By Colombo Telegraph –
“The President’s statement that he would appoint an independent panel to review the report submitted by the 7 Government Members of the PSC on the impeachment of the Chief Justice, is an admission by the President that it was an unlawful process and that the report is flawed.” says the Lawyers Collective.
“Therefore the said Report must be withdrawn immediately. Any future inquiry must take place only after a fair procedure and tribunal are lawfully introduced. Until then the agitation of the Bar will continue.” issuing a statement the Lawyers Collective further says.

Correct if the report is unlawful he can order his minions to withdraw it. Why sit on it for one month and waste tax payers money. This is what he always says and postpones things until they die a natural death.

Thanks to the BASL standing firm on the principles of NATURAL JUSTICE AND DUE PROCESS, Mahinda Rajapassa who set up and REMOTE CONTROLLED THE KANGAROO COURT run by a bunch of uneducated and MORONIC POLITICIANS in the Diyawenna Parliament is now feeling the heat and has tried to distance himself from the PSC panel of clowns and thugs who performed Chamal Rajapassas dirty work.
MR now wants to set up another commission – having exposed his own clownish Ministers who operated the Kangaroo Court called the PSC on his instructions as a bunch of morons – the likes of Weerawansa, Dilan Perera, the Adam with many Eves, Senaratne, Yapa etc.
Rajapassa’s and the regime’s IMPUNITY AND IMMUNITY MUST END. The regime has INSULTED THE PEOPLE OF SRI LANKA and he must be held accountable for bringing the Judiciary and legislature into disrepute and making the SOVEREIGN PEOPLE of Lanka the laughing stock of the world.
The CJ should sue the members of the Kangaroo Court in the Diyawenna Oya who insulted her since they are on record and there a witnesses.

Please do not fall for MR’s trap. He is not going to appoint a panel to have fresh inquiry. He will appoint 3 former judges who are with him to “review” the PSC report. These judges will say that the report is fair and MR will go ahead with the impeachment.
In fact Colombo Telegraph predicted this under the title “Short-Circuiting The Impeachment Process Under Consideration”- https://www.colombotelegraph.com/index.php/short-circuiting-the-impeachment-process-under-consideration/
This is what CT said: “Realizing that the Select Committee process would be longer than expected, the Mahinda Rajapaksa Government is contemplating short-circuiting the process. According to reliable sources, the Government is now thinking of advising its members in the PSC to submit a report to Parliament on 08 December on only one or two of the 14 allegations made in the impeachment motion. The majority would say in the report that those one or two charges have been proved and that there is no need to go into all the 14 charges.Colombo Telegraph also understands that the Government is worried that the PSC’s majority report will be seen as a hurried job. Therefore, the President will request three retired judges of the Supreme Court to consider the report and advise him as to what should be done. The three retired judges will be persons who are certain to give a report unfavourable to the Chief Justice. Former Chief Justice Asoka De Silva has been entrusted with the job of getting three “safe” judges for this exercise. The three retired judges would then advise the President that the PSC report is a “sound” report.”
“The plan is to submit a short report on one or two charges on 08 December and pass the impeachment motion on 08 January after the one month period required by the Constitution. However, senior SLFP-ers are said to be concerned about the proposal. They have pointed out
that such a hasty end to the process would lead to loss of credibility both within the country and internationally.”
What the CT predicted has come true.
As demanded by the Lawyers’ Collective, the PSC report should be withdrawn. A panel consisting of 3 retired or serving judges of the Commonwealth must be appointed to go into the charges. A fair trial will only then be ensured.

The Lawyers Kibbutz also must ask publicly from where the President
secured his authority to appoint the CJ “to another position” and even
drop all charges against the allegedly crooked husband. As to be expected, MR will deny he ever said that in that “nae, bae, kawadadha” tradition for which he has become so infamous.

Good position taken by the Lawyers Collective.
I am only puzzled by the headline – how can it say ‘Bar’ rejects President’s Offier? The Collective is a group of mainly NGO lawyers. Its numbers are small. It should not issue misleading titles claiming it speaks for the entire Bar.

No end to the harrassment of the CJ
(Mirror) – The Bribery and Corruption Commission has decided to specially investigate the bribery and corruption charges against the C. J. and her husband, and until such time the investigations are complete , the govt is considering the banning of foreign travel for the two of them, according to internal sources. The Chairman of the Bribery and Corruption Commission, Mr. Jagath Balapatabendi has told ‘ Divaina’ that a complaint has been lodged with the Commission that the C.J. ,Dr. Shirani Bandaranayake recently had come into possession of assets beyond her income and a report has been called for from the Commission’s Legal dept
When there are allegations against +30 Govt ministers, mp’s etc no action been taken? Why only the CJ?

The President should have informed which provision of the Constitution entitles him to appoint an independent panel to review the report submitted by the 7 PSC members on the matter concerned with the impeachment proceedings of the CJ.
He should also have given an assurance that the said panel would consist of at least four committed independent people learned in the law and not venal types to do a hatchet job at tax payers expense.
As he has not done any of that the Lawyers Collective is correct in taking a bold stand in rejecting his offer.

The only remedy is as suggested by UNP to hear the three CJ charges by a panel of Commonwealth Judges.
The more Govt. drag this case the more it will hurt our economy and investment opportunities.
Therefore the more earlier the new process begins, the better.
Also I would like if the parliament publish information/profiles on Academic qualifications of it’s members in it’s website.
