the CJ issue. Little doubt the Brits are sending out messages the Hambantota CWG is out unless he behaves to civilised standards.

    Problem is although the attack on the office of the CJ is in bad form, the CJ herself appears to have burnt her boats far too much. The racket in the alleged purchase of super-luxury apartments brings into question judgements-for-sale and the role of the extra-legal currency market to launder crooked money coming as lawful remittances. An independent audit and inquiry on the Australian side will reveal if her sister lawfully earned the large sums involved here.

    Allowing a tainted husband, with no known professional qualifications, to accept high position at the time she was looking into sensitive cases is untenable. Already GKCC Depositors officials say they have got hold of documents and evidence to incriminate her into questionable deals where she will be accused of benefitting from the misery of nearly 9,000 upper middle class families sent into penury by an egoistic Kotelawala. There seems to be evidence the CJ
    took open interest in the matter of causing justice to these people earlier and suddenly turned course asking another Court to look into the matter.If it is established this was the period where she took an interest in purchasing two apartments “for her sister” it will be difficult for her to wriggle out of the charge she used her office for personal gain. In the circumstances, she cannot function in her high office any more with the expected measure of judicial independence.

    In any major “clash” “war” there is and was an immeadiate cause. To give a very recent example was the “Eelam War”. This victorious war started when LTTE terrorist outfit cut off the water supply to more than 25,000 villagers by closing the “Mavil Aaru”. The Government got the opportunity and the war was carried to an end sucessfuly.

    In like manner there would have been some “immeadiate event” for this Impeachment to come about. In my mind, it reveberats to be the “refusal” of the JSC to meet the HE the President on an invitation, first made over a “telephone call” and then on a letter sent in compliance with the request of the CJ. It was reported that the JSC or the CJ on its behalf sent a lengthy letter and followed with a very “unusual” “Press Statement”. This “Press Statement” created all the fuss and we know all the events that immeadiately followed, which included the “complaint” of the 117 Governement MPs. Perhaps the HE The President when this complaint was received would have been very “apprehensive”, yet being under a “hefty blow” from the JSC, without realizing the consequences referred to the Speaker for “necessary action”.

    Now, what we have “forgotten” and perhaps “denied” of any information is:

    1. What did the “letter of Invitation, apparently sent by the Secretary to the HE contained?

    2. What was the letter, (i.e. it’s contents) of relpy sent by the CJ on behalf of the JSC?

    Will the “PEOPLE” who are now hailed as “Supreme” be given the opportunity to peruse and study the above two documents? Then we will be able to at least put “two + two” and say it is “four”. Isn’t that our basic right nothwithstanding being “Supreme”?

    MR thinks by getting an “Independent” committee of judges who will be told to find CJ not guilty of one or two charges but guilty of at least one he will provide the process with a semblance of fairplay that will make it acceptable to the international community and more importantly the Commonwealth Heads of State. The sad thing is that he may get away with it

    I welcome the wise decision.It is the conscience in all of us, that is the final arbiter. The president has also responded to public opinion as he should. A crisis has been averted temporarily.

    What is important now is that the committee he appoints has the requisite expertise, neutrality and wisdom. It must also have the confidence of the public. Further, it should give the CJ the opportunity to examine the evidence and present her response.

    There is yet hope for democracy in Sri Lanka.

      Dr Rajasingham – you mean you actually believe him??? I gave you credit for more insight and intelligence, but it seems that I was wrong. Let’s see what kind of ‘Committee’ he comes up with. If he is really serious, why not allow truly neutral international….. oh what’s the point??!!

        Peter do not waste your time on this Narendran. The fact remains that none, not even GL, Asoka De Silva, Mohan Pieris or whoever who was involved with the Impeachment, knew that one has to adhere to the Latimer Resolutions. What Ranil did was he kept quiet giving the rope to MR and gang to hang themselves. After they did, Ranil explained the requirement and the consequences MR would face from the Common Wealth. Now the whole lot are in sixes and sevens. Now MR just can not appoint past Judges, as Asoka De Silva, Balapatabandi crowd, but from the Commonwealth Countries only. So the bugger is a goner, only to go through the motions.

          Ranil is good at giving long ropes. He tried it with the LTTE -remember the peace trap and the safety net- and they ensured Mahinda won the election. They also allegedly received a payment for their services. Now Ranil is trying to bring down Mahinda with a long rope. Unfortunately, Mahinda is also a master at the rope trick! MR’s success with the rope trick far exceeds that of Ranil! It is not the Latimer resolutions that made Mahinda respond as he has, but the overwhelming public opinion against how the impeachment procedures were conducted. Mahinda knows very well which side his bread is buttered! Please do not deceive yourself.

        Where does the question of believing come in? He is responding to overwhelming public opinion. He is suggesting a new option. Let us make sure the new option is above board.

        My grandmother taught me to only believe in myself and my God. Each one of us as individuals have act honestly, however, we have to expect everyone beyond us will not do so.This system, saves one from a lot of trouble and disappointments.

          Dr N – My question was with regard to whether you believed MR’s statement “I Was Not In favour Of Impeachment, I’m Saddened By Recent Developments..” to be true and about his recent developing of a “conscience”. If he was truly affected by his “conscience”, would he be doing the things he is?

          Believing in yourself is fine (as your grandmother taught you), I just hope MR isn’t your “god”. And have you been saved from “disappointments” with regard to MR?

    Now that the President has spoken and Naren Mahathaya has swallowed whole sale and is waiting for demoncracy for apothecary’s, all is solved…the white van’s, Gota’s filthy language, the various killings and night car racing….all in all the utter degradation of law, democracy is being given a facelift by our aiya Naren!
